About this file

This document is a Questions and Answers (Q&A) response addressing inquiries regarding a federal contract opportunity for construction, maintenance, and cleaning services at U.S. Army garrisons (USAG) in Germany under a Multiple Award Task Order Contract (MATOC) framework.

The Government will award contracts to multiple vendors, including large prime contractors with country-wide logistical reach as well as joint ventures and teaming arrangements comprised of localized and specialized contractors. Prime contractors may subcontract regulated construction and maintenance work to appropriately qualified German companies, including through first-tier operational subcontractors, and no self-performance minimums or subcontracting limitations are anticipated. While the prime contractor is not required to hold German trade registrations or Meister qualifications, all regulated trade work (electrical, plumbing, HVAC, mold remediation) must be executed by subcontractors properly registered, certified, and licensed under German Host Nation law. The prime contractor must demonstrate corporate and managerial capability to oversee specialized subcontractors and remains solely responsible for total contract performance, safety, quality control, and schedule adherence across all five Army garrisons. Contractors are encouraged to identify proposed teaming arrangements with operational and specialist subcontractors in their Sources Sought responses, clearly distinguishing capabilities and certifications between the prime and subcontractors. Regional and specialized trade companies operating in limited geographic areas are welcomed and should clearly identify their trade specializations and geographic areas of operation. For task orders involving facility repairs, construction, or mold remediation, DFARS 252.246-7002 (Warranty of Construction) will apply, requiring the prime contractor to warrant all work, materials, and equipment. Contractors must maintain standard commercial general liability insurance compliant with both U.S. Army Europe (USAREUR) regulations and German Host Nation insurance requirements.

Text version

May the prime contractor subcontract regulated construction and maintenance work to appropriately qualified German companies, including through a first-tier operational subcontractor?

Yes. The prime contractor may utilize subcontracting arrangements with qualified firms, including through first-tier operational subcontractors. For work executed within Germany, the use of local national subcontractors is a standard and acceptable practice. However, the prime contractor remains solely responsible and contractually liable for total contract performance, safety, quality control, and schedule adherence across all five Army garrisons.

Are any self-performance requirements, subcontracting limitations or restrictions on second-tier subcontractors anticipated?

No self-performance minimums or subcontracting limitations are anticipated for this requirement. There is no regulatory requirement for the prime contractor to self-perform a specific percentage of the labor. The US Government retains the right to implement limitations on work performed by subcontractors. Any limitations shall be expressly stated in the solicitation.

Must the prime contractor itself hold German trade registrations or Meister qualifications for work performed exclusively by properly registered German specialist subcontractors?

All companies shall be required to show certification(s) to perform work in Germany. However, no, the prime contractor is not required to hold all German trade registrations (Handwerksrolle) or Meister (Master Craftsman) qualifications, provided that any regulated trade work (such as electrical, plumbing, HVAC, or mold remediation) is executed by subcontractors who are properly registered, certified, and licensed under German Host Nation law (Handwerksordnung-

HwO) to perform those specific trades. The prime contractor must, however, demonstrate the corporate and managerial capability to oversee these specialized subcontractors.

What warranty, defect-correction, insurance and acceptance responsibilities are anticipated for the prime contractor and subcontractors? Is DFARS 252.246-7002 expected to apply?

The prime contractor is responsible for adhering to all terms and conditions of any subsequent contract award.

Warranty of Construction: For all task orders involving facility repairs, construction, or mold remediation, DFARS 252.246-7002 (Warranty of Construction) is expected to apply. This requires the prime contractor to warrant all work, materials, and equipment.

Service Warranties: For commercial cleaning tasks, any defects identified during the joint

Government-Contractor inspection must be corrected immediately prior to unit handover.

Insurance: The contractor must maintain standard commercial general liability insurance compliant with both U.S. Army Europe (USAREUR) regulations and German Host Nation insurance requirements.

May a Sources Sought response identify a proposed team of operational and specialist subcontractors, with outstanding commitments and qualifications clearly identified?

Yes, this is highly encouraged. Contractors are encouraged to outline their proposed teaming arrangements, joint ventures, or established subcontractor networks in their Sources Sought responses. When submitting, please clearly distinguish between the specific capabilities, past performance, and certifications held by the prime contractor and those held by the proposed operational/specialist subcontractors.

Is the RFI primarily directed at companies capable of providing the full range of construction, maintenance, and cleaning services across all USAG locations in

Germany?

While the resulting MATOC is intended to support multiple USAG locations across Germany, we anticipate awarding contracts to multiple vendors. This pool may include large prime contractors with country-wide logistical reach, as well as joint ventures and teaming arrangements made up of localized, specialized contractors.

Or would you also welcome responses from companies specializing in construction trades and operating within a limited geographic area, such as southern Germany?

Yes, responses from regional and specialized trade companies operating in limited geographic areas are highly welcomed and encouraged. Understanding local market capacity is critical for

DPW operations at individual garrisons. Regional firms should submit their capabilities clearly identifying: their specific trade specializations (commercial cleaning, mold remediation, HVAC, electrical) and their specific geographic areas of operation. The Government may utilize these responses to facilitate teaming opportunities, joint ventures, or to structure localized task-order competition within the MATOC framework.
