Generally, paper documents will also govern where effective receipt dates are required, such as contractor claims submitted under the Disputes clause of the contract and progress payment requests. However in the case of administrative plans, shop drawings and other submittals transmitted for government review, both the electronic and hard copies are required to begin the review process, so the effective date of receipt will be the date when both the electronic and hard copies are received by the government.

1.3 PARTNERING
The Government encourages formation of informal project partnerships on all projects. A project partnership strives to utilize a cooperative working relationship to jointly establish and effectively reach mutual project execution goals. The partnering process will in no way relax or stiffen the requirements of the contract, but will enhance the likelihood of success through improved working relationships. The possibility of an informal partnership may be discussed at the Pre-construction Conference for this project.
1.4 RIGHTS-OF-WAY
a. The rights-of-way for the work to be constructed under this contract, within the limits indicated on the drawings, will be provided by the Government without cost to the Contractor. If these rights-of-way are used by the Contractor, he shall, at his own expense, do all work necessary to make such rights-of-way suitable for traveling to and from the worksite. Upon completion of the Contractor's work, any such rights-of-way furnished by the Government shall be left in a
SECTION 01 00 00.00 09 Page 3 condition satisfactory to the Contracting Officer.
b. When so directed by the Contracting Officer, the Contractor shall, without expense to the Government and at any time during the progress of the work when it is not being actively used for contract operations, promptly vacate and clean up any part of the Government grounds or rights-of-way that have been allotted to or have been in use by the Contractor.
c. The Contractor shall not obstruct any existing roads on lands controlled by the United States except with written permission of the Contracting Officer and shall maintain such roads in as good condition as exists at the time of commencement of work under this contract.
d. The Contractor shall procure, without expense to the Government, all additional lands, access roads, or rights-of-way necessary for his use in the performance of the work or as required by his method of operation. The Contractor shall submit written evidence to the Contracting Officer that he has obtained the rights-of-way from the property owners. The written evidence shall consist of an authenticated copy of the conveyance under which the Contractor acquired such rights-of-way, prepared and executed in accordance with the laws of the State in which the land is located. The Contractor shall also obtain from the owners a release for the Government for any damages which may result from his use of such rights-of-way. The written conveyance and release shall be provided to the Government prior to use of Contractor obtained additional lands, access roads, or rights-of-way. If temporary rights-of-way are obtained by the Contractor the period of time for those rights shall coincide with Section 00 80 00.00 09 SPECIAL CONTRACT REQUIREMENTS, paragraph COMMENCEMENT, PROSECUTION, AND COMPLETION OF WORK, plus a reasonable time for any extension granted for the completion of the work. Any agreements or permits with levee boards, counties, parishes, municipalities, or other political subdivisions for moving material and equipment will be the responsibility of the Contractor and shall be obtained at no expense to the Government. Any delays to the Contractor resulting from delays in procuring such additional lands, access roads, rights-of-way, or permits for moving material and equipment for his work under this contract will not be a basis for any claim for increase in the cost of this contract. The Contractor shall make his own investigations to determine the conditions, restrictions and difficulties which may be encountered in acquiring such rights-of-way and in the transportation of material and equipment. In addition, the Contractor shall be solely liable for any and all damages and claims of any nature whatsoever arising from or growing out of the acquisition and use of rights-of-way, etc., other than those furnished by the Government.
f. The Contractor shall repair at no expense to the Government, any and all damage to any existing roads when such damage is a result of his operations under this contract. (CEMVK-OC, 1989)
1.5 LAYOUT AND MARKING OF RIGHTS-OF-WAY
The Contractor shall layout and mark the rights-of-way limits as indicated on the drawings prior to beginning any other work, unless otherwise approved. The marking shall be placed at intervals approved by the Contracting Officer. The rights-of-way limits shall be marked by stakes, flagging or other approved means. The marking shall be highly visible from
SECTION 01 00 00.00 09 Page 4 a distance of at least 100 feet, and shall be maintained for the duration of the contract. If the rights-of-way marking should fade significantly in color, become damaged or lost as a result of the Contractor's operation or as a result of vandalism, or in any other way cease to function as a highly visible marker of the rights-of-way limits, the Contractor shall layout and restore the marking to the original condition. After all work is complete and upon approval of the Contracting Officer, the Contractor shall remove all marking. No separate payment will be made for layout, marking and maintaining the rights-of-way limits or for removing the marking.
1.6 INITIAL SURVEYS AND QUANTITIES SURVEYS
Prior to any construction of any definable feature of work, the Contractor shall locate the centerline and baseline stations as specified in the before-construction drawings, task order specifications, and/or as directed in the field by the Contracting Officer Representative. The surveys shall be under the direct supervision of a licensed surveyor with at least five years of hydrographic surveying experience, no less than 7 days before the work commences. Submit the name and address of the professional surveyor responsible for surveying to the Contracting Officer's Representitive prior to the start of survey activities. All Hydrographic surveys shall be conducted using multi-beam technology. The Contractor shall provide overbank surveys at each dig-in portion of the dike. Overbank survey shall extend 400 ft inland along the baseline and shall extend 75 ft each side of the Structural Azimuth Line. The Contractor shall layout the work and take the following surveys of placed stone for compliance with the grades, limits, and tolerances specified in the before-construction drawings, task order specifications, and/or as directed in the field by the Contracting Officer Representative.
Survey profiles, not to exceed 20 feet intervals, shall be taken and plotted to cover the area of the stone construction before stone placement begins. Survey cross-sections, not to exceed 100 feet intervals, shall be taken and plotted to cover the area of the stone construction before stone placement begins. Additional profiles and cross-sections shall be taken and plotted as necessary or as directed by the onsite Government Representative during construction operations. Complete electronic survey data files (.xyz, .txt File: (Point # Northing, Easting, Elevation), .dtm, etc.), copies of the field notes, plotted profiles and cross-sections, and quantity computations for all stone placement under this contract shall be furnished through the Contracting Officer's Representative for review and approval at least 7 calendar days ahead of the initial placement of any stone. Surveys mentioned above shall be provided as RAW data and processed in a 2 X 2 grid. Profiles and cross-sections taken more than 14 calendar days ahead of construction will not be acceptable.
1.7 MONITOR SURVEYS
Once stone placement has begun on the first dike, as shown in SECTION 01 15 00.00 09 GENERAL REQUIREMENTS, para. 3.2.1 Sequece, additional monitor surveys shall be taken of the next or subsequent dikes if stone placement of the next or subsequent dike begins more than 14 days after the initial surveys in para. INITIAL SURVEYS AND QUANTITIES SURVEYS. These monitor surveys shall also be performed before stone placement resumes after more than 14 days delay in stone placement operations. As directed by the Government Representative, if these monitor surveys indicate changed conditions from the initial surveys (para. INITIAL SURVEYS AND QUANTITIES SURVEYS), additional surveys shall be performed. Survey profiles not to exceed 20 feet intervals shall be taken and plotted to cover the area of
SECTION 01 00 00.00 09 Page 5 stone placement. Survey cross-sections not to exceed 100 feet intervals, shall be taken and plotted to cover the area before any additional stone placement begins. Additional profiles and cross-sections shall be taken and plotted as necessary or as directed by the on-site Government Representative during construction operations. Complete electronic survey data files (.xyz, .txt File: (Point # Northing, Easting, Elevation), .dtm, etc.), copies of the field notes, plotted profiles and cross-sections, and quantity computations for all stone placement under this contract shall be furnished through the Area Office to the Vicksburg District, Engineering Division, River Stabilization Section for review and approval at least 7 calendar days ahead of the initial placement of any stone.
1.8 COMPLIANCE SURVEYS
Survey profiles and cross-sections shall be taken and plotted of the completed stone placement daily or as directed by the Government Quality Assurance Representative. Copies of the field notes, plotted cross-sections, and quantity computations shall be furnished as requested by the Contracting Officer or his/her representative. The Contractor can utilize single beam or multi-beam technology hydrographic surveys to prepare daily compliance surveys; however, the Contractor will not be allowed to place Stone "C" above Stone "A" as shown in the construction drawings without multi-beam surveys to ensure that the entire length of underwater revetment is constructed to grade at and between cross sections. Complete electronic survey data as indicated in Paragraph INITIAL SURVEYS AND QUANTITIES SURVEYS shall be provided to the Engineer for review and approval.
The profiles and cross-sections shall be plotted on 10 x 10 cross-section tracing paper to a scale of 1-inch = 20 feet vertical and horizontal. The profiles and cross-sections shall be plotted with the profiles and corresponding vertical and horizontal scales at the top of the sheet. The horizontal stationing for the profiles shall be plotted with increasing stationing running as if looking upstream. The cross-sections with corresponding vertical and horizontal scales shall be plotted beneath the profile directly under the corresponding stationing of the profile. The area of daily stone placement shall be identified by coloring the area of placement with alternating color pencils. The right and left sides of the cross-section shall conform with the direction of the increasing stations.
Horizontal distance shall be shown on the top margin in distances of 100 feet, and datum shown on the appropriate horizontal lines. The cross-sections shall be identified by station number under each section.
Approximately one foot shall be left void at each end of the roll. Near each end of the roll, pertinent information shall be shown, including job name, item number, inclusive stations, contract number, completion data and name of inspector. Sections plotted by the electronic plotter will be acceptable. Pencil work shall be of such firmness and line weight that a good reproduction may be obtained.
