PHASE II SEED PROJECT PROPOSAL
SOLICITATION SECTION
00100
(Phase 2 Seed Project)
BUILDING 2270 RENOVATION AND NEW CONSTRUCTION FOR THE ARMY BAND
Fort Jackson, South Carolina
PROPOSAL SUBMISSION REQUIREMENTS AND
INSTRUCTIONS
A. BASIS FOR AWARD PHASE 2 (Seed Project) The Contracting Officer may award up to 7 (seven) firm fixed-price contracts to the responsible Offeror(s) whose proposal the Source Selection Authority determines conforms to the solicitation, is fair and reasonable, and offers the best value to the Government, considering the non-price factors described herein and price. Non-price factors from Phase 1 and Phase 2 (Seed Project) are all equal in weight. All Non-Price Factors (Phase 1 and 2) when combined are equal to Price. The intent of this solicitation is to obtain the best proposal within the cost limitation. There is no obligation to approach or match the cost limitation in the offer. The Government reserves the right to accept other than the lowest priced offer or to reject all offers.
The Government will not award a contract to an Offeror whose proposal contains a deficiency. The Government will utilize the Best Value Tradeoff Process for Source Selection in accordance with FAR 15.101-1 to determine best value. This process permits tradeoffs among cost or price and non-cost factors. Award will be made to the Offerors proposing the combination most advantageous to the Government based upon an integrated assessment of the proposals received. To receive consideration for award, a rating of no less than “Acceptable” must be achieved for all of the Non-
Price Factors (Phase 1 and 2). The government considers it to be in its best interest to allow award to other than the lowest priced Offeror or other than the highest technically rated Offeror. The perceived benefits of the higher priced proposal shall merit the additional cost, and the rationale for tradeoffs must be documented in the file in accordance with FAR 15.406.
NOTE: ALL NON-PRICE FACTORS FOR PHASE 1 AND PHASE 2 (SEED
PROJECT) ARE EQUAL IN WEIGHT. ALL NON-PRICE FACTORS (PHASE 1
AND 2) WHEN COMBINED ARE APPROXIMATELY EQUAL TO PRICE.
B. PROPOSAL SUBMISSION PHASE 2 (Seed Project)
1. GENERAL INSTRUCTIONS
To assure timely and equitable evaluation of proposals, Offerors must follow the instructions contained herein. Offerors are required to meet all solicitation requirements, including terms and conditions, representations and certifications, and technical requirements, in addition to those identified as evaluation factors. The Offeror shall submit in the proposal all requested information specified in this section of the Request for Proposal (RFP) solicitation at or before the exact time specified.
There will be no public opening of the proposals received as a result of this RFP.
Failure to meet a requirement may result in an offer being ineligible for award. Copies of the RFP are available by INTERNET ACCESS ONLY. All RFP documents will made available for viewing at the Federal Business Opportunities (FBO) website (http://www.fbo.gov). All amendments will be made available for viewing in FBO. It shall be the Offeror’s responsibility to check the website for any amendments.
2. INQUIRIES
Offerors with technical inquiries shall submit their inquiries in writing via “Bidder Inquiry” in ProjNet at www.projnet.org\projnet. The bidder inquiry key is 2J6XE4- CGKAHC. Further, no questions, unless in the government’s interest, will be answered any later than ten business days prior to the stated deadline for offers.
All Offerors are encouraged to register on ProjNet for alerts so as to stay abreast of Q&A’s that are posted in reference to this solicitation. Only self-registered users on ProjNet can submit & review inquiries. To self-register, go to the webpage, click BID tab, select Bidder Inquiry, select agency

Those submitting inquiries will receive a system generated email notification when their inquiry has been processed and answered. It is the Offeror’s responsibility to monitor for inquiries and responses.
3. GENERAL PROPOSAL FORMAT – PHASE 2 (Seed Project)
a. Electronic Proposals. In an effort to reduce paperwork and costs, ALL
PROPOSALS SHALL BE SUBMITTED ELECTRONICALLY. ELECTRONIC
PROPOSAL SUBMISSION IS REQUIRED THROUGH THE FOLLOWING WEB-
BASED FILESHARING SYSTEM: Attunity Repli W eb Managed File Transfer (A- RMFT). The A-RMFT web address (URL) is https://filetransfer.usace.army.mil. See below for instructions on creating an A- RMFT account and how to accomplish the proposal submission process. Electronic submission sent via email or facsimile will not be accepted. Hand carried delivery or USPS/UPS/Fedex delivery of hard copies and/or CD-ROMs is not authorized. It is important that Offerors CAREFULLY follow the RFP instructions below pertaining to account creation, as well as upload / delivery, file organization / file-naming conventions, and file formatting.
b. A-RMFT Account Creation. A-RMFT is accessible at https://filetransfer.usace.army.mil, but Offerors must be invited from an internal USACE user before gaining access to the site. To receive an electronic invitation, Offerors shall notify Contract Specialist Angela Kelly (843.329.8060/ Angela.Kelly@usace.army.mil) via email of their intent to submit a proposal. This must be done NO LATER than seven calendar days prior to proposal due date. At a minimum, the notification shall include the Offeror’s name, CAGE code, DUNS number, and point-of-contact information (email / primary phone) for the individual(s) that will receive the invitation(s). In response, an invitation will be sent for the purpose of A-RMFT account creation. Offerors may specify multiple individuals. IMPORTANT: The invitation will expire after seven calendar days if it is not accepted. Additionally, once the invitation is accepted, user accounts will be set to expire after 7 days. This period can be extended by an additional 7 days if the user is sent another invitation. Be advised that non-USACE A-RMFT users can only deliver to the USACE recipients from whom they received the invitation, or from whom they have otherwise already had an exchange within A-RMFT. Offerors encountering problems with this registration process should contact the Contract Specialist listed above.
c. A-RMFT Proposal Submission Instructions. When completing the transmittal at the A-RMFT website, Offerors shall follow the following instructions:
(i) Addressees. This process is similar to sending an email. You will be asked to enter e-mail addresses for the recipients. For this solicitation, the recipient will be Contract Specialist Angela Kelly (843.329.8060/ Angela.Kelly@usace.army.mil). Be sure to address your A-RMFT message to this recipient. When the upload completes, the specified recipients will be notified.
(ii) Delivery Title (Subject Line). Offerors shall title the A-RMFT delivery
(subject line) as follows, tailoring the highlighted font as appropriate:
“COMPANY NAME PROPOSAL: W912HP-14-R-0012 Multiple Award Task
Order Contract for South Carolina and US Army Corps of Engineers South Atlantic Division (SAD) Region.
(iii) Upload Completion & Delivery Deadline. The non-price proposals
(volume I) are due as specified on the solicitation document (as amended if applicable). The price proposals (volume II) are due on xxxxxxxxxxx at 2:00PM (EDT). The time & date of proposal receipt will be the upload completion / delivery time & date recorded within A-RMFT. Do not assume that electronic communication is instantaneous. Large files (e.g.
10MB or more) will take some time to upload. Also, be advised A-RMFT has a 2GB file size limit per delivery Offerors should time their upload effort with prudence by not waiting until the last few minutes—this will allow for unexpected delays in the transmittal process. If an electronic submission is uploaded minutes before the deadline but the upload doesn’t complete until after the deadline, the submission will be considered late. Offerors are encouraged to keep a copy of the upload confirmation for their record.
(iv) File Organization & Naming Convention. The price proposal volume and the non-price volumes shall be submitted as separate files.
They may be delivered together, but they MUST be submitted as separate single files.
Offerors shall title the file(s) in the following format, tailoring the highlighted font as appropriate:
Volume I - Non-Price: “W912HP-15-R-0007_COMPANY NAME_VOL I NON- PRICE”, Date.
Volume II - Price: “W912HP-15-R-0007_COMPANY NAME_VOL II PRICE”, Date.

If the electronic files are of a size at which they must be compressed (zipped), they shall be compressed into one zipped folder using WinZip version 6.2 or later. Self extracting exe files will not be accepted.
e. Offerors shall prepare proposals in the English language. The proposal shall be typed and neatly organized. All pages shall be numbered. Type pitch shall be 10 pitch or larger.
f. Information presented should be organized so as to pertain to only the evaluation factor in the section that the information is presented. Information pertaining to more than one evaluation factor should be repeated in the each section for each factor.
g. Proposals shall be in a narrative format, organized and titled so that each section of the proposal follows the order and format of the factors set forth below in paragraphs 4 and 5 below
h. Any information, presented in a proposal that the Offeror wants safeguarded from disclosure to other parties must be identified and labeled in accordance with the requirements of Provision “FAR 52.215-1, Instructions to Offerors Competitive Acquisition (Jan 2004),” subparagraph (e), which is found in Section L of the RFP.
The Government will endeavor to honor the restrictions against release requested by Offerors, to the extent permitted under United States law and regulations.
C. EVALUATION APPROACH – PHASE 2 (Seed Project)
All proposals will be evaluated on the factors listed below. Offerors are required to provide data addressing all stated factors in a clear and understandable format. If an Offeror does not have data relating to a specific factor, it shall be clearly stated in the proposal.
Proposals that do not clearly address all factors may be considered unacceptable and may not receive further consideration. A detailed explanation of the criteria for the evaluation is set forth in the “PHASE 2 (Seed Project) FACTORS AND RATINGS,” paragraph D of this section. Evaluators will ensure Offeror’s complied with all submission requirements set forth in the “PROPOSAL SUBMISSION PHASE 2 (Seed Project),” paragraph B of this section. The non-price and price factors are as follows:
NON-PRICE FACTORS: The purpose of the non-price factors is to assess whether the Offeror’s proposal will satisfy the Government’s minimum requirements. A marginal or an unacceptable evaluation for Factors 1 through 5 will result in an overall unacceptable proposal.
Factor 1: Phase 1 CORPORATE SPECIALIZED EXPERIENCE Factor 2: Phase 1 PAST PERFORMANCE Factor 3: Phase 1 ORGANIZATIONAL APPROACH Factor 4: Phase 2 (Seed Project) UNDERSTANDING OF THE WORK Factor 5: Phase 2 (Seed Project) DURATION AND PROJECT
SCHEDULE
PRICE FACTOR: The purpose of the price factor is to ensure a fair and reasonable price. The price factor will be evaluated differently than the non-price factors, and is subject to Contract Pricing policies as set forth in FAR Subpart 15.4.
Factor 6: Phase 2 (Seed Project) PRICE
RELATIVE IMPORTANCE OF EVALUATION FACTORS: In accordance with FAR 15.304(e), all non-price factors for phase 1 (factors 1-3) and phase 2 (factors 4 and 5 for seed project) are equal in weight. All non-price factors from Phase 1 and 2 (Factors 1 through 5) when combined are approximately equal to Price.
Concurrent with or upon completing the evaluation of all non-price proposals, the Contracting Officer will, in accordance with the provisions of this RFP and applicable acquisition regulations, evaluate price. In the event that discussions are determined necessary, the Contracting Officer will conduct discussions with Offerors determined to be within the competitive range. In determining the competitive range, the Government will include analysis of the non-price and price proposals of Offerors.
Upon conclusion of discussions, the Contracting Officer will request final proposal revisions and may, upon receipt of final proposal revisions, proceed to award a contract without further discussions or notice.
D. PHASE 2 (Seed Project) FACTORS AND RATINGS:
1. FACTOR 4 – UNDERSTANDING OF THE WORK:
a. The government will evaluate the Offeror’s understanding of the work on the basis of information presented that demonstrates the offeror’s:
Understanding of the unique site constraints of the building addition.
Narrative should address utilities, topography and relationship to existing building 2270.
Understanding of the unique technical requirements of the building addition as related to UFC 4-171-04AN. Narrative should address major features and acoustical criteria.
Understanding of the unique renovation requirements of building 2270.
Narrative should address the requirements of selective demolition and accommodation of ‘Wenger Sound Modules’.
Understanding of the unique renovation requirements of building 2280.
Narrative should address selective demolition and hazardous materials abatement.
b. Submission Requirements:
i. Narrative: At a minimum, the proposal submission for this factor shall be prepared by the Designer of Record and include a brief narrative that clearly demonstrates an understanding of each requirement; an explanation of the contractor’s approach to the above requirements in paragraph D.1.a.
Provide charts, tables, sketches and maps as needed to make the work approach understandable. The offerors shall provide a conceptual work plan (no more than 10 pages) that describes the work to be accomplished for the project.
ii. Organizational Chart: The chart should identify the key personnel and individuals on the project team that show clear lines of authority, responsibility, and communication between corporate staff, key on-site staff, and subcontractor interface. Offerors should propose a logical flow of authority and demonstrate that assigned responsibilities and experience of proposed on-site personnel will enhance operation of the project.
c. For the Understanding of the Work evaluation, Offerors will be assigned a combined technical/risk rating from the following table, based on the evaluation of the Offeror’s proposal:
NON-PRICE FACTOR COMBINED TECHNICAL/RISK RATINGS
Color Rating Description
Blue Out-standing
Proposal meets requirements and indicates an exceptional approach and understanding of the requirements. Strengths far outweigh any weakness. Risk of unsuccessful performance is very low.
Purple Good Proposal meets requirements and indicates a thorough approach and understanding of the requirements. Proposal contains strengths which outweigh any weaknesses. Risk of unsuccessful performance is low.
Green Accept-able
Proposal meets requirements and indicates an adequate approach and understanding of the requirements. Strengths and weaknesses are offsetting or will have little or no impact on contract performance. Risk of unsuccessful performance is no worse than moderate.
Yellow Marginal Proposal does not clearly meet requirements and has not demonstrated an adequate approach and understanding of the requirements. The proposal has one or more weaknesses which are not offset by strengths. Risk of unsuccessful performance is high.
Red Un-acceptable
Proposal does not meet requirements and contains one or more deficiencies. Proposal is unawardable.
2. FACTOR 5 - DURATION AND PROJECT SCHEDULE:
a. The Government will evaluate the Offeror’s proposed Seed Project duration to ensure it does not exceed the maximum task order duration specified in the RFP.
The Government will also evaluate the Offeror’s Seed Project Schedule to ensure it reflects the proposed task order duration and shall present a sequence of work and reasonable activity durations for working around building systems and components to remain.
b. Submission Requirements:
i. Proposed Seed Project Task Order Duration: The Offeror shall propose the task order duration in the appropriate Contract Line Item Number in the Bidding Schedule, not to exceed the maximum task order duration specified for the initial Seed Project task order.
ii. Project Schedule: Provide a time scaled summary network Project Schedule for the Seed Project for integrated design and construction prepared in a software capable of meeting all requirements of Section 01 32
01.00 10. The Project Schedule shall be clearly labeled as Tab A. This summary schedule will, after contract award, be replaced with a Project Schedule as required by Section 01 32
1.1 10. The project schedule shall be task oriented, indicating the number of calendar days, after notice to proceed, by which milestones are to be achieved. The proposed project schedule shall reflect the proposed task order duration and shall present a sequence of work and reasonable activity durations for working around building systems and components to remain. Specifically address the following items:
(a) Show the design phase, including events associated with coordinating the interim and final submittals for each design stage and package and the proper handling of the review comments for each design submittal (see Section 01 33 16).
(b) ) Offeror must demonstrate the capability and flexibility to plan and schedule the complete project to meet the proposed contract completion period. Clearly identify any constraints on the schedule presented (e.g., labor or material availability, permits, weather, etc.).
(c) Clearly indicate the critical path.
(d) Show turnover of the facility. The time to complete the facility and turnover to the Government must consider the requirement for the Contractor’s CQC completion inspection and the subsequent joint contractor-Government turnover inspections (See Section 01 45 00.00 10)
(e) Show Closeout Submittal activities (See Section 01 78 00).
iii. Project Schedule Narrative: Provide a narrative that explains the Project Schedule within Tab A and do not to exceed 2 (two) typewritten pages. Specifically address the following items:
(a) Describe the design packaging plan for separate design stages and packages.
(b) Describe any construction challenges that the Offeror foresees that may jeopardize the successful completion of all contract work, plans for overcoming these challenges, and how the schedule will be used to manage construction.
(c) Demonstrate the offeror’s understanding of working within a partially renovated building and the management approach to protect the existing building components and systems to remain.
(d) Describe closeout inspections, turnover, and closeout submittal procedures.
c. For the Duration and Project Schedule evaluation, Offerors will be assigned a combined technical/risk rating from the following table, based on the evaluation of the Offeror’s proposal:
E. EVALUATION OF INDIVIDUAL FACTORS
1. PHASE 2 – FACTOR 4 – UNDERSTANDING OF THE WORK
a. Evaluation Criteria:
Narrative: The Offeror’s Understanding or Work Narrative will be evaluated based on the basis of information presented that demonstrates the offeror’s:
Understanding of the unique site constraints of the building addition.
Narrative should address utilities, topography and relationship to existing building 2270.
Understanding of the unique technical requirements of the building addition as related to UFC 4-171-04AN. Narrative should address major features and acoustical criteria.
Understanding of the unique renovation requirements of building 2270. Narrative should address the requirements of selective demolition and accommodation of ‘Wenger Sound Modules’.
Understanding of the unique renovation requirements of building 2280. Narrative should address selective demolition and hazardous materials abatement.
NOTE: The Offeror’s proposal must address all areas described above to be considered Acceptable.
NOTE: The Offeror’s proposal must provide an Organizational Chart that addresses all the requirements above to be considered Acceptable.
2. PHASE 2 – FACTOR 5 - DURATION AND PROJECT SCHEDULE
a. Evaluation Criteria:
Proposed Contract Duration: This duration will become the contractually binding completion period. The Government will evaluate the contract duration, as proposed by the Firm in the Contract Line Item Schedule, not to exceed the maximum allowed duration specified in specification section 00 73 10. In assessing the reasonableness of the proposed contract duration, the Government may take into account how well the proposed summary schedule supports the proposed duration, as well as use other information, such as but not limited to independent judgment concerning logic, constraints and typical construction durations. A proposed contract duration matching the maximum allowed contract duration is “acceptable”.
A proposed contract duration shorter than the maximum allowed duration will receive additional rating consideration, provided it is realistic and deemed to be achievable. The Government will consider an unreasonably condensed contract duration, which places additional cost or schedule risk on the Government or which may create a risk of contract or performance failure, as a significant weakness or a deficiency, depending upon the evaluators' judgment.
During the subsequent comparison between proposals, differences between proposed contract durations of at least three weeks (differences of 21 calendar days between proposals) will be considered an advantage to the Government, with greater differences also considered, accordingly.
No advantage will be considered between proposals for differences less than 21 calendar days.
Summary Schedule: In addition to the proposed contract duration, the Government will evaluate the summary schedule for integrated design and construction. The length of the schedule must match the proposed contract duration. If it is shorter than the proposed contract duration, it offers no advantage to the Government because it is non-binding, only representing a preliminary planned schedule. A Schedule shorter than the proposed contract duration may indicate the Firm is placing additional risk on the Government for any delays between the scheduled completion date and the required contract completion period. Both parties shall assume field overhead costs are included in the contract price for the full proposed contract duration. Therefore, the Government believes that there is no valid need to shorten the schedule less than the full proposed contract duration.
The Government will evaluate the schedule to assess the strength of understanding of the project scope, restrictions which must be considered in the schedule e.g., permitting (see Section 01 10 00), long lead items, etc.
The Government will evaluate the strength of understanding of events associated with coordinating design submittals, reviews and incorporating review comments, the firm's capability to schedule the complete project within the proposed contract duration and the realism of the schedule. The Government will evaluate the design packaging plan for logic, reasonableness, how it facilitates meeting the proposed contract duration and how it facilitates the Government’s ability to timely perform its design reviews. The packaging plan should minimize risk to the Contractor and to the Government for tear-out and coordination for reviews. For example, is the footing and foundation plan based on adequate design for building loads; etc.? A schedule that offers advantage(s) to the Government over one that merely indicates an adequate understanding of the scope, restrictions, major milestones and general understanding of the various events that can affect start and completion of construction will receive additional consideration.
3. PHASE 2 – FACTOR 6 – PRICE
a. Price will not be rated, but will be evaluated for fairness and reasonableness through the use of a price analysis. The price evaluators will also check for appearance of unbalanced line item prices. Offerors are cautioned to distribute direct costs, such as material, labor, equipment, subcontractors, etc. and to evenly distribute indirect costs, such as job overhead, home office overhead, bond, etc., to the appropriate contract line items.
F. DISCUSSIONS.
The source selection process for this procurement is based upon the assumption and the specified intent of the Government to award without discussions. If after receipt of proposals it is subsequently determined discussions are necessary, appropriate steps will be taken and the need for such discussions adequately documented in the contract file in accordance with FAR Part 15.306(a)(3).

52.209-5 CERTIFICATION REGARDING RESPONSIBILITY MATTERS (APR 2010)
(a)(1) The Offeror certifies, to the best of its knowledge and belief, that-
(i) The Offeror and/or any of its Principals-
(A) Are ( ) are not ( ) presently debarred, suspended, proposed for debarment, or declared ineligible for the award of contracts by any Federal agency;
(B) Have ( ) have not ( ), within a three-year period preceding this offer, been convicted of or had a civil judgment rendered against them for: commission of fraud or a criminal offense in connection with obtaining, attempting to obtain, or performing a public (Federal, State, or local) contract or subcontract; violation of Federal or State antitrust statutes relating to the submission of offers; or commission of embezzlement, theft, forgery, bribery, falsification or destruction of records, making false statements, tax evasion, violating Federal criminal tax laws, or receiving stolen property (if offeror checks “have”, the offeror shall also see 52.209-7, if included in this solicitation); and
(C) Are ( ) are not ( ) presently indicted for, or otherwise criminally or civilly charged by a governmental entity with, commission of any of the offenses enumerated in paragraph (a)(1)(i)(B) of this provision.; and
(D) Have , have not , within a three-year period preceding this offer, been notified of any delinquent Federal taxes in an amount that exceeds $3,000 for which the liability remains unsatisfied.
(1) Federal taxes are considered delinquent if both of the following criteria apply:
(i) The tax liability is finally determined. The liability is finally determined if it has been assessed. A liability is not finally determined if there is a pending administrative or judicial challenge. In the case of a judicial challenge to the liability, the liability is not finally determined until all judicial appeal rights have been exhausted.
(ii) The taxpayer is delinquent in making payment. A taxpayer is delinquent if the taxpayer has failed to pay the tax liability when full payment was due and required. A taxpayer is not delinquent in cases where enforced collection action is precluded.
(2) Examples. (i) The taxpayer has received a statutory notice of deficiency, under I.R.C. Sec. 6212, which entitles the taxpayer to seek Tax Court review of a proposed tax deficiency. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek Tax Court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(ii) The IRS has filed a notice of Federal tax lien with respect to an assessed tax liability, and the taxpayer has been issued a notice under I.R.C. Sec. 6320 entitling the taxpayer to request a hearing with the IRS Office of Appeals contesting the lien filing, and to further appeal to the Tax Court if the IRS determines to sustain the lien filing. In the course of the hearing, the taxpayer is entitled to contest the underlying tax liability because the taxpayer has had no prior opportunity to contest the liability. This is not a delinquent tax because it is not a final tax liability. Should the taxpayer seek tax court review, this will not be a final tax liability until the taxpayer has exercised all judicial appeal rights.
(iii) The taxpayer has entered into an installment agreement pursuant to I.R.C. Sec. 6159. The taxpayer is making timely payments and is in full compliance with the agreement terms. The taxpayer is not delinquent because the taxpayer is not currently required to make full payment.
(iv) The taxpayer has filed for bankruptcy protection. The taxpayer is not delinquent because enforced collection action is stayed under 11 U.S.C. 362 (the Bankruptcy Code).
(ii) The Offeror has ( ) has not ( ), within a three-year period preceding this offer, had one or more contracts terminated for default by any Federal agency.
(2) Principal, for the purposes of this certification, means an officer, director, owner, partner, or a person having primary management or supervisory responsibilities within a business entity (e.g., general manager; plant manager;
head of a division or business segment; and similar positions).
(b) The Offeror shall provide immediate written notice to the Contracting Officer if, at any time prior to contract award, the Offeror learns that its certification was erroneous when submitted or has become erroneous by reason of changed circumstances.
(c) A certification that any of the items in paragraph (a) of this provision exists will not necessarily result in withholding of an award under this solicitation. However, the certification will be considered in connection with a determination of the Offeror's responsibility. Failure of the Offeror to furnish a certification or provide such additional information as requested by the Contracting Officer may render the Offeror nonresponsible.
(d) Nothing contained in the foregoing shall be construed to require establishment of a…
