Question

Response

1a) When do you anticipate the award of the work?
Approximately 2 weeks after bid opening.
When do you anticipate issuing the Notice to Proceed?
The contract must be awarded and the contractor must submit his bonds for approval. The NTP may be issued at any time after approval of the bonds. NTP is usually issued within two weeks of bond approval.

All of the estimated quantities have an asterisk preceding the amount. The asterisk refers to the following statement:

“QUANTITY IS AN ESTIMATED AMOUNT, SEE SECTION 00700, FAR 52.211-18, EFARS 52.211-5000, AND 52.211-5001, FOR VARIATION IN ESTIMATED QUANTITIES CONTRACT CLAUSE.”

Clause FAR 52.211-18 indicates that a price adjustment can be made if the actual quantity of either Bid Item 0002AA or 0002AB varies by more than 15 percent above or below the estimated quantity. However, Clauses EFARS 52.211-5000 & 52.211-5001 state that a price adjustment can be made only if the actual quantity of Item 0002AA varies by more than 15 percent above or below the estimated quantity. Which clauses govern? FAR 52.211-18 or EFARS 52.211-5000 & 52.211-5001? Please delete the one(s) which does not govern.

An Amendment will be issued to delete FAR 52.211-18 from the Contract Notes,

Paragraph 5 of the page entitled, “CONTRACT AWARD”, states that we must complete and submit the attached “Dredging Plant and Equipment Schedule”. No such form was included in the bid package. Please provide this Schedule.
Amendment 0002 was issued 7/21/08 with the two forms P.1 and P.2 attached as well as other changes.
The last page of Section 00100 contains a clause, Representation of Extent of Transportation by Sea. Are we required to complete and submit this representation with our bid?
Please submit the representation with your bid.
Section 01 32 23, Paragraph 3.1.1, states that we must provide QC surveys at least once per week. It also states that we must provide QC surveys “when directed by the Contracting Officer”. How will we be paid for these directed surveys? If we are to include this cost in our bid, please state specifically how many of these surveys the Contracting Officer will direct.
The Contracting Officer (CO) has thus far not directed any additional Contractor QC surveys during the performance of recently completed dredging contracts, or required,” on” site” print outs of cross-sectional plots i.a.w. paragraph 3.1.4, Section 01 32 23. This does not mean that the CO will not direct QC surveys on this job. In general, additional QC surveys would be directed only when the Government’s Quality Assurance process raised questions about the validity of an already conducted QC survey. These surveys will be paid for as associated subsidiary obligations i.a.w. paragraph 3.5, Section 01 32 23.
Section 01 32 23, Paragraph 3.2.5.3, states that we must “ensure that the quantities dredged and delivered to the different disposal sites can be calculated using Government pre- and post-dredge survey data”. The calculation of the volume sent to the other disposal sites which the Government might direct us to use will require additional pre- and post-dredge surveys. Will the Government provide these additional surveys? If not, then how many other sites will be used so that we can calculate and include the cost of these additional surveys?
The Government will conduct pre- and post-dredge surveys if the disposal site is changed.
Section 01 32 23, Paragraph 3.2.5.3, states that we must “perform a QC survey between each disposal site switch”. How many disposal site switches will the Government direct? We need this information so that we can calculate and include the cost of these additional QC surveys in our bid.
Please refer to Bid Schedule Contract Note 6 which states, ‘At this time the Government is unable to predict whether the off loader will be continuously operable during the performance of this contract. In the event the offloader becomes unavailable during the pendency of this work the Government may negotiate for the delivery of the O&M material to be dredged under this contract to an alternative site. Subject to a reasonably negotiated price, the Government reserves the right to modify this contract to designate an

alternative disposal location in accordance with the Changes clause, FAR 52.243-4.’ The costs associated with between-disposal-site QC surveys could be, at the bidder's discretion, part of the "reasonably negotiated price" referred to in Contract Note 6.

Section 35 20 25, Paragraph 3.2.1, states that the “current offloading schedule for Hamilton shows that the Oakland O&M offloading shall be complete by 31 October 2008 in order to avoid conflicts with the following O&M offloading schedule.” First, are we required to complete the dredging (and thus offloading) by October 31, 2008? Block 11 of SF1442 indicates we will have 105 calendar days to complete the work. Assuming a notice to proceed date of August 18, 2008, the contract completion date will be December 1, 2008. Which date governs – 10/31 or 12/1?

Second, no “O&M offloading schedule” was provided. Please provide this schedule.

Yes, the contractor is required to complete dredging by 31 October 2008. Extra time is given in the 105 calendar days for contractor submittals, final acceptance survey(s), and mobilization and demobilization.

The off-loading schedule is to be developed by the Oakland O&M dredging Contractor in conjunction with the Hamilton Operator as described in paragraph 3.2.1 of Section 35 20 25. Adjustments will be made in this schedule of production days as described in subsequent paragraphs of Section 35 20 25.

For information regarding the off-loading operation, please refer to the bidding schedule, under Contract Notes:

8. HAMILTON OFFLOADER OPERATION: The Hamilton Offloader is operated by the

Manson-Dutra Joint Venture (MDJV) under Contract No. W912P7-07-C-0001, Oakland

Navigation Improvement -50 ft Deepening Project Phase 3E, Oakland Inner and Outer Harbor, Alameda and San Francisco Counties. Bidders are advised that the dredged material to be disposed of at the HWRP will be off loaded from scows via hydraulic offloader, and pumped through several booster pumps and through approximately 35,000 to 40,000 lineal feet of pipeline. As such, the successful bidder is cautioned that its work plan and execution will require coordination with the MDJV and will further require certain equipment and production limitations as described in these contract documents. For coordination of additional requirements and/or further details relating to the Hamilton Offloader, please contact Manson-

Dutra JV, Attention: Terry Hammerwold, phone # (415) 884-2973.

And in the Technical Specifications: Transportation for Hamilton Off Loading, Section 35 20 25.

Amendment 1 to the solicitation corrected the language, see at the end of Paragraph 3.2.1, thus the Government does not intent to provide an O&M offloading schedule

9) How long will it take the Hamilton operator to off load a barge containing about 4,000 cy of material? While the specifications states that they can accept a maximum of 6,000 cy per production day, this does not allow us to determine how long a barge will be tied up for the unloading process.

I request that you specifically state how long a barge will be tied up during the entire offloading process.

Please note that I am concerned that the operators of the offloader will give priority to barges from their other dredging operations and not to barges from this project if it is awarded to a third contractor.

Alternatively, I suggest that you include an hourly unit price bid item, with an estimated quantity, for the time at the offloader. The measurement for payment would include the time a barge waits for unloading as well as the time it takes to offload the material. By doing so you will obtain more accurate and less expensive prices because bidders won’t have to put an undefined and incalculable contingency for the offloading time.

10. It will take between 1.5 hours (O&M material) and 3 hours (sand or old bay mud material) to off load the material from a 4000 CY scow. When any given scow arrives, it will be put in line with other scows already at the site. MDJV has no way of knowing what material may be in the other scows and how long they will take to offload. If an O&M scow is in line behind a scow with old bay mud, it could be 12 to 15 hours at the offloader. Bidders are strongly encouraged to coordinate deliveries of material to the off-loader with the Manson Dutra JV Contact Mr.Terry Hammerwold to minimize equipment stand by time.

Section 35 20 25, Paragraph 3.5, states that the barges which deliver the dredge spoils shall have a capacity greater than 3,000 cy. This requirement effectively limits competition for this project to the two joint venture partners (Manson and Dutra) which operate the Hamilton Off Loader. We own two split-hull dump barges. One has a capacity of 4,000 cy and the other has a capacity of 1,800 cy. We are also aware of another dredging contractor who owns two 1,700 cy capacity split-hull dump barges. In order to allow increased competition, I request that you revise this Paragraph to read that the barges “shall have a capacity greater than 1,500 cubic yards”.
11. The recommended minimum scow capacity of 3000 cy will remain as stated in the specifications.
Section 35 20 25, Paragraph 3.5, states that the barge combings must be able to fit under the offloader when the barge is empty. Please provide detailed drawings of the offloader (and its elevation relative to water level) so that we determine whether or not our equipment can meet this requirement.
12. The dimension from the bottom of the transverse section of snorkel piping to the end of the snorkel mouth is approximately 25 feet. The dimension from the water line to the bottom of the transverse section of snorkel piping is approximately 18 feet. The Manson-Dutra JV maintains a minimum 3 foot spacing between the bottom of the transverse snorkel piping and the top of the combing on a scow. Therefore, the top of the combing any scow that will be offloaded must not be more than 15 feet above the water line when empty. See attached sketch.
Lastly, Section 35 20 23, Paragraph 3.2, states that we are expected to examine the site of the work and that “records of previous dredging are available” for review. I would like to look at the Corps’ files of these previous dredging projects and see whatever records (daily reports, pay quantity, unit price, plans and specifications, etc.) are available. Please let me know when I can travel to your office to review these records.
Please contact the Contract Specialist James Garror at 415-503-6988. Please provide him with a written request listing what documents you are interested in examining. He will forward your request to the appropriate technical offices to obtain the documents and will contact you regarding it.

Regarding Amendment No. 0002, the drawing which was included in Appendix 15 is not readable. Please provide a clean and clear copy of this drawing.

From what I can see, it shows one power cable which was in one location on 12-12-2007 and at a second location on 5-28-08.

However, it is not possible to see where the cable is in relation to the dredge prism.

Also, is the cable buried or laying on the surface?

Concur. The original power cable .DWG drawing was posted under Amendment 0003.

The cable is sitting on the bottom of the channel and, when necessary, it is dragged into position by the reel barge and a tug.

Lastly, will the cable be moved by others so that the dredging under this contract can be performed?
The power cable will be removed by the Oakland Deepening contractor when the deepening of the outer harbor is completed, currently scheduled for mid September. If the deepening project work has not been completed by the time the maintenance work is set to begin, the maintenance dredging contract shall coordinate his/her dredging operation schedule with the Oakland Deepening contractor, so that arrangements can be made to move or remove the power cable outside the area of the maintenance contractor’s dredging area.

It is our understanding that the current dredging contract Oakland Deepening 3E is currently dredging from station 130+00 to 164+00 to a -50. The current drawing for the above referenced IFB call out dredging in reach 4 from stations 130+53 to 167+47.

Will there be dredging to be completed in reach 4 and is the volume to be removed included in the quantity available for bid item 2? If there is to be dredging completed in reach 4 under the avoe referenced IFB, what is the estimated quantity?

On drawing # 2 1 208, Sheet 5 of 5, reach 4 is shown from station 130+53 to 167+47. A new drawing changing the entire Reach 4 area will be changed to read, "Reach 4 (Not in Contract)". Additionally the drawing coversheet (Sheet 1 was changed to read "Reach 4 (Not in Contract)". The new drawings will be a part of Amendment 6.
