Government Responses to Industry Questions for the:

West Shore Lake Pontchartrain, Louisiana Hurricane and Storm Damage Risk Reduction Project Bonnet Carre Stockpile Contract 1 St. Charles Parish, Louisiana Solicitation No. W912P819B0045 Amendment 0004

1. Is railroad insurance required?

Government Response: No.

2. Section 00010, page 4, note 7 (a) and (b) states contract duration of 320 calendar days.

Standard Form 1442, paragraph 11 states contract duration of 370 calendar days. Please clarify.

Government Response: The original contract duration is changed from 370 calendar days to 320 calendar days.

3. Bid Bond form provided in specifications is expired. Please provide updated form.

Government Response: Please see Attachment (1)_SF24(REV.AUG 2016).

4. Specification section 01 57 23.00 12, pages 2 thru 7 reference permit number LAR100000.

Permit number LAR200000 has been provided at the end of the section. Please clarify.

Government Response: Please see Attachment (2), page 16.

5. Specification section 32 12 16.00 12, paragraph 2.3.3 references binder course. Paragraph

3.7.1 of the same section references wearing course. Please clarify.

Government Response: Please see Attachment (2), page 2, SECTION 32 12 16.00 12.

6. Is the “U.S. Army Corps of Engineers, New Orleans District Current Small Business Program Target Percentages FY2018” table applicable for this project as this project is a Small Business Set-Aside? Please clarify.

Government Response: Yes.

7. Regarding the table mentioned in question 6 above, the note states “The above figures are subject to change. Contact the New Orleans District Small Business Office for further information”. Will any changes made?

Government Response: The below figures are subject to change. Contact the New Orleans District Small Business Office for further information, as stated on page 23 of the solicitation.

8. Regarding the table mentioned in question 6 above, will the contractor be required to meet these target percentages?

Government Response: These goals are applicable to all the Contractor’s construction work performed in the covered area. If the Contractor performs construction work in the geographical area located outside of the covered area, the Contractor shall apply the goals established for the geographical area where the work is actually performed.

9. If the Optional Work Items are to be exercised, how many calendar days from NTP does the Government anticipate this to take place?

Government Response: The Government may exercise the Optional Work Items at any point during the original contract duration.

10. Does the sand overburden stockpile pit need to be dewatered prior to placing any material in?

Government Response: No.

11. Will any type of erosion control features, such as silt fence, be required around the Hwy 61 Stockpile as it is located outside of the spillway?

Government Response: If silt fencing is required at the Hwy 61 Stockpile location, an equitable adjustment will be made pursuant to the Contract Clause in Section 00700, entitled

CHANGES (FAR 52.243.4).

12. Borrow pit bottom cut elevations have been provided on sheet C-02. Please provide the existing ground elevation.

Government Response: Ground elevations at the time the borings were taken are shown on Drawings B-02 – B-13. As listed on each of the boring drawings, “ground elevations and overburden materials/depths shown herein may not reflect current conditions”. Current existing ground elevations will not be provided by the Government and should be obtained by your company if so desired.

13. Is the contractor required to clear, dike, and develop all areas of Borrow Sites 1A, 1B, 2, and 3, or use only the necessary areas to produce the required material quantities?

Government Response: There are three designated borrow sites within the Bonnet Carre labeled borrow pit 1, borrow pit 2, and borrow pit 3. There are also 2 stockpile sites with the Bonnet Carre labeled as stockpile area 1 and stockpile area 2. All three borrow pits shall be cleared, stripped of overburden, and diked. The Bonnet Carre stockpile area 1 shall be cleared and grubbed in its entirety. The specifications will be updated accordingly in a forthcoming amendment.

14. Is the contractor required to utilize the borrow areas in a specific order?

Government Response: The contractor may choose the order of the pits to excavate from, however no more than two pits can be excavated from at a given time. One pit must be completely exhausted prior to moving to the third pit.

15. In the Synopsis on FedBizOps is states that this is a small business set-aside but on the tab to the right it says N/A. I do not see anything on the solicitation itself. Is this Small Business, or any other Set aside?

Government Response: This is a 100% Small Business Set-Aside.

16. The original solicitation stated that under optional work a location within a 12 mile radius may be identified to have material stockpiled and processed. The Amendment identifies a specific location. Now that the Optional Stockpile area on US 61 has been identified, is there still the possibility/option that another location within the 12 mile radius will be identified and utilized under this contract?

Government Response: No.

17. I represent a client that has a lease to the land that the USACE New Orleans District intents to stockpile on for the above referenced project. My client has not given permission or right of entry or easement on the land for use as a stockpile area.

I respectfully request that you delay the bid opening until such time that this can be sorted out.

Furthermore, my client intends to utilize the land as a borrow site for clay for the West Shore Project having spent over $250,000 on environmental documents, analysis and geotechnical borings.

Government Response: The area shown as the stockpile site that is in question is part of an option to the contract. That option will only be exercised if the non-Federal sponsor provides the government, the Authorization for Entry. If the Authorization for Entry is not provided the contractor will stockpile all of the material in the Bonnet Carre Spillway.

18. Spec 31 24 00.00 12-3.3 states that if road construction at the HWY 61 Stockpile is required, an equitable adjustment will be made pursuant to the CHANGES clause. Does this include all road construction required to improve the existing access road from Hwy. 61 to the stockpile area as the existing road does not meet specification requirements?

Government Response: An equitable adjustment will be made to allow for initial construction of a 30' wide unimproved road. Maintenance costs of this road will be incidental to the stockpiling operations.

19. Spec 31 23 00.00 12-3.3.2 states that the Contractor shall contribute to maintenance of any existing drainage within the Bonnet Carre Floodway limits that benefit its activities. Will the Government perform any maintenance of major existing drainage canals in the spillway subsequent the recent opening of the spillway?

Government Response: Yes.

20. Will the Government perform any repairs to damaged access roads in the spillway to be used for this project prior to work commencing?

Government Response: Yes.

21. Is there any chance that the Corps would consider the NAICS Code of 237990 (Other Heavy and Civil Engineering Construction) which would broaden the number of competitive bids that could be provided.

Government Response: No.

22. Is this project a set aside for small business, or does the NAICS Code and $15,000,000 size apply to work that is subcontracted?

Government Response: Solicitation W912P8-19-B-0045 is 100% Small Business Set- Aside. The North American Industry Classification System (NAICS) Code for this acquisition is 238910, with a small business size standard of $15,000,000.00, in accordance with clause FAR 52.204-8, Annual Representations and Certifications (Oct 2018) in Section 00600 – Representations & Certifications on page 00600-1.

23. Since this is only a stockpile job, with third party testing, can the Superintendent be the Quality Control Manager provided he has the proper training?

Government Response: No.

24. Does the easement on the access road off Route 61 allow widening the haul road?

Government Response: The easement is 40’ wide. The access road may be widened.

25. The sand is reportedly fifteen feet deep along the tree line in Borrow Pits 1 and 2: is there a maximum amount of overburden removal that must be completed for the Job price? Is there a depth where exploration may be stopped?

Government Response: The depths of the pits for required suitable material removal are as shown on the plans. All overburden on all the pits shown on the plans shall be removed to allow removal of suitable clay materials.

26. To fit 1,000,000 cubic yards of sand in the footprint shown on the plans for the Route 61 stockpile, the pile would be 50 feet high: can the footprint be expanded in the easement?

Government Response: It is estimated a 25 foot high stockpile at Hwy 61 will accommodate 1,000,000 cubic yards. In the event the stockpile dimensions must be revised, the footprint may be expanded during construction. Please note the Contract is for stockpiling of clay, not sand.

27. The original solicitation indicated that the offsite stockpile would be within twelve miles:

is the Route 61 Stockpile the only one that will be used, or must we anticipate the possibility of some twelve mile locations?

Government Response: No.

28. Is it possible CLIN 003 will only move 100,000 cubic yards, and the balance of the clay be moved under CLIN 007?

Government Response: Yes, see note 7b of Section 00010 regarding CLIN Item 007.

29. What is the anticipated maximum cumulative volume of clay to be removed from the three pits?

Government Response: See Note 8 of Section 00010. Quantities can be calculated by your company based on the drawings.

30. It usually states on the front page of the solicitation if set-aside for small business or other. While the cover sheet does not show any restrictions and FBO under General Information under Set Aside shows N/A, the synopsis in FBO states 100% Small Business set-aside under

NAICS Code 238910. Additionally, on page 00600-1 of the advertisement, it states the NAICS code for this acquisition is 238910 and the small business size standard is $15,000,000.00. Is this acquisition set-aside and is there a size limitation?? Current small business size standard by NAICS for Code 238910 is $16.5 m and for Code 237990 is $39.5 m.

Government Response: Please see the Government Response to Industry Question number 22. Small Business Size Standard for NAICS Code 238910 from $15M to $16.5M, and NAICS 237990 from $36M to $39.5M are interim change and has not taken effect at this time.

31. Can you please clarify if this project/solicitation has any set aside goals that must be met for the general contractor? We understand that the goals for minority and female participation are as noted in the specifications, but we are asking for clarification on the bidding/award set aside goals.

Government Response: Please see the Government Responses to Industry Questions 6, 7, and 8.

Part I. COVERAGE UNDER THIS PERMIT

A. Applicability.

1. This permit authorizes discharges of storm water from construction activities that disturb

5 acres or more of total land area, including the disturbance of less than 5 acres of total land area that is part of a larger common plan of development or sale if the larger common plan will ultimately disturb 5 acres or more, as defined in LAC 33:IX.2511.B.14.j and those construction site discharges designated by the State Administrative Authority as needing a storm water permit under LAC

33:IX.2511.A.1.e, except for discharges identified below under Permit Part I.A.3. Permit coverage is required from the “commencement of construction activities” until “final stabilization” as defined in Permit Part IX.

Construction activities regulated under this permit include clearing, grading, excavation operations, and/or adding fill material that result in the disturbance of five acres of land or more.

Road and pipeline building and construction of residential houses, office buildings, industrial buildings, and runways are examples of construction activities.

The clearing of land solely for agricultural purposes is NOT a regulated activity so it is exempted from Louisiana Pollutant Discharge Elimination System (LPDES) permitting requirements

(LAC 33:IX.2315.A). Projects on cultivated croplands are not regulated, as these are already

“disturbed” areas.

Storm water discharges at field activities or operations associated with oil and gas exploration, production, processing, or treatment or transmission, are regulated in accordance with the latest provisions of LAC 33:IX.2511.A.

Construction activities related to oil and gas exploration, production, processing, or treatment, or transmission activities are exempt from regulation. Section 323 of the Energy

Policy Act of 2005 modified paragraph (24) of Section 502 of the Clean Water Act (CWA) to define the term “oil and gas exploration, production, processing, or treatment, or transmission facilities.”

This term is used in CWA Section 402(1) (2) to identify…
