SECTION SF 30 BLOCK 14 CONTINUATION PAGE
SUMMARY OF CHANGES
SECTION SF 30 - BLOCK 14 CONTINUATION PAGE
The following have been added by full text:
AMENDMENT 0002
1. Section 31 24 00.00 12 Paragraph 3.2 Sand Fill Construction states the sand fill shall be place in a bullnose configuration to minimize the amount of soft material trapped underneath the sand fill and to minimize the mud wave forming ahead of the sand fill. It also states contractor’s equipment shall be kept on the sand fill at all times to minimize damage to the surrounding swamp. Would the government consider allowing marsh buggy excavators in the swamp in the sand placement area only to contend with the mud wave anticipated on this project as the soil borings show unrecovered samples for a significant depth signifying massive potential for large mud waves and the need to contend with it with equipment that can work from the leading edge of the mud wave.
USACE Response: Yes. No objection to the use of marsh buggy excavators.
2. Section 01 57 20.00 paragraph 3.3 states significant work restrictions when colonial nesting wading birds or bald eagle nests are found in the vicinity of the work. In the event work restrictions are placed due to the discovery of nests with given distance and work restrictions will a change order be issued to compensate the contractor for standby and work restrictions?
USACE Response: Yes.
3. Section 31 11 00.00 12 paragraph 3.3 Grubbing refers to Section 31 24 00.00 12 Sand Fill paragraph 2.1 Materials regarding what is to be removed. We just want to confirm the intent is to remove concentrated masses of unsuitable sticks, branches and roots AND the stumps.
USACE Response: Yes, that is the intent.
4. 52.236-4 (c) requires the contractor to provide transportation such as an airboat or marsh buggy to Government personnel for the purpose of inspecting the work in process and documenting the progress of work for approving request for payments. Will contractor need to provide this for times the contractor will not be present, or will the government only require this piece of equipment when the contractor is present and working?
USACE Response: Required only when the Contractor is present.
5. Given the recent nature of fuel escalations can the government allow fuel escalation payments with basing fuel on a specific stated price in the bid.
USACE Response: No.
6. Section 01100 – 16 states permissible hours of work between 7am and 7pm, would the government consider adjusting the permissible work hours to daylight hours?
USACE Response: No.
7. Please provide details of the settlement plate required by the contract. A simple plate seems likely to displace with the mud wave.
USACE Response: Settlement Plate Details have been added to the plans under Amendment No. 001.
W912P822B0030
8. Section 32 15 00.00 12 Paragraph 1.5.2.2 states testing of surfacing material shall be performed at a minimum frequency of one set of tests per day surfacing material is placed. Would the government consider just one initial test of the material instead of testing every day material is placed?
USACE Response: Yes, this will be revised to just one initial set of testing.
9. Section 01 55 26.00 12 Traffic Control and Coordination Paragraph 3.3.2 requires a traffic engineer or traffic control supervisor to inspect the project at 30-day intervals with a report issued with each inspection. Considering the minimal amount of traffic control required on the access road can the government waive this requirement.
USACE Response: Traffic Control Plan to be removed.
10. According to FAR Clause 52.217-7, the Contracting Officer may exercise Option 1 by written notice to the Contractor no later than 170 days from Notice to Proceed. The Contracting Officer may exercise Option 2 by written notice to the Contractor no later than 200 days from the Notice to Proceed. With the Base Bid contract time being 170 days, the Government may wait until the last day of the Base Bid contract before awarding the first option. This may force Contractors that are aggressive with their schedule to go on standby while waiting for the Government to decide on the optional work. Please consider reducing the maximum time the Contracting Officer must exercise the options so that the Government receives the lowest possible bid.
USACE Response: Specification will remain as written.
11. Section 01100-General Provisions, Item 4 requires the Contractor to furnish for the exclusive use of the Government employees, a temporary building that shall be placed within the locations and limits of the Government environmentally cleared right of way or limits of construction. Please identify areas where the temporary inspector’s field office can suitably be located, and can the temporary building be located off the project?
USACE Response: Will not specify on plans where inspector’s field office should be located. Inspector’s field office should be within the projects right of way as stated in Section 01100, paragraph 4(e).
12. Is it the intent to require the Contractor to clear and grub the limits of the base bid and option 1 and 2 areas regardless if the optional work is awarded?
USACE Response: Yes.
13. Please confirm if both 52.219-14 Limitations on Subcontracting and 52.236-1 Performance of Work by the Contractor will apply to this contract.
USACE Response: Yes.
14. Please confirm if this Solicitation is subject to the Executive Order 14026 minimum wage of $15 per hour?
USACE Response: Executive Order 14026 applies:
1. To solicitations issued on or after January 30, 2022, and their resulting contracts.
2. To new contracts awarded without a prior solicitation (e.g., a purchase order under part 13), on or after January 30, 2022.
3. To new contracts with a prior solicitation awarded on or after March 31, 2022. 4. To existing contracts, including procurements for recreational services, when extending, renewing, or exercising an option on the existing contract on or after the effective date of the rule. Contracting officers shall incorporate the amended clause in this rule at 52.222- 55, Minimum Wages for Contractor Workers Under Executive Order 14026, in the existing contracts through bilateral modifications. In such a circumstance, if the
W912P822B0030 contracting officer is unable to incorporate the clause in an existing contract through bilateral modification, then the contracting officer shall decline to extend, renew, or exercise the option on the existing contract.
5. In accordance with FAR 1.108(d), contracting officers are strongly encouraged to include the amended clause in other contracts awarded before March 31, 2022, with appropriate consideration.
15. Please confirm if this Solicitation subject to the Executive Order 13706 accrued paid time off 1 hour per each thirty hours worked?
USACE Response: Executive Order 13706 applies to new contracts and replacements for expiring contracts with the Federal Government that result from solicitations issued on or after January 1, 2017 (or that are awarded outside the solicitation process on or after January 1, 2017) Under the Final Rule, Executive Order 13706 applies to four major categories of contractual agreements:
1. procurement contracts for construction covered by the Davis-Bacon Act (DBA);
2. service contracts covered by the McNamara-O’Hara Service Contract Act (SCA);
3. concessions contracts, including any concessions contracts excluded from the SCA by the Department of Labor’s regulations at 29 CFR 4.133(b); and
4. contracts in connection with Federal property or lands and related to offering services for Federal employees, their dependents, or the general public. Furthermore, any subcontract of a covered contract that (like the upper-tier contract) falls into one of these four categories is subject to the paid sick leave requirements.
Procurement Contracts for Construction Under the Final Rule, any contract covered by the DBA and its implementing regulations is subject to the Executive Order’s requirements. The Executive Order does not apply, however, to contracts that are subject only to the Davis-Bacon Related Acts, i.e., Acts under which Federal agencies provide financial and other assistance to construction projects through grants, loans, guarantees, insurance and other methods, but do not directly procure construction services.
Service Contracts
Under the Final Rule, both procurement and non-procurement contracts that are subject to the SCA and its implementing regulations are subject to the Executive Order’s requirements.
16. Would the USACE provide the estimated quantity for the items they have bid on a JOB basis?
USACE Response: Requested Cost Engineer provide to contracting.
17. If Option Work 2 is issued, will it be only after Option Work 1 is issued so it can be accessed if those options are deemed to be exercised by the government?
USACE Response: Yes.
18. Please confirm there is only access from Frenier Road and there will be no access from Hwy 51?
USACE Response: Correct. There ill only be access from Frenier Road and no access from Hwy 51.
19. Please confirm if the SSHO is a full-time responsibility and that they can not perform any other duties concurrent with the performance of that duty?
W912P822B0030
USACE Response: Yes.
20. Please confirm if the CQCM is a full-time responsibility and that they can not perform any other duties concurrent with the performance of that duty?
USACE Response: The CQCM is a full-time responsibility and cannot have other concurrent duties.
21. 01100-3 (j) discusses limitations on trucks in the performance of this contract, please confirm trucks shall not exceed 24 cubic yards in capacity?
USACE Response: Limitations on trucks not to exceed 24 cubic yards in capacity will be removed.
22. Shall original cross sections of sand base be provided prior to or after clearing?
USACE Response: After clearing and placement of sand fill the contractor shall take cross sections every 300-feet. After all sand fill has been placed, the contractor shall take final cross sections as specified in Section 1100 para. 24.
23. Will the As-Built schedule required by section 01 32 17.00 20 paragraph 1.8.2 have the same submission time requirements as the as-built drawings?
USACE Response: Yes.
24. Please confirm if a minimum of 45 days shall be allowed for review and approval of the Traffic Control Device Plan discussed in Section 01 55 26.00 12 paragraph 3.2?
USACE Response: Yes.
25. Section 31 05 20.10 12 paragraph 1.4 discusses the contractor requirement of using a Geogrid manufacturer/Installer (GMI) subject to the approval of the government. Please describe the requirements of an approvable GMI if this is different than a contractor just having had experience installing geogrid on past projects.
USACE Response: Experience installing geogrid on past projects and ability to supply the specified geogrid is sufficient.
26. Please confirm if the requirements of Section 31 05 20.10 12 paragraph 3.2 apply to the 1’ thick crushed stone layers identified on plan sheet C-009?
USACE Response: Yes.
27. Please confirm if cleared and stockpiled timber discussed in Section 31 11 00.00 12 paragraphs 3.2.2 and 3.2.5.1 and 3.4.1 and 3.4.3 shall be removed from site or if all cleared and grubbed material and stockpiled trees can be stockpiled outside of the limits of the sand base identified on the drawings? The specification is not clear and allows then disallows certain dispositions of different materials associated with clearing and grubbing of the corridor and contradicts what can be stockpiled to the side outside of the sand placement and what must be removed or burned.
USACE Response: Paragraph 3.4.1 has been revised to state, “All cleared material shall either be disposed of offsite or burned. All grubbed material shall be stockpiled outside of the sand base. If burning, the burning permit must be approved before any burning is allowed. Windrows will not be allowed.”
28. Will the compliance surveys including the centerline profile shots at 20’ intervals and initial cross sections have to be performed by a licensed surveyor?
USACE Response: Yes.
29. Section 31 24 00.00 12 paragraph 2.1.1 Sand fill states it shall be obtained from an approved contractor-furnished commercial sand stockpile. Is there a list of approved sources like what is provided for stone, if not what criteria are needed for approval?
USACE Response: No. Contractor furnished has been revised to Government furnished.
W912P822B0030
30. Section 31 24 00.00 12 paragraph 2.1.1 states gradation tests are required every 20,000 cubic yards. Given this contract is paid for and tracked by the ton, is there a tonnage conversion to consider meeting the cubic yard frequency requirement?
USACE Response: No sand testing is required. This will be revised.
31. References are made to FAR 52.236-7 thru the specifications. Please advise if the contractor is responsible for damages to Frenier Road from hauling operations regardless that fuel taxes pay for roadway maintenance in the state. Given Frenier Road is a gravel road, would the government consider adding a maintenance aggregate item so aggregate can be added to the roadway at the direction of the government so the gravel access road can be maintained to perform the work required by the government? It should be noted this is the only access to the project.
USACE Response: Any temporary repairs to Frenier Rd made by the contractor during the hauling operation shall be submitted to and approved by St John Parish. Temporary repairs shall be included within the items it is incidental to.
32. Will the pipeline and canal crossing be removed at the end of the project?
USACE Response: Pipeline and canal crossing will remain in place for future contracts.
33. Please provide profiles of Montz Canal North and South for the canal crossings. It is not possible to estimate the amount of material required to make these crossings. Or consider paying for the sand fill in these crossing by the ton.
USACE Response: Profiles will not be provided.
34.
Are we allowed to unwater area around culvert pipes to install?
USACE Response: Yes.
35.
With the access to the work area being off of Frenier road which is a side street in disrepair the specifications call for an Engineer designed traffic control plan. Would this been necessary or can standard construction signs be used.
USACE Response: Standard signs can be utilized.
36.
With Frenier road in complete disrepair and aggregate will be required to improve the access is a full time street sweeper still a requirement?
USACE Response: Yes.
37.
Specification 31.11.00.00 para 3.2.5.1 states "All cleared and grubbed material shall be either disposed of offsite, burned, or stockpiled outside the limits of the sand base. While para 3.4.1 in the same specification says that cleared and grubbed material shall either be disposed of offsite or burned. What is the final disposition of the clear and grubbed material? Can the material be left onsite outside of the sand base?
USACE Response: Paragraph 3.4.1 has been revised to state, “All cleared material shall either be disposed of offsite or burned. All grubbed material shall be stockpiled outside of the sand base. If burning, the burning permit must be approved before any burning is allowed. Windrows will not be allowed
38.
Based on the Caution to Bidders Reference: In delivery of hand-carried bids, bidders are cautioned to allow sufficient time for delays which may be encountered as a result of frequent trains which are subject to block all access roads to place of bid opening for various lengths of time. Such delays DO NOT permit acceptance or consideration of late bids. Will the government allow bids to be emailed in lieu of hand delivery?
USACE Response: Please see instruction to Bidders for Bid submission.
W912P822B0030
39. Is the only allowed Access for Site Prep Contract 2 through Frenier Road?
USACE Response: Yes.
40. Sheet C-001 has a note that there is “No Access From HWY 51”: is this to advise that there is no current available access, or to prohibit ingress/egress access from that point?
USACE Response: Access is prohibited from HWY 51. The only access to the site is from Frenier Rd.
41. With the close proximity to Lake Pontchartrain, this will be the wettest job: due to the effect/force of buoyancy wet sand loses compaction or density and will not hold up the trucks: will time be allowed when the Lake level is above an elevation that allows loaded truck access (for instance 1.0’ or 1.5’ Lake elevation will be less than 1.5 to 2 feet of unsaturated sand)?
USACE Response: Time extensions in accordance with the Default clause will be issued if high tides prevent sand placement.
42. Will any sand loss due to the frequent tide waters from Lake Pontchartrain be considered the contractor’s responsibility?
USACE Response: No, refer to Damage to Work clause.
43. Is it acceptable for the contractor to use contract sand to build a pad to above elevation
5.0 for equipment and material storage above the possible tide elevation, and then cut the pad down and utilize the sand in plan fills when complete?
USACE Response: No objection.
44. On plan sheet C-003 along Frenier Road it notes a Canal Crossing Design by contractor (CLIN 0002?) and also the Access Road and Pipeline Protection Section from Typical Section 3 (CLIN 0007?): please define the limits of the two pay items?
USACE Response: Channel Crossing (CLIN 0002) is the channel crossing off Frenier Rd. Crushed Stone Pipeline Crossings (CLIN 0007) is the surfacing, sand and geogrid over the pipeline crossings.
45. Plan sheet C-003 appears to suggest that five runs of 24 inch pipe is acceptable for the temporary culverts at the pipeline and/or canal crossing: is any minimum flow rate required? (Environmental Section 01 57 20.00 12, part 3.3 does not allow altering water flows) USACE Response: The minimum flow rate for the canal crossing near Frenier Rd is 25
CFS.
46. The Canal Crossings are by contractor design, but will the contractor be compensated for any damage/repairs to the crossings due to tide, flood, etc.?
USACE Response: No, refer to Damage to Work clause.
47. Since the temporary culverts on the job are to be retained by the Government when the job is complete, can they be made a bid item?
USACE Response: No.
48. Can the Geotextile Separator Fabric, Geogrid, and aggregate for the canal and pipeline crossings be made unit prices?
USACE Response: No.
49. Since the job is bid by the ton, and thus the cross section surveys are then only informational, can the requirement for using a Licensed Surveyor for the original and final cross sections and settlement readings be eliminated?
W912P822B0030
USACE Response: No.
50. Does the Traffic Engineer or Traffic Control Supervisor for inspections have to meet any training requirements like the Traffic Control Design Engineer?
USACE Response: No. Traffic Control Plan will be removed.
51. What measures are required for the project for the Environmental specifications at the Canal crossings?
USACE Response: None.
52. What measures are required for the project for the SWPPP/Erosion Control this close to Lake Pontchartrain?
USACE Response: None.
53. With the extreme volatility in the petroleum market would the USACE consider adding a fuel escalation clause to the contract for the sand and aggregate deliveries and the debris disposal?
USACE Response: No.
54. Section 31 24 00.00 12 part 1.3.2 provides that no separate payment will be made for the sand for the pipeline crossing: does that mean it will be paid for by the ton with the rest of the sand fill?
USACE Response: Payment for the sand fill for the pipeline crossing shall be included in the JOB price for the Pipeline Crossing line item.
55. Are two Truck Wash Down Racks required?
USACE Response: One Truck Wash Down Rack is sufficient.
56. For sand placed in water there will be no means of testing compaction, please verify the testing requirements? Is it waived as with Contract 1?
USACE Response: There will be no required sand testing.
57. Is an airboat or marsh buggy with Captain required for USACE inspection access?
USACE Response: Yes.
58. The USACE has made SWPPP measure costs incidental to other work, but have not provided any proposed plan or erosion control measures: is silt fence to be required anywhere?
USACE Response: No.
59. Note 2 on the Existing Condition Typical Section of sheet C-004 states “Contractor will encounter standing water along Project. Depth will vary.” What erosion control measures are required in the water or canals: are turbidity curtains required anywhere?
USACE Response: No.
60. Section 01 57 23.00 12, part 1.8.1 states that “At the Contractor's option, the structural practices shall include either of the following devices.”, but none are listed: please advise what Structural Controls for erosion control are expected?
USACE Response: None.
61. Is this Solicitation subject to the Executive Order 14026 minimum wage of $15 per hour?
USACE Response: Executive Order 14026 applies:
1. To solicitations issued on or after January 30, 2022, and their resulting contracts.
2. To new contracts awarded without a prior solicitation (e.g., a purchase order under part 13), on or after January 30, 2022.
3. To new contracts with a prior solicitation awarded on or after March 31, 2022. 4. To existing contracts, including procurements for recreational services, when extending, renewing, or exercising an option on the existing contract on or after the effective date of
W912P822B0030 the rule. Contracting officers shall incorporate the amended clause in this rule at 52.222- 55, Minimum Wages for Contractor Workers Under Executive Order 14026, in the existing contracts through bilateral modifications. In such a circumstance, if the contracting officer is unable to incorporate the clause in an existing contract through bilateral modification, then the contracting officer shall decline to extend, renew, or exercise the option on the existing contract.
5. In accordance with FAR 1.108(d), contracting officers are strongly encouraged to include the amended clause in other contracts awarded before March 31, 2022, with appropriate consideration.
62. Is this Solicitation subject to the Executive Order 13706 accrued paid time off 1 hour per thirty hours worked?
USACE Response: Executive Order 13706 applies to new contracts and replacements for expiring contracts with the Federal Government that result from solicitations issued on or after January 1, 2017 (or that are awarded outside the solicitation process on or after January 1, 2017) Under the Final Rule, Executive Order 13706 applies to four major categories of contractual agreements:
1. procurement contracts for construction covered by the Davis-Bacon Act (DBA);
2. service contracts covered by the McNamara-O’Hara Service Contract Act (SCA);
3. concessions contracts, including any concessions contracts excluded from the SCA by the Department of Labor’s regulations at 29 CFR 4.133(b); and
4. contracts in connection with Federal property or lands and related to offering services for Federal employees, their dependents, or the general public.
Service Contracts Under the Final Rule, both procurement and non-procurement contracts that are subject to the SCA and its implementing regulations are subject to the Executive Order’s requirements.
63. Would the USACE provide the estimated quantity for the items they have bid on a JOB basis?
USACE Response: Requested Cost Engineer provide to contracting.
64. SECTION 31 24 00.00 12, Part 3.3.1.4 provides for a speed limit of 15 mph “within the construction easement area”: does this apply to Frenier Road also?
USACE Response: No, posted speed limit applies.
65. Will the contractor be required to re-check sand surface after settlement and bring any low areas back up to +3’ upon completion?
USACE Response: Yes.
W912P822B0030
66. The design criterial as stated in the spec for the canal crossing as shown in the plans. Will they be considered temporary/for construction purposes or permanent? Will they need to be stamped by a PE?
USACE Response: Pipeline and canal crossing will remain in place for future contracts.
Crossings do not need to be stamped by a PE.
67. Are we required to get any additional permits for road access from LADOTD or the Parish?
