1. The following water stage, wave, wind, and weather data are provided for inclusion into the subject Plans and Specifications. The following water level datums are provided for information only and are not to be utilized in conjunction with any contract related hydrographic surveying.

a) Water Stages. Water levels in the project area are mainly affected by semi-diurnal tidal fluctuations in the Atlantic Ocean. The project area is also subject to storm surges from hurricanes and tropical storms from June through November. Surges from extratropical storms may affect the area during any time of the year.

Elevations of tidal datums in the vicinity of the project area are provided in the following table.

All datum elevations in this table are referenced to mean lower low water (MLLW). These datums are based on values from an active tide station located on Virginia Key, at the University of Miami’s Rosenstiel School of Marine and Atmospheric Science. This gage is located approximately 8 miles south of the project area, and contains the longest and most recent record of tidal datums. This tide station was established by the National Oceanic and Atmospheric Administration (NOAA), National Ocean Service (NOS). Additional information on this and other nearby tide stations is available at this NOAA website:

http://tidesandcurrents.noaa.gov/stations.html?type=Bench+Mark+Data+Sheets#Florida .

1.7.1 Established Project Control

The Government has established monuments along the work site(s). Each monument is represented in the contract drawings by a Designation and in most cases, an alphanumeric Permanent Identifier (PID). Information concerning the location and elevations can be found within the Survey Notes on the plan sheets. The Survey Notes for each included field survey will cite a particular survey number, and specify the control used to conduct that survey. Additional information is included in the Survey Notes that must be duplicated if an attempt to recreate the subject survey is desired.

For navigation channels, the Government has established tidal calibration sites for projects constructed and maintained to a tidal datum. Each tidal calibration site is represented in the plan sheet drawings by Station ID, and is cited in the Survey Notes. All projects constructed and maintained to a tidal datum shall be calibrated to the Station ID specified in the plan sheet drawings. Information regarding the location and associated benchmarks of the referenced Station ID is included in the Monument Description section of these specifications.

See Section 00 31 21 CONTROL MONUMENT DESCRIPTIONS.

1.7.2 Layout

From the monuments, control data and elevations established by the Government, the Contractor shall complete the layout of the work and shall be responsible for all measurements that may be required for the execution of the work to the location and limit marks prescribed in the specifications or on the contract drawings, subject to such modifications as the Contracting Officer may require to meet changed conditions or as a

SECTION 01 11 00 Page 4 result of necessary modifications to the contract work.

1.7.3 Survey

The Contractor shall furnish, at his own expense, such stakes, templates, platforms, equipment, tools and material, and all labor as may be required in laying out any part of the work from the monuments, control data and elevations established by the Government. It shall be the responsibility of the Contractor to maintain and preserve all stakes and other marks established by the Contracting Officer until authorized to remove them, and if such marks are destroyed by the Contractor or through his negligence, prior to their authorized removal, they may be replaced by the Contracting Officer, at his discretion, and the expense of replacement will be deducted from any amounts due or to become due the Contractor. The Contracting Officer may require that work be suspended at any time when location and limit marks established by the Contractor are not reasonably adequate to permit checking of the work.

1.8 DAMAGE TO WORK

The responsibility for damage to any part of the permanent work shall be as set forth in Clause PERMITS AND RESPONSIBILITIES of Section 00700 CONTRACT CLAUSES in Volume 1. However, if, in the judgment of the Contracting Officer, any part of the permanent work performed by the Contractor is damaged by flood, earthquake, hurricane, or tornado, which damage is not due to the failure of the Contractor to take reasonable precautions or to exercise sound engineering and construction practices in the conduct of the work, the Contractor will make the repairs as ordered by the Contracting Officer and full compensation for such repairs will be made at the applicable contract unit or lump sum prices as fixed and established in the contract. If, in the opinion of the Contracting Officer, there are no contract unit or lump sum prices applicable to any part of such work, an equitable adjustment pursuant to Clause CHANGES of Section 00700 CONTRACT CLAUSES in Volume 1 will be made as full compensation for the repairs of that part of the permanent work for which there are no applicable contract unit or lump sum prices. Except as herein provided, damage to all work (including temporary construction), utilities, materials, equipment and plant shall be repaired to the satisfaction of the Contracting Officer at the Contractor's expense, regardless of the cause of such damage.

1.9 TIME EXTENSIONS FOR UNUSUALLY SEVERE WEATHER (31 OCT 1989)

This provision specifies the procedure for the determination of time extensions for unusually severe weather in accordance with the Clause DEFAULT (FIXED-PRICE CONSTRUCTION) of Section 00700 CONTRACT CLAUSES in Volume 1. In order for the Contracting Officer to award a time extension under this clause, the following conditions must be satisfied:

a. The weather experienced at the project site during the contract period must be found to be unusually severe; that is, more severe than the adverse weather anticipated for the project location during any given month.

b. The unusually severe weather must actually cause a delay to the completion of the project. The delay must be beyond the control and without the fault or negligence of the Contractor.

SECTION 01 11 00 Page 5

1.9.1 Schedule of Monthly Anticipated Adverse Weather Delays

The schedule of monthly anticipated adverse weather delays is based upon National Oceanic and Atmospheric Administration (NOAA) or similar data for the project location and will constitute the base line for monthly weather time evaluations. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

See Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA. A reasonable number of anticipated weather delay work days is obtained from the average number of days per month with precipitation greater than that indicated in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA rounded to the nearest whole number.

1.9.2 Contractor Responsibility

The project area may be affected by stormy, windy and/or rainy weather, including thunderstorms, during any time of the year. The Contractor shall be responsible for obtaining information concerning rain, wind and wave conditions that could influence safety, hauling and placement operations prior to submitting a proposal or bid. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all-weather dependent activities. A list of potential sources providing climatological and meteorological observations and data for the project area is provided.

a. Contractor shall research the project site conditions and incorporate potential adverse weather delays into their schedule prior to submitting a proposal or bid. The Contractor shall develop a schedule of monthly anticipated adverse weather based on the equipment to be used to complete the project and determine the conditions that would cause them to cease operations using the sources provided in Section 00 33 50 WEATHER, WATER STAGE AND TIDE DATA. The Contractor's progress schedule must reflect these anticipated adverse weather delays in all weather dependent activities.

b. Upon acknowledgment of the Notice to Proceed (NTP) and continuing throughout the contract, the Contractor will record on the daily CQC report the occurrence of adverse weather and unusually severe weather with the purpose to note impact to normally scheduled work. Actual adverse weather delay days must prevent work on critical activities for 50 percent or more of the Contractor's schedule to be considered "unusually severe weather".

c. The number of actual adverse weather delay days shall include days impacted by actual adverse weather, be calculated chronologically from the first to the last day of each month, and be recorded as full days.

If the number of actual adverse weather delay days exceeds the number of days anticipated for adverse weather by the Contractor, the Contracting Officer may convert any qualifying delays to calendar days, giving full consideration for equivalent fair weather work days that should have been anticipated for the conditions at the project location.

SECTION 01 22 00

MEASUREMENT AND PAYMENT

PART 1 GENERAL

1.1 SUMMARY

This section describes how Line Items will be measured and paid for when making progress payments. Work to be measured is described in specification sections listed for each Line Item. Measurement procedures for payment, required quantity survey or procurement documentation and payment restrictions are described in applicable specification sections.

Allocate costs for work not specifically mentioned to the Line Item most closely associated with work involved. Unless there is a specific Line Item for administrative costs, such as Quality Control and Safety, allocate such costs proportionally across all Line Items.

1.2 QUALITY CONTROL SYSTEM (QCS)

1.2.1 Definition

The terms "Contract Line Item Number (CLIN)" and "Line Item" are interchangeable herein (e.g.: CLIN 0001 is Line Item 0001). The term "CLIN" is a contracting term used in the Quality Control System (QCS) payment data base.

1.2.2 Instructions

See Section 01 45 04 C0NTRACTOR QUALITY CONTROL for instructions on linking a CLIN to a schedule of values of pay activities and construction schedule, and in-depth payment procedure.

1.3 DEFINITIONS

1.3.1 Compensating Slopes

The allowance for material to be placed above the specified fill tolerance to compensate for the specified foreshore slope being below grade due to sediment relocated by natural forces between the time of placement and payment surveys. This is permitted for payment purposes only.

1.4 SUBMITTALS

Government approval is required for submittals with a "G" designation;

submittals not having a "G" designation are for information only. When used, a designation following the "G" designation identifies the office that will review the submittal for the Government. Transmit submittal items in accordance with Section 01 33 00 SUBMITTAL PROCEDURES:

SD-01 Preconstruction Submittals

Schedule of Values; G, RO

SECTION 01 22 00 Page 2

Provide a breakdown of lump sum items into proposed pay activities. Schedule of Values will become basis for CLIN and Pay Activity data in the QCS payment data base.

1.5 LUMP SUM PAYMENT ITEMS

Payment items for the work of this contract for which contract lump sum payments will be made are listed in the LINE ITEMS AND PRICING SCHEDULE and described below. All costs for items of work, which are not specifically mentioned to be included in a particular lump sum or unit price payment item, shall be included in the listed lump sum item most closely associated with the work involved. The lump sum price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for which separate payment is not otherwise provided.

Progress payments for lump sum CLINs will be made in accordance with the Payments Under Fixed-Price Construction Contracts clause of Section 00700 CONTRACT CLAUSES in Volume 1. Provide a list of pay activities, (Schedule of Values) to breakdown bid for each lump sum CLIN. Within 20 calendar days after receiving Notice to Proceed, submit Schedule of Values for Government approval. An unbalanced Schedule of Values and Pay Activity Schedule will be returned for revision. If this contract contains either the Continuing Contracts clause or the Continuing Contracts (Alternate) clause, the Contractor should take into account the amount reserved for contract payments when preparing the construction schedule.

1.5.1 Construction/Vibration Control and Monitoring (Line Item 0003)

Payment will be made for costs associated with or incidental to the protection of existing structures from construction activities and monitoring. See Section 02 22 13 VIBRATION MONITORING REQUIREMENTS FOR

EXISTING STRUCTURES.

1.5.2 Environmental Species Monitoring (Line Item 0004)

Payment will be made for costs associated with or incidental to coordination and management of the monitoring of sea turtles, migratory birds, and endangered species, which will be performed by Miami-Dade County. See Section 01 57 20 ENVIRONMENTAL PROTECTION.

1.5.3 Turbidity Monitoring (Line Item 0005)

Payment will be made for costs associated with or incidental to obtaining, analyzing, and reporting the results of monitoring for turbidity. See Section 01 57 25 TURBIDITY AND DISPOSAL MONITORING.

1.6 UNIT PRICE PAYMENT ITEMS

Payment items for the work of this contract on which the contract unit price payments will be made are listed in the LINE ITEMS AND PRICING SCHEDULE and described below. The unit price and payment made for each item listed shall constitute full compensation for furnishing all plant, labor, materials, and equipment, and performing any associated Contractor quality control, environmental protection, meeting safety requirements, tests and reports, and for performing all work required for each of the unit price items.

SECTION 01 22 00 Page 3

Each Unit Price CLIN may be a single pay activity item or may be broken down into pay activities with smaller quantities equal to CLIN total.

Contract unit price multiplied by agreed quantity is full compensation.

1.6.1 Beach Fill (Line Item 0001)

1.6.1.1 Payment

a. Payment will be made for costs associated with or incidental to preparation of access areas, barricades and signs, debris removal, pipeline crossing, excavation and transportation of beach fill, constructing the beach profile and final dressing; noise control;

condition surveys; and restoration of all access areas to preconstruction condition or as otherwise indicated on the drawings.

See Sections 01 57 20 ENVIRONMENTAL PROTECTION and 35 30 00 BEACH FILL.

b. In addition to the above, payment will be made for in-place beach fill to the tolerance line indicated in Section 35 30 00 BEACH FILL.

Payment quantities will be determined by the Government using average end area method of calculation. When beach fill is placed up-slope above slough zone to compensate for wave action, payment of end area will be based on a cut and fill calculation. No payment will be made for material placed on the up-slope above the tolerance A(u) that exceeds A(s) (Refer to Beach Fill Tolerance figure indicated in the paragraph CONSTRUCTION FORMS AND DETAILS of Section 35 30 00 BEACH

FILL).

c. The Government will pay 95 percent (withhold 05 percent) of progress and total payment made under this line item until all access areas have been restored as indicated above. This is not considered retainage under clause PAYMENTS UNDER FIXED-PRICE CONSTRUCTION CONTRACTS of Section 00700 CONTRACT CLAUSES. This is considered payment withheld for work paid for under this line item which has not been performed. Acceptance of repairs to access routes may be subject to final approval of local permitting authorities.

1.6.1.2 Measurement

a. The maps and/or drawings already prepared (clause CONTRACT DRAWINGS, MAPS, AND SPECIFICATIONS of Section 00700 CONTRACT CLAUSES in Volume 1) are believed to represent accurately the existing conditions at the time the surveys were performed, but the depths and elevations shown thereon may be verified and corrected by elevations and soundings taken before commencing the work. Once quantities within a specified reach or section have been determined through the use of in-place measurement, they will not be reopened except on evidence of collusion, fraud, or obvious error.

b. Beach fill satisfactorily placed will be measured for payment by use of the average end area method. The quantities will be computed by the Government in accordance with clause QUANTITY SURVEYS of Section 00700 CONTRACT CLAUSES in Volume 1. Measurement of quantity placed for pay purposes will be based on original and final cross sections made on the section or reach indicated on the drawings. The Contractor shall give 3 calendar days advance notice, in writing, to the Contracting Officer's Representative of the need to perform the original and final surveys. Quality Control Surveys shall be the responsibility of the Contractor. Monthly partial payments will be based on approximate

SECTION 01 22 00 Page 4 quantities determined by measurement of the in-place beach fill and in accordance with clause QUANTITY SURVEYS of Section 00700 CONTRACT CLAUSES in Volume 1.

c. In accordance with clause QUANTITY SURVEYS of Section 00700 CONTRACT CLAUSES in Volume 1, the Government will perform pre- and post-construction topographic survey at 100-foot stations with elevations taken at 10-foot range intervals from the baseline to the toe slope elevation. In order to achieve final grade in slough zone, and account for natural fencing prior to Government survey, the Contractor shall place material to final grade within tolerance for the entire slope or may stockpile beach fill up-slope of the swash zone as long as the upslope fill volume above tolerance does not exceed volume on the foreshore slope below tolerance, known herein as the compensating slopes. After stockpiled beach fill is measure for payment, the Contractor shall produce a smooth uniform slope to within the acceptable tolerances of the final grade from the top of slope to the water line. Once post-construction survey is performed, no measurements will be revised except on suspicion of fraud or obvious error.

1.6.1.3 Unit of Measure

Cubic yard.

1.6.2 Beach Tilling (Line Item 0002)

1.6.2.1 Payment

Payment will be made for costs associated with or incidental to beach tilling. See Sections 01 57 20 ENVIRONMENTAL PROTECTION and 35 30 00 BEACH

FILL.

1.6.2.2 Measurement

Beach tilling will be measured for payment by the actual area tilled to the tenth of a acre.

1.6.2.3 Unit of Measure

Acre.

1.6.3 Contracting Officer's Field Office (Line Item 0006)

1.6.3.1 Payment

Payment will be made for costs associated with or incidental to providing, maintaining, and final disposition of the Contracting Officer's field office including all costs for rent and provision of all services indicated in Section 01 52 10 CONTRACTING OFFICER'S FIELD OFFICE. Costs for such provision and maintenance of the Contractor's own field office and other facilities will not be paid for under this line item.

1.6.3.2 Measurement

The basis for payment will be the amount of time that the Contracting Officer's field office is available to the Government within the duration of the contract.

SECTION 01 22 00 Page 5

1.6.3.3 Unit of Measure

Month.

1.6.4 55th Street Hotspot Staging Area (Line Item 0007)

1.6.4.1 Payment

Payment will be made for costs associated with or incidental to use of the staging area at the 55th Street Hotspot. A total of 52 parking spaces are available within the limits of the staging area shown on the drawings.

This encompasses 2 full rows of parking located along the southern most parking aisle. Each spot has a cost of $10 per day per spot. See Section

01 50 02 TEMPORARY CONSTRUCTION FACILITIES.

1.6.4.2 Measurement

Payment shall be measured by the actual number of days used by the Contractor. The estimated duration in Section 00010A LINE ITEMS AND PRICING SCHEDULE is provided for bidding purposes only and will be determined on actual quantity used.

1.6.4.3 Unit of Measure
