H. THE USACE’S RESPONSES TO CONTRACTOR’S QUESTIONS FOLLOW IN THE

TABLE BELOW:

From the information I can gather, the "No.9" Field Fence refers to a straight 9 gauge (ga) field fence. I have never seen this requested but apparently at least one of our competitors does make this, but I can only find it in Class 1 galvanization and your specs require Class 3. I do not see that Deacero makes any all 9 ga field fence, but I am confirming this. The closest I know we have is 9 ga top and bottom wires, 11 ga filler wires. I am not sure if you can check to see if that would work?

"No. 9" (as referred to in the Specification SECTION 32 31 26 Paragraph 2.1.1- Page

4) precedes the ASTM Designation (ASTM A 116, the Standard Specification for Metallic-Coated, Steel-Woven Wire Fence Fabric) and refers to the Design Number for Woven Wire Fence Fabric.

The Design Number describes the standard sizes and constructions of the fabric. Within ASTM's Designation, the Size or Steel Wire Gauge for Intermediate Line and Stay Wires as well as Top and Bottom Wires is listed as 9 gauge. Indiana DOT also specifies coated 9 gage wire for both line wires and vertical stays for Woven Wire Fabric in their Construction Procedures Manual.

The second part of your questions refers to a Class 3 galvanization, though we do not see this in the Plans or Specs. Please refer to ASTM A 116 for the coating Type and Classification.

We have already sent out a lot of the PPQ for the project and I see that you have updated the first page of these forms. Do I need to resend them to our clients to have them sign this revised document or will the original one work? I don't want to have to take any more time up from my clients if I do not need to.

You must use the form provided in Amendment 0002, which is the PPQ-0 form.

I would like to formally ask for a couple more days to get this proposal together. There are a lot of changes in the proposal and we were not able to get started with not knowing what changes were coming in the amendment. A couple more days would help us finalize the costs and provide the best value to the government.

The revised due date for proposals is 19 September 2016 at 4:30P.M. (CDT). See Amendment 0004 to the solicitation on FBO, which changed the due date.

I have a question about some of the changes made for Amendment 2.

Broadcast herbicide was taken out of the line items and looks as if it will be included in Plant Establishment Activities as Site Preparation, although Broadcast herbicide is still included as a Sub-line item for Oak Woods and Oak Ravine, which seems odd because the Sub-line item Selective Clearing were taken out for those as well. Could you please clarify?

This was an oversight. The canopied communities, Oak Woods and Oak Ravine, will receive selective clearing, as well as broadcast and selective herbicide treatments. See the changes in CLIN 0009AA, and in CLIN 0010AA, within this Amendment.

Please provide information on the fire breaks.

The fire breaks are 20 feet wide and essentially follow the mitigation tract perimeters, but also ring the Kim Tract ravines. There will be no woody plantings (trees or shrubs) within the fire breaks, but they will receive the same clearing/seeding treatment as the adjacent communities.

2.1.1 Woven Wire

Size of mesh is not mentioned (size of squares in the fence).

2.1.1 Woven Wire

*Per C-502 scaling Spacing of Stay Wires 6 inch vertical spacing. Horizontal spacing is per ASTM A 116 Fence Fabric Dimensions

2.3.2 Composite Poly Resin Posts

How often are these to be used & can we offer an alternate?

2.3.2 Composite Poly Resin Posts

*Per C-502 for Line Post Spacing 16 FT MAX (Line Panel) *Refer to 2.3.1 Metal Posts for Farm Style Fence metal post acceptable alternatives(ASTM A 702)

2.4 Braces and Rails

"..Group II line posts." Not sure if this applied to this project or not.

2.4 Braces and Rails

*Refer to C-502 for Braces and Rails (Group II Line Posts DO NOT APPLY)

2.6 Padlocks

Are padlocks for "A-Frame" gates only? Or for woven wire gates also?

2.6 padlocks *They are for A-Frame Gates only.

3.4 Barbed Wire

Is there any? If so, last line in this section must not apply.

3.4 Barbed Wire

*No barbed Wire is required for this project.

No gate shown for woven wire fence.

Mentioned in notes on C-502.

*No woven wire fence panel gates (A- Frame Gates only, per C-501)

I have some additional questions for the Little Calumet River, Flood Risk Management Hobart Marsh Wetland Mitigation- W912P6-16-R-0034 project. These questions were brought to my attention by our nursery and are about the native seeding specifications that are in amendment 02. The amended native seeding specifications mention Tables 4A, 4B, 4C, and so but those tables don’t exists unless I am missing something. There are Tables 3A, 3B, 3C and so on in the original specifications. Section 2.1.4 of the amended native seeding specifications also mention Table 4BB, that table does not exist at all. Are these typos or are there new amended seeding tables?

In looking through Amendment 2, my seed supplier noticed that the amendment references species listed in multiple tables from 4A, 4B, 4C all the way to 4BB. However, we don’t see any such tables. Was this a typo and the correct tables are 3A to 3BB? If so, it still seems like there may be an error as the tables only go from Table 3A to Table 3Y.

This is an error. The “Hobart Marsh Native Seed Mixes For Tract (No. Acres)” tables should have been numbered Table 4A: Hobart Marsh native seed mixes for Bailey NW Tract Emergent Wetland Area (1.95 Acres) through Table 4BB: Hobart Marsh native seed mixes for Quail Hollow Tract Oak Woods Area (6.44 Acres). This is corrected in the amendment. See corrected Tables 4A through 4BB in Section 32 92 19.10 03-1 NATIVE

SEEDING.

13 CLIN 0013 for herbaceous plugs quantity changed from 6,852 to 1,308.

Is there a new number/acre for table 3k?

Number/acre for table 3K is No./.23 Acres per table in section 32 93 01.00 03.

14 CLIN 0014AC plugs reduced from 13,312 to 5,356. This seems to correspond to plug table 3O being removed. Is this the case?

This was a mistake. CLIN 0014AC is 13,312 plugs.

15 CLIN 0012 Plugs were reduced from 47,656 to 28,612. This seems to correspond to removing all forbs from the plug mix for this item. Is this correct?

This was a mistake. CLIN 0012AD is 47,656 plugs.

16 CLIN 0012 Shrubs were reduced from 523 to 98. Is there a new number per acre for each species?

This was a mistake. CLIN 0012AC is 523 shrubs.

17 CLIN 0014AB Is 2.67 acres the correct acreage for this? I see swale seed for

1.07 ac in table 3P but I don’t see any other swale seed mix in any table.

Should there be a swale seed mix in the Kim tract?

Tables 3I, 3O, 4Q and 4Y cover the swale areas and the acreage (2.67) is correct. See Section 32 92 19.10 03 of the Project Specifications.

18 CLIN 0006 I don’t see a seed mix table that corresponds with this.

See Table 4J, in Section 32 92 19.10 03 of the Project Specifications.

19 CLIN 0005 I can’t determine which cover crop should be used for this line item.

See Table 4B, in Section 32 92 19.10 03 of the Project Specifications.

20 CLIN 0004AB Do we have a seed mix table for this or should be use table 3C (same as CLIN 0007)?

See Table 4U, in Section 32 92 19.10 03 of the Project Specifications.

21 CLIN 0008AB The amendment states that forbs are added to table 4G (I’m presuming this should actually be 3G).

Do we have the new forbs list? Also, should this CLIN be updated with the acreage of 201.87?

The acreage will be updated. The forb seed list is in table 4G , in Section 32 92

19.10 03 of the Project Specifications.

22 The wage rates identified in the documents (Amendment 2) offer several classifications of labor for Lake County, IN. None of the specified classifications describe planting or landscape maintenance activities.

Which rates will the government expect to see published on the wage labor report (certified payroll) provided by the contractor?

Once the contract is awarded, if the Contractor identifies one or more classifications considered necessary by the Contractor for performance of the work is/are not listed on the applicable wage determination, initiate a request for approval of an additional classification along with the proposed wage and benefit rates for that classification. The complete answer, from the DOL website, is displayed below

Conformances Under the Davis-Bacon Act (Response to Question #22, continued)

Contracting Officers may submit completed SF1444 Requests to the Department of Labor via email. Please scan the completed form and all supporting documents into a 'pdf' file and attach to the email. Include the Contracting Officer's name, address, telephone, and email address.

Submit the email to: WHD-CBACONFORMANCE_INCOMING@dol.gov The U.S. Department of Labor (DOL) issues wage determinations under the Davis-Bacon Act (DBA) using survey data on prevailing construction wages and benefits paid in specific areas. On occasion, the data does not contain sufficient information to issue rates for a particular classification of worker needed in the performance of the contract. Because of this, DBA provisions contain a conformance procedure for the purpose of establishing an enforceable wage and benefit rate for the missing classification.

Contractors are responsible for determining the appropriate staffing necessary to perform the contract work. Contractors are also responsible for complying with the minimum wage and benefits requirements for each classification performing work on the contract. If a classification considered necessary by the contractor for performance of the work is not listed on the applicable wage determination, the contractor must initiate a request for approval of an additional classification along with the proposed wage and benefit rates for that classification.

The awarded Contractor initiates the request by preparing an SF1444, Request for Authorization of Additional Classification and Rate, at the time of employment of the unlisted classification. (Reference FAR 22.406-3 and 52.222-6(b), and Title 29 CFR Part 5, Section 5.5(a)). The contractor completes blocks 2 through 15 on the form. Request may be submitted to DOL without the form, but must contain the required information.

Employees, if present, or their designated representative must sign block 16 noting their concurrence or disagreement with the contractor's proposed wage and benefit rate. If the employee indicates disagreement with the contractor's proposal, he must provide a statement supporting a recommendation for different rates.

(“Designated representative” is generally a union. It cannot be the contractor 's personnel officer or other contractor representative.)

The Contractor submits the request to the Contracting Officer. The Contracting Officer reviews the request for completeness and signs the form designating the contracting agency's concurrence or disagreement with regard to the contractor's proposal. If the Contracting Officer indicates disagreement with the contractor's proposal, a statement must be attached supporting a recommendation for different rates. The Contracting Officer then submits the proposal with all attachments to DOL for approval. The Contractor is obligated to pay the proposed wage and benefit rates pending a response from DOL.

Checklist for DBA Conformances:

a. The classification must be appropriate for the contract work, and must be a classification that is utilized in that locality by the construction industry.

b. The contractor cannot propose a new classification by combining job duties from two or more existing classifications on the wage determination, or propose a new classification that performs only part of the duties of an existing classification.

c. The proposed classification cannot be a "trainee". Generally, a proposed classification of "helper" will not be approved. Under DBA provisions, a "helper" will not be approved by DOL unless the contractor establishes that the criteria in the regulations at 29 C.F.R. Part 5 are met.

d. Conformance requests should not be submitted for exempt classifications (project managers, full-time supervisors, professionals such as engineers), nor for classifications other than "laborers or mechanics" employed on the site of work, as covered by DBA.

e. The proposed rate and fringe benefits should bear a reasonable relationship to the wage rates listed on the wage determination.

f. The contractor must attach a brief job description to each SF1444 request submitted for classifications that are not generally known and utilized in the construction industry in the locality. The contractor should include all pertinent documentation that supports his request for approval of an additional classification.

g. If the contractor has further questions about a conformance process, he/she may contact the nearest Regional Office of the U. S. Department of Labor, Wage and Hour Division (see DOL's website in the WDOL.GOV Library).

IMPORTANT PROPOSAL NOTES

a. The contractor shall submit a price for ALL items that are contained in Section 00010

(SOLICITATION CONTRACT FORM) of this solicitation, which will serve as the contractor’s price proposal. Should a contractor fail to fully complete the solicitation contract form, its price will not be considered responsive to the solicitation and eligible for the resultant contract award. Therefore, the offeror’s total price for the work shall be based upon the TOTAL of all line items included in the solicitation contract form. The contractor shall enter both unit and extended prices for each line item.

b. The Government intends to award all Base line Items to the responsive, responsible offeror submitting the lowest aggregate fair and reasonable price for all line items.

c. Split awards or multiple award contracts will not result from this Solicitation.

d. Evaluation of Options: Except when it is determined in accordance with FAR 17.206(b) not to be in the Government's best interests, the Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. Evaluation of options will not obligate the Government to exercise the option(s). FAR 52.217-5 EVALUATION OF OPTIONS (JUL 1990)

e. Option provisions: Any, all, or none of the Options Items 0022AA, 0022AB, 0022AC, 0022AD, 0023AA, 0023AB, and 0023AC may be exercised by the Government within 90 days of the Contractor’s acknowledgement of their receipt of the Notice to Proceed (NTP). No time will be added to the contract completion date if an option is exercised.

Also, one or more of the option item(s) may be exercised at time of contract award.

f. This Amendment updates the CLIN numbering at FAR Clause 52.217‐7 OPTION FOR INCREASED QUANTITY‐‐SEPARATELY PRICED LINE ITEM (MAR 1989), which was incorporated into Section 00700 of the RFP via Amendment No. 0002. The Government may require the delivery of the numbered line items, 0022AA, 0022AB, 0022AC, 0022AD, 0023AA, 0023AB, and 0023AC, identified in the Schedule as an option item, in the quantity and at the price stated in the Schedule. The Contracting Officer may exercise the option by written notice to the Contractor within ninety (90) days of the contractor’s acknowledge of their receipt of the Notice to Proceed (NTP).

Delivery of added items shall continue at the same rate that like items are called for under the contract, unless the parties otherwise agree.
