Contractor Inquiries and Responses
1. In section 1.2.5.1 it states that payment will only be made yearly according to the schedule outlined in Section 32 01 90.56. This basically allows a small business to pay up front all the labor, materials, mobilization and overhead for an entire year before payment is made. This is a significant challenge for any small business. It is much more customary to hold back retainage on these tasks to be released once the performance requirements have been met paying 95% as the work is completed. Overall this project is bonded so the insurance is already included to prevent against a contractor that does not meet the performance requirements.
Response: Specification Section 01 22 00 – Measurement and Payment – Bid Item 0005 language has been modified by Amendment 0002 to allow partial payment with COR approval.
2. The project contains base bid seeding areas, optional seeding areas and remnant areas that will not be seeded. Should we only include stewardship activities in our establishment item (CLIN 0005) for the newly seeded areas, or for the entire project site? If establishment activities are only for the base bid seeding areas how will establishment be addressed for optional areas be seeded?
Response: In those areas that do not receive native seeds, by way of not executing optional items or remnant, they will be only assessed for invasive species control not native species establishment. Invasive species will be controlled throughout project site at the specified levels.
In areas that do receive native seed they will be assessed for all performance standards as specified in section 32 01 90.45 ESTABLISHMENT ACTIVITIES.
3. We request that the qualification timeline be expanded to cover the last 25 years of a companies or organizations history as it relates to ecosystem restorations of, creeks and rivers, vegetation cover, and reestablishments of natural flora as it relates to the Midwest.
Response: Request denied. General understanding of freshwater stream restoration techniques and best practices has evolved over the past 20 years, so much so, that a comparison between a 20 year old stream restoration and a 10 year old restoration would not be appropriate.
