*Denotes a change from the previous Bidding Schedule.
Award will be made as a whole to one bidder.
NOTE 1: The Contractor shall note that the area, shown as the borrow area, on the contract drawings is also designated as a disposal area for hopper dredges.
NOTE 2: It is the Government’s intent, under this contract, to dredge approximately 14,000,000 cubic yards of material (if Optional Work is exercised) from the hopper dredge disposal area (HDDA) and place it into the wetland creation areas, as shown on the contract drawings.
Circumstances may arise such that the Contractor may be required to coordinate this work with hopper dredges working in Southwest Pass of the Mississippi River. If such coordination is required, the Contractor may be directed to move dredging operations within the borrow area to an area which will cause the least impact to both dredging and disposal operations. In addition, the Contractor shall closely coordinate with the Corps of Engineers, US Coast Guard, River Pilots and Vessel Traffic Service (VTS) in order to assure safe operations and minimal impacts to navigation when placing material within the West Bay area.
NOTE 3: The unit “Job” as used in this Bidding Schedule is synonymous with the term “Lump Sum” used elsewhere within these plans and specifications.
NOTE 4: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE
UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS
BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD.
NOTE 5: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or subline items are materially unbalanced (See FAR 14.404-2, Rejection of Individual Bids).
NOTE 6: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442 after Notice of Award. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within 24 hours after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Plan, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.
NOTE 7: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the options.
NOTE 8: OPTION FOR INCREASED QUANTITY -- SEPARATELY PRICED LINE ITEM (FAR
52.217-7). The Government may require the delivery of the numbered line item, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within three days prior to the estimated completion date of the basic line item or any previously exercised option. Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
NOTE 9: OPTIONAL WORK ITEMS: The Government may require the delivery of the numbered line item(s), identified in the schedule as Optional Work items, in the quantity (total or part quantity) and price stated in the schedule. Bidders shall bid on all items including the Optional Work item (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid. If the Government activates the Optional Item, the activation will occur while the Contractor’s plant is within the limits of the dredging Base Work.
NOTE 10: TIME ADJUSTMENT IN THE EVENT OF OPTIONAL WORK. In the event that Optional Work Item 0005 Dredging – OW is exercised under the terms of this contract, the time required for completion of the contract will be increased by 130 calendar days beyond the original duration of 400 calendar days established for the Basic Work set forth in the Section 00700 Contract Clause paragraph entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK”. For partial award of Optional Work Item 0005 Dredging – OW, the 130 calendar day allowance will be prorated accordingly. Optional Work Item 0006 “Bird Nesting Prevention and Avoidance Measures – OW” requires work to be performed concurrent with Optional Work Item 0005 “Dredging – OW”. The successful bidder is advised that the contract time required for Optional Work Item 0006 “Bird Nesting Prevention and Avoidance Measures – OW” is included in the performance period allowed for completion of Optional Work Item 0005 “Dredging – OW”, thus the time required for completion of Optional Work will not be increased.
NOTE 11: ASSESSMENT OF LIQUIDATED DAMAGES. As this contract includes both Base and Optional Work items, and the durations allowed for completion of both the Base Work and awarded Optional work are independent of each other, liquidated damages will be assessed if and when the Contractor goes beyond the duration allowed for completion of the Base Work, and assessed until the Base Work is completed; and if Optional Work is awarded, liquidated damages will be assessed if and when the Contractor goes beyond the duration allowed for completion of the awarded Optional Work, and assessed until the Optional Work is completed."

AM0001 VIRTUAL BID OPENING
INSTRUCTION TO BIDDERS
Due to the response for COVID-19, most federal employees have been mandated to telework, and currently only authorized personnel are allowed access to the District buildings throughout USACE. As a result, we have implemented the below procedures for all current and future bid openings, until such restrictions have been lifted and normal access has resumed at the MVN HQ Building.
Electronic Submission of Bids:
MVN will utilize the DoD Safe website for receipt of electronic bids under IFB Solicitations. In order to submit an electronic bid please follow these steps:
1. Send an email containing your name and email address to the Contracting Officer and Contract Specialist associated with the IFB:
Contracting Officer – Ms. Veronica Garner Flint, email: veronica.garner-flint@usace.army.mil Contract Specialist – Ms. Karen Hargrave, email: karen.d.hargrave@usace.army.mil
2. The Contracting Officer or Contract Specialist will go to the DoD Safe site, input your name and email address, and then will request the file from you. You will then receive an automated email from the site with a unique link in the email.
3. Once the email with the link is received, please click on the link in the email, which will take you to the DoD Safe site.
4. This will be a unique webpage where you can upload your file. The default page will load with the box checked off next to, “Send me an email when each recipient picks up the files”.
Please leave this box checked in order to receive a notification when the file is received from the Contracting Officer or Contract Specialist. Please leave unchecked, “Encrypt every file”. The site itself contains a high level of security in which additional encryption is not required.
5. When you are ready to upload your bid file (please use pdf format for bid submission), you can either click the blue button which says, “Click to Add Files or Drag Them Here” to locate the file on your computer, or simply drag the file onto the screen.
6. In the Description box that appears after uploading your file, please type your Company Name.
7. Click the button that appears at the bottom of the page, “Drop-off Files”. A banner will pop-up asking for confirmation that your upload does not contain Classified Information. Click ok on the banner.
8. You will be taken to a confirmation page that should say, “Drop-Off Completed” at the top.
This is your confirmation that your file was successfully uploaded to the site.
9. The Contracting Officer or Contract Specialist will receive an automated email stating that the file has been submitted. They will then send an email back to the company, confirming that they received the notice from the DoD Safe site.

Superseded General Decision Number: LA20190007
State: Louisiana
Construction Type: Heavy Dredging
Counties: Louisiana Statewide.
DREDGING PROJECTS ALONG THE GULF COAST AREA INCLUDING THE
MISSISSIPPI RIVER AND ITS TRIBUTARIES TO THE OHIO RIVER
Note: Under Executive Order (EO) 13658, an hourly minimum wage of $10.80 for calendar year 2020 applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2015.
If this contract is covered by the EO, the contractor must pay all workers in any classification listed on this wage determination at least $10.80 per hour (or the applicable wage rate listed on this wage determination, if it is higher) for all hours spent performing on the contract in calendar year 2020. If this contract is covered by the EO and a classification considered necessary for performance of work on the contract does not appear on this wage determination, the contractor must pay workers in that classification at least the wage rate determined through the conformance process set forth in 29 CFR 5.5(a)(1)(ii) (or the EO minimum wage rate, if it is higher than the conformed wage rate). The EO minimum wage rate will be adjusted annually. Please note that this EO applies to the above-mentioned types of contracts entered into by the federal government that are subject to the Davis-Bacon Act itself, but it does not apply to contracts subject only to the Davis-Bacon Related Acts, including those set forth at 29 CFR 5.1(a)(2)-(60). Note: Executive Order (EO) 13706, Establishing Paid Sick Leave for Federal Contractors applies to all contracts subject to the Davis-Bacon Act for which the contract is awarded (and any solicitation was issued) on or after January 1, 2017. If this contract is covered by the EO, the contractor must provide employees with 1 hour of paid sick leave for every 30 hours they work, up to 56 hours of paid sick leave each year.
Employees must be permitted to use paid sick leave for their own illness, injury or other health-related needs, including preventive care; to assist a family member (or person who is like family to the employee) who is ill, injured, or has other health-related needs, including preventive care; or for reasons resulting from, or to assist a family member (or person who is like family to the employee) who is a victim of, domestic violence, sexual assault, or stalking. Additional information on contractor requirements and worker protections under the EO is available at www.dol.gov/whd/govcontracts.
Unlisted classifications needed for work not included within the scope of the classifications listed may be added after award only as provided in the labor standards contract clauses (29CFR 5.5 (a) (1) (ii)).
The body of each wage determination lists the classification and wage rates that have been found to be prevailing for the cited type(s) of construction in the area covered by the wage determination. The classifications are listed in alphabetical order of ""identifiers"" that indicate whether the particular rate is a union rate (current union negotiated rate for local), a survey rate (weighted average rate) or a union average rate (weighted union average rate).
Union Rate Identifiers
A four letter classification abbreviation identifier enclosed in dotted lines beginning with characters other than ""SU"" or ""UAVG"" denotes that the union classification and rate were prevailing for that classification in the survey. Example:
PLUM0198-005 07/01/2014. PLUM is an abbreviation identifier of the union which prevailed in the survey for this classification, which in this example would be Plumbers. 0198 indicates the local union number or district council number where applicable, i.e., Plumbers Local 0198. The next number, 005 in the example, is an internal number used in processing the wage determination. 07/01/2014 is the effective date of the most current negotiated rate, which in this example is July 1, 2014.
Union prevailing wage rates are updated to reflect all rate changes in the collective bargaining agreement (CBA) governing this classification and rate.
Survey Rate Identifiers
Classifications listed under the ""SU"" identifier indicate that no one rate prevailed for this classification in the survey and the published rate is derived by computing a weighted average rate based on all the rates reported in the survey for that classification. As this weighted average rate includes all rates reported in the survey, it may include both union and non-union rates. Example: SULA2012-007 5/13/2014. SU indicates the rates are survey rates based on a weighted average calculation of rates and are not majority rates. LA indicates the State of Louisiana. 2012 is the year of survey on which these classifications and rates are based. The next number, 007 in the example, is an internal number used in producing the wage determination. 5/13/2014 indicates the survey completion date for the classifications and rates under that identifier.
Survey wage rates are not updated and remain in effect until a new survey is conducted.
Union Average Rate Identifiers
Classification(s) listed under the UAVG identifier indicate that no single majority rate prevailed for those classifications; however, 100% of the data reported for the classifications was union data. EXAMPLE: UAVG-OH-0010 08/29/2014. UAVG indicates that the rate is a weighted union average rate. OH indicates the state. The next number, 0010 in the example, is an internal number used in producing the wage determination. 08/29/2014 indicates the survey completion date for the classifications and rates under that identifier.
A UAVG rate will be updated once a year, usually in January of each year, to reflect a weighted average of the current negotiated/CBA rate of the union locals from which the rate is based.
WAGE DETERMINATION APPEALS PROCESS
1.) Has there been an initial decision in the matter? This can be:
* an existing published wage determination
* a survey underlying a wage determination
* a Wage and Hour Division letter setting forth a position on a wage determination matter
* a conformance (additional classification and rate) ruling
On survey related matters, initial contact, including requests for summaries of surveys, should be with the Wage and Hour Regional Office for the area in which the survey was conducted because those Regional Offices have responsibility for the Davis-Bacon survey program. If the response from this initial contact is not satisfactory, then the process described in 2.)
and 3.) should be followed.
With regard to any other matter not yet ripe for the formal process described here, initial contact should be with the Branch of Construction Wage Determinations. Write to:
Branch of Construction Wage Determinations Wage and Hour Division U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
2.) If the answer to the question in 1.) is yes, then an interested party (those affected by the action) can request review and reconsideration from the Wage and Hour Administrator (See 29 CFR Part 1.8 and 29 CFR Part 7). Write to:
Wage and Hour Administrator U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
The request should be accompanied by a full statement of the interested party's position and by any information (wage payment data, project description, area practice material, etc.) that the requestor considers relevant to the issue.
3.) If the decision of the Administrator is not favorable, an interested party may appeal directly to the Administrative Review Board (formerly the Wage Appeals Board). Write to:
Administrative Review Board U.S. Department of Labor 200 Constitution Avenue, N.W.
Washington, DC 20210
4.) All decisions by the Administrative Review Board are final.
