CONTRACTOR QUESTIONS & GOVERNMENT ANSWERS

W912P921R0010

1. Please extend the May 7, 2021 deadline for contractors to submit inquires.

GOVERNMENT ANSWER: The deadline for questions will not be extended at this time.

2. SF-1442 block 13 requires one copy to be submitted with the original. We assume since we are emailing our proposal that no copy is required.

GOVERNMENT ANSWER: Correct. Only the emailed version is required. Block 13(A) on SF 1442 has been amended to reflect this.

3. Small Business participation and Participation Commitment – are we required to subcontract 20% of the total contract dollars to small businesses (pg. 33 of 176)?

GOVERNMENT ANSWER: At least twenty percent (20%) of the total contract value must be performed by a small business, as required by Factor 3 – Small Business Participation. Offerors whose proposal fails to meet the 20% small business participation requirement will be rated unacceptable.

4. What if, for example, a task order is issued for work to begin between 98.6 and 0 on June 1, 2022 and completed by July 31, 2022. The next task order issued for work between 195 and 98.6. A third task order is issued October 1, 2022 for work at Mile 40.0, will the contractor be paid for a second mob/demob for the 98.6 to 0 reach? If we are required by a further task order to return to a previously completed task order in the same reach of the project (98.6 to 0, 195 to 98.6, etc.) are we paid another mob/demob? Example year 2022 the first task order is for work at mile 40, task order 2 is for work between 195 to 300, and task order 3 is for work at mile 10

– are we paid a second mob/demob to return to the 98.6 to 0 reach?

GOVERNMENT ANSWER: If the first task order is completed in MRM 98.6 to 0 and you have demobilized, then another task order is issued within the same year and in the same MRM area, but after the demobilization for the first task order is completed, you will be paid mobilization and demobilization for the second task order in the same reach as work previously completed.

5. Will USACE accept a consent of surety from our bonding company if multiple task orders are issued in say the base year or will you require new bonds for each task order?

If an Option Year is exercised will USACE request new bonds?

GOVERNMENT ANSWER: The awardee shall be required to provide Performance and payment bonds in the requisite amount for each task order prior to Government issuance of Notice to Proceed.

6. Section 01 00 00 – Ordering Procedures states “The contractor will have 14 calendar days, unless otherwise specified in the RFP, to provide a proposal in response to the RFP.” Does this mean our submitted bid unit prices are only used to evaluate our bid versus other bidders, and the contractor’s response to the RFP will govern for the unit prices to complete the task order? Do you agree the unit prices may be less or greater than the bid units due to the existing conditions, etc.? The wording in the proposal could mean different unit pricing required than the unit pricing on the bid sheet.

GOVERNMENT ANSWER: The Bidding Schedule unit prices will be locked in at the time of award, and all task orders issued will use those unit prices for those items of work. However, the quantities provided in the Bidding Schedule are “estimated quantities” for evaluation purposes only and are not guaranteed. It is possible that the combination of all task orders issued throughout an ordering year will use a higher or lower quantity of the items than what is listed in the Bidding Schedule.

The Request for Proposal will be issued for each task order in order to receive a proposal of required quantities for the specific work, and/or to provide a proposal for items that may be required for the task order that is not included in the base contract IDIQ bidding schedule.

7. Section L – Volume II, Tab A: Factor 3 on page 22 of 176, states “1. All offerors (both large and small businesses) are required to complete a Small Business Participation Commitment Document (Appendix D), in accordance with DFARS 215.304.” Should “Appendix D” be “Appendix C?

GOVERNMENT ANSWER: Yes. Solicitation has been amended to reflect correct appendix, “Appendix C”

8. Section L – Appendix C – Small Business Participation Commitment Document (Sample Format) – Do you want us to use your 4-page document? Or do we prepare our own document based on this solicitation on our letterhead?

GOVERNMENT ANSWER: Appendix C provides a sample format that can be used for the Small Business Participation Document and is not required to be used. However, if you do not use this format, your contractor version should cover all of the same information.

9. Section L – Appendix B – Subcontractor Consent – Experience Information Form – Am I correct in assuming you want us to provide an existing or completed project where we utilized a potential subcontractor or supplier that we may utilize on this solicitation and ask them for permission for USACE to discuss their performance?

If we only submit 2 or 3 Appendix B forms, is that acceptable? We won’t know if we will utilize onsite subcontractors until we see the task orders.

GOVERNMENT ANSWER: Subcontractor Consent form is NOT required. Projects performed by contractors other than the offeror, including, but not limited to, teaming partners, subcontractors, sister or parent companies, and affiliates will not be evaluated for past performance, unless those other contractors are part of a joint venture offeror as demonstrated by a signed joint venture agreement.

10. Section L - Paragraph F. 2. b. v. on page 14 of 176 states “Volume number, factor, solicitation number, and date submitted shall appear in the bottom right corner of each page (along with the revision number for the amended page, if applicable).

Since we are submitting our proposal electronically, do we need to submit all the listed information on each page?

GOVERNMENT ANSWER: Yes

Can we put some of the required data on the top of the page? For example, the solicitation number could be in the middle of the top line?

GOVERNMENT ANSWER: See response to question 12 below.

Do you want the required information above on the Form 1442, the Reps & Certs, Bond, etc. which have the solicitation number already in place?

GOVERNMENT ANSWER: No

11. Which volume do you want the proposal cover sheet?

GOVERNMENT ANSWER: As a separate electronic PDF, or at the front of Volume I.

12. Section L - Paragraph F. 2. f. iii. on page 15 of 176 states “All pages of each volume shall be numbered and identified by the complete name, date, and solicitation number in the header or footer.”

What is the complete name? What date? I assume the bid date? In the header or footer? This contradicts Section L – Paragraph F.2.b.v. on page 14 of 176, which says “in the bottom right corner”.

GOVERNMENT ANSWER: Solicitation has been amended to remove the statement “All pages of each volume shall be numbered and identified by the complete name, date, and solicitation number in the header or footer.” from Section L – Paragraph F.2.f.iii.;

changed statement in Section L - Paragraph F.2.b.v. to “All pages of each volume shall be numbered and contain the volume number, factor, solicitation number, complete contractor name, and date proposal submitted in either the header or the footer of each page (along with the revision number for the amended page, if applicable).”

13. FAR Clause 52.228-1 Bid Guarantees is not included in section 00 70 00. Is a bid bond required?

GOVERNMENT ANSWER: Bid Guarantees are required. Solicitation has been amended to include FAR Clause 52.228-1.
