CLAUSES INCORPORATED BY FULL TEXT

52.211-10 COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK (APR 1984)

The Contractor shall be required to;

(a) Commence work under this contract within 10 calendar days after the date the Contractor receives Notice To Proceed (NTP) on the hydraulic design phase.

(b) Prosecute the work diligently, and

(c) Complete the entire work ready for use not later than the timeframes listed below.

(1) The work shall be completed in (3) Phases which include (1) Hydraulic Design, (2) Prototype

Design, Manufacture and Supply/Delivery and (3) Component Installation as defined below.

These phases will involve two types of runners and at times the tasks within and between the phases will overlap depending on the scope and progress of the tasks. The Contractor shall anticipate and plan for the submittal process and timeframes required for Government review and approvals. Submittal review and approvals will occur during all phases of the project.

a. Phase (1) generally includes the hydraulic design, development, and evaluation of turbine wetted passage components and prototype design for selected components. The turbine runner designs will include two types of runners (fixed and adjustable blade) and include the integrated development and evaluation of the turbine runner and hydraulic components throughout the water passageway.

b. Phase (2) generally includes detailed component engineering of both types of runners, ancillary components, generator components, and other hydraulic components in the water passageway as required by these specifications. Phase (2) also includes manufacture and supply of the required components, delivery to site or other agreed location, and safely store the components until installation commences.

c. Phase (3) generally includes the installation of the turbine runners, generator windings (where applicable), required ancillary and water passageway components, along with the refurbishment of some existing turbine components. Phase (3) also involves the cooperative process to fully commission and test the completed unit, and generator components where applicable.

(2) Schedule Information and Constraints for Phase (1) Hydraulic Design:

a. Phase (1) work includes an iterative and collaborative effort between the Contractor and the Government as described in these specification. The time period to complete each iteration is dependent on the Contractor’s plan, facilities and resources but will generally follow the following order and duration for both the Adjustable and Fixed Designs;

c. Prior to the start of each iteration performance model testing the contractor shall ship the appropriate wicket gates to the Government’s research facility at ERDC for Observational testing.

d. Following completion of each iteration performance model testing, the Contractor shall ship the model runner to the Government’s research facility at ERDC for Observational testing.

e. Most activities in the table above have a finish-start relationship and cannot be conducted concurrent with another activity with the following exceptions: Baseline CFD – Existing Runner (Initial CFD) can be conducted in parallel with the Hydraulic Design and CFD Analysis (First Iteration); Hydraulic Design and CFD Analysis (Second Iteration) may begin following the 1st Iteration Design IPR and acceptance of the First Iteration hydraulic design for model.

f. USACE ERDC Observation Model has one test stand and can accommodate testing for one runner at a time.

g. Transition from the Adjustable Runner Hydraulic Design to the Fixed Runner Hydraulic Design - CFD Design (First Iteration) for the fixed runner can begin following CFD Design (Fourth Iteration) for the adjustable runner. Should an optional adjustable runner hydraulic design iteration be awarded, it will have priority in the Performance and Observational model test stands and a revised schedule shall be created as such.

h. Prototype Design shall begin following the Hydraulic Design and CFD Analysis (Third Iteration) for each runner type In Accordance With (IAW) with the specifications.

(3) Schedule Information and Constraints for Phase (2) Prototype Design, Manufacture and

Supply:

a. Prototype Design effort will overlap between Phase 1 and Phase 2 for each runner type as specified

b. The Government will inspect the supplies during the casting, fabrication and machining and upon delivery as required by the specifications. The Contractor shall plan for Government involvement and the required timeframes for these activities.

c. Following the approval of the Prototype Design for the Adjustable Runner and water passageway components a NTP will be issued for the manufacture and supply of the Base six (6) Adjustable Runners and all other associated equipment related to those units IAW the Adjustable Runner Supply Bid Schedule CLINs.

d. Following the acceptance of the Prototype Design for the Fixed Runner and water passageway components a NTP will be issued for the manufacture and supply of the remaining eight (8) Runners and all other associated equipment related to those units consistent with the base CLINs or associated options clause guidance. As described in 01 11 00.00 26 paragraph 1.2, the configuration (fixed or adjustable) of the remaining eight (8) units may vary based upon design outcome. Should some of the remaining eight runners be determined to be adjustable runners, award of alternate bid items and modification to the base contract will take place according to the Bid Schedule.

e. Delivery and storage of components; the government anticipates that two units may be stored in the government furnished storage building beyond unit components staged for installation in the powerhouse. Any additional space and storage that might be available should be coordinated with the Contracting Officer or the Contracting Officers Representative before delivery. All other finished items shall be stored by the contractor until space is made available.

(4) Schedule Information and Constraints for Phase (3) Component Installation: For Contractor schedule development purposes the work shall commence at the determined unit location as follows:

a. NTP for each unit will be granted only after confirmation that all parts are on-site and accepted for installation.

b. Following the Adjustable Runner and associated component design, manufacture and delivery, a NTP and outage for the First unit will be issued.

c. The first unit outage shall be conducted without any other unit installation NTPs issued until commissioning is complete and the unit is accept by the government.

d. The Contractor shall include 10 working days in the schedule for the Government to dewater and prepare each unit for disassembly.

e. Following completion of the first unit installation, no more than two units may be out of service at the same time unless allowed by the Contracting Officer.

f. Notification by government to contractor of next unit number for dewatering and replacement will be given at least 90 days in advance of dewatering

g. Following the commissioning of the first unit, NTP will be issued for each successive unit installation. A schedule pattern of starting a unit outage at approximately mid-point of the preceding unit completion is anticipated for the remaining 12 units, the exact schedule will be as coordinated between the contractor and the USACE in the execution schedule.

(5) Asbestos Containing Materials (ACM). Asbestos abatement (cleaning and wiping) in the generator rotor and stator area is planned for all fourteen units. Asbestos abatement (cleaning and wiping) of the generator rotor and stator areas will be performed under a separate contract (by others). Units 1-4, and 7-12 generator stator and rotor areas were abated during a recently completed generator rewind contract, but may contain some residual asbestos. During prosecution of the work, other ACMs may be encountered, such as wire insulation, pipe insulation, gaskets, etc. If ACMs are encountered, the Contractor shall immediately notify the Contracting Officer to coordinate further abatement (by others).

a. The Contractor shall include 28 calendar days in their schedule for asbestos abatement

(cleaning and wiping) of the stator and rotor (by others) for each unit. This time includes initial asbestos abatement pre-cleaning of the generator area. After acceptance of the pre-cleaning the Contractor shall begin disassembly of the generator and shall place the rotor on the existing rotor pedestal and provide a dust containment structure over and around the rotor. The structure shall be adequate for the abatement of asbestos and containment of any dust as a result of the abatement effort.

b. The Contractor shall provide a safe working platform for all work conducted on the stator for asbestos abatement (by others). During this time frame the Contractor shall allow for unimpeded access to the rotor and stator for asbestos abatement. The Contractor can proceed with other work in the powerhouse but will not be allowed to work in the generator/turbine pit areas that are subjected to the asbestos abatement operations.

Actual time may vary depending on the extent of the abatements as required.

(6) Upon completion of work on the First unit (and all subsequent units) and prior to unit water-up, Pre-Operational Test Phase inspections and tests will commence. Upon completion of Pre-Operational Test Phase, Operational Test Phase will commence. The Contractor shall include 15 consecutive calendar days in the project schedule for Pre-Operational Test Phase and Operational Test Phase inspections and tests. Upon completion of the Operational Test Phase, the Government will perform Post-Operational Test Phase prior to unit acceptance.

(7) After the completion of each unit, the Contractor shall complete final cleanup for the unit not later than 15 calendar days after returning the unit to service.

(8) Upon completion of the Last unit, the Contractor shall complete submission of, working “as-built” contract drawings and final approved versions of Contractor prepared drawings in accordance with Section 01 78 00.00 28.

(9) Upon returning the Last unit to service, powerhouse demobilization shall be completed within 30 calendar days and full site demobilization and clean-up shall be completed within 60 calendar days.

(10) The timeframes to complete the work will be based on the accepted proposed schedule as awarded. See specification for details in preparing a proposed project activity based schedule.

52.211-12 LIQUIDATED DAMAGES--CONSTRUCTION (SEP 2000)

(a) If the Contractor fails to complete the work within the time specified in the contract, the Contractor shall pay liquidated damages to the Government in the amount of $42,161.00 for each calendar day of delay until the work specified in FAR Clause 52.211-10, Commencement, Prosecution, and Completion of Work, subparagraph (c)(4), Phase 3 Component Installation, is completed or accepted.

(b) If the Government terminates the Contractor's right to proceed, liquidated damages will continue to accrue until the work is completed. These liquidated damages are in addition to excess costs of repurchase under the Termination clause.
