MEMORANDUM FOR THE RECORD 9 August 2019
SUBJECT: Brand Name Justification under the Simplified Acquisition Threshold (SAT) for a refurbished HVAC Compressor
1. FAR 13.106-1(b)(1)(i) stipulates that for purchases not exceeding the SAT Contracting Officers may solicit from one source if it is determined that only one source is reasonably available. The required compressor needs to be of the exact form, fit, and function of the existing compressor, which is identified by its brand name and model number. So, the refurbished unit must be just like the unit it replaces if we are to ensure that it will work reliably and without significant added time and costs associated with adapting a different unit. Further, a different unit will be much more likely to malfunction. The health and safety of the building occupants are compromised until the refurbished unit is installed. Because there are numerous firms that provide such refurbished units, we firmly expect competition. The refurbished Carlyle/Carrier Screwed Rebuilt Compressor Model# 06NW2250S7EAA00 meets the required specifications necessary for successful execution. Again, a solicitation for a refurbished unit of this particular brand and model will foster reasonable competition since there are multiple HVAC rebuilders located throughout the country.
2. It is our intention to ensure that the replacement equipment does not require any additional training, does not detract from a uniform industrial appearance, and is of sufficient quality to hold up to the rigors of heavy use, 24/7 – i.e. 24 hours per day, 7 days per week.
3. The POC for this MFR is Rick Klein at 703-428-7943 or Richard.C.Klein@usace.army.mil
4. Based on the above, it is in the Government’s best interest to limit competition to only brand name providers of the above mentioned refurbished compressor.
