AMENDMENT 3

The purpose of this amendment is as follows:

1. REPLACE: Technical Factor 7: AISC Certification.

a. Proposal must provide 1 active American Institute of Steel Construction (AISC) certification meeting one of the following certification options for the fabricator of the tainter gates. To be considered an active certification it must be in effect as of the date this solicitation closes, including any amended date. The AISC certification must remain active for the entire contract duration.

i. Intermediate bridge certification with fracture critical and sophisticated paint endorsement;

OR

ii. Advanced bridge certification with fracture critical and sophisticated paint endorsement;

iii. Hydraulic steel structures (HYD) certification with sophisticated paint endorsement.

SECTION 00 21 16 - INSTRUCTIONS TO PROPOSERS

PROPOSAL REQUIREMENTS AND EVAL

PROPOSAL REQUIREMENTS AND EVALUATION METHODOLOGY

I. Information to Offerors

A. Award will be made to the responsible offeror representing the best value based on the Lowest Priced, Technically Acceptable (LPTA) proposal received in response to this Request for Proposals (RFP). Firms will be rated in accordance with the adjectival ratings of Acceptable or Unacceptable as noted in the matrix below. Each technical evaluation factor must be determined Acceptable in order for the proposal to be found technically acceptable. Proposals will not be ranked. Award will be made to the offeror providing the lowest priced, technically acceptable proposal. Firms may only submit one proposal. Facsimile proposals will not be accepted. Offerors must propose pricing for all Contract Line Item Numbers (CLIN’s), including subCLIN’s, in order for their proposal to be considered for contract award.

Adjectival Rating Description Acceptable Proposal meets the requirements of the solicitation.

Unacceptable Proposal does not meet the requirements of the solicitation.

B. It is the offeror’s responsibility to ensure the completeness of its proposal.

Incomplete proposals may not be considered for contract award. The Government may evaluate solely on the information provided in the initial proposal and not assume that an offeror possesses any capability that is not specifically identified in the proposal. The Government intends to award without discussions, see FAR provision 52.215-1.

C. Failure to submit required information for a factor, indicated by the word “shall” or similar verbiage below, will result in a rating of Unacceptable for that factor, and the offeror will be ineligible for award unless the Procuring Contracting Officer/Source Selection Authority (PCO/SSA) decides to hold discussions and includes the offeror in the competitive range.

II. Proposal Submission Requirements A. The offeror’s proposal shall be submitted in hard copy, with accompanying digital copies as set forth below.

B. The offeror’s proposal shall consist of two volumes:

1. Volume 1-Technical proposal

2. Volume 2-Price proposal

C. Each hardcopy volume shall be submitted in separate three-ring binders that are clearly identified with project title, volume number, solicitation number W912ES19R0019, and the name of the offeror.

D. Facsimile of proposals and modifications thereto will not be accepted.

E. All pages in the Technical proposal containing text in response to this RFP shall be consecutively numbered, type-written on 8.5 X 11 inch paper with margins of at least one inch, double sided, and use a font no smaller than 12 with a maximum of 30 double-sided pages. Pages in excess of the limitation will be neither read nor evaluated. All pages of both volumes shall be identified by the prime offeror’s name in the header or footer. Text shall begin at the top of each page. Printing shall be single spaced. Each paragraph shall be separated by at least one blank line. The submission shall be clearly indexed and logically assembled using a table of contents and tabbed dividers. Tables and illustrations may use a reduced font size no less than 8-point. These formatting requirements and page limitations do not apply to the Technical Factor Submission Worksheets (Attachment A) nor the required AISC Certification detailed below. Tabbed dividers, the table of contents or other means of providing an organized proposal do not count towards the page limitation.

F. There are no page limitations for the Price proposal. All pages in the Price proposal shall be consecutively numbered and include the prime offeror’s name in the header or footer.

G. Files shall not contain classified data. The use of hyperlinks in proposals is prohibited. The electronic files shall contain identical information to the hard copy files. Offerors are responsible for including sufficient details to permit a complete and accurate evaluation of their proposal. Proprietary information shall be clearly marked.

H. Electronic copies shall be submitted on CD’s or DVD’s. Zip disks or external drives are not permitted. Self-extracting exe files are not acceptable. Files shall be in read-only format, using PDF files that are configured for printing by the Government.

Each CD shall be externally labeled with the volume number, solicitation number, and offeror’s name. All of the hardcopy versions shall be identical, if the hardcopy versions differ from the electronic version, the hardcopy versions will govern. If the hardcopy versions differ from each other, then the signed original hardcopy proposal shall govern.

I. Proposals shall be mailed, delivered by courier or hand delivered to the address below and received by the Government on or before the solicitation closing due date and time.

III. Proposal Contents: Volume 1 and Volume 2 A. Volume 1, the Technical proposal shall include all of the following:

1. The offeror’s name and address with the signature, title and email address of the person authorized to sign the proposal.

2. Responses to all technical evaluation factors.

a. Factors 1 to 5: Provide two (2) recent and relevant projects for each Technical Factor 1 to 5 using the attached Technical Factor Submission Worksheet (Attachment A). Ten (10) total worksheets shall be submitted. If more than ten (10) total worksheets are submitted in response to this solicitation, only the first two worksheets provided for each technical factor 1 to 5 will be read and evaluated. Incomplete Technical Factor Submission Worksheets may result in an Unacceptable rating for that factor.

b. Factor 4: In addition to the two (2) Technical Factor Submission Worksheets, provide a copy of the license for the mechanical engineer that will be assigned to this contract and whose experience is used for this factor.

c. Factor 6: For this factor, the management team is considered the project manager, site superintendent, and quality control manager.

Resumes for each of these individuals showing relevant experience shall be submitted for this factor. Relevant experience is demonstrated by past experience in the assigned role for the Wild Rice River Structure contract on two other heavy civil construction projects that are valued (total price) at $25 million dollars or more.

d. Factor 7: One (1) AISC certification shall be submitted in response to this Technical Evaluation Factor.

3. Recent is defined as work that is ongoing but not less than 50% physically complete as of July 1, 2019 or work that was completed within the last 10 years (completed on or after July 1, 2009). The definitions of relevant are included within each of the technical factors below.

4. If an offeror wishes to be credited with a subcontractor’s or supplier’s experience, certification, or license, a letter of commitment signed by the subcontractor or supplier and the prime contractor (offeror) must be submitted with the proposal. The letter of commitment shall clearly state that the offeror and the subcontractor or supplier have committed to construct this project together if the offeror receives the contract award. In regard to Experience, if an offeror submits projects demonstrating experience in one of the factors, and that project was completed by a subcontractor, a subsidiary, or a supplier, as opposed to the offeror, the offeror MUST submit a signed letter of commitment from the contractor who performed and completed the work. If a letter of commitment is not submitted, the experience/certifications will not be considered.

5. Attachments to the Technical Factor Submission Worksheets for each project submitted as described in the Technical Factor Submission Worksheet.

6. The Technical proposal shall not include pricing information.

B. Volume 2, the price proposal shall include all of the following:

1. Completed and signed Standard Form (SF) 1442, including acknowledgement of all amendments.

2. The offeror's name, title and signature of the representative who is authorized to sign the proposal and legally bind the offeror. Include their telephone number and email address.

3. Documentation verifying the individual noted above who signed the proposal and 1442 has the authority to bind the offeror, appropriate to the partnership, company, corporation, or joint venture demonstrating the business relationship such as copies of corporate resolutions, powers of attorney, or official meeting notes.

4. Completed pricing schedule/schedule of items. Offerors shall complete and submit the final amended (if applicable) schedule of items with their proposal and include a price for each contract line item number (CLIN) and subCLIN including subtotals (as applicable) and a contract total. Failure to provide complete pricing on all CLIN’s and subCLIN’s and a total price may result in the proposal being rejected without further consideration.

5. DUNS number, CAGE code and TAX ID number.

6. Proof of current System for Award Management (SAM) registration with your firm’s business size under the applicable North American Industry Classification System (NAICS) code for this acquisition: 237990-Other Heavy and Civil Engineering Construction.

7. Complete your Federal Acquisition Regulation (FAR) and Defense Federal Acquisition Regulation Supplement (DFARS) representations and certifications in SAM.

IV. Basis of Award A. Evaluation Factors

1. Technical Factor 1: Fabrication of tainter gates, tainter valves, radial gates, miter gates, sector gates, or vertical lift gates.

a. Proposal must provide two (2) projects demonstrating experience in the fabrication of any of the following weighing 20 tons or more: tainter gates, tainter valves, radial gates, miter gates, sector gates, or vertical lift gates.

2. Technical Factor 2: Installation of tainter gates, tainter valves, radial gates, miter gates, sector gates, or vertical lift gates.

a. Proposal must provide two (2) projects demonstrating experience in the installation of any of the following weighing 20 tons or more: tainter gates, tainter valves, radial gates, miter gates, sector gates, or vertical lift gates.

3. Technical Factor 3: Mix design with thermal analysis and temperature monitoring of mass concrete.

a. Proposal must provide two (2) projects demonstrating experience in developing a mix design that includes thermal analysis and a temperature monitoring plan for 1,000 cubic yards or more of mass concrete meeting the definition of mass concrete. Mass concrete is defined by the American Concrete Institute (ACI) Committee 207 as “any volume of concrete in which a combination of dimensions of the member being cast, the boundary conditions, the characteristics of the concrete mixture, and the ambient conditions can lead to undesirable thermal stresses, cracking, deleterious chemical reactions, or reduction in long-term strength as a result of elevated concrete temperatures due to heat from hydration.”

4. Technical Factor 4: Design of electro-mechanical gate operating machinery.

a. Proposal must provide two (2) projects demonstrating experience by a licensed (in any state or country) mechanical engineer in the design of electro-mechanical gate operating machinery with a rated capacity of 20 tons or more that consists of an electric motor driven hoisting winch with a geared reduction. The mechanical engineer submitted as providing relevant experience must be the mechanical engineer used in the design of the electro-mechanical gate operating machinery for this contract. A copy of the license for the mechanical engineer must be provided with each project.

5. Technical Factor 5: Manufacture and assembly of electro-mechanical gate operating machinery.

a. Proposal must provide two (2) recent and relevant projects demonstrating the manufacture and assembly of electro-mechanical gate operating machinery with a rated capacity of 20 tons or more that consists of an electric motor driven hoisting winch with a geared reduction.

6. Technical Factor 6: Management team experience.

a. The management team is the project manager, site superintendent, and quality control manager. Provide the resume for the individual serving in each of those positions for this contract. The resumes submitted must demonstrate experience in the assigned role this contract on two other heavy civil construction projects that are valued (total price) at $25 million dollars or more.

7. Technical Factor 7: AISC Certification.

a. Proposal must provide 1 active American Institute of Steel

Construction (AISC) certification meeting one of the following certification options for the fabricator of the tainter gates. To be considered an active certification it must be in effect as of the date this solicitation closes, including any amended date. The AISC certification must remain active for the entire contract duration.

i. Intermediate bridge certification with fracture critical endorsement;

ii. Advanced bridge certification with fracture critical endorsement;

iii. Hydraulic steel structures (HYD) certification.

V. Approved Substitutions In connection with this contract, any in-house personnel, subcontractors, and suppliers will be limited to individuals or firms that were specifically identified in the Contractor's accepted proposal. The Contractor shall obtain the Contracting Officer's written consent before making any substitution for these designated in-house personnel, subcontractors, or suppliers. If the Contractor proposes a substitution, it shall submit the same type of information that was submitted in the accepted proposal to the Contracting Officer for evaluation and approval. The level of qualifications and experience submitted in the accepted proposal or that required by the Solicitation, whichever is greater, is the minimum standard for any substitution.

VI. Evaluation Process

A. After receipt of proposals, the Source Selection Evaluation Board (SSEB) will convene. Each member will independently evaluate all submitted proposals according to the evaluation factors set forth in the solicitation as amended, beginning with the Technical proposals. Once the Technical evaluations are completed, the SSEB chairperson will lead the SSEB in discussions of each proposal, and they will come to a consensus decisions as to the acceptability of each factor for each offeror.

If the SSEB cannot achieve consensus, the PCO/SSA will resolve the matter. After concluding the evaluations, the SSEB Chairperson will provide an oral briefing of the consensus evaluation results to the PCO/SSA and submit a written consensus evaluation report for the record.

B. The written consensus report will detail the reasons for acceptability or unacceptability of proposals noted during the SSEB evaluation. The SSEB will make no recommendation as to whom shall receive the award and will not establish a ranking order or order of merit list pertaining to the offers begin evaluated. Upon completion of the Technical evaluation report, the SSEB will evaluate all offered price proposals.

C. The SSEB will evaluate each offeror’s price in terms of unbalancing and for potential performance risks. The PCO/SSA and Contract Specialist will evaluate each offeror’s price per FAR 15.404 to determine price reasonableness. Reasonableness will be determined by comparing offered prices to one another, to the Government estimate, and using pricing for previous work of a similar nature unless additional methods are required.

D. After receiving the SSEB Chairperson’s written, consensus evaluation report and briefing, the PCS/SSA, independently exercising his prudent business judgment, will make a source selection decision on the LPTA basis of award as solicited and amended. While the SSA/PCO may use reports and analyses prepared by others, the source selection decision is the SSA’s independent judgment. The source selection decision will be documented.

E. If during the evaluation process, any offerors are eliminated from the competition, they will be promptly notified in writing. The notice will state the basis for the elimination and that proposal revisions will not be considered. The SSA/PCO will award one contract to the successful, responsible, offeror by furnishing the executed contract or other notice of award to that offeror. Each offeror whose proposal was unsuccessful, will be notified in writing within 3 days after the date of the contract award. Debriefings will be provided to all offerors whom submit timely requests.
