RESPONSES TO CONTRACTOR QUESTIONS QUESTIONS ON W912P420B0013

GREAT SODUS BREAKWATER REPAIR.

24 June 2020

1. Please provide prevailing wage rates for upland work, which would include clearing, material handling, and construction of shoreline protection not staged from a barge.

Answer: The Government does not believe this Wage Determination is limited to Barge work and no other Wage Determination is needed.

2. Please confirm USACE has secured required permissions from private and public stakeholders for all contract work and related operations within the work limits shown.

Answer: Real Estate has certified the lands needed for the project area. Our Chief of Real Estate for the Great Lakes has signed the 3rd BCOES back check approving the real estate certification.

3. Is silt fence required for upland work (clearing, removals, stone fill, etc.)?

Answer: USACE did not require the use of a silt fence. The use of a silt fence may still be required by NYSDEC as a condition of the 401 Water Quality Cert.

4. As it relates to the two bid schedules, what dates does USACE currently plan to AWARD CONTRACT and issue NOTICE TO PROCEED?

Answer: Based on the current project schedule:

CONTRACT AWARD: 15 JUL 2020

NOTICE TO PROCEED: 29 JUL 20

5. Will USACE have full-time Quality Assurance on-site able to review and attest to the work in progress including dimensions, elevations, weights, etc.?

Answer: USACE will not be on site full time and will not provide approval based off of field measurements. Approval will come from the submitted survey information that is required by the contract.

a. Related to (5) above, Please clarify what as-built documentation is required and who will certify that documentation (Contractor?, USACE?, Third-party PLS?, other?)

Answer: Section 01 57 19 defines what submittals, and their content, are required from the Contractor for approval by the Government.

6. This project has a significant upland component in terms of receiving and transferring stone from shore to the material barges to take out to the point. Has USACE made any arrangement for contractor laydown and staging within the vicinity of the project either on public or private lands?

RESPONSES TO CONTRACTOR QUESTIONS QUESTIONS ON W912P420B0013

GREAT SODUS BREAKWATER REPAIR.

Answer: . USACE did not acquire an upland staging area for the contractor to use. The need of an upland staging area was not identified during the BCOES process. If the contractor chooses to acquire a staging area for the project, they are to refer to the specs section 1.4.1 "Additional Real Estate Rights" which states the following:

"1.4.1 Additional Real Estate Rights If additional real estate agreements, real estate rights, or both, are desired by the Contractor for staging areas for the purposes of the project, the Contractor may obtain and utilize such agreements at no cost to the Government. Within all agreements, clearly relieve the Government of any potential responsibility for damages or liability resulting from the Contractor’s use of such grounds. The Contractor must conform to Federal Requirements of Real Estate, Environmental, and others which may be applicable. The submission does not relieve the contractor from ensuring conformance with permits and responsibilities clause."

7. Will USACE be issuing a sales tax exemption for project materials?

Answer: The US Government does not provide these forms for projects.

The Pre-bid was held 15 June, 2020. The Pre-bid was attended by Travis Lake and Mike Russell of Great Lakes Dock and Materials, Dan Ryder of Bidco Marine Group, Paul Luedtke of Luedtke Engineering.
