The contractor shall remove and replace the wide-flange beam and various structural components in the following proposed order. Prior to the start of work, the government and contractor will agree on the order work shall be completed:

1) The government will operate the gate into the opened or recessed position. From here, the contractor can enter a pit to access the work area, or work can be done via a barge and scaffolding from the water. Confined space entry permits are required to access the gate pocket. Air monitoring is required if hot work is performed as oxygen levels may diminish.

2) The contractor shall secure the gate in the opened position via anchors in the top of the concrete wall and come-alongs attached to the gate. The contractor shall coordinate with the government to establish two separate anchor points. Each anchor point shall be capable of supporting a minimum 4 tons of force.

3) Remove the single section of timber fender and steel channel on the outside (water side) of the gate. The channel is welded to the gate. Set aside as the channel and fender shall be replaced later.

4) Block the 8” diameter hydraulic cylinder in the rear under the house. This will prevent damage to the cylinder and the clevis from rising when it is disconnected in the next step.

5) Disconnect the twelve (12) 7/8” diameter rods which secure the clevis to the wide flange beam. Four (4) of these rods penetrate through the outer bulkhead plate. Discard bolts.

6) Coordinate with the government to fully retract the cylinder, pulling it away from the W14x90 beam. The contractor shall expect only a fraction of an inch of retraction. The cylinder cannot be moved from here unless the body is unbolted, hydraulic lines disconnected, and physically moved back. Retain the steel shim plate for reuse.

7) On the outside or water side of the gate, there is a large plate known as the bulkhead plate. The bulkhead plate is approximately 8’ 8 ½” x 3’ 10 3/8”, and there are two layers of it, along with a filler plate between the inside layer and the beam. At each side of the bulkhead plate to be removed, there are 10” wide vertical plates to be removed which secures the bulkhead plate. At the pivoting side of the gate, there are two layers of plates. The outer plate is a 10” x 1” plate, which can be removed and set aside for later reuse. The inner plate is 10” x 5/8” and runs the full height of the gate. The plate shall be cut just below where the bulkhead plate to be removed is. The top of the 10” plate shall then be unbolted from the gate and disposed of, while the lower section of this plate shall remain. There is a variety of solid rivets and bolts which shall be removed. Retain the other 10” x 1” vertical plate as it shall be reinstalled later. Dispose of the removed rivets and bolts, as longer ones will be required later.

8) Remove the rivets on the angles at the top and bottom of the bulkhead plate. These angles will be replaced with new angles, of an equal size, galvanized A36 steel. Refer to the drawings for angles to be replaced.

9) Remove the W14x90 beam and recycle off-site. Care must be taken not to damage the hydraulic cylinder.

Any damage to government property shall be repaired or replaced by the contractor at the contractor’s expense.

10) In each side of the gate pocket, there are steel plates, known as diaphragm plates. Remove the diaphragm plates and angles as shown in the drawings. Recycle the plates and angles off-site.

11) Drill two (2) new 15/16” holes in both the clevis eye mounting and shim plate. The plate shall be modified in place, as removal of the plate includes removing the pressed-in pin from the bearing inside the clevis eye. One hole will go in each the top and bottom row of bolts. Two (2) new 7/8” bolts will be added later, for a new total of fourteen (14) bolts to secure the plate to the beam.

12) The government will inspect all work and determine if demolition is complete. The new plates and beams shall not be installed until government approval is given.

13) Apply two (2) coats of cold galvanizing compound to any areas where paint has been damaged or surface modified.

14) Insert the two (2) new diaphragm plates onto each side of the beam, including angles. The diaphragm plates are approximately 3’ 11 5/8” x 3’ 5/8” x 3/8”. Bolt the perimeter of each plate to the new angles using 3/4” hex head bolts. Use a direct tension indicating washer and tighten until dye is seen.

15) Insert the new W14x211 beam from the water side of the gate and secure to the vertical angle with 3/4” hex head bolts. Use a direct tension indicating washer and tighten until dye is seen. Verify proper mounting location as the hydraulic cylinder clevis eye mounting plate will later be joined to this. There is some small play allowed in the two axes of the hydraulic cylinder assembly.

16) Insert the bulkhead plate and bolt to the flange of the beam and the angles, using 1” bolts. The bolts shall be installed with 1” tension-indicating washers. Install a structural washer between the tension-indicating and nut or bolt head. Tighten until indicating dye is seen.

17) Install the new 10” x 5/8” vertical plate on the water side of the gate using new bolts, length to be determined by the contractor. Install the existing 10” x 1” plate which was removed and set aside earlier. New A325 bolts are required. The contractor shall determine the length of fasteners required, as there is now extra thickness and a longer length is required than what was removed. Use a direct tension indicating washer and tighten until dye is seen.

18) The government will extend the hydraulic cylinder for the clevis eye mounting plate to meet the beam. Insert the shim plate that was removed earlier. The nuts shall be on the hydraulic cylinder side. Use thread locker on the nuts.

19) Bolt the mounting plate to the beam using 7/8” bolts. Install a 7/8” tension-indicating washer. Install a structural 7/8” washer between the tension-indicating and nut or bolt head. Tighten until indicating dye is seen.

20) The government will perform a joint inspection with the contractor.

21) After inspection acceptance is given, reinstall the timber fender and steel channel by welding the channel back to the gate.

22) Remove the come-alongs securing the gate.

23) The government will operate the gate and perform a final inspection with the contractor to ensure work meets the contractual requirements.

The contractor shall supply to the government red-lined construction drawings as part of a project closeout submittal.

Payment for this line item will be one lump-sum payment when the final inspection is accepted by the government.

All government structures, grounds, and equipment disturbed by contractor during the performance of work shall be returned to a pre-work condition prior to request of final payment.

Damages to government property that were caused by contractor and/or sub-contractor will be repaired at no expense to the government by the prime contractor.

10 Work Stoppage, Contract Cancellation Actions The Lock Master of Black Rock Lock, PM, or government QA person may issue temporary “Stop Work” notification if they find activities or job site conditions are in violation of Federal, Department of Defense, State or local health, safety and/or environmental standards, laws and regulations. The District Safety Officer (DSO), the DCO, and the PM shall be contacted immediately after a Stop Work notification order is issued or rescinded. Violation of health, safety or environmental regulations committed by the contractor shall not be grounds for compensation by the government to the contractor. Refer to contractual documents provided by the District Contracting Office regarding additional work stoppage and/or contract cancellation actions.

11 Material Change Orders Once equipment and materials are approved and accepted by the government, the contractor shall not substitute equipment or materials without providing a detailed explanation for the substitution. Changes in materials will require full justification and approval from the DCO. Modifications to contractual documents must be reviewed by the contractor, government QA person and PM, and approved by the government’s DCO. Requests for modifications must be in writing explaining the reasons for the modification, detailed description of the modification and what the benefits are and an estimated cost broken down by materials, labor and equipment.

12 Liquidated Damages Liquidated damages of $950 per calendar day will be assessed if the work is not completed within the time period described in Section 6.2 of this Statement of Work. Liquidated damages shall be assessed beginning the day following the end of the initial period.

13 Inspection/Testing

13.1 Pre-Final/Final Inspection

Upon completion of the work, the government will perform a pre-final inspection to verify that the project is complete. A government pre-final punch list may be developed as a result of this inspection. If contractual requirements are not met, this list shall be provided to the DCO, who will bring them to the attention of the contractor.

The contractor’s QC supervisor shall ensure that all items on this list have been corrected in a timely manner before notifying the government, so that a final inspection with the government and contractor can be scheduled. The contractor’s QC supervisor, PM, DCO representative, and QA person shall be in attendance at the final acceptance inspection.

14 Completion The contract will not be deemed fulfilled until all submittals, products, services, equipment, material, installation, construction work, and final inspection is provided by the contractor under the terms of the contractual documents and found satisfactory to the DCO.

15 Payment The project will be paid for on a lump sum basis, the price for which includes all labor, materials, equipment, mobilization/demobilization, disposal, and other costs required to complete the work. Partial payment(s) may be made; this will be discussed at the pre-construction meeting.

16 Safety

Refer to Attachment #4 for government safety requirements.

17 Security

17.1 Access and General Protection/Security Policy and Procedures All contractor and all associated sub-contractors employees shall comply with applicable installation, facility and area commander installation/facility access and local security policies and procedures, which will be provided by a government representative. The contractor shall also provide all information required for background checks or background investigation and to meet installation/facility access requirements to be accomplished by the Army Corps of Engineers (USACE) Buffalo District Emergency Management Office. Contractor workforce must comply with all personal identity verification requirements as directed by the Department of Defense (DOD), Headquarters Department of the Army (HQDA) and/or USACE Buffalo District policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) at any installation or facility change, the government may require changes in contractor security matters or processes.

17.1.1 Candidate Pre-Screening

The contractor must pre-screen candidates using the E-verify Program (http://www.uscis.gov/e-verify) website to meet the established employment eligibility requirements. The vendor must ensure that the candidate has two valid forms of government issued identification prior to enrollment to ensure the correct information is entered into the E-verify system. An initial list of verified/eligible candidates must be provided to the COR no later than 3 business days after the initial contract award.

17.1.2 Background Investigation

Complete name, social security number, driver’s license number, date of birth, place of birth, and current address of residence. This information is mandatory before any workers will be allowed to enter the facility. The contractor shall allow up to twenty-one (21) days from time of receipt for government completion of background checks. Work may not begin until government clearance of employees is given to the prime contractor.

17.1.3 Access Badge

In order to grant access to the Buffalo District Reservation and Black Rock Lock, all employees will be required to turnover a valid photo ID on a daily basis to the security guard. Employees shall be given a visitor badge which shall be worn at all times on the premises. The photo ID will be returned once the employee leaves the premises.

17.1.4 Suspicious Activity Reporting Training

The contractor and all associated sub-contractors shall receive a brief/training provided by the PM on the local suspicious activity reporting program. This locally developed training will be used to inform employees of the types of behavior to watch for and instruct employees to report suspicious activity to the project manager, security representative or law enforcement entity. This training shall be completed within 30 calendar days of contract award and within 30 calendar days of new employees commencing performance with the results reported to the PM no later than five calendar days after the completion of the training.

17.2 Start of Work

Contractor shall notify the PM of their planned arrival at the project to start work at least seven (7) calendar days in advance. Contractor shall submit a weekly work schedule thereafter by no later than the Friday before the coming work week.

17.3 Arrival/Departure

Contractor is required to notify the government QA person or Lockmaster of their arrival to and departure from the project site. A similar notification is required if there shall be any deviation or cancellation of a scheduled work day during the life of the project.

17.4 Video/Camera Equipment

Contractor shall not transport or use video or camera equipment while working at Black Rock Lock unless permission to do so is requested through the Lockmaster and approval is granted by the Buffalo District Security Officer.
