Award will be made as a whole to one bidder.

* Denotes a change from the previous Bidding Schedule.

**The unit "JOB" as used in this Bidding Schedule is synonymous with the term "Lump Sum" used elsewhere within these plans and specifications.

NOTE 1: The Contractor shall note that the area, shown as the borrow area, on the contract drawings is also designated as a disposal area for hopper dredges.

NOTE 2: It is the Government’s intent, under this contract, to dredge approximately 12,700,000 cubic yards of material (if option work is exercised) from the hopper dredge disposal area (HDDA) and place it into the wetland creation areas, as shown on the contract drawings. Circumstances may arise such that the Contractor may be required to coordinate this work with hopper dredges working in Southwest Pass of the Mississippi River. If such coordination is required, the Contractor may be directed to move dredging operations within the borrow area to an area which will cause the least impact to both dredging and disposal operations. In addition, should the Contractor elect to place material within the West Bay area, close coordination will be required with the Corps of Engineers, US Coast Guard, River Pilots and VTS in order to assure safe operations and minimal impacts to navigation.

NOTE 3: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE

UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY

ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE

INELIGIBLE FOR AWARD.

NOTE 4: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or subline items are materially unbalanced (See FAR 14.404-2).

NOTE 5: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 142 after Notice of Award. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within 24 hours after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

NOTE 6: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). Except when it is determined in accordance with FAR 17.206(b) not to be in the Government’s best interests, the government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the government to exercise the options. Also, due to unforeseen circumstances, (i.e., Mississippi River stages and hopper dredging requirements for Southwest Pass, as well as uncertainty in the prep work and repairs that might be required to roads and staging areas) the Contractor shall note that the Government may exercise, by written notice, all or part of Item 0004 – 'Dredging - OW ', and/or all or part of Item 0005 – 'Bird Nesting Prevention and Avoidance Measures - OW ', and/or all or part of Item 0009 – 'Crushed Stone Road Repairs - Spanish Pass and Haliburton Roads

- OW '. The exercise of any option in part does not obligate the government to the full extent of the option.

NOTE 7: OPTIONAL WORK ITEMS: The Government may require the delivery of the numbered line item(s), identified in the schedule as Optional Work items, in the quantity (total or part quantity) and price stated in the schedule. The Contracting Officer may exercise all or part of the Optional Work by written notice to the Contractor. Bidders shall bid on all items including the Optional Work item (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid. If the Government activates the Optional Item, the activation will occur while the Contractor’s plant is within the limits of the base dredging work.

NOTE 8: TIME ADJUSTMENT IN THE EVENT OF OPTIONAL WORK. In the event that OPTIONAL WORK, Line Item 0004 is exercised under the terms of this contract, the time required for completion of the contract will be increased by 170 calendar days, and if OPTIONAL WORK, Line Items 0006 through 0011 are exercised under the terms of this contract, the time required for completion of the contract will be increased by 270 calendar days beyond the original duration of 225 calendar days established for the Basic Contract Work set forth in Section 00800, Special Contract Requirements paragraph entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK”. For partial award of OPTIONAL WORK Item 0004, the 170 calendar day allowance will be prorated accordingly.

OPTIONAL WORK Items 0005 and 0012 requires work to be performed concurrent with other construction operations, thus the time required for completion of this contract will not be increased for these items.

NOTE 9: RAPID VENDOR PAYMENT: Web based instructions for the submission of invoices;

http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx

NOTE 10: Any VEQ analysis under Option Items 0007AA will be based upon the variation in the line item quantity provided in the Bid Schedule above, and not a variation in any lesser quantity actually awarded under that option line item.

NOTE 11: The quantities shown in Items 0005 and 0009 are for evaluation purposes only; payment for this line item will be based on the actual quantity used and they shall be excluded from the “VARIATIONS IN ESTIMATED QUANTITIES” clause.

http://www.mvn.usace.army.mil/BusinessWithUs/Contracting/RapidVendorPayment.aspx

EVALUATION OF SUBDIVIDED ITEMS.

Item No. 0007 is subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.

(End of Clause)

VARIATIONS IN ESTIMATED QUANTITIES - SUBDIVIDED ITEMS.

The Variations in Estimated Quantities Subdivided Items clause is applicable only in Item No. 0007.

a. Variations from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.

b. Where the actual quantity of work performed for Item No. 0007 is less than 85% of the quantity of the first sub-item listed under such items, the Contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment in contract price shall be made in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity .

c. If the quantity of work performed under Item No. 0007 exceeds 115% or is less than 85% of the total estimated quantity of the sub-items under that item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. NONE exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.

SECTION 35 20 23.00 12

DREDGING

PART 1 GENERAL

1.1 SCOPE

(a) The work provided for herein consists of furnishing all plant, labor, materials, and equipment and performing all operations necessary for the removal of all materials to the required dimensions as shown on the contract drawings, satisfactory disposal thereof, and all operations incidental thereto. Under this contract, the Contractor may use either the West Bay marsh creation disposal area, the marsh creation and peninsula sites within the Delta Refuge along the east side of the Mississippi River and north of Pass a Loutre, the marsh creation areas within the Pass A Loutre Wildlife Management Area (PALWMA) along South Pass, or a combination of all three.

(b) If the Contractor elects to dispose of material dredged from the Hopper Dredge Disposal Area (HDDA) site via a temporary pipeline under and across the Mississippi River, then the pipeline must be installed and removed in accordance with the guidelines specified herein and assure that the channel is open at all times for safe navigation. The only exception will be the times that the Contractor will be allowed to work within the navigation channel in order to install and remove the dredge pipeline within the allowable navigation channel limits. This will also require close coordination with the Corps of Engineers, US Coast Guard, River Pilots, and VTS in order to assure safe operations and minimal impacts to navigation.

(c) If the Government elects to exercise the Option Items for Spanish Pass Disposal, the Contractor will be required to mobilize plant and equipment required to haul/ transport material dredged from the HDDA approximately 12 miles upstream to an existing slip, at the end of Haliburton Road and along the right descending bank of Tiger Pass, for use as an offloading/pump out area, from which disposal pipeline shall be established and run to the proposed Spanish Pass ridge location. Maintenance dredging of the slip, along with disposal of material dredged for accessing the slip, shall be performed as deemed necessary and in compliance with these plans and specs. The dredge pipe shall pass under Tide Water Road, immediately east of its junction with Haliburton Road, via a 42" casing to be installed in advance by others. Construction of a crushed stone and/or earthen ramp over the dredge pipeline in order to provide local access, as well as road rehabilitation and staging area preparation via crushed stone surfacing will be required. In addition, significant retention dike construction will be required at the Spanish Pass ridge site prior to placement of dredged material.

1.2 MEASUREMENT

1.2.1 Quantity Surveys

A survey of the sites for dredging shall be made in accordance with the provisions of Section 02 21 10.00 12 SURVEYS AND CHANNEL BOTTOM GRAB SAMPLING and all measurements to determine dredging quantities will be based on the "before and after dredging" cross sections described therein.

SECTION 35 20 23.00 12 Page 3

W912P8-14-B-0053

Determinations of quantities to be paid for in the area specified, after having once been made, will not be reopened.

1.2.2 Quantity Computations

The quantity of dredged material removed and to be paid for will be measured by the cubic yard by computing the volume along the centerline of each dredge cut between the "before-dredging" cross sections and the required dimensions as shown on the contract drawings using the average end area method. No allowance will be made for excessive dredging except as provided in the paragraph entitled "Excessive Dredging". In order for the Government to make dredging volume computations, the Contractor shall furnish the track plotter charts described in Section 02 21 10.00 12 SURVEYS AND CHANNEL BOTTOM GRAB SAMPLING, paragraph "Preliminary Field Surveys", and the "before and after dredging" data described in Section 02 21 10.00 12 SURVEYS AND CHANNEL BOTTOM GRAB SAMPLING, paragraph "Before and After Dredging Cross Sections".

1.2.3 Acceptance Reach
