1.3 PRINCIPAL FEATURES OF WORK

The following principal features are expressed in general terms and in no way shall limit the responsibility of the contractor in performing all work indicated.

The work items for sustainment / restoration, modernization, (S/RM) work for maintenance of building exterior, repair/construction of building exterior, maintenance of building interior, repair /construction of building interior, removal of existing building (demolition work), removal / control of hazardous materials to include asbestos and lead base paint, affected work in removal process, and temporary work; and all other incidental work for above work which are described in Exhibits.

All work to be performed under this contract are listed in the pricing exhibits attached to the solicitation document. The principal features not mentioned in the Exhibits are described in this contract specification. Prices for the items in the Exhibits shall cover all necessary costs to complete the work in accordance with the contract specification and terms of the contract. Payments under this contract will be made for the work actually performed and accepted by the Government.

The indefinite delivery / indefinite quantity (IDIQ) contract projects shall cover the Kanto Plain, including Camp Zama, Sagamihara Family Housing Area, Sagami General Depot, Yokohama North Dock and Akasaka Press Center.

Maintain a management office within commuting distance of Camp Zama, in order to receive requests for joint measurement & task order & other management services related to this contract accomplishment.

Individual jobs will vary in size and scope.

1.4 PERFORMANCE PERIODS

The performance period to complete individual project(s) assigned by each Task Order (TO) shall be established prior to Task Order award. Each performance period will include the time for contractor’s material procurement, mobilization, submission of all necessary material submittals, quality control, on-site work, etc., to complete each project within required performance period. Material submittals include all necessary technical documents such as shop drawings, test reports, work plans, qualifications, and all other requirements described in this contract specification.

1.5 KEY PERSONNEL QUALIFICATIONS

1.5.1 General

The Contractor’s Project Key personnel shall not be assigned duties to any other contracts (excluding the project manager and pass coordinator) without approval from the Contracting Officer. Within five (5) working days after receipt of the Notice to Proceed, the Contractor shall submit in writing to the Contracting Officer an organizational chart, the qualifications and background history of the proposed Key Personnel for approval. The Contracting Officer shall have the explicit right to determine acceptability (or rejection) of the proposed individuals. In addition, the Contractor shall be responsible to replace said individuals upon notification by the Government should performance become inadequate during the contract period. All Key Personnel, with the exception of the Contractor’s Commissioning Coordinator and Pass Coordinator, shall attend the Pre-Construction Conference.

1.5.2 Project Manager

The project manager shall have at least 5 years of experience managing contracts for work comparable to the work being executed under this contract. The Project manager will have the authority to negotiate all aspects of the contract with the Government and shall provide an appointment letter outlining those authorities. The project manager need not be present on the site daily but will attend weekly progress meetings, monthly meetings, and be available on site within 24 hours upon request.

1.5.3 Site Superintendent

The Site Supervisor (Superintendent) shall be a skilled Licensed Architect in accordance with the latest version of “The Building Standard Law of Japan (Kenchiku Kijun Hou)”. A second class Architect is acceptable if allowed by the “The Building Standard Law of Japan” (Kenchiku Kijun Hou)”. The site supervisor (superintendent) shall have the authority to act on behalf of the Contractor to resolve issues that arise on the site. If deemed appropriate by the Contractor, the site Supervisor (superintendent) will have the authority to negotiate aspects of the contract with the Government and if so, the Contractor shall provide an appointment letter outlining those authorities. The Superintendent shall be responsible for all work performed under this contract and shall be responsible for appropriate supervision of that work and shall be available to the Contracting Officer upon request.

1.5.4 English Speaking Representative

At all times during the contract period, the Contractor shall have an employee capable of fluent bilingual speech in the Japanese and English languages at the job site. The bilingual interpreter shall have the capability to receive and issue concise and technical explanation and instructions between the Government representative(s) and Contractor supervisory personnel concerning all aspects of contract administration and construction. Within 5

SECTION 01 11 00 Page 5 days after notice of contract award, the Contractor shall submit in writing to the Contracting Officer the qualifications and background history of the proposed interpreter for approval. The English Speaking Representative shall provide evidence that he/she has a TOEIC score of 760 or higher or is a high school graduate from an English speaking country. The Contractor shall be responsible to replace said individual upon notification by the Government should performance become inadequate during the contract period. The English Speaking representative shall attend the preconstruction conference.

1.5.5 Contractor Quality Control System Manager (CQCSM)

The CQCSM shall meet the requirements stated in Section 01 45 01

QUALITY CONTROL.

1.5.6 Site Safety and Health Officer (SSHO)

The SSHO shall meet the requirements stated in section 01 35 29 (Governmental Safety Requirements).

1.5.7 Written Communication in English

All submittals required under this contract (including but not limited to: safety analysis plan, quality control plan, all correspondence, and all other written communications, documents, drawings, reports, manuals, etc.) shall be written in English or translated into English before being provided to the Government by the contractor.

1.6 SUBSTITUTION

Any material systems specified by JIS equal to United States Standards and these specifications may be used in lieu of the systems specified.

Documentary evidence thereof shall be furnished to the Contracting Officer for approval.

1.7 PERMITS AND RESPONSIBILITIES

1.7.1 Permits and Licenses

In accordance with the Clause 52.236-7, Permits and Responsibilities, the Contractor shall, without additional expense to the Government, be responsible for obtaining any necessary licenses and permits, and for complying with any applicable laws, codes, and regulations, including the requirements of material, prefectural and local Government in Japan, applicable to the performance of the work.

1.7.2 Damage by the Contractor

The Contractor shall be similarly responsible for all damages to persons or property that occurs as a result of his fault or negligence. These damages shall be repaired or replaced by the

Contractor at no cost to the Government. The Contractor shall take proper safety and health precautions to protect all work and workers.

1.7.3 Road Closures

The Contractor shall submit a planned schedule of road closures to the Contracting Officer for proper coordination with the proper base personnel, and shall notify the Contracting Office in writing not less than fifteen (15) calendar days for all road closures, in advance of the intended closure. No road closure will be permitted until the Contractor receives written approval for the Contracting Officer.

1.7.4 Utility Outages

The Contractor shall submit a schedule of planned power outages and utility disruptions to the Contracting Officer with the initial project schedule. Notification of specific power outages and the utility disruptions shall be submitted in writing to the Contracting Officer not less than thirty (30) calendar days in advance of the intended outage. All power outages and utility disruptions will be coordinated with base officials and are subject to base requirements.

No power outages and utility disruptions will be permitted (unless under emergency conditions) until the contractor receives written approval from the Contracting Officer.

1.7.5 Fire Protection System Outage

Provide at least thirty (30) calendar days advance notice of planned utility outages including fire systems. Coordinate with the COR when this requirement of 30 days cannot be met. In each request, specify each utility disconnected, the time and date the service will be deactivated and the anticipated time and date service will be reactivated. Do not disconnect or deactivate any base utility systems without advance COR approval. Fire system disconnection and reactivation requires the coordination with Fire and Emergency Service Division through the COR. No utility outages will be permitted until the contractor has submitted the request form and receives an approval of the COR, and other applicable personnel.

1.7.6 Open Flame and Welding

The Contractor shall submit a request for open flame work permits to the COR and Base Fire Department for approval. The Contractor shall describe the work to be performed to the Fire Department representative at the work site.

The Base Fire Department and Representative of the Contracting Officer shall be notified during hours of 0800 through 0900, Monday through Friday, prior to commencement of open flame work.

Open flame work will not begin without approval of the Contracting Officer (open flame and welding permit) or until the Fire Department arrives at work site if required.

1.7.7 Radiation Safety Requirements

Notwithstanding any other hazardous material used in this contract, radioactive materials or instruments capable of producing ionizing/non-ionizing radiation (with the exception of radioactive material and devices used in accordance with USACE EM 385-1-1 such as nuclear density meters for compaction testing and laboratory equipment with radioactive sources) as well as materials which contain asbestos, mercury or polychlorinated biphenyls, di-isocyanates, lead-based paint are prohibited. The Contracting Officer, upon written request by the Contractor, may consider exceptions to the use of any of the above excluded materials. The contractor shall request approval in writing to the Contracting Officer not less than thirty (30) calendar days in advance of any request for exception. Following Contracting Officer approval of any radiation related exception, the contractor shall coordinate with the COR at least fifteen (15) calendar days in advance to notify the Radiation Safety Officer (RSO) prior to excepted items of radioactive material and devices being brought on base.

1.7.8 Directorate of Public Works (DPW) Excavation Permit

It is the contractor’s responsibility to prepare the Excavation Permit at their own expense. The contractors shall not commence work for any excavation, 300 mm or more in depth at the job site until the DPW Excavation Permit form is submitted to the COR reviewed and approved by the listed DPW organizations, Security Police, Safety, Communications, Commercial Utility Company and Chief of Engineering Division, DPW. Only after the permit is approved and signed by organizations and other agencies listed in the DPW Excavation Permit, may the contractor commence with the excavation work. Without a permit, the excavation work will be stopped, until such the time an approved permit is obtained.

1.7.9 Temporary Protection Plans (Kasetsu Keikaku-sho)

Upon request by the Government the Contractor shall provide appropriate temporary protection measures to protect workers and Government personnel at construction work site during construction, and submit the temporary protection plans to the COR for approval prior to on-site work. The Contractor shall be responsible to minimize the inconvenience and avoid any danger to Government personnel and workers.

1.7.10 Licenses for Heavy Equipment Operators

In the case of using heavy equipment in the Government properties, the Contractor shall provide a copy of the license for heavy equipment to the Safety Office through the COR prior to actual commencement.

1.8 SPECIAL CONTRACT REQUIREMENTS

1.8.1 Availability of Work Site and Working Hours

Normal working hours are Monday-Saturday 0800-1700, excluding U.S.

Federal Holidays. Work at times other than normal working hours may be arranged if coordinated at least five calendar days in advance and if approved by the Contracting Officer.

However, the working days and hours may vary depending on individual project work sites such as hospital, child care center/school, restricted area, etc., and work scopes requiring utility outages, noisy demolition work (such as removal of concrete), physical removal of hazardous materials from occupied space, etc., which may be required to perform after the normal working hours or on weekends (including U.S. holidays).

Considering such factors, working days and hours will be determined by the government. The working conditions will be addressed at each project site visit/survey and jointly be confirmed. At that time, if any adjustment is required by the contractor due to variance to the normal working conditions above, the contractor shall submit the intent to the government. Variance to the normal working conditions including adjustment, if any and as mutually agreed upon, will be incorporated into task order.

If the contractor desires to work other than normal working days and hours for his convenience, the contractor must have approval from the government. If approval is authorized, the contractor should refrain from any work that covers, conceals, or buries any portion of the work requirements. All work done during other than normal working conditions will be readily visible and available for the government inspections the following normal work day. Work performed under other than normal working conditions when required by the contractor will not be entitled to any adjustment to the contract terms.

All work under this contract shall be coordinated through and approved by the COR.

Noise and Vibration: Noise greater than 70 decibels and vibration producing work in occupied buildings shall be done outside of core hours (0700 – 1430) unless written permission is given by the Contracting Officer.

1.8.2 Request for Contractor’s Employee Passes and Vehicle Passes

a. No employee or representative of the Contractor will be admitted to the site of work unless he/she is furnished authorized

SECTION 01 11 00 Page 9 admittance to the site of work by the Contracting Officer.

Refer to USAG-J Regulation 190-13 “Installation Access and Control Procedures”. Prior to the start of on-site work the Contractor shall submit applications for base passes to the Contracting Officer for key employees (project manager, site supervisor, interpreter, pass coordinator, etc) for long term DBIDS passes.

The Contractor will then, through the employment of a Pass Coordinator and with the help of the Resident Office, be responsible for securing sufficient passes for other workers, including subcontractor’s employees and vehicles, required to access the base for the project duration. The contractor shall use the USAG-J Form 1529 “EZ Pass” as the primary means of obtaining passes for all personnel who do not qualify for DBIDS passes. The USAG-J Form 1529 “EZ Pass” One Time / Multiple Access Roster must be complete and submitted to the Provost Marshall Pass & Vehicle Registration Office a minimum of three

(3) U.S. workdays prior to access. The use of the USAG-J “one day” pass (AJ Form 47) Should be avoided, and used only for urgent situations.

Applicants for a “one day” pass may be required to wait for several hours for their pass to be issued. Contractor personnel applying for more than one (1) “one-day” pass within any 15-day period will not be issued multiple one-day passes, and will instead be required to apply for access via the USAG-J Form 1529, and wait three or more days for approval.

b. All contractor vehicles must park within the designated construction site. Due to limited parking, no more than thirty

(30) privately owned, personal use vehicles will be issued base access passes. This limitation does not apply to company owned vehicles.

c. Upon completion of this contract, the Contractor shall return all employee and vehicle passes to the base, and obtain a certification of receipt. Final Payment may be withheld until the Contractor has returned all such passes.

1.8.3 Department of Defense (DOD) Security Policy and Procedures

All contractor and all associated sub-contractor employees shall comply with applicable installation, facility and area commander installation/ facility access and local security policies and procedures. The contractor shall provide all information required for background checks to meet installation access requirements to be accomplished by installation Provost Marshal Office, Director of Emergency Services or Security Office. Contractor workforce must comply with all personal identity verification requirements as directed by DOD, HQ Department of Army and local policy. In addition to the changes otherwise authorized by the changes clause of this contract, should the Force Protection Condition (FPCON) ant any individual facility or installation change, the Government may require changes in contractor security matters or processes.

1.8.4 Existing Work

In addition to “FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements”:

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.

1.8.5 Meetings

a. Post Award Orientation: A post award orientation (often referred to as a Pre-Construction Conference for Design-Bid- Build contracts or a Pre-Performance Conference for Design- Build contracts) per FAR 42.503 shall be held. The chairperson shall be the Contracting Officer or his/her designee. The chairperson shall be responsible for providing minutes of the meeting.

b. Progress Meetings: For each task order, at the Contracting Officer’s discretion, weekly and monthly progress meetings shall be conducted with the day, time and location to be agreed upon between the Contractor and Contracting Officer. The Contractor’s Project Manager, Superintendent, Interpreter, and Quality Control

Manager shall attend. Representatives from the Government may include, but are not limited to, representatives from the using agency, Directorate of Public Works personnel, Resident Office personnel, and the Japan Engineer District PM. For weekly meetings, the Contractor shall be prepared to provide a schedule showing work completed during the previous week, work currently in progress, and work forecasted for the following week, as well as the status of any construction issues and open action items.

For monthly meetings, the contractor shall provide updates to the project schedule, billing requests, monthly exposure reports, submittal status, waste management records and provide the Monthly

Progress Narrative Report required by FAR 52.0000-4326. The contractor is responsible for providing digital copies of meeting minutes in English within 4 working days of the progress meeting.

c. Red Zone Meeting. A Red Zone meeting shall be conducted at the Contracting Officer’s discretion for task orders with a value in excess of $500,000 or those deemed sufficiently complex by the

Contracting Officer to warrant one. The purpose of the Red Zone meeting is to discuss closeout requirements for the contract and to establish a timeline to get those items completed (see section 01 78 00 - PHASE TURNOVER AND CLOSEOUT SUBMITTALS for typical closeout requirements). The meeting is a good time for the contractor to gain approval on

d. Safety and Quality Control Meetings: Safety and quality control meetings shall be held as needed and determined by the Contractor. See section 01 35 29 (Safety and Occupational Health Requirements) and section 01 45 01 (Quality Control) for specific requirements.

1.9 GUIDANCES AND REFERENCES

Matters that have not been described in Government drawings and/or specifications shall refer to the latest editions of following the Ministry of Land, Infrastructure, Transport and Tourism (MLIT) publications:

1.10 SAFETY REQUIREMENTS

The Contractor’s work shall conform to the requirements of Safety and Health Requirements Manual EM 385-1-1 unless otherwise indicated in this section. Safety submittals shall be in accordance with Section 01 35 29, SAFETY AND OCCUPATIONAL HEALTH REQUIREMENTS. The Contractor shall maintain an accident prevention plan in accordance with Corps of Engineers Safety Manual EM 385-1-1.

1.11 QUALITY CONTROL/CONSTRUCTION INSPECTION

The contractor shall establish and maintain an effective quality control (QC) system in compliance with Section the contract clause entitled Inspection of Construction. The quality control system shall consist of plans, procedures, and organization necessary to provide materials, equipment, workmanship, fabrication, construction and operations, which comply with contract requirements. The system shall cover construction operations

SECTION 01 11 00 Page 12 both onsite and offsite, and shall be keyed to the proposed construction sequence.

1.12 CONSTRUCTION SCHEDULE

The Contractor shall provide a preliminary construction schedule showing proposed actual construction start and completion dates as well as major portions of work within fourteen (14) calendar days after receipt of Notice to Proceed in accordance with contract clause 52.236-15 entitled “SCHEDULES FOR CONSTRUCTION CONTRACTS”. The preliminary construction schedule can be in any format (a bar chart or a Network Analysis are typical formats) as long as it is clearly understandable to the contractor and the Contracting Officer, shows critical items, has sufficient detail to facilitate the work and allow the Contracting Officer to determine accurately the contractor’s progress. In accordance with section 01 32 16, the formal construction schedule showing actual progress compared with scheduled progress shall be submitted no less than 14 calendar days after receipt of Notice to Proceed for all performance periods equal to or greater than 90 calendar days and no less than 5 calendar days after receipt of Notice to Proceed for performance periods less than 90 calendar days. All schedules shall be updated every 30 days throughout the task order performance period.

1.13 CONTRACTOR FURNISHED MATERIAL AND WORKMANSHIP

The Contractor shall furnish all materials necessary for performance of the work of this contract unless otherwise specified. Materials procured shall be new and shall meet any material or equipment specifications and standards listed in the construction specifications.

All materials needed to perform this contract shall be new, of acceptable industrial grade and quality, equal to or better than the manufacturer’s original equipment for equipment being repaired or replaced, and will be compatible with existing materials and systems.

All material and/or equipment provided under this contract shall be free of asbestos, lead in paint and PCB. The Contracting Officer reserves the right to request additional submittal information of any material or equipment being provided under this contract. The Contracting Office shall make the final determination of the acceptability of any Contractor furnished materials provided under this contract.

1.13.1 Certificate against Use of Asbestos-Containing Material

In addition to the submittals required under this Section, the Contractor shall submit a separate “Certificate Against Use of Asbestos- Containing Material” (see attached form) certifying that no ACM was specified as a building material in any construction document for the building, or, to the best of their knowledge, no ACM was used as a building material in the building. The certificate shall be submitted to the Authorized Representative of the Contract Office prior to final inspection of the project.

1.14 AVAILABILITY OF UTILITY SERVICES

Electricity, potable water, and sewage are available for Contractor’s use without charge; however, the Contractor shall be responsible for all temporary connections required, as well as the removal of these

SECTION 01 11 00 Page 13 temporary connections upon completion of the project. The contractor’s plan for temporary connections shall be submitted to the Contracting Officer for approval prior to making any temporary connections.

Cross Connection: Contractor shall be responsible for preventing actual or potential cross connections between potable and non-potable water supply during the construction work. The contractor must notify the COR for use, installation or maintenance of potable water service connection to ensure the following provision:

a. No water service connection will be installed / maintained to / at any premises where actual or potential cross connections to the potable water system may exist, unless such actual or potential cross connections are properly abated or controlled.

b. No connection will be installed or maintained whereby an auxiliary water supply may enter a public water system, unless such auxiliary water supply will have been approved by the COR.

c. No water service connection will be installed / maintained to / at any premises in which the plumbing system, facilities and fixtures have not been constructed and installed using acceptable plumbing practices.

1.15 AVAILABILITY OF SANITARY FACILITIES

No toilet facility is available for Contractor’s use. The Contractor shall provide toilet and sanitation facilities for Contractor personnel in accordance with EM 385-1-1.

1.16 TEMPORARY TELEPHONE

Upon request, the contractor may install in his field office a Government telephone (Class B) for his use, based on his normal submission of a work order to the area communication officer. All expenses generated from, or related to his use of such instrument will be borne by the contractor.

1.17 OCCUPANCY

The facilities/areas will and/or will not be occupied. The contractor shall provide the construction plan and schedule to be coordinated with the COR for all work to be performed.

1.18 REGULATIONS

1.18.1 Fire

The contractor shall comply with all pertinent requirements of the U.S.

Army and USAG-J Regulations 420-90, and ensure compliance by all subcontractors. All temporary wiring at the construction site shall be installed with ground fault protection.

1.18.2 Environmental

All work pertinent to environmental protection such as storm water, hazardous waste, solid waste and lead-based paint shall follow the requirements of

Japan Environmental Governing Standards (JEGS) and Army Technical Manual 38-

410. Per the AR200-1 and the Installation Environmental Management System Implementation Plan (EMSIP) of latest edition, all the contractor personnel are required to complete the Environmental Management System Awareness training prior to commencing operation on any United States Army Garrison Japan facilities. The certificates shall be submitted for review and approved by the Contracting Officer.

1.19 WORK RECORDS

1.19.1 As-Built Drawing

The Government may provide the Contractor current As-Built Drawings (hard copy) to develop new As-Built Drawings reflecting all completed work. A copy of the drawings shall be kept at the work site during construction to show all changes from the original documents generated by modifications and the exact as-built locations, sizes, types of equipment, hidden utilities or other items. Upon completion of the installation and prior to final inspection, the contractor shall submit a copy of draft As-Built drawings and CADD data. The final As-Built CADD drawing files shall be submitted and formatted with the DPW format in DGN or DWG file format.

1.19.2 Photographic Records

The contractor shall furnish the COR with the photographic records of each sequence of work which will be hidden or if it is difficult to examine the condition of work, such as reinforcement for concrete, underground piping system, air duct system above ceiling and etc.

1.20 DISPOSAL OF MATERIAL

Except as specified elsewhere in the contract, all solid waste, residue and scrap generated by the Contractor during the performance of this contract shall be recycled/disposed of at an authorized off-base facility in accordance with the JEGS, DA AR 200-1 (Environmental Protection and Enhancement), DA AR 420-49 (Utility Services) and DA AR 420-1 as well as local laws and regulations. Waste management including collection and transportation of the waste shall be implemented in accordance with such laws and regulations.

1.21 SALVAGE MATERIAL AND EQUIPMENT

Items designated by the contract to be salvaged shall remain the property of the Government.

1.22 CLEAN UP

The Contractor shall at all times keep the work area, including storage areas used by him, tidy and free from accumulation of waste material or rubbish, and prior to completion of the work, remove any rubbish from the premises. All tools, equipment and materials not the property of the Government shall be removed from the premises and properly disposed of off Government property. Upon completion of the work, the Contractor shall notify the Government representative for final inspection and acceptance.

2.1 LIMITATIONS FOR USE OF MATERIALS

The contractor shall submit the memorandum for hazardous material usage that pledges the conformance of the following requirements signed and sealed by the authority of the contractor. The contractor shall be responsible for selecting and determining the materials used for this contract for conformance with this specification. The contractor shall provide the Contracting Officer a hazardous material (HM) inventory and Material Safety Data Sheets (MSDSs in English) prior to such HM being delivered to the job sites.

a. Do not use materials containing greater than 0.1 % asbestos.

b. Do not use materials containing greater than 0.06 % lead by weight in the total nonvolatile content of liquid paint and 0.5 % (5000 ppm) by weight or 1.0 milligram per square centimeter of Paint in Place. Further, do not use materials containing detectable lead, mercury, chromium and cadmium by atomic absorption spectrum (AAS) deemed as Heavy Metal-Based Paint (HMBP).

c. Do not use materials containing chlorpyrifos.

d. Use Formaldehyde Rated of 4-stars for all products.

2.2 INSPECTION AND SAMPLING BY THE GOVERNMENT

The Government reserves the right to inspect all materials to be used in performance of the project and to take samples to examine the contents of asbestos, lead, etc. to measure the compliance with these requirements specified in this specifications. Whenever the Government becomes aware of any noncompliance with these requirements or any condition which poses a serious or imminent danger to the health or safety of the public, Government personnel or workers, the Government will notify the Contractor orally, with written confirmation, and direct immediate initiation of corrective action at the Contractor's sole cost. This notice, when delivered to the Contractor or the Contractor' representative at the work site, is considered sufficient notice of the noncompliance and that corrective action is required. After receiving the notice, the Contractor must immediately take corrective action to replace the noncompliance with materials/equipment complied with the requirements. If the Contractor fails or refuses to promptly take corrective action, the Government may issue an order stopping all or part of the work until satisfactory corrective action has been taken. The Contractor is not entitled to any equitable adjustment of the contract price or extension of the performance schedule on any stop work order issued under this contract.

SMALL PROJECT CONSTRUCTION PROGRESS SCHEDULES

1.1 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for Contractor Quality Control approval. Submit the following in accordance with Section 01 33 00

1.2 ACCEPTANCE

Prior to the start of work, prepare and submit to the Contracting Officer for acceptance a construction schedule in the form of a Bar Chart Schedule in accordance with the terms in Contract Clause "FAR 52.236-15, Schedules for Construction Contracts," except as modified in this contract.

The acceptance of a Baseline Construction Schedule is a condition precedent to:

a. The Contractor starting work on the demolition or construction stage(s) of the contract.

b. Processing Contractor's invoice(s) for construction activities/items of work.

c. Review of any schedule updates.

Submittal of the Baseline Schedule, and subsequent schedule updates, is understood to be the Contractor's certification that the submitted schedule meets all of the requirements of the Contract Documents, represents the Contractor's plan on how the work will be accomplished, and accurately reflects the work that has been accomplished and how it was sequenced (as-built logic).

1.3 SCHEDULE FORMAT

1.3.1 Network Analysis Schedule (NAS)

Use the critical path method (CPM) to schedule and control project activities. Prepare and maintain project schedules using Microsoft Project 2010. Importing data into the scheduling program using data conversion techniques or third party software is cause for rejection of the submitted schedule. Build the schedule as follows:

a. The Project Schedule must show submittals, Government review periods, material/equipment delivery, utility outages, all on-site construction, inspection, testing, and closeout activities.

Government and Contractor on-site work activities must be driven by calendars that reflect Saturdays, Sundays and all Federal Holidays as non-work days.

b. With the exception of the Contract Award and End Contract milestone activities, no activities shall be open-ended; each activity must have predecessor and successor ties. No activity must have open start or open finish (dangling) logic. Minimize redundant logic ties. Once an activity exists on the schedule it must not be deleted or renamed to change the scope of the activity and must not be removed from the schedule logic without approval from the Contracting Officer. While an activity cannot be deleted, where said activity is no longer applicable to the schedule but must remain within the logic stream for historical record, it can be changed to a milestone. Document any such change in the milestone's "Notebook", including a date and explanation for the change. The ID number for a deleted activity must not be re-used for another activity.

c. Each activity must be assigned its appropriate Responsibility

Code indicating responsibility to accomplish the work indicated by the activity, Phase Code and Work Location Code.

d. Date/time constraint(s) and/or lags, other than those required by the contract, are not allowed unless accepted by the Contracting Officer. Include as the last activity in the contract schedule, a milestone activity named "Contract Completion Date".

The Network must have a minimum of 30 construction activities. No on-site construction activity may have durations in excess of 20 working days.

1.3.1.3 Cost Loading Schedules

Assign material, labor and equipment costs to their respective Construction Activities. Material and equipment costs for which payment will be requested in advance of installation must be assigned to their respective procurement activity (i.e. the material/equipment on-site activity). Evenly disperse overhead and profit to each activity over the duration of the project. Cost loading must total to 100 percent of the value of the contract.
