PERFORMANCE WORK STATEMENT (PWS)

Clark Fork Debris Facility Emergency Maintenance

Albeni Falls Dam, Clark Fork, Idaho

1.0 GENERAL:

1.1 This is a non-personal services contract to provide procurement and installation of equipment to replace specified components of the Clark Fork Debris Facility system. The government shall not exercise any supervision or control over the contract service providers performing the services herein. Such contract service providers shall be accountable solely to the contractor who, in turn, is responsible to the government.

1.2 Purpose. The United States Army Corps of Engineers (USACE) operates Albeni Falls Dam (AFD) just downstream of Lake Pend Oreille (the Lake). USACE also operates a passive drift holding facility where the Clark Fork River enters into the Lake, The Clark Fork Debris Control Facility (Drift Facility). The Clark Fork River flows rose above flood stage in May to June of 2018, causing an unusually high amount of debris material in the lake and damaged portions of the Drift Facility. Work needs to be done on the Drift Facility in order to restore its operational capability.

1.3 Tasks. The contractor will accomplish the following:

1.3.1 Task 1. Mobilization to a job site and de-mobilization from the job site. See Attachment A – Overview of Drift Facility for location of work.

1.3.2 Task 2. Submittal of all required deliverable documents, as specified in this PWS, to include government approval.

1.3.3 Task 3. Replacement of Drift Facility Components, reference Attachment A – Overview of Drift Facility.

1.3.3.1 Task 3A. Boom A:

1.3.3.1.1 Shear Boom: Six (6)

1.3.3.1.2 Dolphin: Six (6)

2.0 OVERVIEW OF SITE CONDITIONS:

2.1 Facility Overview. The Drift Facility is a series of booms that direct woody debris entering the Lake from the Clark Fork River into a debris collection holding area. The Drift Facility is located approximately 3.5 miles northwest of Clark Fork, Idaho off of State Highway #200. The debris booms, either shear booms or string booms, consist of approximately 6,400 linear feet of boom in three (3) different locations beginning at the mouth of the Clark Fork River and ending at the debris collection holding area further north.

See Attachment A - Overview of Drift Facility. Water depth, flow velocity and other conditions vary from site to site.

2.2 Current Component Description. The shear booms consist of three (3) to four (4) floating logs of various lengths laid parallel to each other two (2) to three (3) feet apart, see Attachment B – Reference Drawing. The shear booms are held in position by a series of dolphins, which are a group of three piles embedded into the river and connected together, see Attachment B – Reference Drawing. Additionally, the facility utilizes string booms, which are single logs connected at either end with a chain and held in position by single piles.

3.0 SPECIFIC TASKS.

3.1 Task 1. Mobilization and De-mobilization

3.1.1 The contractor will be responsible for procuring all necessary equipment and materials and will be responsible for the movement and staging of all necessary contractor personnel, materials and equipment to the job site. The contractor lay-down area will be the Drift Facility grounds located adjacent to the Lower C boom, see Attachment A – Overview of Drift Facility.

3.2 Task 2. Deliverables

3.2.1 The contractor will be responsible for the submittal of all required documentation as specified in this PWS and in accordance with the below table.

3.2.1.1 Work schedule deliverable will include a site-specific work schedule. The schedule shall be in sufficient detail to identify all aspects of the work including all significant project tasks with durations and start and finish times and will include proposed dates for the project tasks as well.

3.2.1.2 Work plan deliverable will include pile removal procedures, to include disposal documentation; pile driving procedures, to include equipment used;

installation method for the booms, at a minimum. The contractor will ensure that all project tasks items are included in the work plan.

3.2.2 All deliverables will be delivered electronically to the Contracting Officer’s Representative (COR) and the Project Engineer. The COR will be named in a separate letter. All deliverables will be submitted to the government for review and will be returned to the contractor within two (2) business days of receipt. The contractor will have four (4) business days from receipt of government comments to address them and return the amended deliverable for approval, if necessary.

3.2.3 Deliverables will be considered of sub-standard quality if they lack the necessary content to meet the explicitly stated contract standards, if they lack clear logic and cohesiveness, if review comments are not adequately addressed or if there are obvious quality control deficiencies with the document (e.g., poor formatting, spelling errors).

QUALITY ASSURANCE SURVEILLANCE PLAN

Version 1 – 12 June 2018

Contract Number: TBD

Contract Description: Clark Fork Drift Facility Emergency Repairs

Contractor’s name: TBD

1. PURPOSE.

This Quality Assurance Surveillance Plan (QASP) provides a systematic method to evaluate performance for the stated contract. This QASP explains the following:

What will be monitored.

How monitoring will take place.

Who will conduct the monitoring.

How monitoring efforts and results will be documented.

This QASP does not detail how the contractor accomplishes the work. Rather, the QASP is created with the premise that the contractor is responsible for management and quality control actions to meet the terms of the contract. It is the Government’s responsibility to be objective, fair, and consistent in evaluating performance. In addition, the QASP should recognize that unforeseen and uncontrollable situations may occur.

This QASP is a “living document” and the Government may review and revise it on a regular basis. However, the Government shall coordinate changes with the contractor. Updates shall ensure that the QASP remains a valid, useful, and enforceable document. Copies of the original QASP and revisions shall be provided to the contractor and Government officials implementing surveillance activities.

This QASP was developed to comply with the Federal Acquisition Regulation (FAR), Subpart 37.6, Performance Based Acquisition and 46.4, Government Contract Quality Assurance. In addition, FAR, Subpart 46.103, Contracting Officer Responsibilities, states that agencies shall develop quality assurance surveillance plans when acquiring services.

2. GOVERNMENT ROLES AND RESPONSIBILITIES.

5. METHODS OF QA SURVEILLANCE.

Various methods exist to monitor performance. The COR shall use the surveillance methods listed below in the administration of this QASP.

Regardless of the surveillance method, the COR shall always contact the contractor's primary point of contact when a defect is identified and inform the point of contact of the specifics of the problem. The COR shall be responsible for monitoring the contractor’s performance in meeting a specific performance standard.

a. 100% INSPECTION. (Evaluates all outputs. Most applicable to small quantity, but highly important services. May be used where there are written deliverables and stringent requirements such as tasks required by law, safety, or security.) 100% inspection of all written reports will be conducted by the Government to ensure adequate documentation.

i. Progress or status meetings.

Periodic meetings between the contractor and Government may occur at the USACE Seattle District office, with contract performance as an agenda item.

Surveillance results may be used as the basis for actions (to include payment deductions) against the contractor. In such cases, the Inspection of Services clause in the Contract becomes the basis for the KO’s actions.

6. RATINGS.

Metrics and methods are designed to determine if performance exceeds, meets, or does not meet a given PRS standard. A rating scale shall be used to determine a positive, neutral, or negative outcome. The following ratings shall be used:

EXCEPTIONAL:

Performance significantly exceeds contract requirements to the Government’s benefit.

SATISFACTORY: Performance meets contractual requirements.

UNSATISFACTORY: Performance does not meet contractual requirements.

Ratings shall be used for all PRS identified in Section #4, Performance Standards.

7. DOCUMENTING PERFORMANCE.

a. ACCEPTABLE PERFORMANCE.

The Government shall document positive performance. A report template is attached. Any report may become a part of the supporting documentation for fixed fee payments, award fee payments, or other actions.

b. UNACCEPTABLE PERFORMANCE.

When unacceptable performance occurs, the COR shall inform the contractor. This will normally be in writing unless circumstances necessitate verbal communication. In any case the COR shall document the discussion and place it in the COR file and courtesy copy the KO.

When the COR determines formal written communication is required, the COR shall prepare a Contract Discrepancy Report (CDR), and present it to the contractor's primary or alternate point of contact. A CDR template is attached to this QASP.

The contractor shall acknowledge receipt of the CDR in writing. The CDR will specify if the contractor is required to prepare a corrective action plan to document how the contractor shall correct the unacceptable performance and avoid a recurrence. The CDR will also state how long after receipt the contractor has to present this corrective action plan to the COR. The Government shall review the contractor's corrective action plan to determine acceptability.

Any CDRs may become a part of the supporting documentation for contract payment deductions, fixed fee deductions, award fee nonpayment, or other actions deemed necessary by the KO.

8. FREQUENCY OF MEASUREMENT.

a. Frequency of Measurement.

During contract/order performance, the COR shall take periodic measurements based on 100% inspection of work products as specified in the PRS matrix, and shall analyze whether the negotiated frequency of measurement is appropriate for the work being performed.

b. Frequency of Performance Assessment Meetings.

The COR shall meet with the contractor weekly prior to payment to assess performance and shall provide a brief written assessment of project status. This applies to the base contract and any awarded option years.

9. DOCUMENTING EVALUATIONS

a. Payment Deductions

Due to the critical nature of the support the Contractor’s performance will be compared to contract requirements on a monthly basis against the Acceptable Quality Levels using this Quality Assurance Surveillance Plan to guide evaluations and the 100% Inspection to document findings. If the performance in any required service fails to meet the performance threshold identified in the SOW, payments to the contractor may be reduced by the contracting officer.

The Government’s primary quality assurance procedures are based on validated customer complaints and incidental inspections by the Contracting Officer’s Representative (COR).

b. Deduction Example:

Work that is deficient and does not meet contract requirements shall be re-done at no cost to the Government.
