(c) . A written notice of award or acceptance of an offer furnished to the Notice of award successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

Addendum to Evaluation - Commercial Product and Commercial Services

(4) Tradeoffs are NOT permitted

(5) The offerors must provide all required information or the offer will not be considered

(6) In order to be eligible for an award, an offer shall be rated " ACCEPTABLE" on all non-price factors

FACTORS TO BE EVALUATED

FACTOR I: CERTIFICATIONS

FACTOR II: PRICE

A detailed explanation of the criteria for the evaluation is set forth in the "Evaluation Approach" of this section.

During evaluation of each quote, the Government will assign each factor an acceptable or unacceptable rating.

EVALUATION APPROACH

The non-price factors are defined as follows:

FACTOR I: Certifications

The quoter shall demonstrate to be in possession of the following certifications:

- Certification produced by the Italian Ministero delle Attivita' Produttive, which qualified the company as an

"Organismo di Tipo A", accordingly with Italian D.P.R. nr. 462-2001;

Rating Description

Acceptable Quote clearly meets the minimum requirements of the Request for Quotation

Unacceptable Quote does not clearly meet the minimum requirements of the

Request for Quotation

Quote which meets the minimum requirement of the RFQ is considered the following:

The quoter demonstrates to possess all the listed above certifications.

Quote which does not meet the minimum requirements of the RFQ is considered the following:

The quoter fails to demonstrate to possess all the listed above certifications.

FACTOR II - PRICE

The price structure will consist of quantity multiplied by unit price equaling total line item cost.

The price quote will be evaluated separately from the non-price factors. An assessment of the reasonableness of each proposed price will be made.

A contract will be awarded to the Lowest Priced Technically Acceptable Offeror (LPTA). The total price indicated at CLINs 0001, 0002, 0003, 0004, 0005, 0006 and 0007 will be evaluated for fair and reasonableness and for unbalanced pricing. Unrealistic, unbalanced or unreasonable pricing may cause a proposal to be determined unacceptable.

Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.
