The above numbered solicitation for Mississippi River, Baton Rouge to the Gulf, Head of Passes, Hopper Dredge Disposal Area Project, FY 14-2 Plaquemines Parish, Louisiana (ED 14-043) is hereby amended as follows: (see continuation pages)
THE BID OPENING DATE AND TIME IS HEREBY ESTABLISHED AS TUESDAY 23 AUGUST 2016 AT 2:00 P.M.
LOCAL TIME CST.
NOTE TO BIDDERS:
Bidders are advised that funding for the base work (CLINS 00001 - 00003) and most of the optional work is being made available from two separate and distinct funding sources. The funds available in each source are limited. While the usual statutory cost limitations for eligibility for contract award apply, in addition, bidders are advised that contract award may only be made provided the bid price for the base contract work does not exceed funds that are available for such work. If an overall low bid for the base award CLINs exceeds the amount of funds available for such work no award will be made and the Government may have to cancel the solicitation.
Bidders are requested to ensure that their bids are not unbalanced by including costs associated with Optional CLINs in the Base Award CLINs. The attention of each bidder is called to FAR 15.404-1(g)(3), providing that an unbalanced bid may be rejected upon a determination by the contracting officer that the lack of balance poses an unacceptable risk to the Government.
Responses to Contractor enquiries to Solicitation W912P8-14-B-0053
Will you elaborate on the depths of dredging for the Haliburton Slip and adjacent Tiger Pass Channel?
Answer: As stated in note 2 on Sheet C-13, dredging of the slip at Haliburton road shall be performed to the minimum extent the contractor deems necessary for his/hers operations.
However, where dredging shall not exceed -11' MLG with dredging at this depth no closer than 15' from the bulkheads.
Are there other approved locations for barge off-loading?
Answer: The only location for barge offloading as well as dredge pipeline access from Tiger Pass (if the direct pump option is selected), for which the Government is providing NEPA clearance, as well as ROW, is at the Haliburton slip location off of Tiger Pass.
This, however, does not preclude the Contractor from proposing a deviation to the Government furnished ROW, if desired. (See the GENERAL PROVISION paragraph entitled “RIGHTS-OF- WAY” for further details and requirements.
Is there an order the optional items are to be completed if awarded?
Answer: There is no specific order for which the Optional items are planned to be awarded at this time. Other than the possibility of Option Items 0004 and 0005 being invoked prior to the Spanish Pass Disposal optional work items 0006 through 0012. However, the order will be determined by the timeline for which progress is made for the BASE WORK, followed by other factors such as ROW acquisition for the Spanish Pass Optional Work Items, and the independent contract for the 42” sleeve to be jack-and-bored under Tide Water Road for use under this contract. Aside from these factors, the commencement and completion of optional work items will be based off of the Contractor’s proposed schedule for each item of work required.
What type of geotextile and the amount?
Answer: Quite simply, the P&S do not specify the requirement of geotextile.

“(2) Upon mobilization of required plant and initiation of dredging for filling of the Spanish Pass site, the Contractor is required to dedicate all efforts towards completion of this contract line item. Diverting from 100% dredging and transport of material obtained from the HDDA to Spanish Pass, for pipeline delivery to other available disposal sites, will not be allowed until the necessary placement of dredge fill required for construction of the Spanish Pass ridge and marsh platform is completed. The Contractor shall assure that adequate plant is available to allow continuous dredge and haul/pump operations throughout completion of this effort. If the Contractor should elect to transport the material from the HDDA to the Spanish Pass site via barges, then he/she shall implement a plan that will assure that material losses as a result of barge overflow during filling operations is minimized. This may entail utilizing secondary barge(s) to capture overflow; minimizing barge fill time and quantities; minimizing effluent overflow times, and toggling from one barge to another in order to allow for solids to settle out. This plan shall be submitted to the COR for review and approval.”

25. PERMIT CONDITIONS
a. East Side Disposal - Delta Wildlife Refuge. A Right-of-Entry (ROE) has been obtained from the Fish and Wildlife Service for ingress and egress, as well as to perform work and place dredge material on the Delta National Wildlife Refuge within the areas specified on the contract drawings. As part of this ROE, the following requirements must be adhered to during the course of work: The use of airboats are prohibited from November 1 to January 31 and notification shall be made at least 48 hours before entering the refuge and beginning any work. Notification shall be made via e-mail to Mr. James Harris at james_harris@fws.gov and Ms. Shelley Stiaes at shelley_stiaes@fws.gov. Ms. Stiaes may also be reached at (985) 882-2026.
b. South Pass Disposal Areas - Pass A Loutre Wildlife Management Area (PALWLMA). A Right-of-Entry (ROE) has been obtained from the Louisiana Department of Wildlife and Fisheries (LDWF) for ingress and egress, as well as to perform maintenance dredging, disposal and related activities within the Pass A Loutre Wildlife Management Area (PALWLMA). Compliance with the following conditions will be required:
(1) If the Contractor should elect to use disposal sites on the PALWLMA, the COR shall provide the LDWF with a detailed plan outlining dredging schedules, disposal sites proposed to be used, types of equipment needed, schedules of equipment use, and schedules of project implementation at least two weeks in advance of any activities on PALWMA. In addition, USACE shall provide the LDWF with copies of all pre-project and post project data (elevation/bathymetry information, acreage of marsh created, cut/fill material quantities, etc). All correspondence shall be sent to Shane Granier at sgranier@wlf.la.gov and todd.baker@la.gov.
(2) Following the above mentioned two week notification period, a pre-construction meeting shall be held with LDWF and include the USACE project inspector (COR), the dredging contractor, and any other USACE decision makers for this project. Meeting coordination shall be through LDWF contact Shane Granier at shane.granier@la.gov or Todd Baker at todd.baker@la.gov.
(3) Any and all construction activities on PALWMA including but not limited to dredging areas, access corridors, flotation channel excavations, pipeline corridors, dike construction, buffer areas, fill elevations, etc. shall be performed as depicted on the contract drawings. If any activities extend beyond or outside the locations depicted in the drawings, the USACE shall immediately notify LDWF via email to Shane Granier at sgranier@wlf.la.gov. LDWF and USACE will then meet to discuss how to address the work that is outside of the scope of work detailed in the drawings. Any additional work proposed on PALWMA must be approved by LDWF.
(4) LDWF prefers not to restrict public access on PALWMA. Therefore, the LDWF must approve any requests for closures of waterways in writing.
request for closures of waterways shall be submitted to LDWF staff at least two weeks in advance of the need of the closure(s).
(5) The USACE, its contractors, agents, employees and representatives must follow the rules and regulations of PALWMA. These regulations prohibit the use airboats at any time and mud-boat use after 2:00 pm from September 1 through January 31. LDWF will issue separate conditional permits upon request to allow the use of airboats and/or mud-boats in direct support of this project. LDWF will condition these permits to limit disturbance to waterfowl and to recreational users of the PALWMA during peak periods, particularly during the months of September, November, December, and January. A request for an airboat/mud-boat permit should be made at least one week prior to the need of the vessel, but should be made with as much advanced notice as possible to allow adequate time for permit processing. Requests should be made via e-mail to Shane Granier at shane.granier@la.gov and Vaughan McDonald at vaughan.mcdonald@la.gov.
(6) USACE must coordinate with LDWF regarding the overnight mooring of quarter barges, equipment barges, tugboats, crewboats, etc. and the staging of floating discharge pipe on PALWMA. LDWF reserves the reasonable right to select the locations for mooring and staging of this type of equipment. LDWF also requires all floating structures to be illuminated with flashing hazard lights during night time hours. All submerged pipelines and emergent pipelines in open water must also be marked with lighting to alert boaters of the potential hazards.
(7) Colonial nesting seabirds and wading birds (including, but not limited to, terns, gulls, black skimmers, egrets, herons, and pelicans) should be avoided to reduce the risk of injuring birds. The nesting activity period generally extends from February 15 through September 15. A visual inspection of the project area for nesting birds will be made prior to startup of work by qualified personnel from the USACE and LDWF. Presence of nesting wading birds and/or seabirds must be immediately reported to LDWF by the project inspector. This action will trigger an additional coordination between LDWF and USACE to perform such activities necessary to identify the nesting birds and initiate any necessary project modification(s) that would avoid disturbance to these birds and their nests. If nests of these birds are present on the work area, a “no-work” distance restriction of 650 feet for terns, gulls, and black skimmers, 1,000 feet for colonial nesting and wading birds, and 2,000 feet for brown pelicans must be implemented.
Further coordination by USACE with the U.S. Fish and Wildlife Service may result in a further reduction of “no-work distance restrictions” depending on the species of birds found nesting at the work site.
(8) A copy of these Right of Entry conditions shall be kept on the job site at all times during this project.
mailto:shane.granier@la.gov mailto:vaughan.mcdonald@la.gov
01100-20 ED 14-043
(9) Regular progress meetings between USACE and LDWF staff will be held on site during construction of the project. Additional meetings may be required by LDWF if problems arise.
(10) All equipment used in connection with the project must be removed upon project completion.
(11) Upon completion of the project, a final inspection and/or post-project meeting may be required by LDWF. The meeting would be comprised of PALWMA staff, the contractor, and a representative from USACE to ensure that all stipulations have been adhered to.
(12) In the event the above stipulations are not met, LDWF shall notify the USACE in writing of the infraction. The USACE will have two weeks to rectify the infraction or develop a mitigation plan suitable to LDWF. If no resolution is reached LDWF may cancel this Right of Entry.
(13) The USACE Contractor shall use reasonable care to avoid damage to PALWMA while conducting maintenance dredging operations. The United States has waived sovereign immunity for negligence in the Federal Tort Claims Act, 28 U .S.C. 1346, 2671-2680, and the Department of the Army acknowledges that in the event its employees are negligent, liability may attach for such negligence under the Federal Tort Claims Act. At LDWF’s discretion, the USACE and its Contractor may be asked to repair, or restore to the pre-project condition, any canals, ditches, levees, signs, pilings, or other structures on the PALWMA which are damaged due to the negligence of USACE or its contractors during dredging activities. USACE may be asked to have dredged to their pre-project condition, any waterways (bayous, passes, cuts, canals, trenasses, etc.) that are filled in as a result of the negligence of USACE or its Contractors in the dredging operations. USACE reserves the right to either undertake the performance of any repairs, restoration, or dredging requested by LDWF; or to dispute USACE’s liability for any alleged damages to PALWMA; or to enter into a settlement agreement with LDWF. In no event shall the costs of the repairs, restoration, or dredging, or the financial amount of the settlement, exceed the fair market value of the fee title to the damaged real property at the time immediately preceding the damage. USACE’s liability under this paragraph is subject to availability of appropriations to make any such repairs, restoration, dredging, or payment, and nothing contained in this agreement shall be construed to imply that Congress will appropriate sufficient funds to meet any deficiencies at a later date.
