About this file
This document is a Questions and Answers (Q&A) clarification file for a federal contract solicitation regarding hazardous waste disposal and characterization services.
The solicitation involves two tasks for the U.S. Army Corps of Engineers, Engineer Research and Development Center (ERDC) facility in Warren County, Mississippi. Task 1 is the base requirement for disposal of hazardous, radioactive, and explosive waste materials currently held at the ERDC-EL facility. Task 2 is an optional task involving additional chemical and explosive waste characterization and disposal, with pricing to be determined after sampling is completed post-award. The contractor must identify their own disposal facility or use Waste Control Specialists (WCS) in Andrews, Texas, though alternate facilities are acceptable. For explosive disposal, contractors must identify and price their own disposal location. The base period of performance is one year, though work is expected to complete in less than several months. Per the clarifications, no detailed project schedule is required, though one may be beneficial. Technical proposals should discuss disposal by waste streams rather than individual items. Contractors must address Optional Task 2 with separate pricing; discussion of scalability alone is insufficient. Specialized Services Subcontractors must maintain their own radioactive materials license to perform packaging on-site under NRC authorization. The contractor is responsible for all labor, equipment, materials, supplies, and packaging, though the Government will provide a designated staging area. The Service Contract Act applies with RFO 52.222-41. Resumes detailing required certifications for proposed personnel are required; comprehensive equipment lists are not. The Government cannot provide original assay certificates or procurement records for stock standard materials, as items were acquired over an extensive period. Safety Data Sheets are available only for stock materials, not mixtures. Technical evaluation criteria include eight subfactors: understanding of requirements, waste characterization and handling procedures, technical execution plan, health and safety approach, environmental compliance and regulatory management, quality control and performance assurance, disposal facilities and waste tracking, and risk management and contingency planning, rated as Outstanding, Good, Acceptable, Marginal, or Unacceptable.

Q1. With regard to the transportation and disposal, the requirement for pricing states disposal at WCS, which is in Andrews, TX. It also states treatment needs to be performed at WCS. Is this a specific compliance requirement, or can we propose an alternative to this location?
A1. You may propose an alternative location.
Q2. With regard to the explosive disposal location – is there a specific location you are looking for, or do we have to identify our own location, that is included in our pricing.
A2. You must identify your own location for the explosive disposal.
Q3. With the bid due date moving out a week, in Amendment 1, will the start date of 8/4/26 also move out one week?
A3. Yes, the start dates will slide as needed with edits of the solicitation.
Q4. Please confirm that the government will require Safety Data Sheets (SDS) for all materials to be disposed.
A4. We can provide SDS’s for all stock material, but not for mixtures.
Q5. Have any samples been mixed with any substance that could change their properties, and thus how it would be characterized, packaged, and disposed?
A5. For some samples the properties will be diƯerent. Contractors are expected to characterize, package, and dispose of those items.
Q6. In order to complete a jurisdictional determination, please confirm whether the radioactive materials to be addressed under this scope are currently possessed under a general/specific license(s) issued by the US NRC or State of MS.
A6. Yes. ERDC has NRC licenses for open source, closed source, and gauge sources. EL currently houses open and closed sources.
Q7. Section L does not specify required proposal content, structure, or page limitations for the technical approach discussion. Please clarify the expected level of detail and organization (e.g., does each individual item requiring disposal need to be discussed in detail, or is discussion by the various waste streams suƯicient?).
A7. Discussion by the various waste streams is suƯicient.
Q8. Should Optional Task 2 be addressed within our technical approach description, or is it suƯicient to describe scalability of the approach established for Task 1?
A8. They should address Optional Task 2 and should provide pricing for 2.
Q9. Section M does not clearly define evaluation subfactors for the technical approach.
Please clarify the specific criteria that will be used to evaluate technical proposals (e.g., understanding of requirements, technical methodology, risk mitigation, etc.).
A9.

Does the contractor demonstrate eƯective cradle-to-grave waste accountability?
Q10. Please provide additional clarification on the expected scope of analytical services for unknown or partially characterized waste (e.g., required methods, turnaround expectations, or reporting standards).
A10. Analytics is diƯerent for all samples. Some have analytics from in house Chemistry, or independent labs, some only have user knowledge, some are legacy and we are unsure of the make up.
Q11. An attached spreadsheet is referenced in the solicitation on pages 13 and 27. We did not see a spreadsheet file included with the solicitation document. Please provide.
A11. Please see Attachment 1 Rad Disposal Task 1 List and Attachment 2 Optional Task 2 List.
Q12. The RFP indicates that the project POP will be 1 year. Is a detailed project schedule required as part of our technical approach.
A12. No - not required but it may prove helpful as it is not projected to take the full 12 months to complete.
Q13. Page 93 of the RFP lists “availability of qualified personnel and required equipment” as required for a passing grade on Technical Capability. How do you want that proven in the proposal – e.g., full resumes, a list of trainings, education, certifications, etc., for each proposed personnel. For equipment, do you want comprehensive equipment lists?
A13. Resumes that detail any certifications required. No comprehensive equipment list is required.
Q14. Can the Government provide documentation (e.g., original assay certificates, procurement records, etc.) for stock standard materials and; identify which items remain in their original containers?
A14. No. Items have been acquired over an extensive period of time, so certificates and procurement records are not available.
Q15. For the sealed sources (loose or within devices) that are included in Task 1, Table 2 (e.g., Items 8, 20, etc.) can the Government provide bidders with the most current assay certificates and specifications (e.g., make, model number, serial number, photos, etc.)?
This is to provide the Government with the most cost-effective disposition pathway for sealed radioactive source.
A15.

Q63. Given that Task 2 is a Firm-Fixed-Price option but the waste cannot be fully characterized until sampling is completed post-award, how will the Government handle equitable adjustments if post-award laboratory analysis reveals waste streams that are significantly more hazardous, complex, or expensive to dispose of than the 'similar wastes' estimated in the proposal? Will the Government consider establishing a cost-reimbursable or provisional CLIN for the disposal portion of Task 2 to mitigate this pricing risk?
A63. Task 2 is being solicited as a Firm-Fixed-Price (FFP) option. Offerors should base their pricing on the information provided in the solicitation, including the estimated waste characterization and identified similar waste streams.
If, after award, laboratory analysis identifies waste streams that differ materially from those described in the solicitation and result in disposal requirements beyond the scope of the awarded contract, the contractor may submit supporting documentation for the Government's review. The Government will evaluate any request for an equitable adjustment in accordance with the applicable contract terms and conditions and the Federal Acquisition Regulation (FAR). Submission of such documentation does not guarantee that an equitable adjustment will be approved. The Government is not contemplating the establishment of a cost-reimbursable or provisional CLIN for Task 2 at this time.
Q64. Since original assay certificates or procurement records are unavailable for the stock standard materials, will the Government provide any historical inventory lists, safety data sheets (SDSs), or approximate isotopic/chemical compositions to establish a baseline for safe handling and preliminary profiling prior to on-site characterization?
A64. The Government has provided all known information regarding the stock standard materials in the table included in the solicitation. Original assay certificates, procurement records, historical inventory lists, Safety Data Sheets (SDSs), and additional isotopic or chemical composition information are not available. Offerors shall base their proposals on the information provided in the solicitation. The contractor will be responsible for performing any required sampling, characterization, profiling, and waste management activities necessary to safely manage and dispose of the materials in accordance with the Performance Work Statement (PWS) and all applicable federal, state, and local regulations.
Q65. To ensure compliance with the requirement that the contractor/subcontractor pack under their own radioactive materials license on-site, does the ERDC facility require a formal license reciprocity agreement with the state of Mississippi or the NRC prior to starting work, and is there a designated Government Radiation Safety Officer (RSO) who will coordinate this approval?
A65. The contractor is responsible for obtaining and maintaining all licenses, permits, approvals, and regulatory authorizations necessary to perform the work required under the contract, including any reciprocity requirements applicable to the contractor's radioactive materials license. The contractor shall ensure compliance with all applicable U.S. Nuclear Regulatory Commission (NRC), State of Mississippi, Department of Transportation (DOT), and other federal, state, and local regulatory requirements. The Government will provide reasonable site coordination and access as necessary to support contract performance. A Government representative, including the facility Radiation Safety Officer (RSO), will coordinate site access and radiological controls, as appropriate. However, the Government will not obtain or sponsor regulatory approvals or license reciprocity on behalf of the contractor.
Q66. Is this solicitation subject to the Service Contract Act (SCA)? If so, will the Government provide the applicable Department of Labor (DOL) Wage Determination for Warren County, Mississippi, to ensure all offerors price labor compliantly?
A66. RFO 52.222-41 will apply.
Q67. Will the Government provide any material handling equipment (such as forklifts, cranes, or calibrated scales) or staging facilities for use during the waste consolidation and packaging process, or is the contractor fully responsible for supplying all required equipment?
A67. The Government will provide a designated staging area for the performance of work under this contract. The contractor shall be responsible for furnishing all labor, equipment, tools, materials, supplies, and packaging necessary to safely handle, consolidate, characterize, package, and prepare the waste for transportation and disposal. This includes any material handling equipment required to perform the work, unless otherwise specified in the solicitation.
