Due to the regional economic and environmental impacts of navigation lock closures, the completion date listed in Section 00700, FAR Clause 52.211-10, Commencement, Prosecution and Completion of Work, is a firm completion date. Navigation lock closures are coordinated and scheduled regionally based on economic and environmental factors. Any changes to scheduled lock closures could create legal liabilities for the Walla Walla District. Therefore, time is of the essence and the contractor will prosecute this work using its best efforts to meet the referenced completion date. The Government suggests that the contractor go to 24 hour/7day a week shifts if it appears from the contractor’s construction schedule that the contractor will not complete the work by the completion date. Finally, the per diem liquidated damages rate under FAR Clause 52.211-12 represents a reasonable forecast of costs estimated for 24 hour/7 day a week inspections and superintendence by the Government.
FUNDS ARE NOT PRESENTLY AVAILABLE FOR THIS WORK. NO CONTRACT WILL BE
AWARDED UNLESS FUNDS BECOME AVAILABLE.
