RESPONSES TO QUESTIONS

SELA 26.1a Widening of Florida Ave. Canal Phase IV, St. Ferdinand Street to Peoples Avenue

W912P8-25B0048 Questions and Answers

1Q. General wage decision LA20240008 w/ a “Heavy Industrial” designation. Is this the correct decision of should it be a Heavy Construction designation?

1A. General Wage decision is revised in this amendment.

2Q. Specification section 1100-12; 9 (c) requires timber mat bridges at pipeline crossings. There are quite a few pipelines that cross throughout the project corridor. Can the Government provide specific locations where timber mat crossings are required?

2A. No, the Government will not specify locations for timber mats. The Contractor is allowed to select locations for timber mats. All equipment used within the Railroad ROW requires a submittal for approval. Contractor shall include the weight of equipment in equipment submittals. Ground pressure over the large diameter utilities needs to be limited, Contractors should expect nothing larger than an average sized track-hoe (~20,000lbs) to be allowed to track over the large diameter utilities without a timber mat crossing.

3Q. Will precast pile bents and valve structures be allowed in lieu of CIP?

3A. No.

4Q. Will precast electrical manholes be allowed in lieu of brick?

4A. No.

5Q. Are the steel piles (Gov Furnished) full length for the piles that need to be spliced or are they in pieces?

5A. List of Government Furnished Property will be provided by amendment.

6Q. Please confirm what material the Government will be furnishing.

6A. List of Government Furnished Property will be provided by amendment.

7Q. Can the Governments lump sum qtys be provided?

7A. The Government will provide a breakdown of JOB cost as physical data upon specific request, however the Contractor is not relieved of the responsibility to estimate quantities.

It is expressly understood that in no case shall the quantity estimates provided by the Government for JOB cost items be used as a basis of a claim against the Government.

8Q. In regard to the railroad protective services pay item, are there any circumstances where more than 1 railroad flagman would be required?

8A. Yes. During 24-hour operations, a minimum of two flagmen will be required. Additional flagmen may be required when working in multiple locations simultaneously. For any activity anticipated to take 12 hours or longer, a second shift flagmen and/or observer may be required. There is not a separate pay item for railroad protective services. All measurement and payment for railroad protective services are incidental to other work.

9Q. The work hours listed do not allow work from 9pm to 6am. However, it was discussed at the site visit that all jack and bore operations need to be performed 24/7 until complete. Please confirm this requirement and that the work hours will allow.

9A. Yes. Normal work hours are restricted during this time; however, during jacking and boring operations the Contractor will be required to work continuously (24/7) until complete.

10Q. Section 1100-18 (k) states that all material removed from the NS ROW shall have documentation of where the material is to be disposed of. Has the material been tested, is it to be considered “clean” material for disposal purposes, or is the material considered to be contaminated?

10A. The material has not been tested, and no special disposal requirements are anticipated. The Contractor shall handle, transport, and dispose of all waste materials in compliance with all federal, state, and local statutes, ordinances, rules and regulations.

Yes. The contract requires documentation of the disposal or stockpile location.

11Q Re: Railroad protective insurance. We will need the following to get quotes:

a. Number of trains per day.

b. Is there a mix of passengers and freight trains in the area or just freight?

c. Will slow down orders be in effect?

11A. Information has been requested from the railroad and will be provided.

a. We requested specific numbers and an update with specific train counts may be forthcoming. Track 7 is a pass-through track that can see an average of 15 trains daily. Otherwise, the train activity is Norfolk Southern’s switching yard, estimate each of the other tracks can see an average of 10 trains daily.

b. The majority of the train traffic is freight, Track 7 has passenger trains daily.

c. Trains, including through traffic on Track 7, are all traveling at yard speed, which is very slow.

12Q. Please provide the Government’s estimated quantities for “Job” items.

12A. Refer to the response to question 7 13Q. Specification section 01100, paragraph 11 allows work 7 days per week between 6:00 AM and 9:00 PM. Please confirm that jack and bore operations and tie-in operations will be allowed to be performed continuously, around the clock until complete.

13A. Refer to the response to question 9.

14Q. Specification section 01100, paragraph 32 states “At such time that the Mississippi River is at or above elevation +11.0 feet at the Carrolton gage, some operations such as pile driving and deep excavations will be limited. The contractor can request to continue work but must get Government approval in writing prior to proceeding. These operations shall cease until such time as the elevation subsides below +11.0 feet”. Please define the depth of “deep excavations” mentioned in this paragraph. If excavations are already completed prior to the river rising above +11, will the contractor be required to backfill the excavation until the river falls below +11?

34Q. Specification section 01100, paragraph 17 (C) (11) requires the 24” SFM to remain in service through the 48” tie-in or through the 60” tie-in, but no elevation of the existing 24” SFM is shown. What is the elevation of the existing 24” SFM at the point it crosses the new 60” SFM and new 48” DFM so we can determine what is required to comply with the above note?

34A. The existing pipe is laying on the ground and was relocated against the wall of the building.

35Q. Drawing C-100, Item 1-4E on the west side of the 60” SFM denotes “Install portion of 24”/60” sewer force main (SFM)” and Item 1-4D denotes “Tie-in 60” sewer force main (SFM)”. Should these items be swapped so that Item 1-4E is the tie-in phase to coincide with the Item 1-4E tie in on the east side of the 60” SFM?

35A. Yes. The 24" tie-in will occur at the same time as the 60" in all three locations. All these tie-ins need to happen inside of the same non-stop operation period.

36Q. Has the 345’ portion of the new 60” SFM that was installed in a 72” casing between approximate STA 8+53 and STA 11+98 under the previous contract been pressure tested and accepted by the Government?

36A. Yes. The 60" SFM that was installed in the SELA 26 contract was filled with water and capped on both ends. That cap will need to be removed to complete the tie-in.

37Q. Has the 345’ portion of the new 60” SFM that was installed under the previous contract been grouted in the 72” casing per the end detail provided in the plans?

37A. Yes.

38Q. Has cathodic protection been installed on the 345’ portion of the new 60” SFM and 72” casing that was installed under the previous contract?

38A. Yes.

39Q. W001 on drawing C-401 denotes a 50” water line “DND”. The line is shown on drawing C-107, beginning at the 50” water line 90 degree turn and continuing east through the new 54” gate valve vault and cross over. Is this portion of the 50” water line in the valve vault and cross over footprint abandoned? Can it be removed as necessary for TRS and valve vault construction. Is the current condition of this line known? (i.e. has it been filled with flowable fill, etc.)

39A. Yes. See revised drawing C-401 in the amendment.

40Q. Drawing C-111 depicts the new 48” DFM pile supported pipe support at STA 3+45.

This support is installed over what appears to be the existing 48” DFM and will have to be installed prior to the existing line being taken out of service. Please clarify.

40A. See revised drawing C-111 in the amendment.

41Q. Please confirm that the 24” SFM can be tied in at the same time as either the 60” SFM or 48” DFM.

41A. No. The intent is for the 24"x60" is to be connected at the same time as the 60" SFM.

The 24"x 48 will remain unconnected until the 48" is put into service. This requires the 24" existing valve adjacent to the 48" pipe to be closed and blind flanged.

42Q. There appears to be an existing pile supported pipe support at the 48” DFM tie-in at STA 3+75 that is grayed out on drawing C-111.Please confirm that this support is existing and is to be reused for the new 48” DFM. If the support is to be reused, are there any specific rehabilitation requirements prior to installing the new line?

42A. This pipe support exists and will be reused. The condition of the pipe strap is unknown.

43Q. Drawing C-112 shows a conflict between the new 8” water line and new 48” DFM at approximate STA 0+40. Please clarify how lines are to be offset.

43A. See revised drawing C-112 in the amendment.

44Q. It is very common on utility projects for the proposed tie-in locations to be adjusted in the field. How will these adjustments be handled on this project as no utilities are measured for payment?

44A. Section 01100 paragraph 30. FIELD VERIFICATION OF UTILITY LOCATIONS add sentence: Contractor shall allow for deviations of up to 5' in any direction from the specified tie-in locations at no additional cost to the Government.

45Q. Drawing C-100 shows an existing grayed out TRS near the 54” SF tie in at the S&WB facility. This TRS appears to be in direct conflict with a portion of the new 54” SFM. Are the existing TRS sheet piles to be removed or cut off for 54” SFM installation?

45A. Yes. There was an existing TRS left in place at this location that must be removed to perform work in this area. The Government does not have an as-built for this TRS. See response to Question 32 to estimate the dimensions of the sheet pile.

46Q. The Justification & Approval documentation includes waterproofing of the top slab of box culverts inside Norfolk Southern Railroad Right of Way. Please confirm this is not included in this project.

46A. Waterproofing box culverts is not part of this contract.

47Q. Appendix A, paragraph GI-7 (D) and Appendix B, GI-7 (D) both state “The COMPANY shall provide flagmen, at no expense to the CONTRACTOR, at locations the ENGINEER may deem necessary for the safety of the COMPANY’s property and operations.” Please confirm that the contractor is not responsible for any cost associated with Railroad Flagging and that no cost for Flagging needs to be included in the contractor’s bid.

47A. No, Measurement and Payment information in the NSR documentation does not apply to this contract. The NSR documents are provided to describe technical requirements required by NSR when working on or adjacent to the railroad ROW.

Contractor is responsible for any cost associated with Railroad Flagging. See specification Section 01100 paragraph 18 WORK ON OR ADJACENT TO RAILROAD PROPERTY.

48Q. Specification section 01100, paragraph 18 (g) states “The railroad has sole authority to determine the need for flagging required to protect its operations. A full list of the requirements for Railroad Protective Service can be found in the Norfolk Southern Public Improvement Projects Manual under the Appendix B (Special Provisions for Protection of Railway Interest), paragraph 7, “RAILROAD PROTECTIVE SERVICES”.” We do not see the full list of the requirements for Railroad Protective Services in Appendix B. Please provide.

48A. The wrong document was uploaded in the initial submission. Appendix B - Norfolk Southern Public Improvement Projects Manual (1 Jan 2022) will be included by amendment.

49Q. It was mentioned at the site walk through that the Government is furnishing TRS steel sheet piles for the contractors use on this project. We do not see where this is mentioned in the plans and specifications and no inventory has been provided. Please clarify.

49A. List of Government Furnished Property will be provided by amendment.

50Q. If TRS steel sheet piles are furnished by the Government, do they become the property of the contractor at the end of this project?

50A. See specification section 01100 paragraph 46. Government Furnished Property, which will be provided by amendment.

51Q. If TRS steel sheet piles are furnished by the Government and become the property of the Contractor, can the TRS steel sheet piles be left in place in lieu of removing?

51A. See specification section 01100 paragraph 46. Government Furnished Property, which will be provided by amendment.

** Workers in this classification may be entitled to a higher minimum wage under Executive Order 14026 ($17.75) or 13658 ($13.30). Please see the Note at the top of the wage determination for more information. Please also note that the minimum wage requirements of Executive Order 14026 are not currently being enforced as to any contract or subcontract to which the states of Texas, Louisiana, or Mississippi, including their agencies, are a party.

Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.

Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at https://www.dol.gov/agencies/whd/government-contracts.

Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (iii)).

The body of each wage determination lists the classifications and wage rates that have been found to be prevailing for the type(s) of construction and geographic area covered by the wage determination. The classifications are listed in alphabetical order under rate identifiers indicating whether the particular rate is a union rate (current union negotiated rate), a survey rate, a weighted union average rate, a state adopted rate, or a supplemental classification rate.

Union Rate Identifiers

A four-letter identifier beginning with characters other than ""SU"", ""UAVG"", ?SA?, or ?SC? denotes that a union rate was prevailing for that classification in the survey. Example:

PLUM0198-005 07/01/2024. PLUM is an identifier of the union whose collectively bargained rate prevailed in the survey for this classification, which in this example would be Plumbers.

0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. The date, 07/01/2024 in the example, is the effective date of the most current negotiated rate.

Union prevailing wage rates are updated to reflect all changes over time that are reported to WHD in the rates in the collective bargaining agreement (CBA) governing the classification.

Union Average Rate Identifiers

The UAVG identifier indicates that no single rate prevailed for those classifications, but that 100% of the data reported for the classifications reflected union rates. EXAMPLE:

UAVG-OH-0010 01/01/2024. UAVG indicates that the rate is a weighted union average rate. OH indicates the State of Ohio.

The next number, 0010 in the example, is an internal number used in producing the wage determination. The date, 01/01/2024 in the example, indicates the date the wage determination was updated to reflect the most current union average rate.

A UAVG rate will be updated once a year, usually in January, to reflect a weighted average of the current rates in the collective bargaining agreements on which the rate is based.

Survey Rate Identifiers

The ""SU"" identifier indicates that either a single non-union rate prevailed (as defined in 29 CFR 1.2) for this classification in the survey or that the rate was derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As a weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SUFL2022-007 6/27/2024. SU indicates the rate is a single non-union prevailing rate or a weighted average of survey data for that classification. FL indicates the State of Florida. 2022 is the year of the survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. The date, 6/27/2024 in the example, indicates the survey completion date for the classifications and rates under that identifier.

?SU? wage rates typically remain in effect until a new survey is conducted. However, the Wage and Hour Division (WHD) has the discretion to update such rates under 29 CFR 1.6(c)(1).

State Adopted Rate Identifiers

The ""SA"" identifier indicates that the classifications and prevailing wage rates set by a state (or local) government were adopted under 29 C.F.R 1.3(g)-(h). Example: SAME2023-007 01/03/2024. SA reflects that the rates are state adopted. ME refers to the State of Maine. 2023 is the year during which the state completed the survey on which the listed classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination.

The date, 01/03/2024 in the example, reflects the date on which the classifications and rates under the ?SA? identifier took effect under state law in the state from which the rates were adopted.

WAGE DETERMINATION APPEALS PROCESS

1) Has there been an initial decision in the matter? This can be:

a) a survey underlying a wage determination

b) an existing published wage determination

c) an initial WHD letter setting forth a position on a wage determination matter

d) an initial conformance (additional classification and rate) determination

On survey related matters, initial contact, including requests for summaries of surveys, should be directed to the WHD Branch of Wage Surveys. Requests can be submitted via email to davisbaconinfo@dol.gov or by mail to:

Branch of Wage Surveys Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.

Washington, DC 20210

Regarding any other wage determination matter such as conformance decisions, requests for initial decisions should be directed to the WHD Branch of Construction Wage Determinations.

Requests can be submitted via email to BCWD-Office@dol.gov or by mail to:

Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
