Note concerning the below CLIN sturcuture:
CLIN 0001 (and each subsequent option) represents the labor associated with applying the herbicide mixes for CLINs 0002 – 0011 (and each subsequent option). This is estimated at 1,000 acres per year.
CLINs 0002 – 0011 and their corresponding option CLINs are as prescribed in the PWS, paragraph 6.3, Table 1 and 2 (Herbicide Mixes and Herbicide Authorized Use List). CLIN 0011’s unit of measure is each, with “each” representing the unit of measurement for each application of Mix 10 to the remaining 170 acres of the 1,000 total acres for the base and subsequent option years.

ADDENDUM TO 52.212-1
All offers shall be submitted via email to the points of contact listed in this paragraph. All email submissions shall include the solicitation number (W912DW24QSEW) on the subject line. The offeror bears the burden of ensuring the offer reached the designated contracting office on time and should allow reasonable time for transmission to be completed. Large email files may not transmit properly so it is advised to send large attachments in several separate emails. All pages of the transmission and attachments must reach the office before the offer due date and time. Any part of the offer that arrives after the specified offer due date and time may not be considered. The offeror bears the risk of non-receipt of its offer and should confirm by telephone or email that the offer was received. INSTRUCTIONS FOR WRITTEN SUBMITTALS
The Government will award a single Requirements contract on a Lowest Price Technically Acceptable (LPTA) basis pursuant to the award evaluation criteria stated in FAR clause 52.212-2. The Government intends to award a contract without discussions. Therefore, offerors are cautioned to examine this solicitation in its entirety and to ensure that their proposal contains all necessary information, provides all required documentation, and is complete in all respects. Per FAR provision 52.212-1(g), the offeror’s initial proposal should contain the offeror's best terms from a price and technical standpoint. However, the Government reserves the right to conduct discussions, if determined necessary by the Contracting Officer.
All questions regarding this solicitation shall be submitted in writing via email to all email addresses listed in the first paragraph of this addendum. All email submissions shall include the solicitation number (W912DW24QSEW) on the Subject line. All questions pertaining to this solicitation shall be submitted no later than 15 working days after the issuance of the solicitation to allow the Government sufficient time to respond prior to the closing date. If applicable, please identify the PWS/SOW paragraph number as reference to questions. Answers to questions will be posted to SAM website at https://www.SAM.gov at Contract Opportunities under the solicitation number. It is the offerors’ responsibility to monitor the web site for posting of amendments, answers to questions, and other instructions, if any.
At this time, a site visit is not scheudled, but can be provided, if requested.
ALL OFFERS SHALL INCLUDE THE FOLLOWING DOCUMENTATION:
- A cover letter with signatures of a corporate officer authorized to negotiate for the company. Include name of the company, phone, fax numbers, and email address(es).
- Submit proposed CLIN (Contract Line Item Number) prices for each CLIN, to include all Option CLINs.
Offerors shall include a UNIT price and AMOUNT. The AMOUNT price is determined by multiplying the QUANTITY by the UNIT price.
- Acknowledged and signed copies of amendment(s), if applicable. The number of copies required will be shown on the SF 30.
- Provide Unique Entity ID (as indicated in SAM), CAGE, DUNs and Tax Identification Number. Offerors are required to be fully registered in SAM at the time an offer is submitted. Offers from offerors who are not fully registered in SAM will not be evaluated and will not be eligible for award. There are no exceptions.
Evaluation Criteria:
FACTOR 1 – Technical
- Washington State Department of Agriculture (WSDA) Commercial Applicator License –
Submission: In accordance with PWS Paragraphs 6.1 & 6.5, the offeror shall submit documentation demonstrating that at least one employee, employed by the offeror, has a current and valid WSDA Commercial Applicator License.
- Experience –
Submission: The offer shall submit supporting documentation demonstrating that either the offeror or subcontractor(s) have a minimum of three (3) years of “relevant” experience within six (6) years preceding the issuance of this solicitation.
FACTOR 2 – Past Performance for the Prime Contractor –
The offeror shall submit a MINIMUM of one (1), MAXIMUM of three (3) recent (recent is defined as within six (6) years of the date on this solicitation) past performance with same/similar services. For each project/contract, each offeror shall submit a description to include the place of performance, period of performance, value of contract of effort, and a point of contact. The Contracting Officer may request additional past performance information at any time prior to contract award.
FACTOR 3 – Price –
The offeror shall submit proposed pricing for the base period and each option period; this is applicable to all Contract Line Item Numbers.
Offerors shall enter the total price in each line item. Proposals shall be provided with only 2-digits after the decimal point. Prices provided shall be fully loaded, inclusive of all fees, overheads, G&A, insurance, profits, or any other markups. Failure to do so may be a cause for the proposal to not be considered for award. In the event there is a difference between a unit price and the total amount, the unit price will be held to be the intended proposal and the total of the CLIN will be recomputed accordingly.

52.212-2 EVALUATION--COMMERCIAL PRODUCTS AND COMMERCIAL SERVICES (NOV 2021)
Paragraph (a) is hereby replaced with the following:
The Government will award a Requirements contract resulting from this solicitation to the responsible offeror whose offer conforming to the solicitation is the best value to the Government, price and other factors considered. Award will be made in accordance-with FAR Part 13 – Simplified Acquisition Procedures and using the Lowest Price Technically Acceptable (LPTA) source selection process.
Except communications conducted for the purpose of minor clarifications, the Government intends to evaluate offers and issue a Firm-Fixed-Price (FFP), Requirements contract, without discussions. Therefore, each initial offer should contain the offeror’s best terms from a technical and pricing standpoint. However, the Government reserves the right to conduct discussions if it is later determined by the Contracting Officer to be necessary.
EVALUATION FACTORS. The following factors shall be used to evaluate quotations:
Factor 1. Technical Evaluation Factor 2. Past Performance Factor 3. Price
FACTOR 1: Technical Evaluation–

Scope (types of services identified and defined in the PWS requirements) and Magnitude of Effort (a contract or aggregated contracts during the 6-year time period totaling at least $200,000). At a minimum, the offeror shall provide the following information for each contract that it relies upon to meet the relevant professional experience requirements:
a) Project title and customer name;
b) Contract number (if such a designation exists);
c) A narrative explaining the requirement and how it is relevant to the requirements of this solicitation;
d) Contract performance
ADJECTIVE DEFINITION
Acceptable
Offeror provides a current and valid copy of at least one employee(s) WSDA Commercial Applicator License and supporting documentation demonstrating the offeror or subcontractor(s) have a minimum of three (3) years of relevant experience within the six (6) years preceding the issuance of the solicitation.

Offeror does not provide a current and valid copy of at least one employee(s) WSDA Commercial Applicator License and supporting documentation demonstrating the offeror or subcontractor(s) have a minimum of three (3) years of relevant experience within the six (6) years preceding the issuance of the solicitation.
Factor 2: Past Performance for the Prime Contractor –
The Past Performance rating will be based on an “Acceptable” / “Unacceptable” basis. The following definitions will be used in evaluating the degree the offeror will satisfactorily provide the required services based on past and current performance records. An Acceptable or Unacceptable rating will be determined as follows:
ADJECTIVE DESCRIPTION
Acceptable Based on the offeror’s performance record, the Government has a reasonable expectation that the offeror will successfully perform the required effort, or the offeror’s performance record is unknown. (See note below.)
Unacceptable Based on the offeror’s performance record, the Government has no reasonable expectation that the offeror will be able to successfully perform the required effort.
Note: In the case of an offeror without a record of relevant past performance or for whom information on past performance is not available or so sparse that no meaningful past performance rating can be reasonably assigned, the offeror may not be evaluated favorably or unfavorably on past performance. Therefore, the offeror shall be determined to have unknown past performance. In the context of acceptability/unacceptability, “unknown” shall be considered “acceptable.”
a. Past Performance Information: The information presented in the Past Performance References and information obtained from other available sources other than those identified by the Offeror (such as past performance information obtained from Federal, State and local Government agencies, better business bureaus, published media, and electronic data bases available to the Government) will be the basis for evaluation of this factor.
b. Past Performance Evaluation: The Government will consider the offeror’s previous and current record of contractual performance. The Government assessment will focus on recent contracts that are relevant to the effort required by this solicitation. Recent is defined for this action to be contracts that were performed within the last three (3) calendar years from the issuance date of the Request for Quote (RFQ). Relevant contracts include individual contracts that are similar, in whole or in part, to this solicitation, including contracts performed by a teaming partner or subcontractor.
c. The Government may reject a proposal if it is found that any information that has a negative impact on the offeror’s past performance record has been deleted, misrepresented, or withheld.
d. It is at the Government’s discretion to determine whether past performance information furnished is or is not considered similar to the size and scope of the present requirement. Should the offeror have no past performance information the Government will assign a rating of “Acceptable.”
e. Offerors are cautioned that, in conducting the past performance assessment, the Government may use data provided in the offeror's proposal and data obtained from other sources. Since the Government may not necessarily interview all of the sources provided by the offeror’s, it is incumbent upon the offeror’s to explain the relevance of the data provided. Offerors are reminded that while the Government may elect to consider data obtained from other sources, the burden of proving an “acceptable” past performance rests with the offeror’s.
f. Offerors may provide information on problems encountered on the contracts identified in their past performance submissions and the offeror’s corrective actions.
Factor 3: Price –
Price will not be rated. Price analysis will be conducted to determine reasonableness.
Price will be evaluated using various price analysis techniques and procedures IAW FAR 13.106-2(b) including but not limited to, comparison of the proposed price received in response to the solicitation with a comparison to the Independent Government Estimate (IGE) and Market Research.
In order to be considered for award, the Offeror must receive an acceptable rating for Factors 1 & 2 and a fair and reasonable determination for Factor 3. Under Factor 1, both WSDA Applicator License and Experience must be acceptable to receive an overall rating of acceptable for Factor 1, no exceptions.
Factor 1 Technical Evaluation – Acceptable Factor 2 Past Performance – Acceptable Factor 3 Price – Price is determined to be fair and reasonable
(b) Options: The Government will evaluate offers for award purposes by adding the total price for all options to the total price for the basic requirement. To account for the option period(s) possible under Clause 52.217-8 (maximum six months), Option to Extend Services, the Government will take the price for all CLINS of the final option period, prorate it to a six-month value, and add it to the sum of all CLINS (base plus all option periods). This amount will be the total evaluated price. The Government may determine that an offer is unacceptable if the option prices are significantly unbalanced. Evaluation of options shall not obligate the Government to exercise the option(s).
(c) A written notice of award or acceptance of an offer, mailed or otherwise furnished to the successful offeror within the time for acceptance specified in the offer, shall result in a binding contract without further action by either party. Before the offer's specified expiration time, the Government may accept an offer, whether or not there are negotiations after its receipt, unless a written notice of withdrawal is received before award.

The Offeror shall not complete the representation at paragraph (d)(1) of this provision if the Offeror has represented that it "does not provide covered telecommunications equipment or services as a part of its offered products or services to the Government in the performance of any contract, subcontract, or other contractual instrument" in paragraph (c)(1) in the provision at 52.204-26, Covered Telecommunications Equipment or Services-- Representation, or in paragraph (v)(2)(i) of the provision at 52.212-3, Offeror Representations and Certifications- Commercial Products and Commercial Services. The Offeror shall not complete the representation in paragraph (d)(2) of this provision if the Offeror has represented that it "does not use covered telecommunications equipment or services, or any equipment, system, or service that uses covered telecommunications equipment or services" in paragraph (c)(2) of the provision at 52.204-26, or in paragraph (v)(2)(ii) of the provision at 52.212-3.
(a) Definitions. As used in this provision-
Backhaul, covered telecommunications equipment or services, critical technology, interconnection arrangements, reasonable inquiry, roaming, and substantial or essential component have the meanings provided in the clause 52.204-25, Prohibition on Contracting for Certain Telecommunications and Video Surveillance Services or Equipment.
(b) Prohibition.
(1) Section 889(a)(1)(A) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2019, from procuring or obtaining, or extending or renewing a contract to procure or obtain, any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(2) Section 889(a)(1)(B) of the John S. McCain National Defense Authorization Act for Fiscal Year 2019 (Pub. L.
115-232) prohibits the head of an executive agency on or after August 13, 2020, from entering into a contract or extending or renewing a contract with an entity that uses any equipment, system, or service that uses covered telecommunications equipment or services as a substantial or essential component of any system, or as critical technology as part of any system. This prohibition applies to the use of covered telecommunications equipment or services, regardless of whether that use is in performance of work under a Federal contract. Nothing in the prohibition shall be construed to--
(i) Prohibit the head of an executive agency from procuring with an entity to provide a service that connects to the facilities of a third-party, such as backhaul, roaming, or interconnection arrangements; or
(ii) Cover telecommunications equipment that cannot route or redirect user data traffic or cannot permit visibility into any user data or packets that such equipment transmits or otherwise handles.
(c) Procedures. The Offeror shall review the list of excluded parties in the System for Award Management (SAM) (https://www.sam.gov) for entities excluded from receiving federal awards for "covered telecommunications equipment or services."
(d) Representations. The Offeror represents that--
(1) It [ ___ ] will, [ ___ ] will not provide covered telecommunications equipment or services to the Government in the performance of any contract, subcontract or other contractual instrument resulting from this solicitation. The Offeror shall provide the additional disclosure information required at paragraph (e)(1) of this section if the Offeror responds "will" in paragraph (d)(1) of this section; and
(2) After conducting a reasonable inquiry, for purposes of this representation, the Offeror represents that--
It [ ___ ] does, [ ___ ] does not use covered telecommunications equipment or services, or use any equipment, system, or service that uses covered telecommunications equipment or services.
