SECTION 00800 - SPECIAL CONTRACT REQUIREMENTS

The following have been modified:

QUESTIONS AND ANSWERS

The following are additional Technical Questions regarding Task Order No. 0001 Plans and Specifications- Project LGM-020B – Phase I Repairs to Golden Meadow Pumping Station, Lafourche Parish, LA (Questions # 35 – 37 ):

35. Timber pile casings:

Reference drawings S-05, S-06 and specification section 31 62 20.20 12. Subsection 1.4 (submittals) for the timber piles call for the shop drawings to include pile placement and casings.

There are no other mention of casings for timber piles in the drawings or other areas of the specifications. Are casings required for the timber piles? If so, please provide size, depth, etc.

Answer – There are no casings, this amendment removes casings from the submittal requirements.

36. H-Pile Testing:

Reference drawing S-01, S-19, S-20 and specification sections 31 62 16.00 12 (subsections 1.2.1.1, 2.1, and 3.1) and 31 62 18.00 12. The two defined lengths of HP14x89 piles are shown as 115" and 132". There is no indication of how long the HP14x89 test piles are to be. Please define required test pile lengths.

Answer – This amendment provides additional information on sheet S-19 and S-20.

37. 14" Precast/Prestressed Pile lengths:

Reference specification section 31 62 13.20 12. Subsection 3.2.1 states that "The Contracting Officer will determine the actual lengths of piles required to be driven below cutoff elevation for the various locations in the work and will furnish the Contractor a quantities list indicating lengths and locations of all piles to be placed." There are no specifications found for testing of the concrete piles.

37.a. Please advise on who will perform the testing for the concrete piles. If we are to perform, please provide the required specifications.

Answer – There are no pile load tests required for concrete piles, see revisions to this section in amendment attached.

W912P8-10-R-0050

If the bidder fails to insert a unit price in the appropriate blank for required item(s), but does furnish an extended total, or an estimated amount for such item(s), the Government shall deem the unit price to be the quotient obtained by dividing the extended amount for that line item by the quantity. IF A BIDDER OMITS BOTH THE UNIT PRICE AND THE EXTENDED TOTAL OR ESTIMATED AMOUNT FOR ANY ITEM, ITS BID SHALL

BE DECLARED NON-RESPONSIVE AND THEREFORE INELIGIBLE FOR AWARD.

NOTE 2: Any bid may be rejected if the Contracting Officer determines in writing that it is unreasonable as to price. Unreasonableness of price includes not only total price of bid, but the price for individual line items as well. Any bid may be rejected if the prices for any line items or sub line items are materially unbalanced (See

FAR 14.404-2).

NOTE 3: THE NOTICE TO PROCEED (NTP): The successful bidder is advised that performance and payment bonds shall be submitted in accordance with the time frame in block 12B of SF 1442. The NTP will be issued immediately after verification of acceptable performance and payment bonds. Within seven (7) days after issuance of the NTP, the Contractor shall initiate a meeting to discuss the submittal process with the Area or Resident Engineer or his authorized representative. Physical work cannot start until the Accident Prevention Program, Contractor Quality Control Plan, and other submittals which may be required, have been submitted and approved and all preliminary meetings called for under the contract, have been conducted.

EVALUATION OF SUBDIVIDED ITEMS. (EFARS 52.211-5000 - MAR 95).

Item Nos. 0021, 0033, 0034, 0038, and 0047 is subdivided into two or more estimated quantities and are to be separately priced. The Government will evaluate each of these items on the basis of total price of its sub-items.

(End of Clause)

VARIATIONS IN ESTIMATED QUANTITIES - SUBDIVIDED ITEMS. (EFARS

52.211-5001 - MAR 95).

The Variations in Estimated Quantities Subdivided Items clause is applicable only in Item Nos. 0021, 0033, 0034, 0038, and 0047.

a. Variations from the estimated quantity in the actual work performed under any second or subsequent sub-item or elimination of all work under such a second or subsequent sub-item will not be the basis for an adjustment in contract unit price.

b. Where the actual quantity of work performed for Item Nos. 0021, 0033, 0034, 0038, and 0047 is less than 85% of the quantity of the first sub-item listed under such items, the Contractor will be paid at the contract unit price for that sub-item for the actual quantity of work performed and, in addition, an equitable adjustment in contract price shall be made in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity .

c. If the quantity of work performed under Item Nos. 0021, 0033, 0034, 0038, and 0047 exceeds 115% or is less than 85% of the total estimated quantity of the sub-items under that item, and/or if the quantity of work performed under the second sub-item or any subsequent sub-item under Item No. NONE exceeds 115% or is less than 85% of the estimated quantity of any such sub-item, and if such variation causes an increase or a decrease in the time required for performance of this contract, the contract completion time will be adjusted in accordance with the clause FAR 52.211-18, Variation in Estimated Quantity.

TEMPORARY FLOOD PROTECTION

PART 1 GENERAL

1.1 SCOPE

The work covered by this section consists of furnishing all plant, labor, materials, equipment, and performing all operations necessary for designing, installing, and removing temporary flood protection for reaches where the existing flood protection system will be breached by demolition of existing floodwalls. Temporary flood protection is not considered hurricane protection, but is intended to prevent flooding during normal high water events (high tides, heavy rains and etc.). The emergency gap closure plan is intended for hurricane protection. See Section 01100 GENERAL PROVISIONS, paragraph EMERGENCY GAP CLOSURE PLAN.

1.2 MEASUREMENT AND PAYMENT

No measurement or payment will be made for work included in this section.

All costs in connection therewith shall be included in the contract prices for the items of work to which the work is incidental.

1.3 REFERENCES

The publications listed below form a part of this specification to the extent referenced. The publications are referred to within the text by the basic designation only.

1.4 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submit the following in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Temporary Flood Protection Plan; G, RO

The Contractor shall submit for approval the proposed plan to accomplish the specified temporary flood protection. The submittal shall include, but not necessarily be limited to the following:

(1) Design and layout of temporary flood protection works.

(2) Methods and duration of maintenance of temporary flood

SECTION 01 53 00.01 12 Page 2 protection.

(3) Methods, sequence, and equipment and materials to be used for drainage of excavations for floodwall demolition and floodwall replacement.

(4) Method and sequence of removal, including disposal of materials.

1.5 QUALITY CONTROL

1.5.1 General

The Contractor shall establish and maintain quality control for temporary flood protection plan operations to assure compliance with contract requirements and maintain records for his quality control for all construction operations including but not limited to the following:

(1) Equipment. Type, size, and suitability for construction of the prescribed work.

(2) Construction. Location and identification of items installed, percentage of work accomplished, status of drainage provisions.

1.5.2 Reporting

The original and two copies of these records of inspections and tests, as well as the records of corrective action taken, shall be furnished to the Government daily. Format of the report shall be as prescribed in Section 01 45 04.00 12 CONTRACTOR QUALITY CONTROL.

1.6 DESIGN

1.6.1 Criteria

The temporary flood control structures shall be designed for a minimum top elevation of +4.0 NAVD 88 (200.65) in accordance with New Orleans District HSDRRSDG available at http://www.mvn.usace.army.mil/eng/hurrdesign.asp.

Subsurface design parameters are provided in a table attached at the end of this section. At his option the Contractor may design the temporary flood control structures to a higher elevation to provide superiority over the adjacent existing flood protection structures. The temporary flood protection structures shall be constructed of materials and in such manner that they will not be subject to detrimental erosion that could lead to their failure. Construction of the temporary flood control structures shall in no way affect the stability of the existing flood protection.

Design of the temporary flood control structures is the sole responsibility of the Contractor, and shall be performed and sealed by a registered professional engineer licensed to practice in the State of Louisiana.

The Contractor shall submit to the Contracting Officer for his approval copies of the professional engineers design along with drawings showing the layout of the proposed temporary flood control structures with all pertinent dimensions and material types and sizes to be used in construction of the structures. The copies submitted shall be in bound form.

SECTION 01 53 00.01 12 Page 3

PART 2 PRODUCTS

Not used.

PART 3 EXECUTION

3.1 GENERAL

The Contractor shall not perform any work on temporary flood protection prior to receipt of written approval by the Contracting Officer of the Contractors plan of temporary flood protection. Demolition of existing floodwalls shall not begin until necessary approved temporary flood protection is in place. The Contractor shall indemnify and hold the Government harmless against any loss or damage sustained by the Contractor arising out of or attributable to failure of temporary flood protection structures of his own design.

3.2 REQUIREMENTS

(1) Temporary flood protection will be required whenever a reach of the existing floodwall is removed until the replacement floodwall is sufficiently completed to withstand flood waters. Sufficiently completed is defined as the time when the concrete in the replacement floodwall reaches a compressive strength of 4000 psi and all earthwork incidental to the floodwall replacement has been completed.

(2) The Contractor's construction of the temporary protection or cofferdam shall in no way affect the stability of the existing flood protection or flood protection constructed under this contract.

(3) The Contractor shall maintain as necessary all temporary flood control, including maintaining and operating drainage facilities, during the time they are required.

(4) The Contractor shall remove all temporary flood control structures, and incidental features thereto when no longer required. All materials used in providing temporary flood control structures, and any debris generated during their removal becomes the property of the Contractor and shall be removed from the job site prior to completion.

(5) Where voids are induced by removal operations, the Contractor shall pump out all seepage and rainwater and backfill to within 3 feet of the ground surface with a tremie-placed slurry. The slurry shall consist of one part cement, two parts bentonite and six parts sand mixed with enough water to produce a slurry viscous enough to thoroughly fill the voids but have no less than 12 pounds of solids per gallon. The upper 3 feet shall be filled with suitable backfill. Suitable backfill and compaction requirements shall be as defined in Section 31 23 16.16 12 STRUCTURAL

EXCAVATION AND BACKFILL.
