SCOPE OF WORK
The contractor shall supply, deliver, and install a new 24’ by 30’ log pavilion, concrete slab, sidewalks, and electrical utilities in the same location as the existing pavilion. The job also includes the removal and disposal of the existing old log pavilion, slab and sidewalks at the US Army Corps of Engineers’ Pokegama Recreation Area located at 34385 US Highway 2 West, Grand Rapids, MN 55744.
1. Removal of Existing Pavilion, Concrete Slab and Sidewalks: The Contractor shall remove and dispose of the existing 22’ by 30’ log pavilion structure, concrete slab, and sidewalks – photos 1-3 below. Care shall be taken by the Contractor to not destroy the root systems of the trees near the building site.
2. Disposal of Existing Pavilion, Slab and Sidewalks: The Contractor shall dispose of all materials and debris from the existing pavilion structure, concrete slab, and sidewalks off-site in an approved disposal site according to all local, County and State disposal codes.
3. Compacted Fill: The Contractor shall remove any roots or debris in the footprint of the new slab and sidewalks and provide a 12” layer of clean, compacted fill for the new slab and a 6” layer of clean, compacted fill for the sidewalks.
4. New Concrete Slab: The Contractor shall pour a 24’ wide by 30’ long by 6” thick reinforced concrete slab with frost footings for the new log pavilion in the same footprint as the existing pavilion. The concrete slab shall be constructed according to the recommendations provided by the log pavilion manufacturer and shall not be any higher than 4” above the grade of the ground when finished. The concrete slab shall also meet all local, County and State building codes.
5. New Sidewalks: The Contractor shall pour a new 5’ wide by 36’ long by 4” thick reinforced concrete sidewalks with 36” radius on both ends between the asphalt parking lot and the concrete pavilion slab. The sidewalks shall be centered on the gable end of the pavilion slab. The sidewalks shall have a smooth finished surface with expansion joints approximately every 5’ and meet ADA Accessibility Standards.
6. New Log Pavilion: The Contractor shall supply and install a new ROMTEC Model 3001 log pavilion or similar structure (see Photo 4 below) with the following specifications:
• Size 24’ wide by 30’ long log pavilion
• Minimum height from the bottom of the purlin to the slab is 9’
• Roof pitch 4/12 or steeper
• Metal roof with matching metal facia, trim and fasteners
• Roof/trim color: Hunter Green
• Roof decking 2“ X 6” Tongue and Groove
• Minimum overhang 12” on the roof gable and eve ends
• Average log diameter 10”
• All Log support structures
• Logs, roof decking and wood trim stain color: Proluxe Sikkens Cetol Log Stain: (078) Natural or similar color. The Contractor shall submit color samples to the COR for approval prior to application.
7. Pavilion Electrical: The existing pavilion has 100 Amp electric service. The Contractor shall install a new 100 AMP 8 circuit weatherproof electric panel on the corner support log pillar of the new pavilion. All electrical work must meet the National Electric code requirements for Itasca County Minnesota. The pavilion shall have the following electrical services:
• Four GFCI 20 AMP weatherproof outlet, one on each corner post
• Two LED outdoor lights centered in the peak
8. Contractor Clean-up: The Contractor shall clean-up the area of debris and construction materials from the project leaving the construction site in the same condition as it was prior to the beginning of construction.
9. Landscaping: The Contractor shall use black dirt, seed, and mulch to restore the disturbed areas.
10. Electric Locate: The Contractor is responsible to locate and mark all electrical and water lines prior to the beginning of work in the construction area.
11. Security: The Contractor is responsible for installing 4’ security fencing around the entire work zone. The Pokegama Recreation Area is a highly utilized public recreation area receiving over 100,000 vehicle visits per year.
The area shall remain open during demolition and re-construction efforts and the contractor shall not block roads or public access to areas outside of the work zone.

SUBMITTAL INSTRUCTIONS
This solicitation is a Request for Quotes (RFQ), which should result in one firm fixed price contract. This solicitation is not an invitation for bids (IFB) or request for proposals (RFP).

52.222-23 NOTICE OF REQUIREMENT FOR AFFIRMATIVE ACTION TO ENSURE EQUAL
EMPLOYMENT OPPORTUNITY FOR CONSTRUCTION (FEB 1999)
(a) The offeror's attention is called to the Equal Opportunity clause and the Affirmative Action Compliance Requirements for Construction clause of this solicitation.
(b) The goals for minority and female participation, expressed in percentage terms for the Contractor's aggregate workforce in each trade on all construction work in the covered area, are as follows:

These goals are applicable to all the Contractor's construction work performed in the covered area. 52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984) -
ALTERNATE I (APR 1984)
The Contractor shall be required to (a) commence work under this contract within 10 calendar days after the date the Contractor receives the notice to proceed, (b) prosecute the work diligently, and (c) complete the entire work ready for use not later than .June 1, 2022. The time stated for completion shall include final cleanup of the premises.
The completion date is based on the assumption that the successful offeror will receive the notice to proceed by October 30, 2021. The completion date will be extended by the number of calendar days after the above date that the Contractor receives the notice to proceed, except to the extent that the delay in issuance of the notice to proceed results from the failure of the Contractor to execute the contract and give the required performance and payment bonds within the time specified in the offer.

52.219-28 POST-AWARD SMALL BUSINESS PROGRAM REREPRESENTATION (NOV 2020)
(a) Definitions. As used in this clause--
Long-term contract means a contract of more than five years in duration, including options. However, the term does not include contracts that exceed five years in duration because the period of performance has been extended for a cumulative period not to exceed six months under the clause at 52.217-8, Option to Extend Services, or other appropriate authority.
Small business concern--
(1) Means a concern, including its affiliates, that is independently owned and operated, not dominant in the field of operation in which it is bidding on Government contracts, and qualified as a small business under the criteria in 13 CFR part 121 and the size standard in paragraph (d) of this clause. Such a concern is "not dominant in its field of operation" when it does not exercise a controlling or major influence on a national basis in a kind of business activity in which a number of business concerns are primarily engaged. In determining whether dominance exists, consideration shall be given to all appropriate factors, including volume of business, number of employees, financial resources, competitive status or position, ownership or control of materials, processes, patents, license agreements, facilities, sales territory, and nature of business activity.
(2) Affiliates, as used in this definition, means business concerns, one of whom directly or indirectly controls or has the power to control the others, or a third party or parties control or have the power to control the others. In determining whether affiliation exists, consideration is given to all appropriate factors including common ownership, common management, and contractual relationships. SBA determines affiliation based on the factors set forth at 13
CFR 121.103.
(b) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, upon occurrence of any of the following:
(1) Within 30 days after execution of a novation agreement or within 30 days after modification of the contract to include this clause, if the novation agreement was executed prior to inclusion of this clause in the contract.
(2) Within 30 days after a merger or acquisition that does not require a novation or within 30 days after modification of the contract to include this clause, if the merger or acquisition occurred prior to inclusion of this clause in the contract.
(3) For long-term contracts--
(i) Within 60 to 120 days prior to the end of the fifth year of the contract; and
(ii) Within 60 to 120 days prior to the date specified in the contract for exercising any option thereafter.
(c) If the Contractor represented that it was any of the small business concerns identified in 19.000(a)(3) prior to award of this contract, the Contractor shall rerepresent its size and socioeconomic status according to paragraph (f) of this clause or, if applicable, paragraph (h) of this clause, when the Contracting Officer explicitly requires it for an order issued under a multiple-award contract.
(d) The Contractor shall rerepresent its size status in accordance with the size standard in effect at the time of this rerepresentation that corresponds to the North American Industry Classification System (NAICS) code(s) assigned to this contract. The small business size standard corresponding to this NAICS code(s) can be found at https://www.sba.gov/document/support--table-size-standards.
(e) The small business size standard for a Contractor providing a product which it does not manufacture itself, for a contract other than a construction or service contract, is 500 employees.
(f) Except as provided in paragraph (h) of this clause, the Contractor shall make the representation(s) required by paragraph (b) and (c) of this clause by validating or updating all its representations in the Representations and Certifications section of the System for Award Management (SAM) and its other data in SAM, as necessary, to ensure that they reflect the Contractor's current status. The Contractor shall notify the contracting office in writing within the timeframes specified in paragraph (b) of this clause, or with its offer for an order (see paragraph (c) of this clause), that the data have been validated or updated, and provide the date of the validation or update.
(g) If the Contractor represented that it was other than a small business concern prior to award of this contract, the Contractor may, but is not required to, take the actions required by paragraphs (f) or (h) of this clause.
