The place of performance will be specified under each task order. Location maps for each lock and control structure are attached at the end of this solicitation.
c. This contract also covers diving services to inspect the New Orleans District’s hopper dredge
Wheeler in the event a problem should occur with the dredge. On rare occasions, the dredge may be located at a site that is further than 5 hours from the approved mobilization location (see paragraph 2-d below concerning the 5 hour requirement). For payment guidelines concerning this occurrence, see paragraph 16, sub-paragraph k.
d. Mobilization Location
The Contractor’s mobilization site shall be in a location that will allow any of the above sites to be reached within 5 hours, as required in paragraph 4-c. The Contractor shall provide the location to the
Contracting Officer in his bid proposal, as stated in Section L of this solicitation. This location shall remain constant throughout the contract unless otherwise approved by the Contracting Officer to change. This location will also be used to calculate the mobilization/demobilization mileage and to determine if per diem will be allowed.
3. Description of Diving Services
All dives will be initiated by individual task orders with specific work to be accomplished set forth therein. The Contractor shall determine the methods with full regard for safety and efficiency.
The diving services to be performed at the navigation locks include, but are not limited to, the following:

c. Preparing reports outlining the condition and placement of wrecks and obstructions, including measurements, sketches, and Global Positioning System (GPS) coordinates with recommendations for removal.
d. Assisting in the removal operation.
4. Task Orders
Once the New Orleans District has determined that a dive is required, the Contracting Officer’s
Representative (COR) will notify the Contractor of the impending dive. The COR will inform the
Contractor of the required scope of work for the specific dive, but the Contractor shall not commence and perform work until a task order has been issued by the Contracting Officer. The task order issued by the
Contracting Officer can be written or verbal as described below.
a. Written Task Orders
Written task orders are required prior to all jobs when time is not a determining factor. The task order will specify the scope of work and contain other particulars of the job such as location, reporting time, depth of dive, special equipment requirements, etc. The reporting time shall be the time at which the Contractor is directed to report to the specified location with all dive team members and all required equipment. It is the Contractor’s responsibility to review the scope of work prior to the crew leaving the home office. The Contractor shall notify the Corps of
Engineers if the required equipment is inadequate, the scope is unclear, suggests unsafe practices or impractical requirements, etc.
b. Verbal Task Orders
Verbal task orders may be issued by the Contracting Officer when determined to be in the best interest of the Government.
c. Emergency Verbal Task Orders
Authority to issue an emergency task order is limited to the Contracting Officer or an Authorized
Government Representative. Emergency task orders are verbal task orders issued during or after work hours for dives deemed an emergency by the Government. In such cases, the Contractor shall be required to mobilize and be at the specified location within 5 hours of notification by an
Authorized Government Representative. The emergency callout limitation is $10,000. A numbered task order will be issued by the Contracting Officer on the first business day after appropriate funds are made available, from which the emergency callout will be converted for contractual, invoicing, and payment purposes.
5. Diving Conditions
Divers may be expected to encounter conditions that affect the ease or safety of operations. Some conditions that may be encountered are reduced or zero visibility, cold water, night dives, dangerous animals (such as poisonous snakes), unpredictable currents, and confined spaces (such as valve tunnels or the girder systems of gates). Generally, water depths for dives vary from six feet to 60 feet.
Occasionally, dives may be to depths in excess of 60 feet, and any special requirements for these dives will be addressed in the task order. See paragraph 16, sub-paragraph e, for payment guidelines.
6. Diving Equipment
All diving equipment shall be provided and used by the Contractor, including any special equipment, which may be required for a given dive. All maintenance to be performed on diving equipment shall be performed on non-duty hours. All diving equipment shall be delivered to the job site in a ready-to-operate condition, with the exception of loading fuel in the compressors. Any loss of time on a job due to the Contractor’s equipment failure shall be omitted from the invoice. See paragraph 16, sub-paragraph c, for payment guidelines.
a. Normal Equipment
Consumables and normal equipment, which are usually required for each dive, shall be provided at no additional cost to the Government and shall be in the offeror’s own inventory, or belong to the individual diver, as appropriate. Examples include, but are not limited to, acetylene, oxygen, boat fuel, two-way communications between supervisor and divers, air compressors and ancillary equipment providing 4.5 cubic feet per minute at all depths, bail-out bottles or other secondary air supplies, diving harnesses, helmets, wet or dry suits, hoses, fuel, knives, hand and/or power tools, tool boxes, boarding ladders, duct tape, rope, etc. Despite the provision of bailout bottles as normal equipment, the use of SCUBA for normal operations or emergencies shall not be allowed without the prior approval of the New Orleans District Diving Coordinator. Divers using direct source surface-supplied air (SSA) shall be provided with a primary air supply of at least 4.5 cubic feet per minute to each diver at the maximum depths and a backup air supply in compliance with
Section 30.D.05 of the most current version of EM 385-1-1.
b. Special Diving Equipment
Special pieces of diving equipment may be required on individual task orders as specified by the
Contracting Officer. Special equipment is that equipment which is identified separately in the
Bidding Schedule under contract line item numbers (CLINs) “0001AM: Hot Water Unit”, “0001AN: Water Jet Pump and Associated Equipment”, “0001AP: Underwater Cutting and
Welding Equipment”, “0001AQ: Dive Boat at a Minimum of 30’ in Length”, and “0001AR:
Underwater Video or Still Camera and Associated Equipment”, which shall be provided by the
Contractor as indicated in the task order, at the cost set forth in the Bidding Schedule. This equipment includes a hot water unit, a 4”x3” water jet pump and associated equipment, underwater cutting and welding equipment, a dive boat measuring a minimum of 30 feet in length, and underwater video/still camera and associated equipment. Underwater welding and burning shall be limited to SSA mode only. Equipment configuration and procedures shall be in accordance with the US Navy Underwater Cutting & Welding Manual, S0300-BB-MAN-010.
The dive boat shall meet U.S. Coast Guard regulations for passenger and equipment load and shall have enough space to accommodate a Government Dive Inspector. Special equipment does not have to be in the offeror’s own inventory, but it must be available for task to the job site within 5 hours. If the equipment is not owned by the offeror, then the offeror shall list the source(s) intended to be used and how it will be assured that it will be delivered to the job site on time and in good operating condition. The Contractor shall receive Government approval before purchasing any equipment for use in which the Contractor seeks full reimbursement. Upon completion of the task order, the equipment will be transferred to the Government.
c. Other Equipment and Costs
Other equipment may be required to accomplish the work specified per task order and not otherwise be identified in the Bidding Schedule. This equipment would be paid for under CLIN
“0001AV: Other Equipment & Costs not otherwise identified in this Schedule”. This equipment includes, but is not limited to, diving barges, tug/tender boats, support vessels, cranes, decompression chamber and associated equipment, air wrench and associated equipment, and an air-lift and associated equipment. Equipment and costs under this line item require Government approval prior to the dive taking place.
7. Government Inspection
a. Pre-Dive Inspection
An equipment inspection will be held jointly by the dive supervisor and the Government Dive
Inspector at the beginning of the dive. The form MVN Form 385-40, entitled “Safety Inspection
Checklist for Diving Operations,” shall be used for this inspection (see Enclosure 1).
Inspection reports shall include, as a minimum, the following:
1. The phase of work underway during the inspection. If others are performing other work in conjunction with the diving services, the phase work for these other activities shall be included.
2. The locations or areas where the safety inspections were performed.
3. The results of the safety inspections, including the nature of deficiencies observed and corrective actions taken.
4. The date and time of the inspection.
5. The signatures of the personnel responsible for the contents of the inspection report.
b. Post-Dive Survey
Following each dive, the District Dive Coordinator or the Government Dive Inspector will independently complete a post-dive survey which rates the Contractor’s job performance. The form entitled “Post Dive Survey” will be used for this evaluation (see Enclosure 2).
8. Safety
a. Safety Indoctrination
The Contractor shall be responsible for initiating and maintaining a safety and health program that complies with the safety and health references described below. The program shall include initial indoctrination and continuing training for all employees who shall work under this contract.
b. Safety and Health References
Equipment and procedures shall comply with:
1. US Army Corps of Engineers Safety and Health Requirements Manual, EM 385-1-1, latest edition.
2. OSHA Regulations, CFR 29.
3. Current US Navy Diving Tables in U.S. Navy Diving Manual Volume I, NAVSEA 0994-LP-
001-9010.
4. The annually updated Safety Practices of the Association of Diving Contractors.
5. These specifications, whichever is the most stringent for the particular application.
c. Required Safety Equipment for Non-Divers
Except for the diver in the water and the stand-by diver, all personnel on the dive team shall wear safety equipment (flotation aids, hard hats, hearing/eye protection, etc.) as required by EM 385-1-
1. The stand-by diver is exempt from the requirements but is required to wear a hard hat. When no divers are in the water, all dive team personnel shall wear the required safety equipment without exception.
9. Diver Qualifications
a. Medical Fitness to Dive and Certifications
The Contractor shall ensure that all divers are medically fit to dive. Divers shall receive an annual diving physical according to ADCI or similar standards preferably by a hyperbaric physician (MD or DO) or other licensed physician knowledgeable in the physiology of diving. A
“Fit to Dive” statement that each diver has been medically examined within the previous 12 months and has been determined fit and approved to dive shall be signed and signature stamped by the examining physician. After any serious diving-related injury or illness, such as an over-pressurization injury and/or decompression illness, divers shall be re-examined by a hyperbaric physician and be re-certified as “Fit to Dive”. In addition, the Dive Supervisor shall verify the divers’ health and well-being at the dive site before allowing the diver to enter the water.
Each dive team member shall have current certification in first aid and cardiopulmonary resuscitation (CPR) from the American Red Cross (ARC), the American Heart Association
(AHA), or from an organization whose training adheres to the standards of the International
Liaison Committee on Resuscitation, or from a Licensed Physician (LP). Additionally, each dive team member shall have current certification in the use of emergency oxygen systems, and, if provided on the dive site, the use of Automated External Defibrillators (AEDs). All classes shall contain a hands-on component and cannot be taken online. Evidence of this will be a photocopy of the certificate(s). The certificate(s) shall state the date of issue and length of validity.
b. Experience and Qualifications
The Contractor shall provide evidence that each dive team member has training and experience consistent with the performance requirements of the scope of work. Training documentation shall be in compliance with the OSHA Diving Standards 29 CFR 1910.410 and shall show that the dive team members have successfully completed training to the appropriate level. A copy of all dive-related training certificates shall be required. Proof of certification (a diploma and/or official transcript) as a commercial working diver from an accredited commercial dive school and other dive-related training certificates (e.g. chamber operator, saturation diver, etc.) shall be required as proof of a dive team member’s certification and/or experience. An ADCI card may be substituted as proof of training for divers demonstrating more than five (5) years of diving experience within the six (6) years preceding commencement of dive operations. As a minimum, each diver, stand-by diver, and dive team supervisor shall have at least one (1) year of commercial experience in the applicable position. Dive tenders must have previous experience and training as a dive tender. If divers are required to perform rigging duties, they must be a qualified rigger and meet the personnel qualifications listed in Section 15.B of EM 385-1-1. The
Contractor shall provide copies of each diver’s certification in his proposal.
Divers shall have completed at least four working dives with similar decompression techniques as in the contract, using the particular diving techniques and equipment to be used under the contract. Divers shall demonstrate that at least one out of the four qualification dives was performed in the last nine months. The District Dive Coordinator will ensure that USACE divers meet the training and qualification requirements of ER 385-1-86.

A four-man dive team may be used whenever a penetration dive is not anticipated. The
Contractor may provide additional personnel for his own convenience, at no additional cost to the
Government. A four-man dive team consists of one dive supervisor, one diver, one stand-by diver, and one tender. Assignments may be rotated among the certified divers, if desired, in order to limit bottom time for any given diver for safety reasons. If such rotation is to occur, this fact must be stated in the diving operations plan.
b. Five-Man Dive Team
A five-man dive team consists of one dive supervisor, two divers, one stand-by diver, and one tender and may be used whenever a penetration dive is not anticipated. A five-man dive shall also be used whenever diver bottom time is limited by water depth. The Contractor may provide additional personnel for his own convenience, at no additional cost to the Government.
c. Six-Man Dive Team
A six-man dive team consists of one dive supervisor, two divers, one stand-by diver, and two tenders and is required whenever a penetration dive is anticipated. A six-man dive may also be used whenever diver bottom time is limited by water depth. The Contractor may provide additional personnel for his own convenience, at no additional cost to the Government. However, if the Government agrees additional personnel are required but not enough that two four-man teams are required, then the rate for additional individuals will be negotiated.
d. Stand-By Diver
The designated stand-by diver shall be wearing his normal equipment (except helmet) and be prepared to enter the water whenever the primary diver is in the water. Due to the heat conduction properties of a wetsuit and considering south Louisiana’s extreme heat indexes, the
Contractor shall provide a shade producing apparatus to shield the dressed out diver from direct sunlight but still allow him to be in an emergency response mode. The stand-by diver is not allowed to work as a tender or have any other duties while the primary diver is in the water. If the stand-by diver is required to enter the water, the dive supervisor may act as a tender.
Manning levels for dive teams are listed in Appendix G of EM 385-1-1.
11. Required Availability of Dive Teams
The Contractor shall be capable of providing up to two full dive teams on the same day, in the event one of the below scenarios occur. Therefore, the Contractor shall always have two six-man dive teams available for use under this contract.
a. There may be instances where two dives are required on the same day, each at a different location.
b. The nature of diving operations under certain task orders may be such that 24-hour operations are required to where shift diving becomes necessary. The Contractor shall provide two dive teams for such operations, each to work a 12-hour shift. No dive team personnel may work two or more consecutive shifts, including the dive supervisor. The second shift may use the same equipment used by the first shift. If separate equipment is used for the second shift, then an additional equipment inspection shall be performed.
12. Hurricane Season
The Government will issue task order(s) as necessary for dive teams to conduct emergency preparations prior to a major storm threatening a New Orleans District navigable waterway. Diving operations may be required one to two days prior to a storm event reaching the area. Diving services to be performed for storm preparedness include, but are not limited to, clearing debris from around and/or under gates and ensuring proper closure of gates at navigation locks and hurricane structures.
13. Documentation Required for Work
a. First Aid, Dives Alert Network (DAN), and CPR Certification
All members of the dive team shall be certified to administer first aid and CPR. Dive team members shall be DAN certified. The Contractor shall show copies of the current certification cards during the pre-dive inspection.
b. Accident Prevention Plan
A written, comprehensive accident prevention plan for all diving activities shall be submitted with the proposal and approved by the New Orleans District Diving Coordinator. A copy of the approved plan shall be maintained on-site during all dives. The accident prevention plan shall include the requirements stated in Sections 01.A.11 through 01.A.18 of EM 385-1-1.
One copy of the Contractor's Safe Practices Manual (see EM 385-1-1, Section 30.A.15) shall be submitted with the proposal package. This manual will be retained by the District Diving
Coordinator and will not be returned.
c. Dive Plan
Following the issuance of the task order, the Contractor shall submit a dive plan, Emergency
Management Plan, and Activity Hazard Analysis (AHA) to the District Dive Coordinator to be reviewed and found acceptable. A dive shall not commence until approval from the District Dive
Coordinator is received in writing.
14. Record-Keeping
A record of all dives shall be kept. An electronic copy of all dive logs shall be submitted to the COR and the District Dive Coordinator immediately following the completion of each dive. The dive logs must state the arrival time at the dive location and the completion time of the dive. In addition, a completion report shall be prepared following all inspection or survey dives, which includes a description of the condition of all items surveyed or inspected. Clear, readable sketches shall be prepared to supplement the text descriptions. The dive logs, reports, and sketches shall be legible, even when reproduced on a photocopier or scanner. An electronic copy of all dive logs, reports, and sketches shall be sent to the
COR and the District Dive Coordinator.
15. Per Diem
Per diem is the allowance for lodging and meals. Per diem will only be paid if the Contractor meets one of the triggers listed below and if the Contractor incurs lodging costs, for which the necessity for such is agreed to by the Contracting Officer prior to the cost being incurred. No partial payments for per diem will be allowed. If per diem is approved by the Contracting Officer, it will be paid for under CLIN “0001AJ: Per
Diem 4 Man Dive Team”, CLIN “0001AK: Per Diem 5 Man Dive Team” or CLIN “0001AL: Per Diem 6
Man Dive Team”, whichever is applicable, and will include costs for lodging and meals.
The following is a list of triggers, which will determine whether the Contracting Officer will allow per diem. The mileage stated in the below triggers is the mileage travelled by vehicle and is the shortest route from the approved mobilization location to the dive location.
a) If the required dive location is greater than 100 miles from the approved mobilization location and the dive team must report to the location at 7:00 a.m. or earlier, then per diem will be allowed for the day prior to the dive.
b) If the dive location is greater than 100 miles from the approved mobilization location and the dive team work time plus commute time is greater than 12 hours, then per diem will be allowed for that day.
c) If the dive location is greater than 50 miles from the approved mobilization location and the dive team is required to perform multiple day dives at the same location, then per diem will be allowed with the exception of the demobilization day (unless the case in paragraph b above applies).
d) If the Contracting Officer deems it necessary in order to accomplish a particular mission not covered in the above cases, per diem may be paid.
16. Payments
a. Payment will be made at the applicable contract unit price(s) for the services described in each task order.
b. Payment for mobilization and demobilization will be made based on the number of round-trip miles between the approved mobilization location and the task order job site. For a job that takes more than one day, mobilization will only be paid for the first day and demobilization the last day. For jobs requiring a second-shift dive crew, mobilization and demobilization will be paid for each crew. Payments for mobilization and demobilization include all work necessary to transport the crew and equipment, with the exception of transporting the dive boat and water jet pump. Separate payment will be made for mobilization and demobilization of the dive boat and water jet pump under CLIN “0001AS: Mobilization and Demobilization of Heavy
Equipment”. Demobilization will begin upon the dive team(s) release by the Government's representative.
c. Pay time for diving will begin at the scheduled time and place stated in the written task order or given verbally under an emergency task order, provided the Contractor is fully equipped/fully staffed and ready to perform work upon the Government’s request. The dive team will be paid a minimum of 8 hours except in the case where the Contractor’s equipment failure causes the job to be delayed resulting in idle/lost time on the job site. In such cases, the amount of time lost will be deducted from the invoice. If the lost time occurs during the first 8 hours, that amount of time will be deducted from the first 8 hours line item. If the lost time occurs during overtime, that time shall be omitted from the Contractor’s invoice. The dive will be considered complete upon release by the Government's representative. Payment to the Contractor for hours worked each day will be determined by the arrival time at the dive location (provided that all dive team members and equipment are at the site) and the completion time of the dive, as shown on the Contractor-submitted dive logs and through confirmation by a Government representative.
d. If the Contractor works more than 8 hours in one day, the Contractor will be paid at the applicable overtime cost set forth in the Bidding Schedule under CLINs “0001AE”, “0001 AG” and “0001AI”.
Payment submitted to the Contractor for overtime will be to the nearest half hour in excess of the time worked. For example, if the Contractor works a total of 8 hours and 20 minutes one day, and his overtime rate is $100.00/hour, he will get paid $50.00 for the 20 minutes that exceeded 8 hours.
e. Hazard pay and/or Depth pay will be subject to an equitable adjustment in accordance with the
Contract Clause 52.212-4, “Contract Terms and Conditions – Commercial Items,” paragraph
(c) “Changes,” and other procedures delineated in the FAR as applicable.
f. When the conditions stated in paragraph 15 are met and the dive team stays at a hotel, the
Contractor is entitled to a per diem allowance.
g. If a dive is required in the winter months and the reasonableness of the use of a hot water unit is agreed to by the Contracting Officer prior to the cost being incurred, a hot water unit and associated equipment will be allowed at the cost set forth in the Bidding Schedule under CLIN “0001AM: Hot Water Unit”.
h. The reasonableness of both quantity and unit cost submitted by the Contractor for other equipment, as defined under paragraph 6-c, shall be determined and approved by the
Contracting Officer prior to work being performed under the applicable task order.
i. If underwater video or still camera equipment is required for a dive, the cost set forth in the Bidding
Schedule under CLIN “0001AR Underwater Video or Still Camera and Associated Equipment” shall include the cost of all equipment, including a clear water box to ensure that the video and/or pictures are clear. If the Contractor is taking underwater video, the Contractor is required under this line item to electronically submit to the Government the video that was taken. If the Contractor is taking pictures with a still camera, the Contractor is required under this line item to electronically submit to the
Government the pictures that were taken. If both video and still camera equipment are required for a dive, the Contractor will be paid twice under this line item.
j. If the Government requires the Contractor to participate in a meeting prior to the dive, which would require one representative from the Contractor, the payment for mobilization and demobilization will be made based on the number of round-trip miles between the approved mobilization location and the meeting site. Payment for the time spent at the meeting will be paid by the hour. These items are identified in the Bidding Schedule under CLIN “0001AT: Mobilization and Demobilization Preliminary
Inspection/Meeting” and CLIN “0001AU: Preliminary Inspection/Meeting”.
k. In the rare occurrence that a dive is required at a location that is further than 5 hours from the approved mobilization location, the rate for the mobilization and demobilization line items (CLINs “0001AA”, “0001AB”, “0001AC”, “0001AS”, and “0001AT”) and the per diem line items (CLINs “0001AJ”, “0001AK”, and “0001AL”) will be negotiated. All other line items will remain at the cost set forth in the Bidding Schedule.
l. If the Government requires the Contractor to perform work on a weekend or federal holiday as specified in Section “Deliveries or Performance” paragraph 8 “Federal Holidays”, the Contractor will be paid the applicable hourly overtime rate.
17. Additional Clauses and/or Provisions
a. Supervision
The Contractor shall give his personal supervision to the work or have a competent foreman or superintendent with authority to act for him, satisfactory to the Contracting Officer, on the job site at all times that work is in progress. All vehicles to be used shall be expressly designated in the insurance policy. A copy of the list of such vehicles shall be submitted to the
Contracting Officer. In the event that the Contractor acquires a new vehicle for use on his contract after his insurance policy has been obtained, he shall immediately amend his policy to reflect the inclusion of the new vehicle on the policy. In no event shall the Contractor drive a vehicle on a Government installation without first obtaining the required coverage for said vehicle.
d. Workmen's Compensation Insurance, in compliance with the laws of the State of
Louisiana.
e. Longshoreman's and Harbor Workers Insurance, in compliance with the laws of the
United States of America.
2. The policies evidencing required insurance shall contain an endorsement to the effect that cancellation or any material change in the policies adversely affecting the interest of the
Government in such insurance shall not be effective for such a period as may be required by the
State of Louisiana, and in no event less than 30 days after written notice to the Contracting
Officer.
3. The Contractor agrees to insert the substance of this clause, including paragraphs 2 and 3 above, in all subcontracts hereunder.
4. It is recommended that the Contractor furnish a copy of this clause to his insurance company, in order to assure that an Insurance Certificate is issued which meets or exceeds the minimum requirements shown above.
