Due to limited field staff available for site visits, only one site visit will be offered. Individual requests for site visits will not be granted. Offerors should visit the site and take such other steps as may be reasonably necessary to ascertain the nature and location of the work, and the general and local conditions which can affect the work or the cost thereof. Failure to do so shall not relieve Offerors from responsibility for estimating properly the difficulty or cost of successfully performing the work. The Government shall assume no responsibility for any understanding or representations concerning conditions made by any of its officers or agents prior to the execution of the contract, unless included in the Solicitation, specifications/plans, or related documents.
Faxed quotes will NOT be accepted. Email quotes shall be accepted before closing at e-mail address-gregory.a.cook@usace.army.mil. All emailed offers shall contain the RFQ No. W912DW19Q0077 in the subject line.
3. This solicitation is 100% set-aside for small business concerns. The applicable North American Classification System (NAICS) code for this acquisition is 238990.
4. PROSPECTIVE CONTRACTORS: Contractors are required to be registered in the System for
Awards Management (SAM) for awards resulting from solicitations.
This rule more efficiently implements the Debt Collection Improvement Act of 1996, as it requires contractors to be registered in SAM for consideration of future solicitations, awards, and payment.
Registration is required prior to award of any contract, basic agreement, basic ordering agreement, or blanket purchase agreement from a solicitation.
LACK OF REGISTRATION IN THE SAM DATABASE WILL MAKE A QUOTER INELIGIBLE FOR
AWARD. The web site may be accessed at www.sam.gov.
5. Award shall be made to the lowest priced; responsive, responsible quoter, whose quote conforms to the requirements of the solicitation.
6. Required Submittals:
a) Signed and dated STANDARD FORM 18 (Request for Quotations).
b) Signed and dated STANDARD FORM 30, if applicable, for any Amendments to the solicitation.
c) Completed pricing information for all CLIN items.
d) Contractor shall provide documentation of their proposed safety ladder equipment that conforms to the requirements in the attached Performance Work Statement.
e) Required information in #12 below.
The quoter must provide pricing for all items in the solicitation for its quote to be acceptable to the Government.
All quoted items must meet the requirements of the Request for Quote (RFQ) including specifications stated in all attachments.
Multiple quotes are not accepted for this RFQ. If multiple quotes are received only one quote (as determined by the Contracting Officer) will be evaluated by the Government. The quote shall be determined acceptable based on the date and time received.
The contractor should list proposed brand and model number, special features, or warranty information applicable to the quoted product(s).
7. The magnitude of construction is between $100,000 and $250,000.
8. Davis Bacon Act wage rates apply, as applicable. No personnel employed directly at the site of the work shall receive less than the prevailing wage rates as determined by the Secretary of Labor. The following wage rates are attached hereto and incorporated herein:

PERFORMANCE WORK STATEMENT (PWS)
FY19 Friday Harbor Floating Breakwater Maintenance
Part 1
Part 1: General Information
1. General: This is a non-personnel services contract to provide USACE, Seattle District, Navigation Section, with Floating Breakwater Maintenance Services, at Friday Harbor, San Juan County, Washington. The Government shall exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the Contractor who, in turn is responsible to the Government.

1.1 Description of Services/Introduction: The contractor shall provide all management, personnel, equipment, supplies, facilities, transportation, tools, materials, supervision, and applicable licenses necessary for the maintenance of the floating breakwater, and its associated anchoring system, as defined in this Performance Work Statement except for those items specified as government furnished property and services. The contractor shall perform to the standards in this contract. Performance will be at the Friday Harbor Marina, at Friday Harbor Washington.
1.2 Background: The Friday Harbor breakwater is located in the town of Friday Harbor along the waterfront adjacent to the ferry terminal, Washington. The breakwater consists of two floating concrete breakwaters totaling 1,600 feet in length. The north breakwater is 330 feet long and 21 feet wide and the east breakwater is 1,260 feet long consisting of three legs (330 by 21 feet, 300 by 16 feet, 300 by 16 feet) (Figure 1).
1.3 Objectives: To maintain the structural stability of the floating breakwater by repairing and/or replacing damaged structural elements.
1.4 Scope: The contractor shall accomplish the following tasks:
Task 001 Concrete Repair: Repair all damaged concrete focusing around the bases of the handrail. This requires both the injection of cracks in the deck and exposed sides of the breakwater as well as spall repairs. The cracks shall be repaired using a pressure injection system and SCB Concresive 1380 structural concrete injection resin or equivalent. Broken spalls should be repaired with LA Repair mortar.

Task 002 Safety Ladders: Install new Safety ladders on Module A and replace all existing safety ladders including attachment hardware as needed on all other Modules. Ladders shall be metal (stainless steel or aluminum) plate mounted marine safety ladders, a minimum of 52" in length when extended and include a minimum of 4 steps.

Task 003 Handrails: Power tool clean all handrails to SSPC-SP3 to remove all loose mill scale, rust and paint. The handrails should be painted with a zinc-primer, an intermediate coat of epoxy and finished with a top coat of paint to match the color of the PVC extensions. (Note: might need to replace at least one handrail that is beyond repair.)

1.5 Period of Performance: (a) commence work under this contract within 14 calendar days after the date the Contractor receives the Notice to Proceed (NTP);(b) Prosecute the work diligently; (c) Complete the in-water work not later than midnight (2359 hours), 14 February 2020.
1.6 General Information
1.6.1 Quality Control: The contractor shall develop and maintain an effective quality control program to ensure services are performed in accordance with this PWS. The contractor shall develop and implement procedures to identify, prevent, and ensure non-recurrence of defective services. The contractor’s quality control program is the means by which he assures himself that his work complies with the requirement of the contract. After acceptance of the quality control plan, the contractor shall receive the contracting officer’s acceptance in writing of any proposed change to his QC system. The QCP shall be delivered, to the QAR within 30 days after contract award.
1.6.2 Quality Assurance: The government shall evaluate the contractor’s performance under this contract in accordance with the Quality Assurance Surveillance Plan. This plan is primarily focused on what the Government must do to ensure that the contractor has performed in accordance with the performance standards. It defines how the performance standards will be applied, the frequency of surveillance, and the minimum acceptable defect rate(s).
1.6.3 Recognized Holidays: The contractor is not required to perform services on holidays.

1.6.4 Hours of Operation: The contractor is responsible for conducting business, between the hours of 0800 to 1800 Monday thru Friday except Federal holidays or when the Government facility is closed due to local or national emergencies, administrative closings, or similar Government directed facility closings.
If working outside the specified work hours is necessary, the contractor shall notify the COR to obtain authorization. For other than firm fixed price contracts, the contractor will not be reimbursed when the government facility is closed for the above reasons. The Contractor must maintain, at all times, an adequate workforce for the uninterrupted performance of all tasks defined within this PWS when the Government facility is not closed for the above reasons. When hiring personnel, the Contractor shall keep in mind that the stability and continuity of the workforce are essential.
1.6.5 Place of Performance: The work to be performed under this contract will be performed at Friday Harbor Marina, Friday Harbor Washington.
1.6.6 Type of Contract: The government will award a firm, fixed-price contract.
1.6.7 Security Requirements: N/A.
1.6.7.1 Physical Security: The project site is open to the public at all times. The contractor is responsible for safeguarding his own equipment and supplies.
1.6.7.2 Key Control: N/A
1.6.8 Special Qualifications: N/A
1.6.9 Post Award Conference/Periodic Progress Meetings: The Contractor agrees to attend any post award conference convened by the contracting activity or contract administration office in accordance with Federal Acquisition Regulation Subpart 42.5. The contracting officer, Contracting Officers Representative (COR), and other Government personnel, as appropriate, may meet periodically with the contractor to review the contractor's performance. At these meetings, the contracting officer will apprise the contractor of how the government views the contractor's performance and the contractor will apprise the Government of problems, if any, being experienced. Appropriate action shall be taken to resolve outstanding issues. These meetings shall be at no additional cost to the government.
1.6.10 Contracting Officer Representative (COR): The COR will be identified by separate letter. The COR monitors all technical aspects of the contract and assists in contract administration. The COR is authorized to perform the following functions: assure that the Contractor performs the technical requirements of the contract: perform inspections necessary in connection with contract performance:
maintain written and oral communications with the Contractor concerning technical aspects of the contract: issue written interpretations of technical requirements, including Government drawings, designs, specifications: monitor Contractor's performance and notifies both the Contracting Officer and Contractor of any deficiencies: coordinate availability of government furnished property, and provide site entry of Contractor personnel. A letter of designation issued to the COR, a copy of which is sent to the Contractor, states the responsibilities and limitations of the COR, especially with regard to changes in cost or price, estimates or changes in delivery dates. The COR is not authorized to change any of the terms and conditions of the resulting order.
1.6.11 Key Personnel: The follow personnel are considered key personnel by the government:
Contractor Quality Control (CQC) and Alternate CQC Manager, Site Safety and Health Officer (SSHO), and alternate SSHO. The contractor shall provide a contract manager who shall be responsible for the performance of the work. The name of this person and an alternate who shall act for the contractor when the manager is absent shall be designated in writing to the contracting officer. The contract manager or alternate shall have full authority to act for the contractor on all contract matters relating to daily operation of this contract. The contract manager or alternate shall be available between 8:00 a.m. to 4:30p.m., Monday thru Friday except Federal holidays or when the government facility is closed for administrative reasons. Qualifications for all key personnel are listed below:
1.6.11.1 CQC Manager: The CQC Manager shall be a person with a minimum of five (5) years of related work. The CQC Manager shall be on the site at all times during operations and be employed by the prime Contractor. The CQC Manager may have duties as project superintendent in addition to quality control.
Identify an Alternate CQC Manager to serve in the event of the CQC Manager's absence in the CQC plan.
The requirements for the Alternate CQC Manager are the same as the CQC Manager.
1.6.11.2 Site Safety and Health Officer: The SSHO and Alternate SSHO must each have a minimum of five (5) years of experience in supervising/managing marine or land-based construction, and work managing safety programs or processes, or conducting hazard analyses and developing controls in activities or environments with similar hazards. This is in lieu of the construction experience required by paragraph 01.A.17.b, EM 385-1-1.The SSHO and Alternate SSHO must take either the OSHA 30-hour Construction Safety Course or an equivalent 30 hours of formal safety and health training covering the subjects of the OSHA 30-hour Course (see EM 385-1-1 Appendix A, paragraph 4.b) applicable to the work discussed in the PWS and given by qualified instructors.
1.6.12 Identification of Contractor Employees: All contract personnel attending meetings, answering Government telephones, and working in other situations where their contractor status is not obvious to third parties are required to identify themselves as such to avoid creating an impression in the minds of members of the public that they are Government officials. They must also ensure that all documents or reports produced by contractors are suitably marked as contractor products or that contractor participation is appropriately disclosed.

1.6.15 Data Rights: N/A
1.6.16 Organizational Conflict of Interest: Contractor and subcontractor personnel performing work under this contract may receive, have access to or participate in the development of proprietary or source selection information (e.g., cost or pricing information, budget information or analyses, specifications or work statements, etc.) or perform evaluation services which may create a current or subsequent Organizational Conflict of Interests (OCI) as defined in FAR Subpart 9.5. The Contractor shall notify the Contracting Officer immediately whenever it becomes aware that such access or participation may result in any actual or potential OCI and shall promptly submit a plan to the Contracting Officer to avoid or mitigate any such OCI. The Contractor’s mitigation plan will be determined to be acceptable solely at the discretion of the Contracting Officer and in the event the Contracting Officer unilaterally determines that any such OCI cannot be satisfactorily avoided or mitigated, the Contracting Officer may affect other remedies as he or she deems necessary, including prohibiting the Contractor from participation in subsequent contracted requirements which may be affected by the OCI.

DEFINITIONS & ACRONYMS
2. DEFINITIONS AND ACRONYMS:
2.1. DEFINITIONS:
2.1.1. Contractor: A supplier or vendor awarded a contract to provide specific supplies or service to the government. The term used in this contract refers to the prime.
2.1.2. Contracting Officer: A person with authority to enter into, administer, and or terminate contracts, and make related determinations and findings on behalf of the government. Note: The only individual who can legally bind the government.
2.1.3. Contracting Officer's Representative (COR): An employee of the U.S. Government appointed by the contracting officer to administer the contract. Such appointment shall be in writing and shall state the scope of authority and limitations. This individual has authority to provide technical direction to the Contractor as long as that direction is within the scope of the contract, does not constitute a change, and has no funding implications. This individual does NOT have authority to change the terms and conditions of the contract.
2.1.4. Defective Service: A service output that does not meet the standard of performance associated with the Performance Work Statement.
2.1.5. Deliverable: Anything that can be physically delivered, but may include non-manufactured things such as meeting minutes or reports.
2.1.6. Key Personnel: Contractor personnel that are evaluated in a source selection process and that may be required to be used in the performance of a contract by the Key Personnel listed in the PWS. When key personnel are used as an evaluation factor in best value procurement, an offer can be rejected if it does not have a firm commitment from the persons that are listed in the proposal.
2.1.7. Physical Security: Actions that prevent the loss or damage of Government property.
2.1.8. Quality Assurance: The government procedures to verify that services being performed by the Contractor are performed according to acceptable standards.
2.1.9. Quality Assurance Surveillance Plan (QASP). An organized written document specifying the surveillance methodology to be used for surveillance of contractor performance.
2.1.10. Quality Control: All necessary measures taken by the Contractor to assure that the quality of an end product or service shall meet contract requirements.
2.1.11. Subcontractor: One that enters into a contract with a prime contractor. The Government does not have privity of contract with the subcontractor.
2.1.12. Work Day: The number of hours per day the Contractor provides services in accordance with the contract.

(a)(1) The North American Industry Classification System (NAICS) code for this acquisition is 238990.

(3) The small business size standard for a concern which submits an offer in its own name, other than on a construction or service contract, but which proposes to furnish a product which it did not itself manufacture, is 500 employees.
