No additional merit is given for proposals that exceed the minimum criteria.

1. Lowest Priced Technically Acceptable. Offerors are put on notice that:

a. Non-price factors and subfactors will be evaluated on an “acceptable/unacceptable” basis

b. Non-price factors and subfactors are evaluate for acceptability and NOT ranked.

c. Tradeoffs are NOT permitted.

d. Offerors must provide all required information or the quote will not be considered.

e. Before awarding a contract, the Government will make a responsibility determination by analyzing whether the apparent successful offeror complies with the requirements of FAR 9.104.

2. Evaluation Approach. Non-price factors will be evaluated on an Acceptable/Unacceptable basis, assigning ratings of “acceptable” or “unacceptable”.

3. Once the contracting officer and the Technical Evaluation Board (TEB) have identified the offers that are technically acceptable, the contracting officer will make the award decision only on the basis of the lowest fair and reasonable price.

4. The U.S. Government intends to evaluate offers and award a contract without discussions; however, the U.S.

Government reserves the right to hold discussions. It should be noted that there is no obligation on the part of the Government to make an award to any offeror in response to this solicitation.

5. Offerors may be asked to clarify some issues regarding the non-price factors to enhance U.S. Government understanding of them. Such clarifications shall NOT be used to cure offer deficiencies or material omissions, enter into discussions, and/or otherwise revise the offer.

B. EVALUATION OF FACTORS AND SUBFACTORS.

1. Factor 1 – TECHNICAL. The two subfactors of the Technical factor will be evaluated as acceptable or unacceptable utilizing the following ratings:

Rating Description

Acceptable Proposal meets the requirements of the solicitation

Unacceptable Proposal does not meet the requirements of the solicitation

a. Subfactor A: Experience. The Government will evaluate this subfactor to determine if the offeror has demonstrated experience on previous contracts relevant to the requirement of this solicitation. In order to be determined acceptable in this evaluation factor, the offeror shall demonstrate experience on at least one, but not more than two (2) contracts performed by the company that are recent (within the last 3 years from the solicitation release date) and relevant (interior and exterior painting of residential/ commercial/ industrial buildings).

b. Subfactor B: SOA Certificate. In order to be determined acceptable in this subfactor, the offeror must provide a current copy of their SOA OS7, CLASSIFICATION II or higher.

2. Factor 2: Past Performance. Evaluation: Past performance will be evaluated to determine if the offeror and any major subcontractors have performed favorably for previous contracts of a similar size and complexity as the services required in this solicitation. The Government will evaluate an offeror’s past performance to determine if past performance evaluations and all other past performance information reviewed by the Government (see below) reflect a trend of satisfactory performance. The offeror’s past performance record must be determined to be acceptable or neutral in order to be considered for award. Offeror(s) must demonstrate successful past performance of the offeror and any major subcontractors or partnerships as evidenced by information gathered from the Past Performance Questionnaires. The Government will evaluate NO MORE than three (3) contracts and subcontracts completed or ongoing within three (3) years from the solicitation release date as identified in Page 1, Block 6 of this solicitation, which are similar to the services requested in this solicitation. Offeror(s) must submit the information as per Enclosure 1 (Past Performance Questionnaire) for each of the contracts provided. If there are subcontractors or partnerships, they will be evaluated in the same manner as the Prime.

Past performance will be rated on an acceptable/unacceptable basis using the following ratings:

Acceptable

Based on the offeror's performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror's performance record is unknown (see note below).

Unacceptable Based on the offeror's performance record, the Government does not have a reasonable expectation that the offeror will be able to successfully perform the required effort.

Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown (or “neutral”) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable

a. The Government may consider past performance information from other sources such as: the offeror's former customers, business associates, federal, state, and local government agencies; the Past Performance Information Retrieval System (PPIRS), Federal Awardee Performance and Integrity Information System (FAPIIS), or other databases; interviews with Program Managers and Contracting Officers.

b. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the offeror.

3. Factor 3: Mandatory Documents. In order to be evaluated acceptable in this factor, offerors shall provide the required documents as requested in Section L. Proposals that do not contain all the required mandatory documents as requested will be determined to be unacceptable. The factor shall be evaluated utilizing the following ratings:

Acceptable Proposal meets the requirements of the solicitation

Unacceptable Proposal does not meet the requirements of the solicitation

a. DURC: The offeror shall provide with the proposal a copy NOT older than ninety (90) days from the date for initial receipt of quotation of the DURC (Documento Unico di Regolarità Contributiva);

b. CHAMBER OF COMMERCE CERTIFICATE: The offeror shall provide with the proposal a copy NOT older than six (6) months at the time set forth for the receipt of the offer of the Chamber of Commerce Certificate of Membership (Certificato di Iscrizine alla Camera di Commercio). The certificate must include a self-certification for the Antimafia Communication in the format of Attachment 2 provided with the solicitation.

c. BID GUARANTEE: The Bid Guarantee in the amount and format as required under the solicitation (Euro 10,000.00).

4. Factor 4: Price:

a. The price evaluation will consist of an overall price analysis, which compares the CLIN prices for each performance period for fairness, reasonableness, and balance. The price factor will be evaluated separately from the non-price factors. Price analysis is the process of examining and evaluating an offered price to determine if it is fair and reasonable, without evaluating its separate cost elements and profit. The Contracting Officer may use various price analysis techniques and procedures to ensure a fair and reasonable price.

b. Only offerors whose proposal is evaluated to be technically acceptable on all non-price factors will be evaluated for price. The offeror whose proposal is determined to be acceptable on all non-price factors and also contains the lowest price will be awarded the contract for this solicitation. Only a responsible offer in accordance with FAR 9.104 will be eligible for award.

c. The Contracting Officer will evaluate proposals by totaling the prices for all CLINs for the base and option years. The Government may reject an offer that is determined to be unbalanced. Unbalanced pricing exists when, despite an acceptable total evaluated price, the price of one or more contract line items is significantly overstated or understated as indicated by the application of cost or price analysis techniques.

An offer may be rejected if the Contracting Officer determines that the lack of balance poses an unacceptable risk to the Government.

d. As part of price evaluation, the Government will evaluate its Option to Extend Services

(see FAR Clause 52.217-8) by adding six (6) months of the offeror's final option period price to the offeror's total price. An assessment of the reasonableness of each offered price will be made. The Contracting Officer will perform a price analysis of each offer. Offerors are required to price the Base and Option Periods. Offerors shall not submit a price for the potential six (6) month extension of services period. The Government may choose to exercise the extension of services at the end of any performance period (base or option periods).
