Oakland Harbor O&M Dredging Project FY08

Transportation for Hamilton Off Loading

Section 35 20 25

SECTION 35 20 25

TRANSPORTATION AND HAMILTON OFF LOADING

PART 1 GENERAL

1.1 INTRODUCTION

This section describes the procedures and methodology associated with the transportation and off loading of dredged material at the Hamilton Wetland Restoration Project through the use of a Government-provided offloader that is operated by the Mason-Dutra Joint Venture (MDJV), hereafter call the Hamilton Operator. Dredged material shall be off loaded, pumped through approximately 35,000 to 40,000 lineal feet of pipeline and placed in upland cells to facilitate wetland restoration. At this time the Government is unable to predict whether the offloader will be continuously operable during the performance of this contract. In the event the offloader becomes unavailable during the pendency of this work the Government may negotiate for the delivery of the O&M material to be dredged under this contract to an alternative site. Subject to a reasonably negotiated price, the Government reserves the right to modify this contract to designate an alternative disposal location in accordance with the Changes clause, FAR 52.243-4.

1.2 PAYMENTS PROCEDURES

No separate or direct payment will be made for the work covered under this section, and all costs in connection therewith will be considered a subsidiary obligation of the Contractor.

PART 2 PRODUCTS (Not Used)

PART 3 EXECUTION

3.1 GENERAL

All plant and equipment to be used in performing the work shall be of sufficient size and efficiency to meet the job requirement. The Government and other authorized personnel shall be allowed access to all equipment and materials pertaining to this contract for the purposes of monitoring and inspection.

3.2 Hamilton Wetlands Disposal Site: Dredged material shall be transported and delivered by barge or dump scow to Hamilton for offloading and disposal as indicated on the drawings and as described herein. Offloading and disposal of the dredged material will be the responsibility of the Hamilton Operator. The dredging contractor (Contractor) shall coordinate and communicate with the Hamilton Operator prior to and during the offloading of the dredge material.

3.2.1 In order to minimize adverse impacts to the production schedule, the Contractor and the Hamilton Operator shall agree on the designation of “production days” taking into account the concurrent (O&M and deepening) offloading requirements. The Contractor, in conjunction with the Hamilton Operator, shall submit to the Contracting Officer a description of an offloader production day. This definition of production day must be acceptable to the Contracting Officer taking into account available equipment, contractor schedules under this contract, maintenance requirements, and environmental restrictions. The “production day” agreement shall be incorporated into the preliminary schedule and shall be utilized to prepare all project schedules as described in Section 01 32 01 in these specifications. The current offloading schedule for Hamilton shows that the Oakland O&M offloading shall be completed by 31 October 2008 in order to avoid conflicts with other scheduled O&M offloading requirements.

3.2.2 The Contractor shall deliver at least 4000-CY of dredged material to Hamilton every production day. The Government will deduct from the Contractor’s earnings $5000 for each production day without a 4000-CY delivery of dredged materials.

3.2.2.1 Deduction Waiver. If the quantity of material delivered for the 4-week period preceding a non-delivery day is at least 5,000CY per production day, the Government will not assess a deduction.

3.2.2.2 Downtime is an operational interruption of a production day longer than 24 consecutive hours. The Contractor is allowed three 24-hour downtime-days per month. Unused downtime-days do not carry forward to the next month.

3.2.2.3 The Contractor is allowed an additional three 24-hour downtime-days for the duration of the contract. These contract-duration downtime-days shall be used after the monthly allocation

Transportation for Hamilton Off Loading

Section 35 20 25 has been expended, can be used anytime during the contract and can be used singly or together or with the monthly allocation of downtime-days.

3.2.2.4 The Contractor shall report downtime-days on the daily CQC Report. The Contractor is not required to make a 4000-CY scow delivery on downtime-days. There will be no compensation for unused downtime-days.

3.3. The Hamilton Operator, working 24 hours per day – 6 days per week, if necessary, will offload every scow delivering acceptable material to the site, but the Government cannot require the Hamilton Operator to offload more than 6,000 CY per production day. The Contractor shall deliver between 4,000 CY and 6,000 CY of dredged material to Hamilton every production day.

The dredging contractor will not be reimbursed for standby time if the dredging contractor attempts to deliver more than 6,000 CY in a production day and the Hamilton Operator cannot accept the excess delivery. The Contractor shall not deliver dredged material to Hamilton on non-production days.

3.3.1 In General the dredging contractor shall be responsible for:

a. Securing and controlling the scows at the off loader until the Hamilton Operator takes control to position the scows for off-loading.

b. securing the empty scow after offloading was completed.

c. ensuring that scows delivered are debris free and any debris grids on the scows are removed and will not interfere with the offloading process. The dredging contractor shall position the scow (or barge) within reach of the suction boom equipment and shall provide tugboats to maneuver the scow during the tie down process at the Hamilton offloader. The towing vessel, which transports the scow to the Hamilton disposal site shall maneuver the scow to the off-loader and assist Hamilton personnel securing the scow to the off-loader. The towing vessel shall then move to the designated waiting area and shall wait until the off-loader empties the scow. After completion of the dredge material offloading, the towing vessel shall maneuver itself and provide assistance releasing the scow from the Hamilton off-loader and shall return the scow to the project site. The Hamilton Operator may reject scows that contain debris that may damage the offloader. If scows are rejected the Contractor shall notify the Government within 24 hours of the rejection. The notice shall contain date, time and the reason that lead to the rejection.

3.3.2 The Contractor is responsible for all damage done to the wharf structure or to the Hamilton offloader (Liberty), caused by movement of scows or other vessels under the Contractor’s control. The Contractor is also responsible for all damage caused to the off-loader, sediment pumps and pipeline caused by debris with a dimension greater than 10-inches.

3.3.3 The Contractor shall coordinate directly with the 3E contractor for the specific dates and times of delivery. The Contractor will provide weekly schedules and estimated quantities to the 3E contractor for proposed delivery at a minimum of 3 calendar days in advance of the following workweek. The 3E contractor may delay offloading, the Contractor scows, as long as the 3E contractor is able to maintain the offloading of 4000-6000 CY of material a day. The Contractor shall record in the daily CQC Report the barge or scow's time of arrival, off-loading period, departure time, size, measurement of the fill line and estimated volume.

3.3.3.1 The Hamilton Operator is allowed three 24-hour downtime-days per month, which do not carry forward to the next month.

Section 35 20 25

3.3.3.2 When the Hamilton Operator declares a downtime-day, the Contractor is not required to and shall not deliver dredged material to Hamilton. As long as the Hamilton Operator has downtime-days for the time that dredged material cannot be accepted at Hamilton, the Contractor will not be entitled to standby costs.

3.3.4 Standby Cost: For non-downtime production-days, if the Hamilton offloader is unable to offload the Contractor’s schedule 6000 CY of material and this delay impacts the Contractor, the Contracting Officer will request a price proposal from the Contractor for standby cost.

3.4 Overflows: No overflow or decant water shall be discharged from a scow, with the exception of spillage incidental to mechanical dredge operations. During transportation from the dredging site to the off load site, no material shall be permitted to overflow, leak or spill from pipelines, barge, bins or scows.

3.5 Scows and Hopper Barges: All scows and hopper barges used to transport material to the off load site shall have capacity greater than 3,000 cubic yards. All hopper and scow barges shall be debris free and open (without a grid) when arriving at offloader. Pocket bins are prohibited. Hopper or scow combings must be able to fit under the offloader when the hopper barge or scow is empty.

3.6 Transport Tugs: All tugs used to transport material to the off load site shall have greater than 2400 horsepower. All transit tugs shall be twin screw vessels. The transport tug shall be responsible for docking and departing all hopper barges and scows delivered to the offloader.

Transport tugs shall assist the Hamilton Operator tending tug during off loading operations.

3.7 Hamilton Offloader Coordination Requirements: The Contractor shall coordinate directly with the Hamilton Operator for the specific dates and times of delivery. The Contractor will provide the Hamilton Operator with weekly schedules and estimated quantities for proposed dredging at a minimum of 3 calendar days in advance of the following workweek.

3.7.1 The Contractor may coordinate or schedule with the Hamilton Operator an increase in the delivery amount. However, this arrangement shall be for the Contractor's convenience and any impacts, delays or added costs shall be its sole responsibility.
