RFIS

QUESTION 1: Giving that the kind of works tied to SOA OS7 are included in the macro-category OG1, please confirm if it is possible to apply the ‘absorbency principle’ (principio di assorbenza) and, as a consequence, if a Company, with OG1 classification V, can take part in the Solicitation.

ANSWER 1: No, the ‘absorbency principle’ (principio di assorbenza) is not allowed. Offerors need to possess the mandatory SOA Certification OS7, Classification II or higher, in accordance with the amendment 0001 to the solicitation W92PF20R0002.

QUESTION 2: Please confirm if it is possible participating in the solicitation, applying the Italian principle of relying (principio di avvalimento).

ANSWER 2: No, principle of relying (principio di avvalimento) is not allowed. Offerors need to possess the SOA mandatory SOA Certification OS7, Classification II or higher, in accordance with the amendment 0001 to the solicitation W92PF20R0002.

QUESTION 3: According to the solicitation documents, page 138 “VOLUME 3: FACTOR 3 – MANDATORY DOCUMENTS” section b, a Consortium (Pool of Firms (Consorzio)) will be allowed. In this case, do all the members of the Consortium need to possess the SOA OS7 (II or higher) or if one member possesses the SOA OS7, would this condition allow the consortium to bid for the subject solicitation? If so, how will the consortium members participation share ratio be distributed. (e.g. The consortium member who possesses the SOA OS7 should have higher participation share ratio- 51 % - 49 %)?

ANSWER 3: In case of establishment of a Pool of Firms (Consorzio), the Consorzio itself shall submit a certified copy (copia autenticata) of the notarized legal document that established the Pool of Firms (Consorzio) and/or the name(s) and address(s) of the associated firm(s) proposed to perform the work under the contract. The firm(s) proposed to perform the work shall possess the SOA Certification OS7, Classification II or higher. In accordance with FAR Clause 52.236-1 “Performance of Work by the Contractor (April 1984), incorporated in the solicitation, the Contractor shall perform on the site, and with its own organization work equivalent to at least 80 percent of the total amount of work to be performed under the contract. Subcontracting work (equal to maximum 20 percent of the entire work to be performed under the contract, shall be authorized by the Contracting Officer, upon request of the prime Contractor. In case of Pool of Firms (Consorzio), all proposed partners will be assessed individually and the results will then be assessed in their totality to derive the offeror’s experience and past performance.

QUESTION 4: Do we have to register the Consortium in SAM as a separate entity? Or can members of the Consortium have their own sperate SAM registration?

ANSWER 4: Temporary Pool of firms (Consorzio temporaneo) is not allowed. Stable Pool of firms (Consorzio Stabile) must be registered in SAM.

QUESTION 5: If a contractor doesn’t possess the SOA OS7, can the contractor utilize a subcontractor who possesses the SOA OS7 in order to be eligible to bid for the subject solicitation?

ANSWER 5: In order to be eligible for an award, the offeror must possess the mandatory SOA Certification OS7, Classification II or higher.
