M. THE USACE’S RESPONSES TO CONTRACTOR’S INQUIRIES FOLLOW IN THE BELOW TABLE:

No. Question Reply

Per Section 32 93 01.00.03 Page 9 Section

2.4.2 Bracing Stakes

May 2” X 2” X 6’ long wood bracing stakes be used in place of the 2” X 2” X 8’ long bracing stakes?

Yes. Tree size has been reduced, making the shorter bracing stake length acceptable. Section

32 93 01.00.03 Section 2.4.2 Bracing Stakes has the language “minimum 6” added.

There is some confusion regarding tree and shrub stock. Is there a mileage radius these can be sourced from?

Section 32 93 01.00 03 page 7 sub‐section

2.1 5th paragraph mentions the plugs origin shall be from within a 200 mile radius of the project site, same stipulation for the seed, in Section 32 92 19.10.03 page 6 last paragraph, but we cannot find this exact wording for the trees/shrubs.

That is the intention. The following paragraph has been moved from the relevant Specification

Section 2.1 PLANT MATERIAL: HERBACEOUS

PLUGS to PART 2 – PRODUCTS to clarify that this standard applies to all plant material:

“Plants shall be true to name as specified. Their origin shall be from within a 200 mile radius of the project site. If some required plants cannot be obtained from within the specified range, the

Contractor may obtain them from alternate locations upon documentation of non‐ availability and approval by the Contracting

Officer. No re‐bagged or relabeled plants from beyond this distance shall be accepted. The

Contractor shall provide an affidavit verifying authenticity and proof of plant sources.”

Regarding FRQ W912P6‐16‐R‐0034

Section 31 31 19.13 03 Herbicide Invasives

Part 1 General; Section 1.2 Submittals 2nd paragraph.

Must ALL workers have an herbicide applicator license, or must the unlicensed workers be supervised by a licensed applicator?

Yes. All workers must have a license; unlicensed workers are not permitted, regardless of the presence of a licensed supervisor. See Section

31 31 19.13 03

Question concerning ANI‐PEL

Section 32 93 01.00 03 page 17 sub‐ section 3.15.1 and 3.15.2 mentions ANI‐

PEL tablets.

Must this particular brand be used, or may

"Repellex" tablets be used?

Yes, Repellex tablets are fine. Note that Section

32 93 01.00 03 page 17, sub‐sections 3.15.1 and

3.15.2 have been updated with the phrase “or approved equal.”

Can a Prime Contractor meet the Proposal requirements, as Outlined in Section 2.1, through the use of Subcontractors?

Per the Solicitation Section 00100, the Offeror in its plans (e.g. proposals) may include work that will be performed by its proposed subcontractor and how the subcontractor will accomplish the work in accordance with the requirements of the contract. Credit for the subcontracted work may be received if satisfying the requirements of this technical evaluation factor. Crediting in this aspect of the proposal does not relieve the

Contractor from fully complying with the

Contract and FAR Clause, “Limitations on

Subcontracting.”

Will a title commitment/report be provided on all of the subject parcels?

We are requesting only a boundary survey, so these reports are probably unnecessary. In any event, the USACE Chicago District cannot provide them. If you would still like to examine them, they may be available from the Local

Sponsor, the Little Calumet River Basin

Development Commission or the IN‐DNR. You may contact them at:

The plan set shows two areas as access routes. Will you need surveys for both of those areas and, if so, can they be included in the Kim site?

Yes, we will need surveys of both the N & S Kim tract access easements and yes, they can absolutely be included with the Kim tract survey. Both access easements were included with the Kim tract acquisition and appear on the deed. Refer to Section 01 22 00; boundary surveys are required for all parcels.

I have counted 11 separate parcels; is this a correct number?

No, this is not correct; there are 10 separate tracts. They are: 1) Bailey NW, 2) Bailey SW, 3)

Bailey NE, 4) Bailey SCentral, 5) Bailey SE, 6)

Nozrik N, 7) Nozrik S, 8) Bundalo, 9) Kim and 10)

Quail Hollow. Please refer to Table 2 and Figure

2 in Sections 32 91 19.10 03 and 32 93 01.00 03.

See Sheet C‐101.

The area just north of BAILEY SCentral and west of BAILEY SE, is this a separate area to be surveyed or included in one of the areas mentioned?

To clarify, if the contractor is referring to the the area adjacent to the SE quadrant of the intersection of 53rd Avenue and Mississippi

Street, at the extreme NW corner of Bailey SE, then no. This lot contains a privately‐owned historic brick house and is being restored. The

Plan set incorrectly includes this area as part of the Bailey SE mitigation tract. The planting plan, Figure 2 in both the Seeding and Planting spec

Sections 32 91 19.10 03 and 32 93 01.00 03; also see Sheet C‐101, correctly exclude this residential lot from the Bailey SE mitigation area. We have already made this correction in the plans, which are part of the modified solicitation.

Will there be any access issues or restrictions for surveying these parcels?

Will we be able to drive survey vehicles on the subject parcels?

The only possible restrictions foreseen are protection of the tenant farmer’s soy bean crops and protection of the soil from rutting and compaction. By the time the contact is awarded, notice‐to‐proceed is issued and submittals are completed and reviewed, the crops will likely have been harvested. Rutting and compaction will be reduced or eliminated by driving on the tracts only when the soil is dry or frozen. All of the tracts are accessible without having to cross private property. See Section 01 10 00.

Native Seeding ‐ Seed mix requirements ask that we include 10 lbs of seed with 3 lbs of forbs while achieving the most diverse seed mix that we can get. This can result in considerable differences in price and quality of seed mixes because some species are much harder to collect and clean and cannot be grown in monoculture. They may be able to be included in the seed mix but at a price.

The seeding rate for open communities is given in paragraph 2.1.2 and calls for grass, sedge and forb seed to be seeded at 6 pounds and forbs to be seeded at 4 pounds pure live seed per acre, for a total of 10 pounds of seed per acre. (Please see the seeding spec Section for graminoid‐only and canopied communities seeding rates.) Seed proportions and numbers of seeds per square foot will be evaluated. We have added the following (underlined) language to seeding spec

Section behind paragraph 2.1.3:

“Seeding rates for individual species are not given since seed availability and, consequently, seed mix composition and individual seeding rates can vary considerably. Instead, the

Contractor shall procure as much seed diversity as possible in each of the seeding areas when obtaining the material. A minimum of ten grass, sedge and rush species and a minimum of 40 forb species is expected.”

How will transect locations be determined?

Please see Specification Section 32 01 90.45 03

MAINTENANCE, MONITORING AND

PERFORMANCE STANDARDS, paragraph 3.1

VEGETATION ESTABLISHMENT AND

MONITORING PERIOD, which reads in part:

“Permanent straight‐line sampling transects will be established within each plant association type within the mitigation project area. These permanent transects will be identified and marked in the field and plotted on project drawings. The sample shall include a number of one square meter quadrats, located at regular intervals along transects, sufficient to sample a minimum of 0.2% of each planting area. There shall also be at least one randomly‐located transect.”

What are the transect quadrat size and spacing?

Please see response to Question 12.

How is the non‐native dominance standard quantified?

Please see Specification Section 32 01 90.45 03

MAINTENANCE, MONITORING AND

PERFORMANCE STANDARDS, paragraphs 3.1

VEGETATION ESTABLISHMENT AND

MONITORING PERIOD and 3.2 PERFORMANCE

CRITERIA.

Is there an approved water source for irrigation, boom spraying etc.?

There is a small farm pond located in the west ravine of the Kim mitigation tract that covers approximately 0.12 acre. We are uncertain of the water quality, whether it may contain herbicide runoff from adjacent farming activities, or whether it would be otherwise unacceptable to the selected Contractor. The selected Contractor could contact the City of

Hobart City Planner‐Zoning Administrator Mr.

Sergio Mendoza at 219‐942‐7985 to determine whether a suitable water source is available from them. Possibilities there include Robinson

Lake and metered City fire hydrants. Ultimately, the Contractor is responsible for furnishing his own water source.

There are several seed mixes other than

Table 4C that do not include forbs. What is the total acre‐seeding rate for these other mixes that do not contain any forbs, 10, 13 or 15 pounds per acre?

Grass‐only Seed Mixes: 28.55 Acres Total

Bailey NW ‐ Mesic/Wet‐Mesic Prairie – 11.99

Acres – Table 4B

Bailey SW – Mesic Prairie – 16.56 Acres – Table

4C

Bailey SCentral – Mesic/Wet‐Mesic Savanna –

17.24 Acres – Table 4G had been slated for a

grass‐only seed mix, but will now receive forbs, as well as trees and shrubs (For these, see

Section 32 93 01.00 03 PLANTING OF TREES, SHRUBS AND HERBACEOUS PLUGS, Table 3C).

The grass‐only seeding rate is 10 pounds per acre. See Section 32 92 19.10 03

NATIVE SEEDING, paragraph 2.1.2.

Please confirm that a 10 pound/acre seeding rate for the grasses, sedges and rushes is required for the emergent and sedge meadow seed mixes.

That is the rate for grasses, sedges, rushes and forbs, yes. Please read seeding spec Section paragraph 2.1.2 and see the appropriate tables for those communities.

The plant lists include: Lotus (Nelumbo lutea), Yellow pond lily (Nuphar advena) &

White water lily (Nymphaea tuberosa).

Does the Corps want them supplied & installed as non‐sprouted tubers or in a larger sprouted form?

Bare root stock is fine per Section 32 93 01.00

03.

On sheet C‐107 the proposed farm field fence is shown going down the slopes and through the existing ravine. Is that the intent or will we be gapping the fence at the ravine?

Gapping the fence at the ravine is acceptable.

See updated sheet C‐107.

On Sheet C‐109 there is a call out in the

Nozrik North area for “Metal Fence” Is that the same as the Farm Field Type Wire

Fence?

The “Metal Fence” noted for the east side of

Nozrik‐N along Liverpool Road is an error.

Fencing here will be the same kind of “Farm

Field Type Wire Fence” called for in other locations. See updated sheet C‐109

2.0 GENERAL PROPOSAL INFORMATION.

Offerors should limit submissions to the data essential for evaluation so that a minimum of time and funds are spent in preparing the information. However, in order to be effectively and equitably evaluated, Offerors must include information that is sufficiently detailed to describe the Offeror's qualifications and experience, equipment features of the proposal, and management capabilities to successfully complete the project. Requirements stated in this Request for Proposal (RFP) are minimums. Proposals that meet or exceed these requirements are encouraged, and all proposals shall conform to these requirements only and shall directly correlate to only the information asked for.

The Government will not be liable for any costs incurred by the Offeror submitting an offer in response to this Solicitation.

The criteria specified in this RFP are binding contract criteria and in cases of any conflict, subsequent to award, between RFP criteria and contractor's submittals, the RFP criteria shall govern unless there is a written agreement between the Contracting Officer and the contractor on the waiving of a specific requirement.

Clarification of the Provisions of this Request for Proposal. Any explanation desired by an Offeror regarding the meaning or interpretation of the RFP shall be requested in writing to the Contracting Branch, Attention: Wesley Dale Dewar at Wesley.D.Dewar@usace.army.mil. (PLEASE INCLUDE THE

SOLICITATION NUMBER AND/OR PROJECT TITLE IN THE SUBJECT LINE OF YOUR EMAIL)

To avoid the government's inability to timely award this critical project, Contractors are highly encouraged to submit any and all questions to the USACE within ten (10) calendar days prior to the closing date of this RFP.

2.1 PROPOSAL REQUIREMENTS

2.1.1 FACTOR 1 ‐ NATIVE PLANT COMMUNITY ESTABLISHMENT: The rating for Factor 1 will be a combination of the ratings of Sub‐factor’s 1A, 1B and 1C; each Sub‐factor will be individually evaluated using the rating method described in the Section entitled, “Evaluation System.” Offerors shall submit a proposal describing the methods to be used to ensure successful completion of the specified work in accordance with the plans and specifications. The government reserves the right to incorporate the winning offeror’s proposal for its Invasive Species Control Plan, Prescribed Burning Plan, Native Seed, Herbaceous Plug, Shrub and Tree Installation Plan, and Erosion Gully Repairs into the contract requirements.

SUB‐FACTOR 1a. INVASIVE SPECIES CONTROL: The Offeror shall submit a plan describing its ability to control herbaceous and woody invasive and aggressive native species to accomplish the requirements of the Specification Section 31 31 19.13 03 HERBICIDING INVASIVES, 31 00 00.00 03 EARTHWORK, and

SECTION 32 01 90.41 03 IMPLEMENTATION AND MANAGEMENT.

SUB‐FACTOR 1b. PRESCRIBED BURNING: The Offeror shall submit a plan describing its ability to conduct prescribed burns within native plant communities adjacent to urban areas to accomplish the requirements of the Specification SECTION 31 31 19.16, PRESCRIBED BURNING.

SUB‐FACTOR 1c. NATIVE SEED, HERBACEOUS PLUG, SHRUB AND TREE INSTALLATION: The Offeror shall submit a plan describing its ability to use native plant material in this project to accomplish the requirements of Specification SECTION 32 92 19.10 03, NATIVE SEEDING AND SECTION 32 93 01.00 03

PLANTING OF TREES, SHRUBS AND HERBACEOUS PLUGS.

2.1.2 FACTOR 2 ‐ EROSION GULLY REPAIR: The Offeror is required to provide a narrative describing at a minimum 3 (three) projects completed within the last ten years from the date of the closing of this Solicitation, wherein, the Offeror has successfully completed erosion gully repairs in the upper Midwest of the United States that are in compliance with Specification Section 31 00 00.00 03 EARTHWORK

2.1.3 FACTOR 3: PAST PERFORMANCE (TAB 3)

The Offeror shall submit with their proposal up to a maximum of ten (10) Past Performance Questionnaire’s (PPQ) in its proposal for Factor 1, whose form is provided in this Solicitation as Attachment A.

DEPARTMENT OF DEFENSE (DOD) PROJECTS:

Offerors should submit a copy of the Government’s Contractor Performance Assessment Reporting System (CPARS) Evaluations or, for older projects, a copy of the Government’s Construction Contract Performance Evaluations (CCASS). If unable to provide the printed CPARS or CCASS evaluations, provide written notification that current ratings are available so that the Government may obtain the printed evaluation.

Offerors should not request PPQs on projects that have final CPARS or CCASS evaluations. If a PPQ is received on a project where a final CPARS evaluation exists, the CPARS evaluation will serve as the official rating of record for evaluation purposes.

PROJECTS THAT DO NOT HAVE A CPARS EVALUATION:

Offerors shall forward a copy of the Past Performance Questionnaire (PPQ) to the points of contact (POC) responsible for monitoring performance under those contracts.

Completed PPQs should be included with the proposal if at all possible. However, if necessary, they can be submitted directly to Contract Specialist Wesley Dewar by emailing completed documents to the following email address: Wesley.D.Dewar@usace.army.mi

The Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for Factor 3

– Past Performance. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed Past Performance Questionnaires should be submitted with your proposal.

If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ (Attachment A), which will provide contract and client information for the respective project(s).

Offerors should follow‐up with clients/references to ensure timely submittal of questionnaires.

If the client requests, questionnaires may be submitted directly to the Government’s point of contact, Wesley Dewar at email address: Wesley.D.Dewar@usace.army.mil prior to proposal closing date.

Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Also offerors may include performance recognition documents received within the last 5 years of the issuance date of this solicitation, such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information Sysems (FAPIIS), Electronic Subcontract Reporting System (eSARS), and any other known sources not provided by the offeror.

While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

The intent of Section 2 of the PPQ is for the Offeror to identify self‐performed work that is relevant to this Solicitation. The self‐performed work shall be expressed as a percentage of the total contract when compared to the “Final Contract Price”.

The intent of Section 4 of the PPQ is for the Offeror to describe in detail how the self‐performed work is relevant to this Solicitation. Such detail should help establish the magnitude and complexity of the past performance and may include, but not be limited to, such items as quantities installed and/or constructed, equipment used, site constraints, and environmental conditions.

If the Offeror is a joint venture (JV), each firm shall only provide information on the PPQ that is relevant to their role on this solicitation. Also, if the JV previously performed work together on a project, the PPQ shall provide information demonstrating relevant experience in the role as a JV and shall indicate the percentage of work the JV completed.

If the Offeror intends to subcontract a particular feature of work, the Offeror is encouraged to submit a PPQ(s) for said subcontractor and specifically identify their role in this Solicitation.

Preferably, only complete PPQs will be included in the proposal and Offerors should follow‐up with clients/references prior to the proposal closing date to ensure timely submittal of questionnaires. If the Offeror is unable to obtain a completed PPQ from a client for a project(s) before the proposal closing date, the Offeror should complete and submit with the proposal the entire PPQ (with the unfilled evaluation section), which will provide contract and client information for the respective project(s). The Government may choose to, but is not obligated to, contact the client during review of the proposal, so the Offeror should ensure that phone numbers and email addresses are current.

New entities without past performance history shall include a letter with the proposal, stating that they have had no previous clients and that the minimum number of questionnaires cannot be provided. It is the Offeror’s responsibility to ensure that sufficient reference documentation is provided to substantiate the statement, as the Government may or may not make additional requests for past performance information from persons familiar with the Offeror’s performance history.

The Government may contact references provided as part of the Factor for Experience for information regarding past performance on the project and for assessing and verifying the scope of the work performed. Offerors should provide accurate, current, and complete contact information for references provided in the project descriptions.

2.1.4 SECTION 3 (SIGNED PROPOSAL; PROPOSED PRICE, REPRESENTATIONS & CERTIFICATIONS; BID BOND; AND any AMENDMENTS)

(Not rated, only reviewed for compliance)

Bid Bond: The offeror must submit a Bid Guarantee for this solicitation. Any offeror failing to submit an authentic Bid Guarantee will be considered non‐responsive to the solicitation and ineligible for initial evaluations and award. The Bid Guarantee shall be in the amount of 20% percent of the Offeror's proposed price or $3,000,000.00, whichever is less. (Not rated, only reviewed for compliance)

Amendments: Any Amendments issued against this Solicitation, shall be acknowledged on a copy of the issued Amendment or on the SF 1442 itself (page 2). (Not rated, only reviewed for compliance)

1.2 PROPOSAL COMPLIANCE REVIEW

The Source Selection Chairperson or Contract Specialist will make an initial review of each of the proposals to look for apparent errors, omissions and areas that require clarification. Thereafter, the findings will be submitted to the Contracting Officer for review. This information will state the specific nature of the question and the page and paragraph of the proposal requiring correction or clarification.

The Contracting Officer will review the findings and, if considered appropriate, task the Chairperson or Contract Specialist to submit questions to the Offerors for a quick response to the Contracting Officer.

The Chairperson or Contract Specialist and the Contracting Officer will not cite apparent deficiencies (parts of the proposal that fail to meet the Government’s requirements). The proposals will not be evaluated at that time. The purpose of this preliminary review session is to eliminate minor irregularities or apparent clerical mistakes. This preliminary evaluation will assure that each proposal contains all required proposal submittals and that all required forms and certifications have been fully completed.

Thereafter, the evaluation team will evaluate each proposal passing the Proposal Compliance Review using the Evaluation process described below.
