7.0 TECHNICAL QUALITY EVALUATION OF PROPOSALS
Offerors are advised that the technical evaluations of proposals are conducted in strict confidence in that technical evaluation personnel review each proposal without knowledge of the price offered.
PROPOSAL EVALUATION SYSTEM
(EVALUATION FACTORS FOR AWARD)
PART 1 GENERAL
1.1 PROPOSAL EVALUATION
An evaluation team will evaluate each eligible proposal in response to this RFP. The number and identities of offerors are not revealed to anyone who is not involved in the evaluation and award process or to other offerors. Proposals will be evaluated based on the factors described herein. The technical and non-technical aspects of each proposal will be evaluated.
1.2 EVALUATION PROCESS
The evaluation process essentially consists of three parts, which are described in paragraphs 1.3, 1.4 and 1.5 below.
1.3 PROPOSAL COMPLIANCE REVIEW
The Source Selection Chairperson will make an initial review of each of the proposals to look for apparent errors, omissions and areas that require clarification. Thereafter, the findings will be submitted to the Contracting Officer for review. This information will state the specific nature of the question and the page and paragraph of the proposal requiring correction or clarification.
The Contracting Officer will review the findings and, if considered appropriate, task the Chairperson to submit questions to the offerors for a quick response to the Contracting Officer.
The Chairperson and the Contracting Officer will not cite apparent deficiencies (parts of the proposal that fail to meet the Government’s requirements). The proposals will not be evaluated at that time. The purpose of this preliminary review session is to eliminate minor irregularities or apparent clerical mistakes. This preliminary evaluation will assure that each proposal contains a technical and price proposal, and that all required forms and certifications have been fully completed.
1.4 TECHNICAL ACCEPTABILITY EVALUATION
The evaluation team will evaluate each proposal passing the first review, above. Proposals will be evaluated against the technical and quality RFP requirements indicated. The technical/quality factors will be rated on a qualitative basis to determine if it is technically acceptable. The ratings are as follows:
Go/No Go Ratings: A proposal must satisfy all the evaluation factors, or it will be considered ineligible for contract award. A technical proposal is considered technically acceptable when all evaluation factors are rated as a "GO."
a. Acceptable (Go rating) - At a minimum the proposal demonstrates acceptable understanding of requirements and approach, and experience that meets performance or capability standards.
b. Not-Acceptable (No-Go Rating) - Offeror fails to meet performance and capability standards or experience or sufficient information was not provided to allow an evaluation. Requirements can only be met with major changes to the proposal.
1.5 PRICE EVALUATION
Offeror’s proposals are evaluated for all technical (non-price) criteria and then all who successfully meet the technical evaluation criteria are advanced into the Price Analysis Phase of the evaluation process. Price will be evaluated for fairness and reasonableness using price analysis. Price will also be checked for unbalancing of line items.
PART 2 DESCRIPTION OF PROPOSAL EVALUATION CRITERIA
The technical evaluation criteria (Sections 1 and 2) will be rated on a qualitative basis. Price (Section 3) is considered separately as discussed in Para. 1.5 PRICE EVALUATION, above.
2.1 Section 1: SPECIALIZED EXPERIENCE (TAB 1)
The offeror shall submit a narrative describing his and/or his prime sub-contractor’s experience with a minimum of two projects with respect to the criteria listed below. Multiple projects can be cited if the scope of a particular project did not include all of the criteria.
(4) Removed and re-installed vertical line shaft storm water pumps which have a discharge diameter of 30” or larger.
(5) Worked in a combined sewer overflow, wet pit type, pump station environment where the following tasks were completed. The Offeror and/or its prime sub-contractor shall have performed three (3) out of the six (6) tasks listed.
a) Managed and maintained the daily flows passing through the pump station
b) Replaced piping
c) Replaced a mechanical trash rack
d) Replaced guide rail mounted submersible sump pumps
e) Installed grit collection and removal machinery
f) Other tasks not specifically listed in a) thru e)
(6) Coordinated installation of various electrical, mechanical and structural features of a project while keeping the facility operational with short (less than a week) allowable outages/downtime.
The offeror and/or its prime sub-contractor has to satisfy all criteria (1), (2) and (3) above to receive a (Go) Rating. If the offeror and/or its prime sub-contractor only satisfies one or two of the criteria he will receive a (No-Go) Rating.
2.2 Section 2: PAST PERFORMANCE (TAB 2)
Any unsatisfactory ratings or more than two marginal ratings will result in an Unacceptable (No- Go) Rating.
The Offeror shall provide a list of the relevant projects, with a Point of Contact Name and Telephone Number. The Government will contact a minimum of two references for interviewing purposes; references interviewed will be requested to rate the Offeror’s: a) Quality of Work; b) Timely Performance; c) Effectiveness of Management; d) Compliance with Safety Standards;
and e) Compliance with Labor Standards.
If the Government does not obtain past performance information for the projects identified by the Offeror or cannot establish a past performance record for the Offeror through other sources, past performance will be rated neither favorably nor unfavorably. The performance risk will be considered unknown.
PART 3 CONTRACT AWARD
3.1 AWARD
The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a)). Therefore, the offeror's initial proposal should contain the offeror's best terms from a cost or price and technical standpoint.
The Government reserves the right to conduct discussions if the Contracting Officer later determines them to be necessary. Award will be made to the responsive and responsible offeror, whose proposal is determined to be technically acceptable and offers the lowest price.
A technically acceptable offer is one in which the offeror complies with the instructions contained in Section 00100 of this Solicitation, does not take exception, nor object, to any of the terms of this Solicitation, and satisfies all the evaluation factors. A technical proposal is rated as being technically acceptable when all evaluation factors are rated as a "GO." Offers that are not technically acceptable will not be considered.
3.2 SMALL BUSINESS SUBCONTRACTING PLAN
Prior to the Contracting Officer awarding the contract, the successful Offeror will be required to submit a Small Business Subcontracting Plan in accordance with the provision of FAR Clause 52.219-9, “Small Business Subcontracting Plan.” This requirement applies to all business concerns other than small businesses. The Contracting Officer must approve the Plan before an award can be made; the Plan will be made apart of the resultant contract.
The successful offeror will be responsible for making a good faith effort to apply the following percentages to its intended amount of subcontracts in order to satisfy the Small Business Subcontracting goals of the Chicago District. The District Goals are identified below:
(1) at least 51.2% with small businesses (SB)
(2) at least 8.8% with small disadvantaged businesses (SDB)
(3) at least 7.3% with women-owned SB (WOSB)
(4) at least 1.5% with service-disabled veteran-owned SB

The Contracting Officer, Ms. Regina Blair, chaired the meeting. Following the introductions, Ms. Blair provided a brief overview of the Solicitation Document (contracting-related items), noted as follows: The solicitation was issued on August 18, 2008. The procurement method is best value contracting. The solicitation type is Request for Proposal (RFP), lowest price technically acceptable. The work is set aside for Service Disabled Veteran Owned Small Business. The estimated construction cost is between ten and twenty-five million dollars. The Davis Bacon Act applies. The contractor begins performance 10 calendar days and the required completion date is 540 calendar days following the contractor’s acknowledgement of the Notice to Proceed. This is a mandatory performance period. The contractor must submit performance and payment bonds within 10 days of award. Proposals are due no later than 4:30 p.m. Central time on September 18, 2008 unless otherwise revised by amendment. The offeror shall complete the entire bid schedule to include the base bid plus options. If the options are awarded, this will be done within 300 calendar days after contract award. Please see Page 33 of the solicitation document for more details on the exercise of the options. Paragraph 2.0 of Section 00100 has the address of where to submit the proposal. There are three technical evaluation factors with a rating system of go/no go. Please read Page 43. Offerors are responsible for submitting a bid guarantee of 20% of the proposed price or three million dollars, whichever is less.
Section 00600, Representations and Certifications, should be completed and submitted with your proposal. In terms of liquidated damages, the Government will assess $1706 per calendar day of delay until the work is completed or accepted. Regarding limitations on self-performance, the contractor must complete 15% of the contract cost. The incremental funding clause indicates that there is $100,000 reserved for this fiscal year ending September 30, 2008. At any point, more funding may be added.
CONTRACTOR’S QUESTIONS FROM PRE-PROPOSAL MEETING
QUESTION #1. Question from Mr. Vance Kenney: After review of proposals, how long will it take to award the contract?
USACE RESPONSE TO QUESTION #1: It depends on the number of proposals received. Goal is to award in September.
QUESTION #2. Question from Mr. Lam Davis: Will it be funded in the next fiscal year?
USACE RESPONSE TO QUESTION #1: It could be. It depends on the Government’s funding stream.
QUESTION #3. Question from Mr. Vance Kenney: Can submittal of Reps and Certs be replaced with online registration?
USACE RESPONSE TO QUESTION #3: Yes.
QUESTION #4. Question from Mr. Vance Kenney: What are the guidelines for a joint venture with Service Disabled Veteran-Owned Small Business Concern?
USACE RESPONSE TO QUESTION #4: This is a question for the Small Business Administration.
ADDED NOTE by way of this Amendment: Offerors planning to form Joint Ventures as a means to propose an offer in response to said Solicitation shall carefully review and comply with the provisions set forth in the Federal Acquisition Regulation, Subpart 19.1403(c), Status as a service-disabled veteran-owned small business concern and should also contact the U.S. Small Business Administration for further guidance.
QUESTION #5: Question from Mr. Mark Titus: Why sole source for the pump reworking?
USACE RESPONSE TO QUESTION #5: To avoid an increase in shaft diameter, the shaft needs to be replaced with a material with higher physical properties.
The original manufacturer knows the original shaft design stresses and can select a material to accommodate the additional torque required by the higher horsepower motor that is required.
QUESTION #6. Question from Mr. Mark Titus: Can it be a new pump? Why is that pump being reworked?
USACE RESPONSE TO QUESTION #6: It is a specified requirement. Offerors shall submit their proposal in accordance with the plans and specifications issued under the solicitation set.
QUESTION #7. Question from Mr. Lam Davis: Since it is a brand name sole source, is there a time line?
USACE RESPONSE TO QUESTION #7: There is only one pump rebuild required.
Other equipment is brand new. Equipment will have to be rebuilt and produced to meet the schedule.
Upon completion of the above Q&A session, Mr. Darin White, assisted by Mr. Russ Witten and Mr. Rick Canterbury, provided a brief summary. Section 01 11 00 in the specifications contains a Summary of Work. Work will be performed at three pump stations: Jackson Avenue, Southside and Indianapolis Boulevard. Some important things to keep in mind include: being sure that your pump supplier can comply with the NPSH requirements in the specifications, obtaining from your pump suppliers requirements for mounting the pumps so this cost can be included in your proposal, scheduling and sequencing of work, temporary pumping requirements, and disposition of the equipment that is removed. At Jackson Avenue, there is structural work required at the loading dock, including concrete overlay and handrail. The rehabilitation includes increasing the pumps from 400 to 600 hp, and a 48” dia. knife gate valve. Work involves modifications of existing piping and cutting holes in the floor for personnel to access the knife gate valve. There is discharge piping, and the exact physical location of where to connect it will be determined during construction. Work includes adding ventilation systems and replacing the trash rack. With the new pumps and motors, the electrical service will be increased from 480 to 4160 volts. And new conduit will be added for the mechanical equipment.
At Southside, modifications are required to the discharge box outside the pump station.
A 12-inch concrete slab will be placed over it. Mechanical work involves replacing four existing pumps and motors. Grit machinery will be removed and replaced. Adding sump ventilation and a small 20 hp de-watering pump. Electrical service at this station is already 4160 volts.
At Indianapolis Boulevard, there is base plus option work. The option includes removing one pump and sending it back to the original manufacturer for modification.
There are four existing pumps at this station, and space for a fifth pump. Work includes removing the old equipment, installing two new dry weather pumps, and replacing and installing two trash racks. The work includes increasing the electrical service from 480 to 4160 volts. The option work is boxed and noted on the drawings. Make sure the pump manufacturer is aware of the net positive suction head requirements. Also, make sure the manufacturer of the new pumps provides the requirements for the large base plates upon which the pumps are mounted.
Question #8. Question from Mr. Chuck Hansen: Where do we submit technical questions after this meeting?
USACE RESPONSE TO QUESTION #8: Fax them to the attention of Ms. Regina Blair, 312-846-5371 (phone), 312-886-5475 (fax).
QUESTION #9: Question from Mr. Vince Rock: Regarding the two 1,000 gpm standby pumps that are specified, will both be operational concurrently? Or is one a back-up in case the other fails?
USACE RESPONSE TO QUESTION #9: This question was reviewed following the pre-proposal conference. Specification Section 01 11 00, paragraph 3.1.2 has been revised to clarify this requirement and is included in this amendment.
QUESTION #10: Question from Mr. Michael Georges: Regarding the possible presence of lead paint and asbestos, what gets painted?
USACE RESPONSE TO QUESTION #10: Answer: Anything new gets painted.
And some existing piping gets cleaned and painted.
QUESTION#11: Question from Mr. Dragan Vjestica: Has there been formal testing done, and has the presence of lead paint and asbestos been confirmed?
USACE RESPONSE TO QUESTION #11: Following the pre-proposal meeting, it was confirmed that it is unknown whether any test data exists. Offerors are advised that the presence of lead paint and/or asbestos is suspected. Please see Paragraphs 1.8.1, 1.8.2, 1.8.3 and 1.8.4.2 in Section 01 11 00.
QUESTION #12: Question from Mr. Vince Rock: Has Hammond Sanitary District specified which pump gets rebuilt?
USACE RESPONSE TO QUESTION #12: No; the contractor will be able to pick whichever one works better in terms of his schedule.
After the pre-proposal conference concluded, the Hammond Sanitary District was contacted and Pump No. 1 at the Indianapolis Boulevard pump station will be rebuilt and installed in the space for the 5th pump if the Option is exercised.
Therefore, the answer given at the pre-proposal conference was incorrect.
QUESTION #13: Question from Mr. Vince Rock: Can we take out one pump at each station at the same time?
USACE RESPONSE TO QUESTION #13: Yes, you can work at each station at the same time. Please see Paragraph 3.1 in Section 01 11 00.
QUESTION #14: Question from Phil Kelser: For temporary bypassing, submersible pumps are specified. Can we use a pump with suction hose? Up to 100 feet of suction hose can be used if needed. The floats control the pump, and the pump can be run dry.
USACE RESPONSE TO QUESTION #14: Specification Section 01 11 00 paragraphs 3.1 and 3.1.2 have been revised to clarify this requirement and is included in this amendment.
USACE RESPONSES TO CONTRACTOR’S QUESTIONS
(RECEIVED AFTER PRE-PROPOSAL MEETING)
QUESTION #15a: Please confirm speed requirements listed in section 22 10 00.00 10 Vertical Pumps, page 15, paragraph 2.2.1. Note current motor at Indianapolis Blvd is 585 rpm and at Southside 390 rpm.
USACE RESPONSE TO QUESTION #15a: The maximum motor speed for Indianapolis Boulevard is incorrect and is changed by this amendment to 590 RPM. The maximum motor speeds for Jackson Ave. and South Side are correct.
QUESTION #15b: If speeds are correctly list, please explain design criteria for the listed speeds so the replace pumps maybe selected using the same criteria.
USACE RESPONSE TO QUESTION #15b: The maximum speeds were determined from the NPSHA based upon Guide Specification 22 10 00.00 10.
QUESTION #15c: Is there an anticipated maximum motor horsepower for the pump motors?
USACE RESPONSE TO QUESTION #15c: We anticipate the maximum horsepower to be 600, but pumps requiring less horsepower will be acceptable provided the pumps and motors meet the requirements of the specifications.
QUESTION #16a: In the structural drawings IND-S1, JAX-S4, and SOS-S1, call for an opening to be made in the existing CMU wall, which is to be later filled with a cast-in-place concrete wall. Would the system be more effective if the existing opening were to be filled with masonry units and not cast in place concrete? Please clarify.
USACE RESPONSE TO QUESTION #16a: We do not believe the system would be more effective. Contractor’s shall bid the project in accordance with the plans and specifications.
QUESTION 16b: The electrical drawings IND-E5, JAX-E5, and SOS-E6 are calling for signage, but there are no specifications or sizes given for these signs. Please provide the specifications or sizes required.
USACE RESPONSE TO QUESTION #16b: Refer to Section 26 20 00, Paragraph
1.3.5 Nameplates for material and fabrication. “Make signs 11" x 14" (nominal) with 1/2" letter height.”
QUESTION #17: On the CGB collector we are replacing a unit supplied by Envirex in 1983 which uses 720S chain with an A45 attachment link. The specifications, for some reason, ask for C110 chain and I don’t understand why if we are replacing in-kind. Also, I don’t know if the C110 chain has an A45 attachment. If it doesn’t then there will be more engineering time to redesign the buckets, etc. to accommodate the C110. Would you please find out if we can use the 720S as was originally used?
USACE RESPONSE TO QUESTION #17: The specifications have been revised to require the #720S chain; the revision is included in the respective Specification Section, which is in this Amendment
QUESTION #18: If there is lead paint, what is the required surface preparation?
Containment, dust collection, wash trailer and decontamination? Or can you hand clean with a wire brush and scraper assuming it will not exceed 30 ppm?
USACE RESPONSE TO QUESTION #18: We suspect the presence of lead paint.
Please refer to Specification Section 09 97 02 "Painting Hydraulic Steel Structures" and to Specification Section 01 11 00 paragraph 1.8.1 "Lead Paint Precaution". Paragraph 1.8.1 of Specification Section 01 11 00 requires the Contractor to develop a comprehensive lead protection program if lead is present.
