WEATHER, WATER STAGE AND TIDE DATA

PART 1 GENERAL

1.1 Water Stages

Water levels in the project area are mainly affected by semi-diurnal tidal fluctuations in the Atlantic Ocean. The project area is also subject to storm surges from hurricanes and tropical storms from June through November. Surges from extratropical storms may affect the area during any time of the year.

Elevations of tidal datums in the vicinity of the project area are provided in the following tables. All datum elevations in these tables are referred to mean lower low water (MLLW). The datums in Table 1 are based on tide station 8723080 (Haulover Pier, N. Miami Beach, FL) located approximately 3.5 miles north of the northernmost project location. These values are based on a control station located in Key West, FL. The datums in Table 2 are based on tide station 8723170 (Miami Beach, FL) located approximately 2.5 miles south of the southernmost project location. These values are based on a control station located in Key West, FL. The tide stations were established by the National Oceanic and Atmospheric Administration (NOAA), National Ocean Service (NOS) and are applicable within the project vicinity. Additional information on these and other nearby tide stations is available at this NOAA website:

1.3 Weather Conditions

The project area is subject to tropical storms and hurricanes from June through November, and to windy and/or rainy weather during any time of the year. The climate of the area is subtropical, and temperatures below freezing occur rarely. The wet season in the project area is from May through October. Rainfall during these months is closely associated with convective activity. These rainfall events are normally of short duration and amounts are spatially variable. In general, the winter months constitute the dry season. Rainfall during the winter months is usually associated with mid-latitude systems (fronts and low pressure systems) and

DOCUMENT 00 33 50 Page 3 is distributed in a more spatially uniform pattern. Occasionally, daily rainfall in the dry season can be quite heavy as mid-latitude systems penetrate into central Florida. Dangerous thunderstorms can occur in this area at any time of the year.

It shall be the contractor's responsibility to obtain information concerning weather conditions in the project area. The Climate Data Online website http://www.ncdc.noaa.gov/cdo-web/ published by NOAA’s National Centers for Environmental Information (formerly the National Climatic Data Center) in Asheville, North Carolina contains climatological and meteorological observations and data relevant to this region. Available data includes quality controlled daily, monthly, seasonal, and yearly measurements of temperature, precipitation, wind, and degree days as well as radar data and 30-year climate normals.

The Summary of Monthly Normals product available at the following web link provides monthly average values for temperature, precipitation, and other information. The Miami Beach, FL Station, is the closest NOAA rain gage in proximity to the project location. Summary of Monthly Normals is provided over the period of record from 1981 through 2010. Station ID, and is cited in the Survey Notes. All projects constructed and maintained to a tidal datum shall be calibrated to the Station ID specified in the plan sheet drawings. Information regarding the location and associated benchmarks of the referenced Station ID is included in the Monument Description section of these specifications.

See Section 00 31 21 CONTROL MONUMENT DESCRIPTIONS.

1.7.2 Layout

From the monuments, control data and elevations established by the Government, the Contractor shall complete the layout of the work and shall be responsible for all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a result of necessary modifications to the contract work.

1.7.3 Survey

The Contractor shall furnish, at his own expense, such stakes, templates, platforms, equipment, tools and material, and all labor as may be required in laying out any part of the work from the monuments, control data and elevations established by the Government. It shall be the responsibility of the Contractor to maintain and preserve all monuments, stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks or monuments are destroyed by the Contractor or through his negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at his discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor. The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.

1.8 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or job prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or job prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or job prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

SECTION 01 11 00 Page 5

1.9 EXISTING WORK

In addition to "FAR 52.236-9, Protection of Existing Vegetation, Structures, Equipment, Utilities, and Improvements":

a. Remove or alter existing work in such a manner as to prevent injury or damage to any portions of the existing work which remain.

b. Repair or replace portions of existing work which have been altered during construction operations to match existing or adjoining work, as approved by the Contracting Officer. At the completion of operations, existing work shall be in a condition equal to or better than that which existed before new work started.

1.10 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

1.10.1 Contractor Responsibility

The project area may be affected by stormy, windy and/or rainy weather, including thunderstorms, during any time of the year. The Contractor shall be responsible for obtaining information concerning rain, wind and wave conditions that could influence safety, hauling and placement operations prior to submitting a proposal or bid.

a. Contractor shall research the project site conditions and incorporate potential adverse weather delays into their schedule prior to submitting a proposal or bid. The Contractor shall develop a schedule of monthly anticipated adverse weather based on the equipment to be used to complete the project and determine the conditions that would cause them to cease operations using the sources provided in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

b. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report the occurrence of adverse weather and unusually severe weather with the purpose to note impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's schedule to be considered "unusually severe weather".

c. The number of actual adverse weather delay days shall include days impacted by actual adverse weather, be calculated chronologically from

SECTION 01 11 00 Page 6 the first to the last day of each month, and be recorded as full days.

If the number of actual adverse weather delay days exceeds the number of days anticipated for adverse weather by the Contractor, the Contracting Officer may convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days that should have been anticipated for the conditions at the project location.

Payment quantities will be determined by the Government using average end area method of calculation, except in locations where a Construction Baseline (CBL) Points of Intersection (PI) existing between two stations and at the end tapers/transitions. At these two locations, Digital Terrain Model (DTM) surface-to-surface method of calculation shall be used. When beach fill is placed above the slough zone to compensate for wave action, payment will be based on a cut and fill calculation. No payment will be made for material placed in excess of the tolerance template A(T) indicated on the drawings.

c. The Government will pay 95 percent (withhold 5 percent) of progress and total payment made under this line item until all access areas have been restored as indicated above. 1.5.1.2 Measurement

a. The maps and/or drawings already prepared (clause CONTRACT DRAWINGS, MAPS, AND SPECIFICATIONS of Section 00700 CONTRACT CLAUSES in Volume

1) are believed to represent accurately the existing conditions at the time the surveys were performed, but the depths and elevations shown thereon may be verified and corrected by elevations and soundings taken before commencing the work. Once quantities within a specified reach or section have been determined through the use of in-place measurement, they will not be reopened except on evidence of collusion, fraud, or obvious error.

b. Beach fill satisfactorily placed will be measured for payment by use of the average end area method and Digital Terrain Model (DTM) surface-to-surface difference method at the respective locations stated in subparagraph "Payment" above. The quantities will be computed by the Government in accordance with clause QUANTITY SURVEYS of Section 00700 CONTRACT CLAUSES in Volume 1. Measurement of quantity placed for pay purposes will be based on original and final surfaces made on the section or reach indicated on the drawings. The Contractor shall give 3 calendar days advance notice, in writing, to

SECTION 01 22 00 Page 4 the Contracting Officer's Representative of the need to perform the original and final surveys. Quality Control Surveys shall be the responsibility of the Contractor. c. In accordance with clause QUANTITY SURVEYS of Section 00700 CONTRACT CLAUSES in Volume 1, the Government will perform pre- and post-construction topographic survey at 100-foot stations with elevations taken at 10-foot range intervals from the baseline to the toe slope elevation. An additional cross section shall be collected at CBL PI's along a line bisecting the angular difference of lines tangent to the incoming and outgoing CBL and every 50 feet within the end tapers/transitions. In order to achieve final grade in slough zone, Contractor shall place material to final grade within tolerance for entire slope or may stockpile beach fill up-slope of slough zone.

After stockpiled beach fill is measured for payment, the Contractor shall shape slope to within the required and tolerance grades from top of slope to waterline producing a smooth uniform slope. Once post-construction survey is performed, no measurements will be revised except on suspicion of fraud or obvious error.
