Section 00 22 00 - Supplementary Instructions

STEP ONE EVALUATION CRITERIA

STEP ONE TECHNICAL PROPOSAL SUBMISSION REQUIREMENTS AND

EVALUATION CRITERIA

A. BASIS OF AWARD

Those offerors who submit “Acceptable” technical proposals in response to Step One will be issued an amendment to the solicitation and will move on to Step Two of the Two-Step Sealed Bidding process. After bid opening in Step Two, the Contracting Officer will award a firm fixed-price contract to the responsive and responsible bidder, whose bid conforms to the solicitation, is fair and reasonable, and provides the lowest overall price to the Government.

Note that this Section includes the submission requirements and evaluation criteria for the Step One technical proposal ONLY. The technical proposal, with the required information noted herein, is the only item that must be submitted in response to Step One.

B. ELIGBILITY FOR CONTRACT AWARD

In accordance with the requirements of Part 9 of the FAR, no contract shall be entered into unless the Contracting Officer ensures that all requirements of law, executive orders, regulations, and all other applicable procedures, including clearances and approvals, have been met. This includes the FAR requirement that no award shall be made unless the Contracting Officer makes an affirmative determination of responsibility. To be determined responsible, a prospective prime contractor must meet the general standards in FAR Part 9 and any special standards set forth in the solicitation.

C. GENERAL TECHNICAL EVALUATION

1. An offeror’s proposal shall consist of all information and material submitted in writing for evaluation in response to the solicitation. The submission of false or misleading information shall be grounds for disqualification of the proposal. Offerors must organize their proposals as described and outlined in Paragraph E below. The offeror’s name, solicitation number, and date must be affixed to the outside of each submission. Each submission must have a table of contents. Pages may be single-sided or double-sided (double-sided pages count as two pages) and must be numbered. Any prescribed page and formatting limitations will be strictly adhered to and enforced by the Government. The Government will not evaluate any excess information resulting from the offeror’s failure to comply with the submission instructions.

2. The evaluation shall be conducted in accordance with FAR Subpart 14.5, Two-

Step Sealed Bidding. For this procurement, only one technical proposal may be submitted by each offeror. Step One proposals are evaluated for technical acceptability. The technical proposal shall not include prices or pricing information.

Offerors should submit a proposal that is complete without the need for additional explanation or information. The Government may make a final determination regarding a proposal’s acceptability solely on the basis of the proposal as submitted.

The Government may proceed with the second step without requesting further information from any offeror; however, the Government may request additional information from offerors of proposals that it considers reasonably susceptible of being made acceptable and may discuss proposals with their offerors. Clarifications or discussions may be held, if necessary and if determined by the Contracting Officer to be in the best interest of the Government. A notice of unacceptability will be forwarded to the offeror upon completion of the proposal evaluation and final determination of unacceptability.

3. Technical proposals will be read at the factor level. If any factor is found unacceptable, the proposal will be determined unacceptable. The initial technical proposal may have limited errors, omissions, weaknesses and/or deficiencies and still be considered reasonably susceptible of being made acceptable, and therefore eligible for discussions, if the Contracting Officer determines that discussions are in the best interest of the Government. However, an initial proposal that contains one or more unacceptable factors will be considered unacceptable and will be eliminated from further consideration.

4. Technical proposals which do not provide the specified information in the specified location in accordance with the submission instructions may be determined unacceptable. The Government is under no obligation to search for information that is not in the specified location.

5. If discussions are held with offerors whose proposals are considered reasonably susceptible of being made acceptable and a revised proposal is requested, the revised proposal will be reevaluated in accordance with the evaluation factors and the standards set forth for the evaluation factors in this solicitation. After completion of discussions and evaluation of any revised proposals, the proposal shall be determined as acceptable or unacceptable. If a proposal, either during initial evaluations or during subsequent evaluations if discussions are conducted, is determined unacceptable, a notice of unacceptability will be forwarded to the offeror upon completion of the proposal evaluation and final determination of unacceptability.

6. The offerors’ conformance with the specified format and submission requirements will be considered during the technical evaluation. Failure to comply with the formatting and/or submission requirements may be seen as indicative of the type of problems that could be expected during contract performance. Lack of conformance and material omission(s) may cause the technical proposal to be rejected as unacceptable.

7. The proposal submission instructions are written to give prospective offerors, where feasible, an indication of the level of detail desired by the Government. The offerors’ failure to include information that the Government has indicated must be included will result in the proposal being found deficient and therefore unacceptable.

D. TECHNICAL FACTOR EVALUATION

1. The Government’s Technical Evaluation Team will evaluate each offeror’s technical proposal received in response to this Step One solicitation based on the standard of each evaluation factor set forth in this Step One solicitation. Each proposal will be evaluated solely against the standards set forth for each technical evaluation factor in this Step One Solicitation. The Technical Evaluation Team will not compare proposals against each other. In accordance with FAR Subpart 14.503- 1(e)(1) and (2), proposals will be rated as Acceptable, Reasonably susceptible of being made acceptable or Unacceptable, as defined in Table 1, below, and as determined by consensus of the Government’s Technical Evaluation Team. There are no relative weights assigned to the factors.

2. The evaluation factors correlate directly to the main organizational tabs identified in the proposal submission instructions in Paragraph E below. However, any information contained in the technical proposal can nonetheless be considered by the Government in its evaluation under any factor.

Table 1 – Technical Ratings

Adjectival Rating Description

Acceptable Offeror has met the Standard indicated by the Evaluation Factor.

Reasonably susceptible of being made acceptable

Offeror has not met the Standard indicated by the Evaluation Factor, due to error(s), omissions(s), weakness

(es) or deficiency (ies), which are capable of being corrected without a major rewrite or revision of the proposal.

Unacceptable Offeror has not met the Standard indicated by the Evaluation Factor.

3. The Government’s Technical Evaluation Team will assign a rating to each evaluation factor within each offeror’s Step One technical proposal. If any factor is categorized as Unacceptable, then the Step One proposal will be categorized as Unacceptable and therefore ineligible to move on to Step Two. If any of the factors is categorized as Reasonably susceptible of being made acceptable, the Contracting Officers reserves the right to enter into discussions in accordance with FAR 14.501(a) and 14.503. However, the Contracting Officer is not required to enter into discussions with offerors whose proposals are categorized as Reasonably susceptible of being made acceptable if the Contracting Officer determines that it is in the Government’s best interest not to enter into discussions. Note that any proposal which modifies, or fails to conform to the essential requirements or specifications of the Step One Solicitation will be considered nonresponsive and categorized as Unacceptable.

INSTRUCTIONS

a. Format, Media, Contents, and List of Tabs for the Technical Proposal

i. Use the attached cover sheet (Attachment A) when submitting the

Step One Technical Proposal.

ii. Do not submit excess information, to include audio-visual materials, etc. Do not include links to information on websites in lieu of incorporating the information physically into the proposal.

Except where another size is specifically authorized for a specific submission, use only 8.5” x 11” paper. Use at least 1 inch margins, which may include headers and footers. Do not justify the right margin. Ensure that all text and graphics are clearly legible. Do not use a font size smaller than 10, or unusual font styles such as script, or condensed fonts. Pages furnished for organizational purposes only, such as a “Table of Contents” or divider tabs, are excluded from page limitations.

iii. There is a 24-page limit for the overall technical proposal. The

Proposal Cover Sheet (Attachment A) and the completed Standard Form1442 do not count towards the 24-page limit. In the case of a Joint Venture Proposal, the Proposal Cover Sheet (Attachment A), the completed Standard Form 1442, copy of Joint Venture Agreement and certificate signed by each participant in the Joint Venture do not count towards the 24-page limit (see SECTION 00 21 16 Paragraph 16. Joint Venture Proposal Requirements).

Organize your technical proposal as indicated below. The tabs directly correlate to the technical evaluation factors as listed below.

Although the Government may use information contained anywhere within the technical proposal in its evaluation of any technical evaluation factor, the Government is not obligated to search for or to consider information that is not located in the specified location. Start the information for each example project on a new page. Number the pages. Do NOT include information pertaining to your proposed pricing for this project in the technical proposal. Limit your submittals to the information specified; excess information and pages will not be evaluated.

Files shall not include classified data.

F. STEP ONE TECHNICAL PROPOSAL: TECHNICAL EVALUATION

FACTOR SUBMISSION REQUIREMENTS/STANDARDS

*** TECHNICAL PROPOSALS SHALL NOT INCLUDE PRICES OR

PRICING ***

1. General

The information provided in this section will be used in evaluating the offeror’s technical proposals in response to the evaluation factors specific to this solicitation.

The information that is required for Factors 1, 3 & 4 are identified in Attachment B, “TECHNICAL EXPERIENCE”, which can be extended to two pages. Offerors are not required to use the form itself as part of their proposal, but the information requested on the form must be in the offeror’s proposal and should be in the same format as the form.

For factors 1 through 4, the project descriptions and relevancy narratives must clearly articulate the relevancy in sufficient detail to determine technical capability. Projects that meet multiple requirements can be submitted under multiple factors; however, the relevancy discussions must be specific to each factor.

Note to Offerors: Projects submitted under Factors 1, 3 and 4 must have been performed by the firm submitting an offer for this solicitation (same CAGE Codes and DUNS numbers) and must have been performed as the prime contractor (not as a subcontractor). Projects performed by a parent company, sister company, teaming partner, affiliate or business other than the specific firm submitting an offer for this solicitation will not be evaluated.

For Factors 1, 3 and 4, projects submitted by Joint Ventures (J-V): Offerors must include at least one project completed by each of the companies representing the J-V agreement. These projects must have been performed by a member of the J-V submitting an offer for this solicitation (i.e., same CAGE codes and DUNS numbers) and must have been performed as the prime contractor (not as a subcontractor).

Projects submitted that were completed by the J-V firm count as a project for each firm within the J-V agreement.

2. Submission Requirements and Technical Evaluation Factors. The following technical evaluation factors will be used to evaluate each proposal submitted in response to Step One:

Factor 1. Relevant Renovation and Repair Experience.

Standard: Offeror shall submit three (3) projects (no more, no less) that have been completed within the past seven (7) years from the date proposals are due, or are substantially complete. Projects outside of this time frame will not be considered. The projects shall involve substantial/complete renovation and repair of multiple buildings. Two of the three projects submitted shall be in the $20 million or greater price range. The remaining project may be of any dollar value. Each project shall have a title and location, a detailed description of the work performed, and the total dollar value of the project, and shall show beginning and end dates for the project. Please note that if the project is in progress, the offeror must demonstrate in the detailed description that the project is substantially complete. Additionally, the Government will ascertain whether or not the project involved renovation and repair of multiple buildings solely from the detailed descriptions; therefore, offerors are advised to provide sufficient information to make this determination.

Factor 2. Qualification of Proposed Key Team Members.

Standard: Offerors shall submit resumes for the following two (2) identified key positions. The individuals submitted shall meet either the required number of years of experience stated or the combined experience and education stated.

Construction Program Manager: The Construction Project

Manager shall have a baccalaureate degree in engineering, architecture, construction management or equivalent and a minimum of five (5) years of experience managing construction projects of similar size, scope, and complexity as the work under this solicitation or have a minimum of ten (10) years of experience managing construction projects of similar size, scope, and complexity as the work under this solicitation.

Project Superintendent: The Project Superintendent shall have a minimum of five (5) years of experience as a project superintendent on construction projects of similar size, scope, and complexity as the work under this solicitation.

The resumes submitted for each of these key personnel must include all relevant education and a list of projects that demonstrate the minimum number of years of relevant experience. Each project shall have a title and location, a detailed description of the work performed, and the total dollar value of the project, and shall show beginning and end dates for the project. The Government will ascertain whether or not the project is similar in size, scope and complexity solely from the detailed descriptions; therefore, offerors are advised to provide sufficient information to make this determination. Offerors are further advised that the projects submitted to demonstrate the relevant experience of each key individual must add up to the minimum number of years of experience as indicated in the standard for each position (e.g. a resume for a Project Superintendent claiming five years of experience but having only
