1) Industry Question: Is a plan sheet for the off-site stockpile to be issued or will the plan sheet from the previous project be used for this contract.

Government Response: If the option is exercised, a plan sheet will be issued for the off-site stockpile area. Note, this is the first Solicitation for this contract.

2) Industry Question: Would it be possible to have the contact for the permitted haulers working within the spillway at this time.

3) Industry Question: Section 00700 (e) refers to some estimated quantities from Mr. Petitbon; would you please provide his contact information.

Government Response: Please contact the contracting specialist, Anthony (Tony) Maiore for estimates of quantities for "Job" bid items at Anthony.p.maiore@usace.army.mil.

4) Industry Question: ...[I]s the clay on site and [does it] have to be excavated and hauled with [road] trucks or is it to haul with off [road] trucks and bring clay in [?] [A]nd how may yards of clay will there be to move [?]

Government Response: Means and methods of hauling within the Bonnet Carre Spillway will be the contractor’s responsibility. Should optional CLIN 0006 be exercised, over the road trucks will be required. The quantities are as shown on the Bid Schedule, Section 00010.

5) Industry Question: Will silt fence or any type of erosion control measures be required on the stockpile areas?

Government Response: No silt fence will be required within the Bonnet Carre. If silt fencing is required at the Off- Site Stockpile location, an equitable adjustment will be made pursuant to the Contract Clause in Section 00700, entitled CHANGES (FAR 52.243.4).

6) Industry Question: On the bid form, 0004 is simply to dig, process, and stockpile in areas as shown on the plans the first 500,000 CYNS of material. 0005 is the same scenario as 0004, just an additional 500,000 CYNS of material. However, 0007 is to dig, process, and HAUL per 3.2.2. Section 31 24 00. 00 12 Page 12 of specifications the material that is dug under this item. Our clarification question is what, if any, of the items listed will be combined to make the unit of pay the paid to the contractor for the work done.

Government Response: If Bid Item 0005 is exercised under the Option, Bid Item 0007 will also be exercised. Please note, Bid Item 0007 is “Development of Bonnet Carre Stockpile Area #2 – OW”. CLINs will not be combined to make the unit.

7) Industry Question: Please provide a copy of subsection FAR 52.243-4 Changes as referred to in section 00700 of job specifications on sheet SECTION 31 24 00. 00 12 Page 13.

Government Response: FAR clause 52.243-4 Changes, is incorporated by reference into the contract on page 49 of 403 of the solicitation. Please see FAR clause 52.252-2 Clauses Incorporated by Reference for a link to a web address where full text clauses may be accessed.

8) Industry Question: Is it possible to post the government estimate for this project. The range is stated from $25 to $100 million.

Government Response: No.

9) Industry Question: What is the anticipated Notice of Award date?

Government Response: An anticipated Notice of Award date cannot be provided. Award will be made in accordance with clause 52.214-19, Contract Award – Sealed Bidding – Construction, which is incorporated into the solicitation by reference.

10) Industry Question: I am trying to find the scope of work for this project, exclusive to metal fabrication. WSLP Borrow Stockpile #2.

Government Response: Scope of Work is as per the synopsis and solicitation.

11) Industry Question: How do I get a copy of the interested vendors list (planholders list) for this solicitation? Let me know. I do not see one on FedBiz. Thanks.

Government Response: Allow Vendors to View Interested Vendors List, is now open.

12) Industry Question: I have a question about the Combined Synopsis/Solicitation posted to FBO under solicitation number W912P820B0020.

I am hoping to find out if there is an incumbent contractor currently performing these services, if similar services have been performed in the past, or if this is a new requirement. If there is an incumbent, could you please provide the contract or task order number?

Government Response: This is a new requirement. There are no contractors currently performing these stockpiling services.

13) Industry Question: Section 31 23 00.00 12, Paragraph 3.1.1 states that “the borrow pit shall be excavated to full depth and width starting along the north side of the pit and working in a southerly direction”. Plan Sheet C-01, note 6 states that “excavation with the borrow pits shall begin at the east end of the pit and shall progress full with and depth toward the west end”. Please clarify in what direction shall the borrow pit be excavated.

Government Response: The correct direction is "east to west". The specification will be revised.

14) Industry Question: Section 31 24 00.00 12, Paragraph 3.2.2 states that “Specific additional stockpile areas outside of the BCS will be provided to the Contractor by the Government and will be within 12 miles (one-way) of the BCS”. It goes on to state that “The Contractor shall anticipate having to haul up to 6 miles on an unimproved road”. Does the 12 miles (one-way) haul distance include up to 6 miles on an unimproved road meaning only 6 miles is the expected haul distance on the highways?

Government Response: Yes.

15) Industry Question: The “Typical Borrow Pit Excavation Section” on Plan Sheet C-01 shows two areas within the borrow pit that were previously excavated with a minimal layer of sand/silt on the bottom of the previously excavated areas. This is not an accurate picture of current conditions of the borrow pit as these two previously excavated areas are nearly filled with several hundred thousand cubic yards of sand and silt. Will the contractor be required to remove the sand and silt from these areas?

Government Response: No. The Section on Dwg. "C-02" will be revised.

16) Industry Question: Plan Sheet C-01: the only egress from the spillway appears to be thru the spillway to the Lower Guide Levee; However, it appears that the Ingress can be from the Lower Guide Levee via Airline Highway and/or the Upper Guide Levee via the CC Road.

Government Response: Correct.

17) Industry Question: If this is correct is the Upper Guide Levee Road Improvement (Asphalting the sloped road) going to be required

Government Response: Asphalting of roads is not required in this contract.

18) Industry Question: In preparing the Stockpile ONE (1); it appears that in balancing this area, due to the existing low areas, that the subgrade before stockpiling may be somewhat low. Would we be allowed to use the sand overburden from Borrow Area to fill some of this area so that the stockpile would be above the surrounding area prior to stockpiling/processing the clay?

Government Response: Yes, but only to provide a smooth groundline prior to commencing stockpiling as is stated on the drawings, Sheet C-03. High spots shall not be artificially created with the sand overburden.

19) Industry Question: Section 31 23 00.00 12 page 4 – 3.1.3 “The Government will, in all anticipatory circumstances, give written notice to the Contractor of the potential need or intent to operate the floodway, granting 10 calendar days to cease borrow operations and remove equipment and stockpiled material. Does this refer to the processed stockpiles #1 & #2?

Government Response: No. The removal of stockpiles of clay material are excluded from this notice.

20) Industry Question: Section 31 24 00.00 12 - 3.2.2: The outside stockpiles referred to in this section are said to be 12 miles away from BCS. Is this mileage from the Lower Guide Levee/Airline Highway and is the 6 miles of unimproved roadway in addition to the 12 miles or included in the 12 miles….

Government Response: The stated 6 miles is an approximate total mileage of unimproved roads from the stockpile/borrow pit site to the outside stockpile locations. The 12 miles is inclusive of 6 miles of unimproved roads.

21) Industry Question: Section 31 23 00.00 12 – 3.1.1 Would it be possible that a section depicting the method described within the paragraph of the excavation of the borrow area be provided. This description appears to be somewhat subjective and would appreciate any clarification that you may be able to provide.

Government Response: The paragraph as written is sufficient to indicate that it is allowable to have a bench but that the bench shall be no more than 300 feet in advance of the full depth excavation.

SECTION 00700

1. Solicitation page 40 of 403. Delete this page in its entirety and substitute the attached revised page 40 of 403 therefore.

2. Solicitation pages 41 thru 47 of 403. Delete these pages in their entirety.

3. Page 63 of 403. Provision 52.236-4, Physical Data, subparagraph (e). Delete this subparagraph in its entirety and substitute the following reference:

In order to fully utilize available borrow areas, the borrow pit shall be excavated to full depth and width starting along the east side of the pit and working in a westerly direction. Any bench, shelf or partial excavation in the borrow area shall be limited to 300 feet in advance of the full depth of the pit excavation. All excavations shall be performed in an unwatered borrow pit. Sand or silt removal from the ground surface is not limited by the 300 foot bench limitation.”

1. Page 5, paragraph 1.4.1. Delete this paragraph in its entirety and substitute the following therefore:

“1.4.1 Clay Stockpile within Bonnet Carre Spillway

Payment for all fill material placed and including additional material placed by reason of foundation settlement during construction, will be made at the contract unit price per cubic yard for "Clay Processing/Stockpiling at Bonnet Carre". Price and payment shall constitute full compensation for furnishing all plant, labor, control testing, surveying, employment of professional engineering services, equipment and material, settlement gages, and performing all operations necessary for excavation, all testing, hauling, foundation preparation, material processing for moisture control and blending, placing and compacting the material and all other incidental work required to complete the stockpiling operations at the Bonnet Carre stockpile area 1. The Government reserves the right to remove and utilize partially stockpiled material at any time after a measurement and acceptance of the partial stockpile. During this removal operation, the Government may occupy not more than four acres of the stockpile area during removal operations.”

2. Page 5, after paragraph 1.4.1, add the following new paragraphs as:

1.4.3 Clay Stockpile at Alternate Site (Optional Work)

Payment for all fill material placed and including additional material placed by reason of foundation settlement during construction, will be made at the contract unit price per cubic yard for "Clay Processing/Stockpiling at Alternate Site - OW", if Optional Work is exercised. Price and payment shall constitute full compensation for furnishing all plant, labor, control testing, surveying, employment of professional engineering services, equipment and material, settlement gages, and performing all operations necessary for excavation, all testing, hauling, foundation preparation, material processing for moisture control and blending, placing and compacting the material and all other incidental work required to complete the stockpiling operations at an alternate site located outside of the Bonne Carre Spillway. The Government reserves the right to remove and utilize partially stockpiled material at any time after a measurement and acceptance of the partial stockpile. During this removal operation, the Government may occupy not more than four acres of the stockpile area during removal operations.”

3. Renumber existing paragraphs 1.4.2, 1.4.3, and 1.4.4 accordingly.

Page 4, paragraph 3.1.3. Delete this paragraph in its entirety and substitute the following therefore:

“3.1.3 Use of Bonnet Carre Floodway Borrow Area

Government-furnished borrow and stockpile areas for the exclusive use in the performance of this contract work have been established in the Bonnet Carre Floodway at the location and within the respective limits shown on the drawings. Borrow and stockpiling from this source shall be performed in accordance with applicable notations on the drawings and as provided in these specifications. This Government-furnished source of borrow material may be overlain by alluvial sand and silt, deposited by the river, of varying thicknesses as a result of Floodway operation and the removal of sand under the terms of annually issued and renewable Federally granted sand hauling permits for specific tracts. Permit tracts may overlay portions of the designated borrow and stockpile area. The permits for this tract, as well as other tracts, grant a permittee 20 calendar days in which to vacate the tract, remove its equipment and any stockpiled sand from its tract after it receives notice from the Government to vacate the tract.

Therefore, the Contractor must give written notice to the Contracting Officer that will allow at least 30 calendar days for notification to the affected sand hauler. This notice will allow the sand hauler adequate time to terminate its operations and grant unobstructed occupancy of the borrow and stockpile areas to the Contractor. River water may seep through the Bonnet Carre' Spillway structure when the river stage at Bonnet Carre' is at or above elevation 15.0 feet N.G.V.D.. Delays to the Contractor's borrow, stockpiling, and hauling operation from water flowing through the unopened structure when the floodway is not being operated will be subject to the provisions of Section 00700 Contract Clause entitled "DEFAULT (FIXED PRICE CONSTRUCTION) (FAR 52.249-10)". The Government may need to operate the Bonnet Carre Floodway, which may adversely affect the availability of borrow. The operation of the floodway will only occur after the President of the Mississippi River Commission has determined that the river has reached a stage or flow that threatens the Federal flood control system downstream of the Spillway. The Government will, in all anticipatory circumstances, give written notice to the Contractor of the potential need or intent to operate the floodway, granting 10 calendar days to cease borrow operations and remove equipment. This notice shall not relieve the Contractor from taking whatever steps necessary to protect its equipment and operations from rising river stages. The Contractor shall cooperate and coordinate its use of mutual haul roads with others. Any changes or delays to the Contractor's operations due to opening the Bonnet Carre Floodway will be made pursuant to Contract Clause in Section 00700, entitled "CHANGES (FAR 52.243-4)".”
