52.212-2 EVALUATION--COMMERCIAL ITEMS (OCT 2014)
(a) The Government will award a contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation will be most advantageous to the Government, price and other factors considered. The following factors shall be used to evaluate offers:
Technical - The Government will evaluate the technical proposals submitted by the lowest priced offeror on a Pass/Fail basis Assigning a rating of Acceptable or Unacceptable. The Government will evaluate the schedule contractor’s proposed technical approach to determine 1) the adequacy of their unique approach to accomplishing the required effort, ensuring a quality service will be provided and 2) that the schedule contractor clearly and reasonably communicates an understanding of the effort that is consistent with the SOW requirements.
Price – The Government will conduct a price analysis to determine whether the proposed prices are fair and reasonable. The Government will also conduct a price analysis to determine whether the level of effort and the mix of labor proposed to perform the services being ordered reflect a clear understanding of the requirements and are consistent with the unique methods of performance described in the offeror’s technical approach.
Past Performance – Past performance will be evaluated as a measure of the Government’s confidence in the offeror’s ability to successfully perform the requirements of the solicitation based upon recent past performance efforts. The Government will use the Past Performance Information Retrieval System (PPIRS) at www.ppirs.gov as part of the past performance evaluation.
Technical and past performance, when combined, are approximately equal to price.
(b) Options. The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer (or part of an offer), whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
