SUMMARY OF CHANGES
SECTION 00010 - SOLICITATION CONTRACT FORM
The required response date/time 24-Aug-2010 02:00 PM has been added.
SECTION 00800 - SPECIAL CONTRACT REQUIREMENTS
The following have been modified:
QUESTIONS AND ANSWERS
The following is an additional General Question regarding Hubzone MATOC Solicitation # W912P8-10-R-0050 (Question # 20):
20. Section 00130, page 3, item 3 - Price Proposal Instructions of the solicitation states that Joint Ventures shall be approved by the Small Business Administration (SBA.) We are aware that the applicable FARs are 19.1303, CFR 126.601 and CFR 126.616 but are not aware of any approvals that can be obtained from the SBA. We called the SBA and their representative said that they do not provide approvals for Hubzone Joint Ventures. Please clarify that an explicit SBA approval will not be required with our proposal as long as the Joint Venture complies with applicable federal regulations.
Yes, that is correct. For further clarification, Joint Ventures must meet the requirements of FAR
19.1303 (c), which states “A joint venture may be considered a Hubzone small business if the business entity meets all the criteria in 13 CFR 126.616.” Refer to Code of Federal Regulations (CFR) 126.616 for Hubzone Joint Venture requirements.
The following are additional Technical Questions regarding Task Order No. 0001 Plans and Specifications- Project LGM-020B – Phase I Repairs to Golden Meadow Pumping Station, Lafourche Parish, LA (Questions # 38 – 48 and revision to Question 22):
Revision to response for Question 22 answered via Amendment No. 0001, dated August 13, 2010:
22. Although there isn’t a pay item for layout and stak ing, is the contractor responsible or will the government handle this?
Original Answer – An amendment is forthcoming that will address this issue. The Contractor is responsible for layout and staking of the work. A note will be added to Drawing G-03.
Revised/Corrected Answer:
Yes, the Contractor is responsible for layout and staking of the work. A note will NOT be added to Drawing G-03 as it is unnecessary. Reference contract clause no. 52.236-17 Layout of Work (Apr 1984) which is included in Section 00700 of the solicitation and provided here for clarification:
“52.236-17 LAYOUT OF WORK (APR 1984)
The Contractor shall lay out its work from Government established base lines and bench marks indicated on the drawings, and shall be responsible for all measurements in connection with the layout. The Contractor shall furnish, at its own expense, all stakes, templates, platforms, equipment, tools, materials, and labor required to lay out any part of the work. The Contractor shall be responsible for executing the work to the lines and grades that may be established or indicated by the Contracting Officer. The Contractor shall also be responsible for maintaining and preserving all stakes and other marks established by the Contracting Officer until authorized to remove them. If such marks are destroyed by the Contractor or through its negligence before their removal is authorized, the Contracting Officer may replace them and deduct the expense of the replacement from any amounts due or to become due to the Contractor.
(End of clause)”
NEW QUESTIONS.
38. SECTION 26 24 16.00 40, Page 5, paragraph 2.3 states "Test complete panelboards in accordance with UL 67". If all installed components pass their respective UL or NEMA test, will this be a necessary test?
Answer – If the assembled panelboards are listed by UL as an assembly and are provided with visible UL listing labels that are permanently attached to the panelboards, then no further testing would be required in this instance only.
39. Bid form indicates 200 LF of Timber Pile (bid item 0036). Drawing S-05 Detail A indicates 8 timber piles with a min of 40’ in length. Please clarify.
Answer – This amendment shall correct the estimated quantity for bid schedule line item # 0036 to 320 LF.
40. Can the discharge pipe 48” and 30” pipe be spiral weld? The existing was spiral but on other USACE projects straight weld was required. The piping spec did not specify.
Answer – Yes, a spiral welded pipe is acceptable.
41. Will the new discharge pipe(s) need the tar epoxy coating applied to the inside and outside?
The painting specs do not specify coatings on the piping.
Answer – Please refer to the painting specifications @ Section 09 90 00.
42. Bid item 0042 indicates an inspection trench. Where and what is this required? I did not find it on the drawings.
Answer –Section 01100, paragraph 9. Utilities and Improvements, subparagraph b., has been revised in this amendmentfor clarification.
It should be noted that payment and description of inspection trench is in section 31 23 17.00 10 “Structural Excavation and Backfill”.
43. If we deem the work platform not to be required, will our bid be considered non-responsive if it is left blank? How should we address this?
Answer – See answer to question #48 below. Yes, offerors that leave these items blank will be considered non-responsive. Please refer to the revisions to Note 1 in Section 00010 – Bid Schedule and response to question # 48.
44. Are the sheet piles for the precast concrete bridge to be paid for under pay item 0027 (Sheet Piling). Please verify.
Answer – Yes, refer to revisions to Section 32 34 00.00 12 in this amendment. Additionally, refer to changes in quantity of bid schedule Item 0027 “Steel Sheet Piling, Type PZC-18” to a revised quantity of 60,415 SF.
45 Section 32 34 00.01 12 page 2 Paragraph 1.2.1 says that the guard rails are not measured for payment, but the bid sheet has an item for Guard Rails (0044).
Answer – Bid schedule Item 0044 Guard Rails is not covered under specification section 32 34
00.01 12. Bid schedule Item 0044 is for the “W” Beam Guardrails as shown on drawing pages S-15 and S-16 and covered by specification section 34 71 13.27 12 Guard Rail.
For clarification, revisions are included in this amendment to remove any references to the contract guardrail and revise the scope, measurement and payment paragraphs in Section 32 34
00.01 12 “Precast Concrete Bridge,” will be revised to include the thrie-beam transition barriers and intermediate barriers.
46. Section 01 53 00.01 12 page 2 paragraph 1.2 reads that payment will be made in the contract prices for the work in which it is incidental, but the bid sheets have a pay item for Temp. Flood Protection (0007).
Section 00010 – Bid Schedule has been revised to Delete Item 0007 Temporary Flood Protection as no measurement and payment will be made for this item. As stated in specification Section 01 53 00.01 12 – Temporary Flood Protection, “No measure or payment will be made for work included in this section. All costs in connection therewith shall be included in the contract prices for the items of work to which the work is incidental.”
47. The two Amendments answered some of our questions, however if you could give us some guidance on the cast-in-place concrete work for the concrete pavement shown on drawing C-05 and the concrete slabs under the discharge pipes shown on drawing C-11.
Which bid item should the bidders include this work under?
Should it be included with the Concrete Scour Protection Bid Item 47, 47AA, 47AB?
Answer - Slope pavement C-05 and the concrete slabs under the discharge pipes shown on drawing C-11 are included in Concrete Scour Protection Bid Item 47, 47AA, 47AB.
48. We are requesting clarification to the answer provided to Question #3 on Page of 8 of Amendment 0001, dated August 13, 2010. The subject question and answer are:
3. PT 1 - Will the contractor be required to build and/or maintain a road way from the two separate entrances to the project right of way? If so, how will this be paid for?
Answer from Amendment No. 0001 – No, the USACE has provided multiple means for temporary accessing the site. It is the Contractor’s option on how to access the site.
They can access along the protected side levee berms from the north and/or south, they can access the site using barges/floats, work platforms, they can use the new Whaskey type bridge or any combination as shown in the plans and specifications.
How should we price Bid Items 0021 – Separator Geotextile (Alt. Access Roads) and 0038 – Alternate Access Roads if we elect to not build the access roads as called for in the plans? Are these option bid items that can be left blank?
Answer: The Government (USACE) has provided several alternatives for temporary access to the project site. For bidding purposes, items 0003, 0021, and 0038 have been included in the bid schedule for offerors to choose which items apply or correspond with their proposed means and methods for temporary access to the project site. Offerors shall provide pricing for the applicable line items (one, two, or all three, as necessary) to correspond with the offerors’ technical approach for accessing the project site. For bid schedule items determined unnecessary based on the offeror’s selected means for temporary access to the project site, offerors shall include a $0.00 in the estimated amount column of the bid schedule for that particular line item. For further clarification, reference Note 1 of Section 00010 – Bid Schedule, which has been revised via this amendment. Please note that offerors shall NOT leave any item blank, but shall include $0.00 for any of the three (3) items that the offeror determines unecessary (0003, 0021, or 0037).

*Denotes a change from the previous bid sheet.
Award will be made as a whole to one bidder.
*NOTE 1: Bidders shall furnish unit prices for each item listed in the Schedule requiring a unit price. If the bidder fails to insert a unit price in the appropriate blank (excluding items 003, 0021, and 0038) for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE (EXLUDING ITEMS 003, 0021, AND 0038) AND
THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL BE DECLARED
NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD. For items 003, 0021, and 0038 the Contractor shall only include an estimated amount dictated by his means and methods. If the item is not chosen as part of the Contractor’s means and methods shall include a $0.0 in the Estimated Amount.
00010-6 Ed 10-056
NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See
FAR 14.404-2).
NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

52.211-5001 - MAR 95).
The Variations in Estimated Quantities Subdivided Items clause is applicable only in Item Nos. 0021, 0033, 0034, 0038, and 0047.
a. Variations from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.
b. Where the actual quantity of work performed for Item Nos. 0021, 0033, 0034, 0038, and 0047 is less than 85% of the quantity of the first sub-item listed under such items, the Contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment in contract price shall be made in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity .
c. If the quantity of work performed under Item Nos. 0021, 0033, 0034, 0038, and 0047 exceeds 115% or is less than 85% of the total estimated quantity of the sub-items under that item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. NONE exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.
