ADDENDUM 52.212-2
EVALUATION FACTORS FOR AWARD
1. Introduction. This section identifies the evaluation factors that will be considered in awarding this Contract for Concessionaire Food & Beverage Operations at the U.S. Army Corps of Engineers, New Orleans District.
This is a Best Value, Lowest Price Technically Acceptable (LPTA) procurement in accordance with FAR Parts 13 and 15. Offeror’s proposals will be evaluated for technical acceptability on an acceptable or unacceptable basis in accordance with the evaluation criteria. This section also describes the minimum requirements for acceptability for each evaluation factor.
A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful Offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the Offer's specified expiration time, USACE may accept an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.
NOTE: In accordance with the Randolph Sheppard Act (RSA), the State Licensing Agency (SLA) shall be invited to respond to this RFP. If the following conditions and the conditions as set forth in 34 C.F.R.
395.33 are met, the SLA will be afforded a priority.
The proposal is determined to be technically comparable to other Offers Menu prices have been determined to be fair and reasonable The SLA’s proposal would have a reasonable chance of being selected for final award
2. Basis for Contract Award.
A. Evaluation Factors. Each Offeror’s proposal and other information will be evaluated against the following factors to determine technical acceptability/unacceptability:
1. Technical Capability
2. Past Performance
3. Price
The technical factors, i.e. Technical Capability and Past Performance, will be evaluated for acceptability. Price is not rated but will be evaluated in accordance with FAR 15.404-1(b) to determine fair and reasonableness.
B. Lowest Priced Technically Acceptable (LPTA). Award will be made to the lowest priced technically acceptable proposal meeting the acceptability standards for non-cost factors as outlined in the solicitation. It is the USACE’s intent to award a single no cost Contract from this solicitation without discussions with Offerors;
however, the USACE reserves the right to enter into discussion if required. Therefore, it is imperative that Offerors submit their best and complete technical requirements in their initial proposal. Only those Offerors determined to be technically acceptable, either initially or as a result of discussions, if discussions are held, will be considered for award. For a proposal to result in an awardable Contract, the proposal must meet all Scope of Work requirements and conform to all required terms and conditions in the solicitation. An assessment will be made of each Offeror’s proposal in the areas of Technical Capability and Past Performance. Price will be evaluated to determine fair and reasonableness. There are no tradeoffs between price and non-priced factors nor are there any ranking of factors in the lowest-priced technically acceptable acquisition. Subjective judgment is implicit throughout this process.
3. Factor and Rating Techniques:
A. Technical Capability: An acceptable technical proposal is one that provides the following minimum documentation:
1. Experience. Resume identifying the Offeror’s qualifications in the food service industry and providing at least three (3) years recent past experience in the operations of facilities similar to the size, scope, complexity and available patronage of the USACE-NOD cafeteria to include profit and loss operations under similar type operations. The proposal should clearly demonstrate that the Offeror has a thorough understanding of the Scope of Work. Statements made in the proposal by the Offeror that he/she understands, can or will meet the solicitation requirements or paraphrasing the solicitation or parts thereof will be considered inadequate. Phrases such as “standard procedures will be employed” or “well known techniques will be used” will also be considered inadequate. Clarity and completeness in the description of the Offeror’s organization (key personnel) and management approach to the successful operation of this facility are essential.
2. Staffing. A weekly staffing plan that clearly demonstrates how the Offeror will insure an adequate number of experienced personnel are assigned to fulfill the requirements of this solicitation along with the appropriate job classifications. If available, provide letters of intent from qualified employees, or specific evidence of similar past successful hiring practices to employ qualified employees.
3. Menu Cycles/Variety. Provide a complete menu cycle indicating the cycle length and changes throughout the year. Menus should include a variety of color, texture, flavor, shape and appropriate garnish.
Sample menus of seasonal menu items and/or choice(s) of popular menu items should also be provided.
Menus should avoid repetition and monotony and should compare favorably with current acceptable industry practices.
4. Financial Information. Offerors shall provide additional financial data such as financial/income statements, lines of credit with bank names, contact and phone numbers as evidence of financial stability.
Table A-1. Technical Acceptable/Unacceptable Ratings Rating Description Acceptable Proposal clearly meets the minimum requirements of the solicitation.
Unacceptable Proposal does not clearly meet the minimum requirements of the solicitation.
B. Past Performance: The Offeror’s past performance will be evaluated on an “acceptable” or
“unacceptable” basis using the ratings provided in Table B-1 below. This assessment will be based on the Offeror’s record of relevant and recent past performance information as it pertains to this requirement and as outlined in the solicitation. Relevancy means same or similar in scope, size and complexity to the solicitation’s requirements. Recent means past performance information within the last three (3) years. An acceptable past performance rating is one that provides the following minimum documentation:
1. Past Performance. Past performance identifying that the Offeror possesses a minimum of three (3) years of recent/relevant experience in managing and operating a comparable type facility.
2. Sanitation. Record of safe and sanitary operations.
NOTE: In the case of an Offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonable assigned, the Offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the Offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
Table B-1. Past Performance Evaluation Ratings Rating Description
W912P825R0029
Acceptable Based on the Offeror’s performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort, or the Offeror’s performance record is unknown.
Unacceptable Based on the Offeror’s performance record, the Government has no reasonable expectation that the Offeror will be able to successfully perform the required effort.
C. Price: The price factor is evaluated to determine whether the price is fair and reasonable. The techniques and procedures described under FAR 15.404(b) will be the primary means of assessing proposal reasonableness. USACE will evaluate price based on Table C-1. All menu prices will be evaluated for reasonableness only. The sum of all proposed prices in Table C-1 will be utilized to determine the low Offeror for this acquisition.
Menu Prices/Portion Sizes. Menus should provide a complete itemized price and portion breakdown to include standard units of measurements for each item. Pricing should be reasonable and comparable to the quality and portion being offered. Prices given shall reference a specific unit of measurement such as ounce, cup, slice, etc; as well as the sales price per portion.
