FAR 52.212-2 ADDENDUM
Basis for Award
This is a best value source selection conducted in accordance with Federal Acquisition Regulation (FAR) Part 12, Acquisition of Commercial Items, and FAR Part 13.5 Simplified Procedures for Certain Commercial Products and Commercial Services, as supplemented by the Defense Federal Acquisition Regulation Supplement (DFARS), and the Army Federal Acquisition Regulation Supplement (AFARS). Award will be made to a single offeror who is deemed responsible in accordance with the FAR, whose proposal conforms to the solicitation requirements, and whose proposal, judged by an overall assessment of the evaluation criteria and other considerations specified in this solicitation, represents the Lowest Price Technically Acceptable (LPTA) offer.
The Government intends to evaluate proposals and award a contract without discussions with offerors (except clarifications as described in FAR 15.306(a), Clarifications and award without discussions). Therefore, the offeror’s initial proposal should contain the offeror’s best terms from a technical, past performance, and price standpoint. The Government reserves the right to conduct discussions if the Contracting Officer later determines discussions are necessary. In the event that discussions are held, a competitive range determination will be made. If the Contracting Officer determines that the number of proposals that would otherwise be in the competitive range exceeds the number at which an efficient competition can be conducted, the Contracting Officer may limit the number of proposals in the competitive range to the greatest number that will permit an efficient competition among the most highly rated proposals.
Evaluation Criteria.
Proposals will be evaluated under three evaluation factors: Technical, Past Performance, and Price. Proposals will be evaluated for technical and past performance acceptability but will not be ranked using the non-price factors.
Proposals will be evaluated for the lowest evaluated price that is technically acceptable.
Factor 1: Technical
The Government will evaluate how the proposal demonstrates an overall understanding of the technical requirements by evaluating:
-the offeror’s methodology, techniques, and procedures and how they meet the Government’s needs including quality control, minimum licensing qualifications and experience of proposed staff.
-the offeror’s capability of mobilizing to various locations within Texas and beginning work with sufficient staffing to perform IAW the period of performance.
-the offeror has a reliable source and/or supply of mobile medical and dental equipment that enables them to begin operations and sustain operations for the duration of the period of performance.
The Technical factor will receive one of the adjectival ratings defined below. The factor ratings will be used to determine an overall rating for the factor. If the factor receives an Unacceptable rating, the Technical Factor will be rated overall Unacceptable and the offeror’s proposal will not be considered for award.
Technical Acceptable/Unacceptable Ratings Acceptable Proposal meets the requirements of the solicitation.
Unacceptable Proposal does not meet the requirements of the solicitation.
Factor 2: Past Performance
To be eligible for contract award, the Offeror must receive an acceptable past performance rating. The Government will evaluate past performance information to ensure offerors meet the solicitation requirements. Past Performance is assessed at the factor level after evaluating aspects of the offeror’s recent Past Performance and focusing on performance that is relevant to the services being procured under this solicitation. Offerors are cautioned that in conducting the performance confidence assessment, the Government reserves the right to use both the information provided in the offeror’s Past Performance Volume and information obtained from other sources, such as the Past
Performance Information Retrieval System (PPIRS) or similar systems, Defense Contract Management Agency (DCMA) and commercial sources. Offerors are reminded that both independent data and data provided by offerors in their proposals may be used by the Government to evaluate offeror past performance. The overall Past Performance factor rating is a subjective decision based on the whole of all data received.
Each offeror will receive a rating based on the recency, relevancy, and quality of an offeror’s past performance record.
1. Recency Assessment. An assessment of the past performance information will be conducted to determine if it is recent. To be recent, an effort must have been performed during the past 3 years from the date of issuance of this solicitation. Past performance information that fails this condition will not be evaluated and will not affect the overall factor rating.
2. Relevancy Assessment. An assessment of the recent past performance information will be conducted to determine its relevancy. To be relevant, an effort must be similar in nature of work, size, complexity, and magnitude to the solicited effort.
The Past Performance Factor will receive one of the ratings defined below.
Past Performance Acceptable/Unacceptable Ratings Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown.
Unacceptable Based on the offeror’s performance record, the Government does not have a reasonable expectation that the offeror will successfully perform the required effort.
In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown (or neutral) past performance. In the context of acceptability/unacceptability, a neutral rating shall be considered acceptable.
Factor 3: Price
The Government will not score or rate the proposed prices. Evaluation of price will be performed using one or more of the price analysis techniques in FAR 15.404-1. Through these techniques the Government will determine whether prices are fair and reasonable, complete and balanced. The Government may determine that an offer is unacceptable if the proposed prices are significantly unbalanced.
Reasonableness. A price is reasonable if, in its nature and amount, it does not exceed that which would be incurred by a prudent person in the conduct of competitive business.
Completeness/Accuracy. The Government will evaluate whether the offeror’s proposal is in compliance with the pricing instructions detailed in the solicitation.
