About this file

This is a Questions and Answers document addressing industry inquiries regarding a federal contract solicitation involving bulk liquid oxygen (bulk-LOX) supply.

The document clarifies two key points: First, prime offerors may utilize a committed producer, distributor, subcontractor, or other supply source to demonstrate technical acceptability through their production/fleet capabilities and relevant bulk-LOX past performance, provided the prime offeror has executed a signed letter of intent with the proposed source. Second, regarding past performance documentation requirements, the government references corrected verbiage in Section L of the solicitation to resolve an apparent conflict between Section L's statement that offerors are not required to submit past-performance documentation (as the government will obtain this independently) and Section 10 of the Statement of Work's requirement for one to three relevant references to be included with the quotation.

Questions from Industry/ Answers from Government

1. Section 10 of the SOW permits an oƯeror to use a committed producer, distributor, subcontractor, or other supply source. If the prime oƯeror uses such a source, may that proposed source's production/fleet capabilities and relevant bulk-LOX past performance be used to demonstrate technical acceptability?

Yes, as along as the prime oƯer has a signed letter of intent with the proposed source.

Basically, if the prime contractor wants to use past performance of a subcontractor/supplier, they need to have a signed letter of intent with the supplier in order for the past performance to be eligible.

2. Section L states that oƯerors are not required to submit past-performance documentation or references because the Government will obtain that information independently, while Section 10 of the SOW requires one to three relevant references.

Please confirm whether those references must be included with the quotation.

See corrected verbiage in Section L.
