Award will be made as a whole to one bidder.
NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE
UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY
ITEM, ITS BID SHALL BE DECLARED NON-RESPONSIVE AND THEREFORE
INELIGIBLE FOR AWARD.
NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See FAR 14.404-2).
NOTE 3: Any proposals which contain a material deviation from the plans and specifications provided with the RFP will be deemed technically unacceptable and ineligible for award. Any proposals which contain conditions or assumptions that render the offer non-binding as to a definite price will be deemed non-responsive and ineligible for award. Value-Engineering proposals submitted with offers will not be considered.
NOTE 4: The contract resulting from this solicitation shall be performed in strict accordance with the plans and specifications included with the RFP. The proposal submitted by the successful offer shall be incorporated into, and become a part of, the resulting contract. In the event of a conflict between the plans and specifications and any part of the incorporated proposal, the terms of the plans and specifications shall govern.
NOTE 5: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.
NOTE 6: OPTION WORK ITEMS. The Government may require the delivery of the numbered line item(s), identified in the schedule as OPTION WORK Items, in the quantities and prices stated in the schedule. The Contracting Officer may exercise the OPTION WORK Items by written notice to the Contractor. The Government will exercise the Optional Work no sooner than 365 and no later than 600 calendar days after award of this contract. Bidders shall bid on all items including optional items (see “Evaluation of Options” FAR 52.217-5). Failure to bid on all items will result in a non-responsive bid.
00010-8 Ed 13-002
NOTE 7: EVALUATION OF OPTIONS (FAR 52.217-5 JUL 1990). The Government will evaluate offers for award purposes by adding the total price for all options to the total price for this basic requirement. Evaluation of options will not obligate the Government to exercise the option(s).
NOTE 8: TIME ADJUSTMENT IN THE EVENT OF THE EXERCISE OF OPTIONAL
WORK. In the event that OPTIONAL WORK items (Items 0076 thru 0102) are exercised under the terms of the contract, the time required for completion of the contract will not be adjusted but shall be performed concurrent with original contract duration of 1,450 calendar days established for the BASE WORK items specified in the Contract Clause entitled “COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (FAR
52-211-10 – APR 1984)”.

SECTION 00130 – PROPOSAL EVALUATION CRITERIA
GENERAL
1.1 SCOPE
In accordance with FAR 15.304, the following factors will be considered in evaluating the non-cost aspects of the proposals. Narrative color descriptors have been selected to highlight the strengths and weaknesses of each offerors proposal for each evaluation factor, paragraph 1.3 (items (1.) through (4.) below). In evaluating a contractor's proposal, evaluators must document the proposal's strengths and weaknesses. Using succinct, clearly stated narratives, evaluators will indicate the impact to the Government of the strengths and/or weaknesses, providing supporting facts and rationale. If the proposal exceeds the Government's expectations in relation to the evaluation criteria/standards, it forms the basis for "strength." If the proposal is below the Government's expectations in relation to the evaluation criteria/standards, it forms the basis for "weakness." A final narrative summary shall be employed when evaluating proposals in accordance with Section 00130 of the Request for Proposals.
This is a Request for Proposal (RFP). Proposals will be evaluated by a Source Selection Evaluation Board (SSEB) comprised of representatives of the Corps of Engineers. Award will be made to that offeror, determined by the Government, who can accomplish the requirements set forth in the RFP in a manner most advantageous to the Government considering both cost and non-cost factors. The Government reserves the right to award this Contract to other than the lowest price offeror after consideration of all factors.
The Government intends to evaluate proposals and award a contract without discussions.
Therefore, Offerors shall submit their best terms from a cost or price and technical standpoint as Offerors may not be afforded an opportunity to revise their proposals.
1.2 BASIS FOR AWARD
The Government will select the offer that represents the best value to the Government by using the trade-off process described in FAR Part 15. This process permits tradeoffs between price and technical merit/quality and allows the Government to accept other than the lowest priced offer or other than the highest technically rated offer. The award decision will be based on a comparative assessment of proposals against all source selection criteria in the solicitation.
00130-2
1.3 EVALUATION FACTORS
1. Evaluation Factors:
TECHNICAL NON-COST FACTORS:
1. Past Performance
2. Technical Approach
3. Key Personnel and Project Management Plan
4. Small Business Participation Plan
COST FACTOR:
5. Price
1.4 RELATIVE IMPORTANCE OF PRICE TO THE TECHNICAL EVALUATION
FACTORS
The Government is concerned with striking the most advantageous balance between Technical Merit (i.e., quality and timeliness) and cost to the Government (i.e., price). Where competing technical proposals are determined to be substantially equal, price could become the controlling factor.
EVALUATION CRITERIA
The Government will evaluate each of the four (4) non-cost factors and rate the proposals. Non-cost factors are not all equal in importance. The following terminology is used to describe the relative importance of each non-cost factor:
Factors 1 and 2 are comparatively equal in importance. For Factor 1, Past Performance Relevancy is less important than Past Performance Confidence. Factor 3 is significantly less important when compared to Factors 1 and 2. Factor 4 is significantly less important than Factor 3. Factor 5 is significantly less important than Factors 1, 2, 3, and 4 when combined.
Factor 5, which is Price, may become more significant in contributing to the source selection decision if competing proposals offer comparatively equal Past Performance and Technical Approaches and due consideration is given to Key Personnel and Project Management Plan and Small Business Participation Plan (SBPP).
1.5 DEFINITIONS:
00130-3
1. A significant strength is an aspect of the proposal that appreciably increases the likelihood of successful contract performance.
2. Performance Confidence Assessment is an evaluation of the likelihood (or
Government’s confidence) that the Offeror will successfully perform the solicitation’s requirements; the evaluation is based upon past performance information.
3. Relevancy, as it pertains to past performance information, is a measure of the extent of similarity between the service/support effort, complexity, dollar value, contract type, and subcontract/teaming or other comparable attributes of past performance examples and the source solicitation requirements; and a measure of the likelihood that the past performance is an indicator of future performance.
4. Risk, as it pertains to source selection, is the potential for unsuccessful contract performance. The consideration of risk assesses the degree to which an Offeror’s proposed approach to achieving the technical factor or subfactor may involve risk of disruption of schedule, increased cost or degradation of performance, the need for increased Government oversight, and the likelihood of unsuccessful contract performance.
5. A strength is an aspect of the offeror’s proposal that has merit or exceeds specified performance or capability requirements in a way that will be advantageous to the Government during contract performance.
6. A weakness is a flaw in the proposal that increases the risk of unsuccessful contract performance.
7. A significant weakness in the proposal is a flaw in the proposal that appreciably increases the risk of unsuccessful contract performance.
8. A deficiency is a material failure of a proposal to meet a Government requirement or a combination of significant weaknesses in the proposal that increases the risk of unsuccessful contract performance to an unacceptable level.
9. Clarification is limited exchanges between the Government and Offerors that may occur when award without discussions is contemplated.
10. Discussions are negotiations conducted in a competitive acquisition. Discussions take place after establishment of the competitive range.
11. Competitive Range See FAR 15.306(c).
12. Recency, as it pertains to past performance information, is a measure of the time that has elapsed since the past performance reference occurred. Recency is generally
00130-4 expressed as a time period during which past performance references are considered relevant.
1.6 SUBMITTAL REQUIREMENTS
VOLUME I:
1. Past Performance
2. Technical Approach
3. Key Personnel and Project Management Plan
VOLUME II:
4. Small Business Participation Plan
5. Price
1.7 NON-COST EVALUATION FACTORS & SUBMITTAL REQUIREMENTS
FACTOR 1. PAST PERFORMANCE - RATED AS FOLLOWS:
Subfactor 1: Past Performance Relevancy. An Offeror’s past performance will be evaluated to determine how relevant a recent effort accomplished by the Offeror is to the effort to be acquired through the source selection. Common aspects of relevancy include similarity of service/support, complexity, dollar value, contract type, and degree of subcontracting/teaming.
OFFEROR’S PAST PERFORMANCE RELEVANCY SHALL BE RATED AS
FOLLOWS:
Table 1a. Past Performance Relevancy Ratings Rating Definition Very Relevant Present/past performance effort involved essentially the same scope and magnitude of effort and complexities this solicitation requires.
Relevant Present/past performance effort involved similar scope and magnitude of effort and complexities this solicitation requires.
Somewhat Relevant
Present/past performance effort involved some of the scope and magnitude of effort and complexities this solicitation requires.
Not Relevant Present/past performance effort involved little or none of the scope and magnitude of effort and complexities this solicitation requires.
Subfactor 2: Past Performance Confidence. An Offeror’s past performance will also be evaluated to determine how well the Offeror performed on past contracts.
OFFEROR’S PERFORMANCE CONFIDENCE ASSESSMENT SHALL BE RATED AS
FOLLOWS:
00130-5
Table 1b. Performance Confidence Assessments Rating Description Substantial Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a high expectation that the Offeror will successfully perform the required effort.
Satisfactory Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a reasonable expectation that the Offeror will successfully perform the required effort.
Limited Confidence
Based on the Offeror’s recent/relevant performance record, the Government has a low expectation that the Offeror will successfully perform the required effort.
No Confidence
Based on the Offeror’s recent/relevant performance record, the Government has no expectation that the Offeror will be able to successfully perform the required effort.
Unknown Confidence (Neutral)
No recent/relevant performance record is available or the Offeror’s performance record is so sparse that no meaningful confidence assessment rating can be reasonably assigned.
Offerors will be evaluated on the quality of similar work performed within the last TEN (10) YEARS using the evidence provided by the Offeror and other sources. Offerors shall submit no more than FOUR (4) past projects for this factor. Offerors are cautioned to take extreme care in selecting projects for review that are both relevant and accurately reflect the Offeror’s past performance capabilities. Please note that if the Offeror chooses to provide more than FOUR (4) projects, the Government will evaluate only the first FOUR (4) projects submitted under this evaluation factor. Any additional projects submitted beyond the FOUR (4) requested will NOT be evaluated. Offerors submitting more than FOUR (4) projects risk the Government selecting the first FOUR (4) projects which may or may not be the Offeror’s most relevant past performance projects in response to this evaluation factor. The success of work performed on similar requirements as a prime or significant subcontractor will be evaluated.
Offerors shall include relevant past performance history that demonstrates experience in providing:
1. Construction of large concrete drainage structures;
2. installation and relocation of water and sewer mains;
3. site unwatering, groundwater monitoring, and stormwater management;
4. installation and handling of foundation jet grout;
5. working with conventionally reinforced concrete;
6. sheet pile driving and temporary retaining structure construction;
7. rail work and overhead and foundation wire contact system relocations;
8. performing work in highly urban areas adjacent to residential and commercial structures;
9. a history that demonstrates familiarity with the local area and the unique conditions of the soils in the Southeastern Louisiana region, and
10. the ability to develop safe and effective traffic control methodologies.
The emphasis should be on the capability and performance of construction, and should include project delivery within schedule, ability to adapt to changing requirements and conditions, and
00130-6 by providing specific examples of challenges faced and solutions proposed and executed. The Offeror shall include the percentage of the final contract amount that was self performed work along with a description of that self performed work.
The information evaluated may include parent or affiliated companies. If past performance information provided is from a parent or affiliated company, the proposal must contain a letter from the parent or affiliated company identifying which of their resources will be available to the Offeror for the proposed work. The letter must also identify what role the parent or affiliated company will have in performance of the proposed work.
Relevant past performance of a parent or affiliate will be evaluated on the same basis as relevant past performance of an individual Offeror, provided that sufficient information is supplied to establish the parent or affiliate's role in the contract work as well as the resources available for such work.
An Offeror relying on the past performance record of a parent or affiliate will not be penalized for that fact. However, such Offeror’s proposal must demonstrate there is a reasonable basis for such reliance; otherwise there will be no basis for crediting the Offeror with the past performance of the parent or affiliate.
The Past Performance Questionnaire (PPQ) included within Section 00130, (Attachment 1) is provided for the Offeror or its team members to submit to the client for each project the Offeror includes in its proposal for Factor 1, Past Performance. Ensure correct phone numbers and email addresses are provided for the client’s point of contact. Completed PPQs should be submitted with your proposal. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the Offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). It is the Offerors’ responsibility to follow-up with clients/references to ensure timely submittal of questionnaires prior to the proposal closing date.
