About this file
This document provides details on a federal contract solicitation for sand stockpiling services. The United States Army Corps of Engineers, New Orleans District is soliciting bids to excavate approximately 750,000 cubic yards of sand material from the Bonnet Carre spillway, haul and stockpile the sand in the Highway 61 stockpile area. Additional requirements include clearing and grubbing vegetation from the stockpile area, constructing and maintaining crushed stone access roads, and other incidental work. Bids are due virtually with amendments providing clarification on questions from industry and adjusting the bid opening date. Pricing will be on a unit price basis for line items such as mobilization, borrow pit development, clearing and grubbing, silt fencing, sand stockpiling, culverts, and crushed stone surfacing, with optional items for additional surfacing and geotextile. The magnitude of work is estimated between $10-25 million.

AMENDMENT 0003
Industry Question and Government Response for West Shore Lake Pontchartrain, Louisiana, Hurricane and Storm Damage Risk Reduction Project, Sand Stockpile Contract 1, St. Charles and St. John the Baptist Parishes, Louisiana (ED 20-028)
Q.1 The Quality Control section below states that this course is given by the USACE from time to time. Can you please provide a list of dates for the next scheduled classes?
3.4.4 Additional Requirement
In addition to the above experience and educational requirements, the CQC System Manager, and his/her alternate, shall have completed the course entitled "Construction Quality Management For Contractors" within the last 3 years. This course is periodically offered at the New Orleans District and other Corps of Engineers districts.
A.1 Government Response: A class is planned for the last week of February 2021, which already has a waiting list over 40 people. Email David.J.Martinez@usace.army.mil to add the names to the waiting list. Here is the link for classes.

Q.2 Can the Government provide the approximate amount of sand available in each borrow pit?
A.2 Government Response: BP 1 = approx. 386,000 CY, BP 2 = approx. 40,000 CY, BP 3‐A =approx. 270,000 CY, BP 3‐B = approx. 333,000 CY, BP 6 = approx. 498,000 CY, and BP 7 =approx. 65,000 CY.
Q.3 Is it intended to utilize all 6 borrow pits provided?
A.3 Government Response: No.
Q.4 Is there an order of precedence in which the pits are to be utilized?
A.4 Government Response: Yes. See drawing C‐01, Note 2. Utilize Pit 7 last. In addition, each borrow pit that the contractor chooses to excavate must be fully excavated of sand as stated in the specifications. The contractor is not allowed to randomly remove a smaller quantity of sand from each of the available pits. The sum of all pits chosen by the contractor to excavate shall yield approximately 750,000 cubic yards of sand.
Q.5 At the stockpile location will any other contractors be utilizing this haul road?
A.5 Government Response: Yes.
Q.6 Please clarify‐ Spec Section 31 23 00; 3.1.1 states “All excavations shall be performed in an unwatered borrow pit”, and Spec Section 31 23 00; 3.1.2 states “The borrow area shall be drained and kept dry during excavation. Excavation will not be permitted in water nor shall excavated material be scraped, dragged or otherwise moved through water.”
A.6 Government Response: Excavation shall be performed in the dry, as described in the referenced specification sections.
Q.7 What are the current USACE estimated quantities for available sand in each of the pits, 1, 2, 3A, 3B, 6, and 7?
A.7 Government Response: See answers to question 1.
Q.8 Will the cane be harvested and roots burned by others at the stockpile site?
A.8 Government Response: The cane has been harvested. The roots will not be burned.
Q.9 There is no pay item for the base bid separator fabric and crushed stone for the Northeast and Southwest Entrances: will these be added?
A.9 Government Response: The separator fabric is included in the unit price for Bid Item 0006. An amendment will address the crushed stone.
Q.10 How wide is the Access Road easement on section A‐3 on sheet C‐06?
A.10 Government Response: About 40 feet wide at that section.
Q.11 Silt Fence will very likely not contain the stockpiled sand over time and rain events:
has the USACE considered concrete barrier? When will this contract no longer be responsible for the stockpile erosion control?
A.11 Government Response: No. We have not considered concrete barrier. The contractor will be responsible for silt fence maintenance until final acceptance of the project.
Q.12 General Note 14 on sheet G‐03 provides that the Contractor clean and remove all trash from ROW limits prior to contract completion: is this only the job limits, or does it include Airline Highway ROW?
A.12 Government Response: The contractor is required to clean all areas within the right‐of‐ way limits including Airline Highway (HWY 61). The truck wash‐down rack is an important feature that the contractor shall utilize for maintaining the cleanliness of the highway.
Q.13 General Note 16 on sheet G‐03 requires cleaning all drainage structures in ROW limits after completion: does this include Airline Highway?
A.13 Government Response: Yes.
Q.14 A note requires removing and stockpiling field culverts in the staging area: is this only cul‐ 07A?
A.14 Government Response: There is another culvert next to cul‐07A, and any other culverts found but not shown in the drawings.
Q.15 Since you have you to turn right off Hwy 628 onto Hwy 61, what will be the route, and what is the mileage to the stockpile?
A.15 Government Response: You are not allowed to turn right off of Hwy 628 onto Hwy
61. As shown on drawing C‐01, egress from the Bonnet Carre spillway onto Hwy 61 is from the levee ramp shown on the northeast side of the drawing. You will be making a right turn from the lower guide levee onto Hwy 61. The access routes outside of the spillway are further restricted to right turns only when entering and exiting the stockpile location off of Hwy 61. The routes and mileage shall be determined by consulting with your Traffic Engineer who will be developing your traffic control plan.
Q.16 Will there be another company using the stockpile road at the same time as the sand contractor?
A.16 Government Response: Yes
Q.17 Is there an area that power, water, and sewage will be available for the construction site trailer? If not, how would this be handled?
A.17 Government Response: The contractor shall visit the site and speak to the utility companies to determine the availability of power, water, sewage and internet. If these utilities are unavailable, a contractor supplied generator, water tank, sewage holding tank and cellular internet data will be necessary to comply with the specification requirements.
Q.18 Can all excavated material generated from item 0003 Clearing and Grubbing Stockpile Area 1 remain on site or will the contractor have to get dispose offsite?
A.18 Government Response: There is no excavation called for within specification section 31 11 00.00 12, Clearing and Grubbing. Disposal of cleared and grubbed materials is as prescribed within paragraph 3.4 of the same specification section.
Q.19 Plan sheet C‐01 is showing that ingress from 628 is apparently from Highway 61. Are we allowed left hand turns onto Highway 61 from the stockpile which contradicts specifications of previous project of clay stockpile
A.19 Government Response: No. Left hand turns are not allowed onto Hwy 61 from the stockpile.

Award will be made as a whole to one bidder.
NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A
BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT
FOR ANY ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE
INELIGIBLE FOR AWARD.
NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).
NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442.

Within ten (10) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.
NOTE 4: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;
http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx
NOTE 5: OPTIONAL WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTIONAL WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTIONAL WORK Items by written notice to the Contractor. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.
NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
NOTE 7: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF OPTIONAL WORK. In the event that CLINS 0008 and 0009 are exercised under the terms of the contract, no additional calendar days shall be added to the time required for completion of the contract original duration of 400 calendar days established for the BASE WORK items specified in the Contract Clause entitled
“COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR 52-211-10 – APR
1984)”.
NOTE 8: The Government will determine the total quantity to be acquired for any unit priced item under either the base or option CLINs.
EVALUATION OF SUBLINE ITEMS (Dec 2019 - AFARS 5152.211-9000).
Item No. 0004 is subdivided into two or more estimated quantities and is to be separately priced. The Government will evaluate the item on the basis of total price of its subline items.
(End of Clause)
VARIATIONS IN ESTIMATED QUANTITIES - SUBLINE ITEMS (Dec 2019 –
AFARS 5152.211-9001).
This variation in estimated quantities clause is applicable only to item No. 0004.
(a) Variation from the estimated quantity in the actual work performed under any second or subsequent subline item or elimination of all work under such a second or subsequent subline item will not be the basis for an adjustment in contract unit price.
(b) Where the actual quantity of work performed for item No. 0004 is less than 85% of the quantity of the first subline item listed under such item, the Contractor will be paid at the contract unit price for that subline item for the actual quantity of work performed and, in addition, an equitable adjustment shall be made in accordance with the clause at Federal Acquisition Regulation (FAR) 52.211-18, VARIATION IN ESTIMATED QUANTITY.
(c) If the actual quantity of work performed under item No. 0004 exceeds 115% or is less than 85% of the total estimated quantity of the subline item under that item and/or if the quantity of the work performed under the second subline item or any subsequent subline item under item Nos. NONE exceeds 115% or is less than 85% of the estimated quantity of any such subline item, and if such variation causes an increase or a decrease in the time required for performance of this contract the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, VARIATION
IN ESTIMATED QUANTITY.
