Therefore, issuance by the Government of an order in response to a supplier’s quotation does not establish a contract. The order is an offer by the Government to the supplier to buy certain supplies or services upon specified terms and conditions. A contract is established when the supplier accepts the offer.
(b) When appropriate, the contracting officer may ask the supplier to indicate acceptance of an order by notification to the Government, preferably in writing, as defined at 2.101. In other circumstances, the supplier may indicate acceptance by furnishing the supplies or services ordered or by proceeding with the work to the point where substantial performance has occurred.
(c) If the Government issues an order resulting from a quotation, the Government may (by written notice to the supplier, at any time before acceptance occurs) withdraw, amend, or cancel its offer. (See 13.302-4 for procedures on termination or cancellation of purchase orders.)
The following provisions and clauses apply to this acquisition:
ADDENDUM 52.212-2
ADDENDUM TO FAR PROVISION 52.212-2 EVALUATION--COMMERCIAL ITEMS
(OCT 2014)
(a) This competitive Request for Quote (RFQ) will be conducted in accordance with Federal Acquisition Regulation (FAR) Part 12 - Acquisition of Commercial Items, FAR Part 13 - Simplified Acquisition Procedures, FAR Part 15 - Contracting by Negotiation, and FAR Part 15.101-1 - Tradeoff Process.
(b) It is in the best interest of the Government to consider award to other than the lowest priced offeror or other than the highest technically rated offeror. The government intends to award a firm-fixed price contract utilizing the tradeoff process to the offeror whom has been determined as the lowest price technically acceptable or Best Interest to the Government in accordance with FAR 15.101-1. The following factors shall be used to evaluate offers: Price, Technical Capability and Past Performance.
Technical and Past Performance are significantly more important than price.
i. PRICE QUOTE:
Evaluation of price will consider the elements and total of the total price of the contract line items. (CLINS)
ii. TECHNICAL QUOTE:
Will be evaluated as outstanding, good, acceptable, marginal, and unacceptable.
iii. PAST PERFORMANCE QUOTE:
Evaluation of past performance will consider references provided and past performance information obtained from any suitable source, such as ratings from automated past performance data bases (i.e. CPARS, PPIRS), direct local business experience with the offeror, or similar military applicable field experience. Past performance will be rated as Acceptable or Unacceptable.
I. VOLUME I: PRICE QUOTE: The Offeror’s price quote will be as follows:
A. An Offeror’s proposed prices will be determined by elements equaling the total price. The price evaluation will document the completeness and reasonableness of the proposed total price for the offers evaluated. Offerors are specifically advised that under this evaluation method, the Government may determine an offer unacceptable if the prices proposed are materially unbalanced between line items and sub-line items. Prices are materially unbalanced if they are significantly overstated or understated in relation to the actual cost of that work. The price will also be evaluated to determine the Offeror’s understanding of the contract requirements as expressed by the solicitation.
B. The Government will evaluate offers for award purposes by adding the total price for all CLINs to the total price for the basic requirement. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced or unrealistic.
C. The Contracting Officer has determined there is a probability of adequate price competition in this acquisition. Upon examination of the initial offers, the Contracting Officer will review this determination and if, in the Contracting Officer’s opinion, adequate price competition exists, no additional cost/price information will be requested. However, if at any time during this competition the Contracting Officer determines that adequate price competition no longer exists, offerors may be required to submit information to the extent necessary for the Contracting Officer to determine the reasonableness of price.
D. The Government intends to evaluate quotes and make award without discussions (except clarifications as described in FAR 15.306(a)). Therefore, the offeror’s initial quote should contain the offeror’s best terms from a price, technical, and performance, standpoint.
II. VOLUME II: TECHNICAL QUOTE: Technical quotes shall be clear, concise and include sufficient detail for effective evaluation. The detail provided must be sufficient to enable the Government to determine the contractor's technical competence and ability to comply with the contract tasks requirements specified in the PWS.
A. Quality Control Plan: The Government will evaluate the contractor’s quote and how they address all requirements of the Performance Work Statement (PWS) and Service Delivery Summary. The Government will evaluate the proposed methods for identifying, preventing, and correcting defects to ensure non-reoccurrence of defective services.
B. FOD Plan, Para 1.4.1.1: The Government will evaluate the contractor's quote plan on how they shall maintain control the prevention of foreign object damage.
C. Accountability Plan, Para 1.4.1.2: The Government will evaluate the contractor's quote plan on how they shall maintain control of all material items.
Technical Factor Quotes will be evaluated as outstanding, good, acceptable, marginal, and unacceptable.
III. VOLUME III: PAST PERFORMANCE QUOTE: An offeror’s past performance must be both recent and relevant as described below. Past performance will be rated as outstanding, good, acceptable, marginal, and unacceptable.
A. For a past performance to be relevant, the offeror must have provided the services/field experience matching the performance work statement at a minimum listed in the applicable tasks stated in PWS.
B. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance (see FAR 15.305 (a)(2)(iv)). Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable”.
