PART 3 EXECUTION
3.1 GENERAL REQUIREMENTS
Prepare for approval a Project Schedule , as specified herein, pursuant to FAR Clause 52.236-15, SCHEDULE FOR CONSTRUCTION CONTRACTS. Show in the schedule the proposed sequence to perform the work and dates contemplated for starting and completing all schedule activities. The scheduling of the entire project, including the design and construction sequences, is required. The scheduling of construction is the responsibility of the Contractor. Contractor management personnel is to actively participate in its development. Subcontractors and suppliers working on the project are to also contribute in developing and maintaining an accurate Project Schedule. Provide a Schedule that is forward planning and is a project monitoring tool. It should be noted that any construction effecting the overall stability of the levee can not be performed during peak hurricane season (August 1 through October 31).This requirement is specifically applicable to zone 1. The Project Schedule will include as a minimum:
(1) The phasing and construction of stone shore protection, and sodding.
(2) Estimated start and completion dates for each phase.
SECTION 01 32 01.01 45 Page 3
(3) A complete list of plant and equipment to be used for each phase of work.
3.1.1 Sub Title
This contract will be executed in accordance with criteria and general sequence specified herein. The sequence was developed, in part, to return the damaged areas of the Hurricane Flood Protection System in Freeport, Texas and Vicinity to the pre-Hurricane Harvey level of protection prior to the next hurricane event. The project repair construction sequence priority is as follows:
(1) Repairs at Zone 1
(2) Repairs at Zone 2
3.1.2 Approved Project Schedule
The approved Project Schedule will be used to measure the progress of the work and to aid in evaluating time extensions. The Schedule will depict activity durations, be based on the percentage of physical completion, and provide the basis for progress payments. Use ENG Form 2454 or equivalent produced by a scheduling program to depict the Progress Schedule and ensure that the Schedule conforms with the requirements outlined in the FAR 52.236-15 SCHEDULES FOR CONSTRUCTION CONTRACTS.
Schedule will show anticipated earnings per Contract Line Item Number (CLIN) for each pay period, and total earnings per pay period. If the Contractor fails to submit a schedule within the time prescribed, the Contracting Officer may withhold approval of progress payments until the Contractor submits the required Schedule. Once approved, the Contractor may not change the schedule for any reason without permission from the Contracting Officer or the ACO.
3.1.3 Updated Progress Schedule
Provide an updated Progress Schedule on at least a monthly basis and submit this updated Schedule along with the monthly pay request. The Government may request the Contractor to provide the Government with an updated Schedule as a result of a change in order of work, activity sequences, or activity duration prior to the monthly pay request. If, in the opinion of the Contracting Officer, the Contractor falls behind the approved Schedule, the Contractor will take steps necessary to improve its progress including those that may be required by the Contracting Officer, without additional cost to the Government and submit an updated Progress Schedule to the Government. In this circumstance, the Contracting Officer may require the Contractor to increase the number of shifts, overtime operations, days of work, or the amount of construction plant, and to submit for approval supplementary Schedule or Schedules as the Contracting Officer deems necessary to demonstrate how the approved rate of progress will be regained.
3.1.4 Default Terms
Failure of the Contractor to comply with the requirements of the Contract will be grounds for a determination, by the Contracting Officer, that the Contractor is not prosecuting the work with sufficient diligence to ensure completion within the time specified in this Contract. Upon making this determination, the Contracting Officer may terminate the Contractor's right to proceed with the work, or separable parts of it, in accordance
SECTION 01 32 01.01 45 Page 4 with the default terms of the Contract.
3.1.5 Hurricane Season
The approved project schedule should take into consideration Hurricane Season and the impacts it will have on construction. Hurricane season starts June 1 and extends through November 30, with "peak season" starting August 1 extending through October 31. During hurricane season, but not during peak season, construction is perishable on all portions of the system. However, if a storm appears to threaten the region (area that will experience tropical conditions, i.e. depression, storm, and/or hurricane) then a Temporary Flood Protection Plan must be implemented within 96 hours prior to storm making landfall and be completed 48 hours prior to storm making landfall in the region. This plan should ensure the system is restored to preconstruction conditions and/or built to conditions suitable to not alter overall stability of the system and maintain a sufficient level of protection for surrounding areas. The Temporary Flood Protection Plan should be submitted to the Contracting Officer and Government for review.
(AM#5) DELETED During peak season, work will not be allowed on any zones that will effect the overall stability of the system. System features that will effect the overall stability of the system include, but are not limited to, the riverside slopes and berms running along the system along Brazos River. Other features may be worked on during this time frame but careful monitoring of these features and related construction activities will be required.
3.1.5.1 Temporary Flood Protection Plan
A Temporary Flood Protection Plan will be required in order to make modifications to a hurricane flood protection system levee during hurricane season. The plan must clearly delineate the maximum length of levee open to construction at any one time and detail how the length can be secured against flooding within a maximum of 48 hours. It is also mandatory that the Contractor maintain materials and equipment to provide immediate protection of all areas during inclement weather conditions, an impending and approaching tropical system or hurricane, or as directed by the Contracting Officer. The Contractor shall note the type of equipment and materials and all details of emergency procedures and sequences for provided flood protection. During emergency situations the Contractor shall be required to immediately repair, construct, and/or replace all areas for completed flood protection.
After the passing of the the storm event or as directed by the Contracting Officer, the Contractor shall remove all temporary flood protection, and repair or replace any permanent construction damaged by its installation.
No separate measurement or payment will be made for maintaining materials, labor, or equipment as required herein, or for any other cost associated with maintaining readiness to perform flood protection measures as required by the Temporary Flood Protection Plan.
3.2 BASIS FOR PAYMENT AND COST LOADING
The schedule is the basis for determining Contract earnings during each update period and therefore the amount of each progress payment. Lack of an approved Schedule update, or qualified scheduling personnel, will
SECTION 01 32 01.01 45 Page 5 result in the inability of the Contracting Officer to evaluate Contract earned value for the purposes of payment. Failure of the Contractor to provide required information will result in the disapproval of the preliminary, initial, and subsequent Schedule updates. If Schedule revisions are directed by the Contracting Officer and those revisions have not been included in subsequent revisions or updates, the Contracting Officer may hold retainage up to the maximum allowed by this Contract, each payment period, until revisions to the Project Schedule have been made. Activity cost loading shall be reasonable, as determined by the Contracting Officer.
3.3 PROJECT SCHEDULE DETAILED REQUIREMENTS
A computer software system utilized to produce and update the Project Schedule is to be capable of meeting the requirements of this specification. Failure of the Contractor to meet the requirements of this specification will result in the disapproval of the Schedule.
