About this file

This is a Questions and Answers document for solicitation W912PB26QA117, a purchase request by the Department of the Army Materiel Command Army Contracting Command for one forklift to support material handling operations at USAG Poland's Camp Kosciuszko Housing and Furniture Warehouse. The document addresses four key inquiries from prospective offerors regarding procurement requirements and timelines.

Regarding pricing and tax treatment, the Government clarified that quotation prices must be submitted exclusive of Polish VAT, as the U.S. Government does not pay VAT; contractors will provide VAT documentation to the Contracting Officer after contract award for validation. For country-of-origin documentation, offerors may submit an OEM/manufacturer declaration, certificate of origin, or technical data sheet to satisfy the requirement. The Government confirmed no additional delivery requirements beyond those specified in the Statement of Work, which requires contractors to provide all equipment, delivery, configuration, and initial operational testing. A request for deadline extension was denied due to fiscal year constraints, though the Government indicated willingness to reassess the timeline as the solicitation closing date approaches.

1. VAT and Tax Treatment

Please confirm the intended Polish VAT treatment for this procurement and whether quotation prices should be submitted exclusive of Polish VAT where the applicable U.S. Forces tax exemption is available.

Answer: the US Government does not pay VAT. Price should be without VAT included. The VAT form would be provided by the contractor to the Contracting Officer to validate for the correct country VAT is owed after the contract is awarded.

2. Country-of-Origin Documentation

The Procurement Requirement Packet specifies country-of-origin restrictions applicable to the equipment, components and battery system.

Answer: An OEM/manufacturer declaration, certificate of origin, or the technical data sheet should list the country of origin and will suffice for this solicitation.

3. Delivery and Installation Access

In addition to the delivery and offloading requirements identified in the solicitation, please advise whether there are any specific delivery appointment, vehicle-clearance, driver-access, security, or receiving procedures that contractors should account for in their quotation.

Answer: There are no additional delivery requirements. As in the SOW: 3.0 SCOPE OF WORK & OPERATIONAL ENVIRONMENT: The contractor shall provide all equipment, delivery, configuration, and initial operational testing for the specified forklift.

4. Request for Quotation Deadline Extension

Considering the coordination required to obtain final OEM technical configuration, manufacturer country-of-origin documentation, local authorized warranty/service confirmation, and complete transportation arrangements, we respectfully request that the Government consider extending the quotation submission deadline. An extension would allow offerors sufficient time to obtain and verify the required manufacturer documentation and submit a complete and technically compliant quotation.

Answer: Due to the fiscal year coming to a close, we are limited in the amount of time to complete this contract action. As the time for solicitation comes to a close we will be able to reassess the timeline.
