A. PROPOSAL REQUIREMENTS, CONTENT, AND FORMAT

The government will not reimburse any costs incurred or associated with preparation and submission of any responses to this solicitation. Oral explanations or instructions to offerors are not binding. Any information given to an offeror which impacts the solicitation and/or offer will be given in the form of a written amendment to the solicitation. Any and all amendments to the solicitation will be issued electronically via www.fbo.gov. It is the offeror’s responsibility to acknowledge any and all amendments in its proposal submission.

Offerors should not modify the terms and conditions of the solicitation in either the technical or price proposal or add conditions or qualifications to their offers. Should an offeror include terms and conditions that conflict with the terms and conditions of the solicitation, that offeror may be determined non-responsive and ineligible for award.

Any questions related to specific terms and conditions contained within the solicitation should be resolved prior to submission of an offer. Notwithstanding the above, the offeror must clearly describe in its price proposal any modifications to the contractual and/or technical terms and conditions of the solicitation contained in its offer.

Use of the words “will”, “shall”, or “must” indicates a mandatory requirement for which failure to comply, at the time and date for submission of proposals, shall result in the offeror’s proposal being disqualified from consideration for award, unless the government elects to initiate discussions with some or all of the offerors, thereby providing a means by which appropriate corrections by the offeror(s) involved can be made. Failure to comply with non-pricing or pricing requirements that are annotated with the words “should” or “may” can result in a lowering of an offeror’s non-pricing ratings, and may have a significant effect upon an offeror being selected for the contract award. Time periods, if stated as a number of days, are calendar days unless otherwise specified.

1. REQUIRED REGISTRATIONS

Failure to provide proof of an active and completed registration in any one of the following databases at the time of proposal submission may determine an offeror’s proposal to be deficient and removed from competition. Offerors with incomplete or expired registrations at the time of proposal submission may not be eligible for award. Information contained within an offeror’s registration must be current and valid. The responsibility of maintaining current information contained in an offeror’s registration rests solely on the offeror.

a. System for Award Management (SAM): http://www.sam.gov/

b. Small Business Administration : www.sba,gov

If an offeror is a joint venture (JV), the JV entity must have a valid registration representing the JV as one business/firm/entity. This is applicable to SAM. The government will not accept separate registrations and licenses for each separate entity representing the JV.

If, at the time of award, an offeror’s registration is no longer active in any one of the databases, the government reserves the right to disqualify the offeror and to award to the next prospective offeror.

2. PROPOSAL CONTENT

Offerors are required to submit proposals with at least the minimum content specified herein. Proposals without the minimum content may be determined non-responsive and removed from the competition. The government will not make assumptions concerning intent, capabilities, or experiences. Clear identification of proposal details shall be the sole responsibility of the offeror. The government may reject incomplete proposals after initial evaluation without further consideration.

All information intended to be evaluated as part of the technical proposal must be submitted within the technical proposal. Do not cross-reference pricing information into the technical proposal or vice versa. Do not include references to material or information not found within its respective volumes. Information submitted in the wrong volumes could lead to an offeror’s proposal being determined unacceptable if materially incomplete in any aspect.

a. COVER PAGE: A cover page shall appear at the beginning of each volume and, at a minimum, shall consist of the following information:

i. Solicitation number

ii. Offeror’s name, physical mailing addresses, telephone number, and email address of the official having the authority to bind the offeror contractually.

iii. Offeror’s DUNS Number, and CAGE Code

b. TABLE OF CONTENTS: A table of contents shall be placed in each volume and shall identify major areas by title, page numbers, and volume location.

i. Factor 1: Technical Capability Subfactor 1-Technical and Management approach: The proposal shall demonstrate its capability to provide a high quality technical and management approach to meet the requirements of the PWS and satisfy the needs outlined for each specific performance objective. The proposal shall include a discussion on how the offeror will perform the technical and contractual requirements of the PWS. The discussion shall address the process for timely incorporation of subcontractor/team member technical, schedule, and financial performance data into the prime’s monthly reports if subcontractors will be used.

The Government will then evaluate the Offeror’s current ability to perform this contract, which will include an examination of its equipment inventory.

Offeror’s shall also provide equipment lists and any other information that will enable the Government to determine the Offeror’s current capability to successfully complete the Scope of Work for this requirement. Failure to provide documentation demonstrating the Offeror’s current ability to perform will result in an “unacceptable” rating for technical capability. (See section J- Attachment 4)

Subfactor 2 Key Personnel/Subcontract Arrangements: The offeror shall propose an organizational structure and staffing concept that demonstrates an effective approach to organize, staff, lead, plan, coordinate, and control resources to meet the requirements of the PWS. The proposal shall discuss organizational business practices and management of subcontractors that will be implemented to facilitate the successful execution of the Government’s requirement. The offeror shall identify any key personnel of the prime vendor and/or any subcontractor key personnel. Provide resumes, background experience and credentials of all key personnel who will provide services to the Government under this contract. Where employees' names are not known, the use of position titles will be acceptable.

Reference FAR clause 52.219-14 -- Limitations on Subcontracting.

Subfactor 3 Experience: The Offeror shall submit a description of contracts performed or awarded in the past three (3) calendar years which are relevant to the efforts required by this solicitation. The description shall include a brief summary of each contract’s scope of work and size of population served. The listed contracts should be limited to experience that involves the type of work included in this solicitation or other experience that is considered by the Offeror to be relevant.

e. VOLUME II, PAST PERFORMANCE PROPOSAL: NOTE: Every contract used as an example of Relevant Experience shall also be submitted as Past Performance.

Past performance refers to the quality of relevant project experience from a client’s perspective. Offerors past performance will be determined relevant or not relevant, and, if deemed relevant, will then be rated as acceptable or unacceptable. The criteria of what is deemed “relevant” can be found in the technical capability evaluation factor.

To demonstrate acceptable past performance, the Offeror shall provide documentation of satisfactory performance (using attachment 03) on past or current contracts of a similar type, size, scope and complexity, performed within the last three (3) years from the date of this solicitation, including references, with names and contact information of the references who can verify such past performance. This does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

The Past Performance Questionnaire (PPQ) included in the solicitation is provided for the offeror or its team members to submit to the client for each project the offeror includes in its proposal for the Past Performance Factor. Ensure correct phone numbers and email addresses are provided for the client point of contact. Completed Past Performance Questionnaires should be submitted with your proposal. If the offeror is unable to obtain a completed PPQ from a client for a project(s) before proposal closing date, the offeror should complete and submit with the proposal the first page of the PPQ, which will provide contract and client information for the respective project(s). Offerors should follow-up with clients/references to ensure timely submittal of questionnaires.

Questionnaires may be submitted directly to the Government’s point of contact, Robert

Jones via email at Robert.J.Jones@usace.army.mil prior to proposal closing date. Offerors shall not incorporate by reference into their proposal PPQs previously submitted for other RFPs. However, this does not preclude the Government from utilizing previously submitted PPQ information in the past performance evaluation.

Also include performance recognition documents received within the last 3 years such as awards, award fee determinations, customer letters of commendation, and any other forms of performance recognition.

The Offerors shall also include a reference list of all the POC's who were sent a questionnaire.

The POC list shall be submitted in PDF form to include the following fields:

Solicitation Number

Offeror Company Name

Contract Number

Customer’s Name (that received your services)

POC last name, first name, and POC Title.

The responsibility to send and track the completion of the Questionnaire rests solely with the Offeror and shall not be delegated to any subcontractors, team contractors, or joint venture partners. If an Offeror has no relevant past performance history, the Offeror must affirmatively state that it possesses no relevant directly related or similar past performance.

The Government wants to ensure timely contract award. To that end, Offerors are encouraged to submit Past Performance information before the solicitation close date to enable the Government to begin contacting references.

New Corporate Entities -- New corporate entities may submit data on prior relevant and recent contracts (within the last 3 calendar years) involving its officers and employees. However, in addition to the other requirements in this section, the Offeror shall discuss in detail the role performed by such persons in the prior contracts cited. Past performance information on work for state and local governments, private sector clients, and subcontractors that are similar to the Government requirement will be evaluated equally with similar federal contracts. Offeror may submit information on key personnel, major subcontractors, and work performed as part of a team or joint venture and other previous reincarnation of its current organization.

Past performance information of key personnel may be provided if the company has limited or no past performance. In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available, the offeror will be evaluated as neutral on Past Performance, provided the offeror supplies a certified statement with their offer that no past performance information is available.

In addition to the above, the Government may review any other sources of information for evaluating past performance. Other sources may include, but are not limited to, past performance information retrieved through the Past Performance Information Retrieval System (PPIRS), including Contractor Performance Assessment Reporting System (CPARS), using all CAGE/DUNS numbers of team members (partnership, joint venture, teaming arrangement, or parent company/subsidiary/affiliate) identified in the offeror’s proposal, inquiries of owner representative(s), Federal Awardee Performance and Integrity Information System (FAPIIS), Electronic Subcontract Reporting System (eSRS), and any other known sources not provided by the offeror. While the Government may elect to consider data from other sources, the burden of providing detailed, current, accurate and complete past performance information rests with the Offeror.

f. VOLUME III, PRICE PROPOSAL: The information required within an offeror’s price proposal is described under Evaluation Factors. Within an offeror’s price proposal, the following must be submitted:
