The work includes underwater excavation, mass concrete placement, installation of underlayer, armor and cover stones. The period of performance is 318 days for base work and an additional 26 days for optional work, though a waiver is being requested to allow work into fall 2021 and 2022. AMENDMENT NO. 4

VERMILION, OHIO

VERMILION HARBOR EAST PIER REPAIR

UPDATED PLAN AND

SPECIFICATIONS

16 SEPTEMBER 2020

QUESTIONS/ANSWERS FROM 20‐AUG‐2020 PRE‐BID MEETING:

Question #1 Spec section 01 35 13 1.2.1 says 318 days for Base work and 344 days for Option work. If NTP is 10‐5‐20 then with fish windows and optional no work periods, start is 7‐1‐21. The base work number of days does not appear to give you the full work season next year from 7‐1‐21 to 9‐15‐21 to even do the base. The option work is roughly 3 times longer than the base work along the wall.

a. Is the option work an additional 344 days beyond the first 318 days or is that from NTP which would only be an additional 26 days?

b. Can the government re‐evaluate the project calendar for the base period and option to extend this project into two or more work seasons (7‐1 to 9‐ 15 based on the fish windows and optional work periods)?

c. Can the government request a waiver for this project for at least the fall fish window which starts 9‐15 each season, so the work calendar can extend into the fall in 2021 and 2022?

Response a. Days are from Notice to Proceed. Complete the option work in 26 additional days.

b. In section 01 35 13, para. 1.2.1. Item ‘c’ is deleted. The first sentence in Item ‘d’ is changed to read as follows: “The time to complete the work includes a no in‐water work period from the date of the NTP to, and including, 30 June 2021.”

c. The Government is currently in the process of requesting a waiver.

Approval of the waiver is not guaranteed, and all bidders should plan accordingly.

Question #2 Section 01 35 13 1.2.1 Commencement and Schedule. The schedule is very aggressive. Basically, there are 49 days between July 1 August 19 for the base bid and an additional 27 days for all the optional work. Section e says that all work must be completed by September 15, 2021.

a. Question: After September 15th, what is the next available work window?

b. Would liquidated damages be charged through the State of Ohio shut down and subsequently through the winter?

Response a. In accordance with Section 01 35 13 para. 1.2.1(e), all work must be completed no later than 15 September 2021.

b. Liquidated Damages are charged in accordance with FAR 52.211‐12, Liquidated Damages—Construction, when the contracting officer determines that liquidated damages are appropriate for late performance per the contract requirements.

Question #3 Section 03 30 53 3. 1.b Photos of exposed bedrock. Lake Erie and the Vermillion River waters can be clouded with turbidity. Taking photos with suitable clarity maybe difficult.

a. Question: What are the government parameters for photo quality and water clarity?

b. What if the contractor is delayed getting photos because of poor water clarity?

c. How will the contractor be compensated?

Response a. Requirements for the photographs are as described in Section 03 30 53 3.1 to ensure proper surface preparation prior to placement of concrete. A new subparagraph ‘d’ has been added as follows:

“d. If water turbidity precludes obtaining photos or videos with suitable clarity to verify exposed bedrock, the Contractor may propose an alternative method (at no additional expense to the Government) to demonstrate that the surface of the bedrock is acceptable for placement of the mass concrete for Government approval.”

b. The Government will evaluate the photographs. Contractors may propose an alternate method for providing proof that excavation to bedrock was completed.

c. The Government will treat this in the same manner as with any other delay.

All factors of the delay will be used to determine what, if any, compensation will be used.

Question #4 Section 03 30 53 3. 3.1 c. Photos of exposed bedrock. The government has 3 business days to review photos of exposed bedrock prior to placing mass concrete.

The Vermillion River and Lake Erie are both capable of depositing sediments onto a cleaned surface, so time will be of the essence to take advantage of these cleaning activities.

a. Question: Can the time period to review the photos be shortened to reduce the potential for rework is diminished?

b. Also, if the government is tardy with such a decision, and siltation occurs, would that be a change of conditions?

Response a. No.

b. Change of conditions will be governed by FAR 52.243‐4 and any other applicable FAR clauses.

Question #5 Section 3.4 f. Placement of precast blocks. After the govt has accepted the placement of all precast blocks, grout placement can begin.

Question: Do all the blocks need to be poured at the same time, or can incremental quantities be set and approved for grout placement?

Response Section 03 30 53, para 3.4 f. – The item has been changed to read as follows: “After the Government has accepted the placement of any precast blocks, grout placement may begin for those blocks.”

Question #6 Section 31 00 00 Project Survey. If each of the areas required to be surveyed are completed in short sections, will the pay item be used for each incremental survey?

Response Section 01 22 00, para. 1.4.1.1 states that payment will be made for a ‘single survey’ for each type of survey listed. If any of the surveys are performed in short sections (increments), there will be only a single payment for that type of survey.

Question #7 Section 31 32 23 3.1.1 Tolerances for Placing Stone. The existing Cut Stone is shown on the 1960’s repair indicates the size was 3 ton or greater. A 2 x 2 layer of Cut Stones will likely exceed the placement tolerances. Question: Can the placement tolerances for Cut Stone and Armor Stone be widened?

Response Tolerances have been adjusted and are addressed later in this amendment.

Question #8 Section 31 32 23, 3.1.2 b Disposal of materials. The contractor is to dispose of all materials not used, off site, at a location that may legally accept the material.

a. Question: Will the Corps sign a manifest for each load as the generator of the waste?

b. Should the contractor assume the materials to be non-contaminated?

c. If they are found to be contaminated, would that be a change of conditions?

Response a. The Government will sign when it is legally appropriate to do so.

b. The Contractor is responsible to sort excavated material and properly dispose of any waste or contaminated material that may be encountered.

Since any excavated sediment, sand, and soil material is required to remain onsite, there should be little risk with contaminated stone or other materials that may be excess and require offsite disposal.

c. Change of conditions will be governed by FAR 52.243‐4 and any other applicable FAR clauses.

Question #9 Drawing C-301 Cross Sections. There is a note on sections 1+81 & 2+00 regarding excavation to stable slope.

a. Question: Would the pay quantity be applied to all material removed to the stable slope?

b. Also, would siltation of material which may refill an excavated area be a payable quantity?

Response a. Yes, but only what is required to meet the contract requirements.

b. Any siltation caused by not completing the work in a timely manner is the responsibility of the Contractor and no payment will be made for the removal of that material.

Question #10 Drawing C-301 Cross Sections. There is a note to backfill with excavated material after stone placement. Question: If excavated materials are stored elsewhere, can they legally be re-introduced back into the water as backfill?

Response Yes, in accordance with project environmental requirements. Placement of excavated material is addressed later in this amendment.
