252.204-7008 COMPLIANCE WITH SAFEGUARDING COVERED DEFENSE INFORMATION CONTROLS
(AUG 2015)
(a) Definitions. As used in this provision--
Controlled technical information, covered contractor information system, and covered defense information defined in clause 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting.
(b) The security requirements required by contract clause 252.204-7012, Covered Defense Information and Cyber
Incident Reporting, shall be implemented for all covered defense information on all covered contractor information systems that support the performance of this contract.
(c) If the Offeror proposes to deviate from any of the security requirements in National Institute of Standards and
Technology (NIST) Special Publication (SP) 800-171, ``Protecting Controlled Unclassified Information in
Nonfederal Information Systems and Organizations, http://dx.doi.org/10.6028/NIST.SP.800-171 that is in effect at the time the solicitation is issued or as authorized by the Contracting Officer, the Offeror shall submit to the
Contracting Officer, for consideration by the DoD CIO, a written explanation of--
(1) Why a particular security requirement is not applicable; or
(2) How an alternative but equally effective, security measure is used to compensate for the inability to satisfy a particular requirement and achieve equivalent protection.
(d) An authorized representative of the DoD CIO will approve or disapprove offeror requests to deviate from NIST
SP 800-171 requirements in writing prior to contract award. Any approved deviation from NIST SP 800-171 shall be incorporated into the resulting contract.

252.204-7009 LIMITATIONS ON THE USE OR DISCLOSURE OF THIRD-PARTY CONTRACTOR
REPORTED CYBER INCIDENT INFORMATION (AUG 2015)
(a) Definitions. As used in this clause--
Controlled technical information means technical information with military or space application that is subject to controls on the access, use, reproduction, modification, performance, display, release, disclosure, or dissemination.
Controlled technical information would meet the criteria, if disseminated, for distribution statements B through F using the criteria set forth in DoD Instruction 5230.24, Distribution Statements on Technical Documents. The term does not include information that is lawfully publicly available without restrictions.

Covered defense information means unclassified information that--
(1) Is--
(i) Provided to the contractor by or on behalf of DoD in connection with the performance of the contract; or
(ii) Collected, developed, received, transmitted, used, or stored by or on behalf of the contractor in support of the performance of the contract; and
(2) Falls in any of the following categories:
(i) Controlled technical information.
(ii) Critical information (operations security). Specific facts identified through the Operations Security process about friendly intentions, capabilities, and activities vitally needed by adversaries for them to plan and act effectively so as to guarantee failure or unacceptable consequences for friendly mission accomplishment (part of Operations Security process).
(iii) Export control. Unclassified information concerning certain items, commodities, technology, software, or other information whose export could reasonably be expected to adversely affect the United States national security and nonproliferation objectives. To include dual use items; items identified in export administration regulations, international traffic in arms regulations and munitions list; license applications; and sensitive nuclear technology information.
(iv) Any other information, marked or otherwise identified in the contract, that requires safeguarding or dissemination controls pursuant to and consistent with law, regulations, and Governmentwide policies (e.g., privacy, proprietary business information).
Cyber incident means actions taken through the use of computer networks that result in a compromise or an actual or potentially adverse effect on an information system and/or the information residing therein.
(b) Restrictions. The Contractor agrees that the following conditions apply to any information it receives or creates in the performance of this contract that is information obtained from a third-party's reporting of a cyber incident pursuant to DFARS clause 252.204-7012, Safeguarding Covered Defense Information and Cyber Incident Reporting
(or derived from such information obtained under that clause):
(1) The Contractor shall access and use the information only for the purpose of furnishing advice or technical assistance directly to the Government in support of the Government's activities related to clause 252.204-7012, and shall not be used for any other purpose.
(2) The Contractor shall protect the information against unauthorized release or disclosure.
(3) The Contractor shall ensure that its employees are subject to use and non-disclosure obligations consistent with this clause prior to the employees being provided access to or use of the information.
(4) The third-party contractor that reported the cyber incident is a third-party beneficiary of the non-disclosure agreement between the Government and Contractor, as required by paragraph (b)(3) of this clause.
(5) A breach of these obligations or restrictions may subject the Contractor to--
(i) Criminal, civil, administrative, and contractual actions in law and equity for penalties, damages, and other appropriate remedies by the United States; and
(ii) Civil actions for damages and other appropriate remedies by the third party that reported the cyber incident, as a third party beneficiary of this clause.
(c) Subcontracts. The Contractor shall include the substance of this clause, including this paragraph (c), in all subcontracts for services that include support for the Government's activities related to safeguarding covered defense information and cyber incident reporting, including subcontracts for commercial items.

252.209-7991 REPRESENTATION BY CORPORATIONS REGARDING AN UNPAID DELINQUENT TAX
LIABILITY OR A FELONY CONVICTION UNDER ANY FEDERAL LAW—FISCAL YEAR 2016
APPROPRIATIONS (DEVIATION 2016-O0002) (OCT 2015)
(a) In accordance with section 101(a) of the Continuing Appropriations Act, 2016 (Pub. L. 114-53) and any subsequent FY 2016 appropriations act that extends to FY 2016 funds the same restrictions as are contained in sections 744 and 745 of division E, title VII, of the Consolidated and Further Continuing Appropriations Act, 2015
(Pub. L. 113-235), none of the funds made available by this or any other Act may be used to enter into a contract with any corporation that—
(1) Has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability, where the awarding agency is aware of the unpaid tax liability, unless the agency has considered suspension or debarment of the corporation and made a determination that this further action is not necessary to protect the interests of the Government; or
(2) Was convicted of a felony criminal violation under any Federal law within the preceding 24 months, where the awarding agency is aware of the conviction, unless the agency has considered suspension or debarment of the corporation and made a determination that this action is not necessary to protect the interests of the Government.
(b) The Offeror represents that—
(1) It is [ ___ ] is not [ ___ ] a corporation that has any unpaid Federal tax liability that has been assessed, for which all judicial and administrative remedies have been exhausted or have lapsed, and that is not being paid in a timely manner pursuant to an agreement with the authority responsible for collecting the tax liability,

252.225-7045 BALANCE OF PAYMENTS PROGRAM--CONSTRUCTION MATERIAL UNDER TRADE
AGREEMENTS--BASIC (OCT 2015)
(a) Definitions. As used in this clause--
Caribbean Basin country construction material means a construction material that---
(i) Is wholly the growth, product, or manufacture of a Caribbean Basin country; or
(ii) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a Caribbean Basin country into a new and different construction material distinct from the materials from which it was transformed.
Commercially available off-the-shelf (COTS) item--
(i) Means any item of supply (including construction material) that is--
(A) A commercial item (as defined in paragraph (1) of the definition of ``commercial item'' in section 2.101 of the
Federal Acquisition Regulation);
(B) Sold in substantial quantities in the commercial marketplace; and
(C) Offered to the Government, under a contract or subcontract at any tier, without modification, in the same form in which it is sold in the commercial marketplace; and
(ii) Does not include bulk cargo, as defined in section 3 of the Shipping Act of 1984 (46 U.S.C. 40102), such as agricultural products and petroleum products.
Component means any article, material, or supply incorporated directly into construction material.
Construction material means an article, material, or supply brought to the construction site by the Contractor or a subcontractor for incorporation into the building or work. The term also includes an item brought to the site preassembled from articles, materials, or supplies. However, emergency life safety systems, such as emergency lighting, fire alarm, and audio evacuation systems, that are discrete systems incorporated into a public building or work and that are produced as complete systems, are evaluated as a single and distinct construction material regardless of when or how the individual parts or components of those systems are delivered to the construction site.
Materials purchased directly by the Government are supplies, not construction material.
Cost of components means--
(i) For components purchased by the Contractor, the acquisition cost, including transportation costs to the place of incorporation into the end product (whether or not such costs are paid to a domestic firm), and any applicable duty
(whether or not a duty-free entry certificate is issued); or
(ii) For components manufactured by the Contractor, all costs associated with the manufacture of the component, including transportation costs as described in paragraph (1) of this definition, plus allocable overhead costs, but excluding profit. Cost of components does not include any costs associated with the manufacture of the construction material.
Designated country means--
(i) A World Trade Organization Government Procurement Agreement (WTO GPA) country (Armenia, Aruba, Austria, Belgium, Bulgaria, Canada, Croatia, Cyprus, Czech Republic, Denmark, Estonia, Finland, France, Germany, Greece, Hong Kong, Hungary, Iceland, Ireland, Israel, Italy, Japan, Korea (Republic of), Latvia, Liechtenstein, Lithuania, Luxembourg, Malta, Montenegro, Netherlands, New Zealand, Norway, Poland, Portugal, Romania, Singapore, Slovak Republic, Slovenia, Spain, Sweden, Switzerland, Taiwan (known in the World Trade
Organization as ``the Separate Customs Territory of Taiwan, Penghu, Kinmen, and Matsu'' (Chinese Taipei)), or the
United Kingdom);
(ii) A Free Trade Agreement country (Australia, Bahrain, Canada, Chile, Colombia, Costa Rica, Dominican
Republic, El Salvador, Guatemala, Honduras, Korea (Republic of), Mexico, Morocco, Nicaragua, Panama, Peru, or
Singapore);
(iii) A least developed country (Afghanistan, Angola, Bangladesh, Benin, Bhutan, Burkina Faso, Burundi, Cambodia, Central African Republic, Chad, Comoros, Democratic Republic of Congo, Djibouti, Equatorial Guinea, Eritrea, Ethiopia, Gambia, Guinea, Guinea-Bissau, Haiti, Kiribati, Laos, Lesotho, Liberia, Madagascar, Malawi, Mali, Mauritania, Mozambique, Nepal, Niger, Rwanda, Samoa, Sao Tome and Principe, Senegal, Sierra Leone, Solomon Islands, Somalia, South Sudan, Tanzania, Timor-Leste, Togo, Tuvalu, Uganda, Vanuatu, Yemen, or
Zambia); or
(iv) A Caribbean Basin country (Antigua and Barbuda, Aruba, Bahamas, Barbados, Belize, Bonaire, British Virgin
Islands, Curacao, Dominica, Grenada, Guyana, Haiti, Jamaica, Montserrat, Saba, St. Kitts and Nevis, St. Lucia, St.
Vincent and the Grenadines, Sint Eustatius, Sint Maarten, or Trinidad and Tobago).
Designated country construction material means a construction material that is a WTO GPA country construction material, a Free Trade Agreement country construction material, a least developed country construction material, or a Caribbean Basin country construction material.
Domestic construction material means--
(i) An unmanufactured construction material mined or produced in the United States; or
(ii) A construction material manufactured in the United States, if--
(A) The cost of its components mined, produced, or manufactured in the United States exceeds 50 percent of the cost of all its components. Components of foreign origin of the same class or kind for which nonavailability determinations have been made are treated as domestic; or
(B) The construction material is a COTS item.
Free Trade Agreement country construction material means a construction material that--
(i) Is wholly the growth, product, or manufacture of a Free Trade Agreement country; or
(ii) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a Free Trade Agreement country into a new and different construction material distinct from the material from which it was transformed.
Least developed country construction material means a construction material that--
(i) Is wholly the growth, product, or manufacture of a least developed country; or
(ii) In the case of a construction material that consists in whole or in part of materials from another country has been substantially transformed in a least developed country into a new and different construction material distinct from the materials from which it was transformed.
United States means the 50 States, the District of Columbia, and outlying areas.
WTO GPA country construction material means a construction material that--
(i) Is wholly the growth, product, or manufacture of a WTO GPA country; or
(ii) In the case of a construction material that consists in whole or in part of materials from another country, has been substantially transformed in a WTO GPA country into a new and different construction material distinct from the materials from which it was transformed.
(b) This clause implements the Balance of Payments Program by providing a preference for domestic construction material. In addition, the Contracting Officer has determined that the WTO GPA and Free Trade Agreements apply to this acquisition. Therefore, the Balance of Payments Program restrictions are waived for designated country construction materials.
(c) The Contractor shall use only domestic or designated country construction material in performing this contract, except for--
(1) Construction material valued at or below the simplified acquisition threshold in part 2 of the Federal Acquisition
Regulation;
(2) Information technology that is a commercial item; or
(3) The construction material or components listed by the Government as follows:
Not applicable because Bahrain is a free trade agreement country.

(End of Summary of Changes) must be individually bound in a three-ring binder. Each section of the volume must be individually tabbed and labeled.
The proposal must be prepared on 8-1/2" x 11" paper (11”X17” for drawings), A-4, bond paper and include a Title Page and a Table of Contents unless otherwise stated under each Factor. Margins should be no smaller than a half inch (1/2”) and font face is Times New Roman and font size should be no smaller than 10 size. Page is defined as a single sheet of paper with text on both sides. The Government will not evaluate any material that exceeds the page limits specified herein. The proposal must be tabbed and bound or presented in a three-ring binder. Elaborately prepared proposals are not required.
The offeror shall place the following notification on the bottom of each page of its proposal: “Source Selection Information – See FAR 2.101 and 3.104. Do not disclose any source selection information to any unauthorized person.”
Time periods, if stated as a number of days, are calendar days unless otherwise specified.
Lack of applicable Letter(s) of Commitment is considered a deficiency and submissions lacking the applicable Letter(s) of Commitment may not be considered.
Amendments to the RFP. Any and all amendments to the Phase One Request for Proposal (RFP) will be issued electronically and be available via www.fbo.gov . It is the Offeror’s responsibility to continuously check for any amendments to this RFP and acknowledge any and all amendments in the text of the cover letter (amendment number and date acknowledged by Offeror) sent with their proposal package in response to this RFP. Those offerors selected to receive the Phase Two RFP will be notified how to access the Phase Two documents.
Pre-proposal Conference/Site Visit. No pre-proposal conference or site visit will be conducted during Phase One. A pre-proposal conference and site visit will be conducted during Phase Two.
Joint Ventures (JV). A joint venture is defined as follows: a legal business entity formed between two or more companies (parties) to undertake the performance activities of a contract together. This does not include other arrangements such as “teaming agreements” or “strategic alliance”, which are not recognized as bona fide joint ventures for the purposes of this solicitation.
Offerors proposing as joint ventures shall provide evidence that the Joint Venture as a legal entity has been duly formed. Joint ventures shall include a copy of the legal joint venture agreement signed by an authorized officer from each of the firms comprising the joint venture with the chief executive of each entity identified. The Government will not evaluate the capability of any contractors that are not included in the joint venture agreement.
If submitting a proposal as a joint venture, the experience, and past performance of each of the joint venture partners can be submitted for the joint venture entity. The experience for each joint venture partner will be considered the experience of the joint venture entity. Page and project form limits apply to the joint venture as a whole. Prospective Offerors that submit Phase One proposals may not change their firm (including LOC’s and proposed sub-contractors) or their Joint Venture firms, if selected to submit Phase Two proposals. If the offeror proposes to change subcontractors or Letter of Commitment after award, the offeror may not change subcontractors or Letter of Commitment without the Contracting Officer’s approval. Approval will not be given unless the Contracting Officer considers the proposed substitute to be equal in all respects to the originally proposed subcontractor and that the substitution is in the best interest of the Government.
Subcontractors. The Government recognizes that completion of a project is often a team effort. Therefore, if an Offeror wishes to be credited with experience and past performance of a subcontractor (i.e., a firm that is not a member of the Joint Venture), a firm, unequivocal letter of commitment signed by the firm must be submitted. The letter of commitment must be submitted even if the firm is in some way related to a Joint Venture partner (for example, the subcontractor is a subsidiary of a Joint Venture partner, or a subsidiary of a firm to which a Joint Venture partner is also a subsidiary). If such a letter of commitment is not submitted, the experience and past performance of subcontractor firms may not be considered. If the Offeror’s proposal includes the use of n0ctmdez Highlight subcontractors, the Offeror may not change subcontractors without the Contracting Officer’s approval. If the offeror proposes to change subcontractors or Letter of Commitment after award, the offeror may not change subcontractors or Letter of Commitment without the Contracting Officer’s approval. Approval will not be given unless the Contracting Officer considers the proposed substitute to be equal in all respects to the originally proposed subcontractor and that the substitution is in the best interests of the Government.

Please ensure that NAICS code 237990 (Other Heavy and Civil Engineering Construction) is listed in your SAM registration.
Expenses Incurred. The Government will not reimburse any costs incurred or associated with preparation and submission of any response(s) to this solicitation.
Discussions. The Government intends to select up to five (5) of the most highly qualified Offerors in Phase One without conducting discussions, however, the Government reserves the right to conduct discussions as determined necessary by the Contracting Officer.
Obtaining a D.U.N.S. Number. Data Universal Numbering System (D-U-N-S) Number. The Data Universal Numbering System (D-U-N-S) Number is a unique nine-character identification number provided by the commercial company Dun & Bradstreet (D&B). Call D&B at 1-866-705-5711 or access their website if you do not have a D-U-N-S number. The site addresses are http://fedgov.dnb.com/webform OR http://www.dnb.com/.
The process to request a D-U-N-S number via phone takes about 10 minutes and is free of charge. Internet request are fulfilled within 24 hours. You must have a different nine-digit D-U-N-S number for each physical location or different address in your company as well as each legal division that may be co-located.
Late Proposals. Any proposal, modification, or revision received at the Government office designated in the solicitation after the exact time specified for receipt of offers is “late” and will not be considered unless it is received before award is made, the Contracting Officer determines that accepting the late offer would not unduly delay the acquisition; and--(1) If it was transmitted through an electronic commerce method authorized by the solicitation, it was received at the initial point of entry to the Government infrastructure not later than 4:00 p.m. one working day prior to the date specified for receipt of proposals; or (2) There is acceptable evidence to establish that it was received at the Government installation designated for receipt of offers and was under the Government's control prior to the time set for receipt of offers; or (3) It is the only proposal received. However, a late modification of an otherwise successful proposal that makes its terms more favorable to the Government will be considered at any time it is received and may be accepted. Acceptable evidence to establish the time of receipt at the Government installation includes the time/date stamp of that installation on the proposal wrapper, other documentary evidence of receipt maintained by the installation, or oral testimony or statements of Government personnel.
D. PHASE I BASIS OF EVALUATION
To determine the Most Highly Qualified contractors, a source selection process will be used that involves evaluation of qualification proposals.
Phase I evaluation Factors: Phase I evaluation factor, Technical Approach shall be evaluated using reasoned judgment that results in the assignment of a combined technical/risk rating as follows: Outstanding with Very Low risk, Good with Low risk, Acceptable with Moderate risk, Marginal with High risk, or Unacceptable encompassing a proposal that is unawardable. The Past Performance evaluation factor will be evaluated for Relevancy and Confidence.

PART 1 GENERAL
1.1 SUBMITTALS
Government approval is required for submittals with a "G" designation;
submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Submittals with an "S" are for inclusion in the Sustainability Notebook, in conformance to Section 01 33 29.05 20 SUSTAINABILITY REPORTING FOR DESIGN-BUILD. Submit the following in accordance with SECTION 01 33 00.05 20 CONSTRUCTION SUBMITTAL PROCEDURES and SECTION 01 33 10.05 20 DESIGN SUBMITTAL PROCEDURES:

1.2 SPECIAL SCHEDULING REQUIREMENTS
a. The Mina Salman Concrete Pier will remain in operation during the entire construction period. The Contractor must conduct his operations so as to cause the least possible interference with normal operations of the activity.
b. Permission to interrupt any activity roads, and/or utility service must be requested in writing a minimum of 15 calendar days prior to the desired date of interruption.
c. The work under this contract requires special attention to the scheduling and conduct of the work in connection with existing operations. Identify on the construction schedule each factor which constitutes a potential interruption to operations.
The following conditions apply:
(1) The Mina Salman pier must only be used to transport personnel and equipment to the work site. Use the center of the pier for all traffic.
(2) NSA Bahrain has no available land area for laydowndesignated a mobilization area for use by the Contractor which is shown in Attachment A of Section 01 50 00. The Contractor mustmay use barges for all equipment and material used in demolition and construction of this project, subject to Port Security requirements.
1.3 CONTRACTOR ACCESS AND USE OF PREMISES
1.3.1 Port Regulations
Ensure that Contractor personnel employed on the Port become familiar with and obey Port regulations including safety, fire, traffic and security regulations. Keep within the limits of the work and avenues of ingress and
SECTION 01 14 00 Page 2 egress. Wear hard hats in designated areas. Do not enter any restricted areas unless required to do so and until cleared for such entry. Mark Contractor equipment for identification.
1.3.1.1 Subcontractors and Personnel Contacts
Provide a list of contact personnel of the Contractor and subcontractors including addresses and telephone numbers for use in the event of an emergency. As changes occur and additional information becomes available, correct and change the information contained in previous lists.
1.3.1.2 No Smoking Policy
Smoking is prohibited within and outside of all buildings on installation, except in designated smoking areas. This applies to existing buildings, buildings under construction and buildings under renovation. Discarding tobacco materials other than into designated tobacco receptacles is considered littering and is subject to fines. The Contracting Officer will identify designated smoking areas.
1.3.2 Working Hours
Regular duty hours consist of a 9.0 hour period , between 0730 to 1630 Sunday through Thursday, excluding Government holidays.
1.3.3 Work Outside Regular Hours
If the Contractor desires to carry on work outside regular duty hours, or on holidays (including the following U.S. holidays: New Year's Day, Martin Luther King Jr's Birthday, George Washington's Birthday, Memorial Day, Independence Day, Labor Day, Columbus Day, Veteran's Day, Thanksgiving and Christmas), he shall submit an application to the Contracting Officer. The Contractor shall allow ample time to enable satisfactory arrangements to be made by the Government for inspecting the work in progress. At night, exterior lighting shall be provided in conformance with EM-385-1-1 entitled "Safety and Health Requirements Manual". The following pertains to this contract:
1.3.4 Occupied Areas and Existing Facilities
The Contractor may be working around occupied areas and existing facilities. Do not enter these areas or facilities without prior approval of the Contracting Officer.
]1.3.5 Utility Cutovers and Interruptions
a. Make utility cutovers and interruptions after normal working hours or on Saturdays and Government holidays. Conform to procedures required in the paragraph "Work Outside Regular Hours."
b. Ensure that new utility lines are complete, except for the connection, before interrupting existing service.
c. Interruption to telephone service, electric service, and fire alarm are considered utility cutovers pursuant to the paragraph entitled "Work Outside Regular Hours."
d. Operation of Station Utilities: The Contractor must not operate nor disturb the setting of control devices in the station utilities system, SECTION 01 14 00 Page 3 including water, sewer, electrical, and steam services. The Government will operate the control devices as required for normal conduct of the work. The Contractor must notify the Contracting Officer giving reasonable advance notice when such operation is required.
1.4 PORT SECURITY REQUIREMENTS
Contract Clause "FAR 52.204-2, Security Requirements and Alternate II," "FAC 5252.236-9301, Special Working Conditions and Entry to Work Area," and the following apply:
Work under this contract will be performed at a location with security and access control procedures. Compliance with port pass and access procedures is the sole responsibility of the Contractor, and is required to be accomplished prior to initiation of the process for gaining access to controlled sites. Contractor shall be responsible for determining the nature and amount of any fees required. Contractor is responsible for all workers granted access pursuant to work under this contract. Contractor shall pay all gate pass fees.
a. Other Data: Contractor shall provide additional data, as required and not specifically indicated above, to secure all required passes for where work is required to be performed.
b. Compliance with Revised Requirements: The government may revise requirements and procedures for obtaining passes and/or access to the site of work at any time during the life of the contract. Contractor shall comply with all such requirements, as directed by the Contracting Officer.
c. Contractor shall employ an acceptable system for accountability and control of all compound passes/access badges issued to him.
Passes/Access Badges shall be returned to the Government as soon as they are no longer required. This system shall be approved by the Contracting Officer, and shall be modified as directed by the Contracting Officer to correct any deficiencies noted during contract performance in maintaining an acceptable level of accountability and control.
d. Attachment A of this section contains personnel and vehicle access forms that will be required to gain access to the Mina Salman Pier.
These are not the NSF approved access forms for access to HNSA Bahrain.
e. Any access to the project site by water must be coordinated with Port Operations, NSA Bahrain as a separate activity to normal badging/access. This requires force protection inspections that are significant. Please inform and coordinate with Port Operations, NSA Bahrain at least 72 hours in advance on all water access issues regarding the Harbor and Mina Salman Area. POC is Mr. Randy Alford (439-4228 desk and cell is 39339735) and LCDR Juan Figueroa (desk 439-3765).
1.4.1 Requirements
The Port Security Office maintains the ultimate authority for establishing, monitoring, and enforcing security requirements for the port. All contractor, subcontractor, or vendor personnel and vehicles at any tier working at any location on the port are subject to a thorough search upon entering, departing, or at any time deemed necessary by Port Security

Personnel. The Contractor shall be responsible for compliance with all port security requirements. The Government reserves the right to deny access or to require the contractor to remove any personnel or equipment deemed to be a threat to the security of the port or port personnel. The Contractor shall work through the Contracting Officer to assure that port security regulations are followed.
1.4.2 Security Areas
For the duration of this contract, the port will be divided into two zones, the Port Security Area and the Construction Security Area. The contract work will be confined to the Construction Security Area for the majority of the work. Limited access to the Port Security Area will be coordinated with Port Security personnel, through the Contracting Officer. Minimum requirements for Contractor entry and operations in each of these areas is described below.
1.4.3 Construction Security Area
The Construction Security Area encompasses the area surrounding the Mina Salman Pier, the ongoing construction of the pier, the Contractor's mobilization areas, and the Construction Security Area Access Gate. The Construction Security Area will be established by temporary movable fencing and shall be indicated on the Contractor's Area Use Plan. All temporary fence separating port and construction security zones shall be high quality movable metallic type. Fence shall be 1800 mm (6 feet) tall. All fencing shall be provided with visual screen or be solid metallic panels. For separation of areas within construction security zone, the Contractor may use existing movable fence and provide additional quantities as required.
The Government will have the primary responsibility for implementation and enforcement of the security requirements for all contractor personnel and equipment in the Construction Security Area. The Construction Security Area will exist for the entire duration of this contract. However, as various parts of the work are completed the temporary movable fence will be relocated to redefine the boundary of the Construction Security Area.
Relocations of the temporary movable fence must be coordinated through the Contracting Officer and approved by the Port Security Officer. Upon completion of all contract work the temporary removable fence shall remain the property of the Contractor and be removed from the port.
1.4.3.1 Access to the Construction Security Area
Contractor access to the Construction Security Area for all personnel, vehicles, equipment and materials will be limited to the Construction Security Area Access Gate. During the period of this contract, other contractors will also utilize the Construction Security Area Access Gate and have mobilization areas in the Construction Security Area. The Construction Security Area will be open at 0600 hours each morning and close no later than 1800 hours each evening. Special requests to extend either the opening time, closing time or both shall be approved by the Port Security Officer 5 working days in advance of the requested time. Any approval for extended hours may be because of emergency circumstances and will not be approved for large blocks of time or because the Contractor needs to work additional hours to regain its schedule. The Port Security Officer, from time to time and possibly for extended time periods throughout the duration of this contract, without notice, may increase or decrease the threat condition (THREATCON) under which Port Security operates. At anytime during the duration of this contract while THREATCON CHARLIE is in effect the Construction Security Area will be open for work
SECTION 01 14 00 Page 5 activities from 0600 until 1800 only, seven days per week. There will be no exceptions to these operating hours. At anytime during the duration of this contract while THREATCON DELTA is in effect, the Construction Security Area may be closed for all construction activity. The Port Security actions to safeguard the Military and Civilian personnel on the NSA, during any security condition may have a negative affect on contractor's employees, vehicle and materials access and overall ability to perform. Any such action taken by Port Security is considered necessary for the security and protection of military and civilian personnel. The Contractor should expect daily 60 to 90 minutes waiting period for his workers to access the site.
1.4.3.2 Identification of Employees in the Construction Security Area
The Contractor shall provide a list of all employees who will need access to the Construction Security Area. The access list shall contain the following information: name, company, nationality, date of birth, place of birth, Central Population Register (CPR), expiry date, passport number, date issued and expiry date, visa expiry. In order to get on the access list, copies of Passport, CPR and Residence Permit shall be provided. All of these three (3) documents must be valid at all times to remain on the access list. The access list additions/deletions will be provided in three
(3) copies through the Contracting Officer to the Port Security Officer on a weekly basis. The Contractor shall plan his employee force requirements such that the access list will contain all those employees who will need access to the Construction Security Area for the period the list is in effect. Supplemental updating of the employee access list will be allowed only at the discretion of the Contracting Officer with the approval of the Port Security Officer. Employees who no longer require access to the Construction Security Area should be removed from the list. Each contractor employee seeking entrance to the Construction Security Area must be on the approved Access List. To gain access to the Construction Security Area personnel shall surrender their CPR card or Passport to the personnel at the Construction Security Area Access Gate, and receive an identification badge allowing that individual access to the Construction Security Area. Employees shall wear identification badges prominently displayed at all times while in the Construction Security Area. Failure to wear a properly displayed identification badge may be considered grounds for removal of the employee from the site. The Contractor shall conduct random inspections to assure that identification badges are properly displayed. At the conclusion of the work day each employee shall return the badge to the security personnel at the Construction Security Area Access Gate and receive his CPR card or Passport back. In addition to identification badges, all contractor labor personnel shall wear coveralls in a distinct color for the contractor's personnel and for each subcontractor's personnel. The Coveralls shall have markings on the back clearly identifying the company for whom the employee works.
1.4.3.3 Identification of Vehicles and Equipment in the Construction Security Area
The Contractor shall provide a list of all vehicles that require access to the Construction Security Area. This access list shall contain the same information and back-up documents as required for the Construction Security Zone.
